ADMINISTRATIVE TEMPORARY USE PERMIT Wanderlust, LLC, Applicant, is hereby granted an Administrative Temporary Use Permit for a Special Event to be beginning WEDNESDAY, JULY 2, 2014, and continuing through SUNDAY, JULY 6, 2014 at the FANNY HILL, SNOWMASS MALL, BASE VILLAGE, AND POKOLODI LODGE as the following activity: WANDERLUST FESTIVAL Applicant has complied with the procedures as specified in Section 16A-5-260 of the Town of Snowmass Village Municipal Code. This administrative approval is for the period stated above and it is subject to the Conditions, Operations Plan and Site Maps attached hereto. Contacts, Location and Hours of Operation 1. Site Maps is attached as Exhibit A. 2. The Wanderlust Festival is an event featuring a gathering of yoga teachers, music, speakers, chefs and performances. The event is five (5) days long and tickets are required to participate. Various Wanderlust-related activities will be taking place in many areas of the Town, including Fanny Hill, Snowmass Mall, Base Village, and Pokolodi Lodge. 3. An estimated attendance between 800-1200 people is expected on any of the festival days. The festival will take place July 2-6, 2014. Each days’ events are scheduled to begin at 11:00 AM and continue through midnight each day. 4. Throughout the event, temporary structures, including tents and a large “D’Om” will be placed throughout Base Village, Fanny Hill, and the Snowmass Mall and will house vendors and activities related to Wanderlust. A complete site map is included in Exhibit A – Site Maps. 5. The festival shall include a special, ticketed concert to be held on Saturday, July 5, 2014. This concert is subject to the terms and conditions of another Temporary Use Permit (Attached as Attachment 2). B. Authorization 1. The use of any privately owned property, including the location of any vehicles, equipment or materials within said property, is not authorized without the express written approval of the landowner. A copy of said approval(s) shall be forwarded to the Town Planning Department prior to the commencement of this event series. 2. Town or its designee (Police, Fire and/or Building Departments) can inspect each venue area before, during or after the event to confirm that all conditions of this permit are being met. 3. No penetrations of concrete or other surfaces within the subject properties shall occur without the express authority of the landowner(s) and Town Manager or designee. 4. No electrical or other utility connections may be made to existing facilities nor shall Wanderlust Festival Page 2 of 7 construction activities occur, without obtaining necessary permits or approval from the Town Building Department (923-5524). 5. All vehicles shall park only in the authorized public parking areas with the exception those vehicles clearly needed by the Applicant and others on a continual basis of during each event. No trucks, vans, trailers or other vehicles can be authorized to park, load or unload within the Daly Lane cul-de-sac or area between the Timbermill and Mountain Chalet buildings (fire lane). Any individual, group or organization that fails to properly supervise and ensure that vehicles park only in authorized areas may be restricted from future use of the facility or permit area. C. General Conditions 1. Applicant is responsible for full and complete compliance with all applicable Federal, State and Local laws and regulations in the production and management of this special event series. Concerning smoking in public places, refer to Town Ordinance No. 07-19. 2. Applicant shall adequately supervise all aspects of the event to ensure conformance with the terms and conditions of this permit. 3. Applicant shall coordinate with the property owners and Town regarding scheduling of events, set-up, take-down and any required maintenance and/or repair. 4. Applicant shall promptly notify the Town Planning Department (923-5524) of any additions, modifications or amendments to this permit or proposed use of the subject property. Any such changes shall not be in conflict with the findings and review standards relative to this permit and are not permitted without written approval of the landowner(s) and Town Manager or designees. 5. Certain refinements, modifications or amendments to the permit may be necessary at the request of the Applicant, Town or in response to impacts, complaints or concerns that were not apparent at the time this application was made. The Town Manager or designee may authorize any such changes, provided they are not in conflict with the findings and review standards relative to this administrative temporary use permit. 6. The event shall not generate debris, excessive noise, traffic or congestion, and shall not unreasonably affect neighboring residences, accommodations, businesses or surrounding property. 7. Any vendors are to have a Town Business License or obtain a Vendor’s License from the Town Clerk’s Office (923-3777) prior to the start of this festival. 8. Overnight camping by festival-participants on Fanny Hill, in parking lots or other areas in Town is prohibited. 9. All affected areas shall be restored to their pre-event condition promptly at the conclusion of the event. Any damaged sprinklers, landscaping, or other material shall be repaired or replaced at Applicant's expense, to the satisfaction of the land or property owner, within fourteen (14) days of the event unless other arrangements are made. Town property shall be restored or replaced to the satisfaction of the Town Manager or designee. 10. Concerts affiliated with other special events during the Summer 2014 Season shall require separate Temporary Use Permits to be filed by their respective applicants due to extraneous impacts to the town not addressed in this Temporary Use Wanderlust Festival Page 3 of 7 Permit. The concert associated with this event is subject to the terms and conditions of the Wanderlust Festival Concert Administrative Temporary Use Permit (Attachment 2). D. Police and Fire Departments 1. All requirements of the Town Police Chief (923-5330) and Snowmass-Wildcat Fire Chief (923-2212) and/or designees, whether imposed prior to or during this event, must be satisfied and shall be considered conditions of this permit. 2. The Town is not responsible for security or traffic control at any activity related to Wanderlust, excluding the concert on Saturday, July 5, 2014. Applicant must make appropriate security and traffic control arrangements and shall coordinate with the Town Police Chief. 3. A tent permit or approval of the Fire Chief must be obtained for any and all tents or canopies prior to the event. The existing facilities should be checked to ensure there are adequate exits and all other life/safety requirements are addressed. 4. No chairs, tables, benches, platforms, booths, tents, canopies, vehicles, equipment or other material of any kind shall be permitted within established fire lanes (24’-0” minimum width and 13’-6” minimum height clearance) without the express authorization of the Snowmass-Wildcat Fire Chief or designee, who must approve all structure locations prior to the commencement of any event. Access ways from the slope to the Snowmass Mall shall be in place. No vehicles may be parked at the slopeside end of the Snowmass Mall. E. Animal Services Department 1. All requirements of Town Animal Services (923-5330), whether imposed prior to or during this event series, must be satisfied and shall be considered conditions of this permit. 2. No person shall knowingly leave or store any refuse, food product, pet food, grain or salt in a manner that would constitute a lure, attraction or enticement of wildlife. Failure to comply with these provisions may result in penalty assessments pursuant to Snowmass Village Municipal Code Section 7-161. 3. Dogs are welcome in a designated areas within the event area. Pet owners are responsible for picking up and properly disposing of their animal’s solid waste. No dogs are allowed within the Fanny Hill venue and no animals shall be left unattended outside the venue or in parked vehicles during any part of the event. F. Security and Emergency Services 1. Applicant is required to provide adequate security staff where needed. Security personnel are to be stationed on-site from 5:00 PM-12:00 AM, Sunday. 2. Emergency medical services shall be summoned by dialing 911. 3. Any vendor tents that serve food or contain ovens and/or burners, or other cooking equipment shall be required to have a Class K fire extinguisher within their tent. 4. Applicant is responsible for the regulation of all entrances and exits throughout the duration event. G. Parking, Transportation and Signage 1. Event parking may be available in the free numbered Village Parking Lots (excluding the timed or permit lots). Upper/lower Lot 1 is not available for event Wanderlust Festival Page 4 of 7 parking due to Blazing Adventures’ staging area. 2. Additional parking may be available at the Town Park (Rodeo) Lot and Base Village garage in Town or at the Highway 82/Brush Creek Intercept Lot. Applicant is responsible for adequately monitoring all parking areas. 3. Parking along Town roadways or in non-designated parking areas is prohibited and may result in the ticketing or towing of vehicles. 4. Shuttle service from the Town Park (Rodeo) parking lot shall be coordinated with the Town Transportation Department (923-2543) if necessary. If the Town Transportation Department is unable to provide service, Applicant shall be responsible for providing the necessary shuttle service. 5. Public transportation is provided by Town Shuttles and RFTA buses and will be operating on special services if needed. Shuttles within the Town and RFTA bus service between Snowmass Village and Aspen are free. Fare-service is provided by RFTA to Down-valley destinations. 6. The “Skittles” Lift is scheduled to operate normal summer hours from 10:00AM to 10:00PM each day during the event, connecting Base Village and the parking garage with the Snowmass Mall. Should extra “Skittles” services be required, Applicant shall be responsible for coordinating this with Aspen Skiing Company. 7. Location of any temporary directional signage and electronic variable message signs shall be coordinated and approved by Town Police (923-5330) and Town Road Department (923-5110). If temporary signage is to be installed, Police and Road Departments need to be contacted well in advance of this event. H. Public Health, Sanitation and Safety 1. Smoking is prohibited at Outdoor Public Places with the exception of specifically designated “Smoking Permitted Areas” that must be clearly marked and delineated and posted. For complete regulations refer to Town Council Ordinance No. 19, Series of 2007. 2. Applicant shall coordinate with the Aspen/Pitkin County Environmental Health Department regarding any activities involving food service and is responsible for satisfying all applicable health code and sanitation regulations, including adequate hand wash stations. Free purified water should also be available. 3. There are to be an appropriate number of portable toilets, ADA portable toilets and hand-washing stations located at the event site. All porta-potties are to be well maintained and shall be cleaned on a regular basis throughout the event. Additional restroom facilities may be available in the Snowmass Mall and Base Village. 4. Trash cardboard receptacles and recycling bins are to be placed throughout the event area including all exit points. The bins are to be emptied when full. Trash that is collected shall be deposited into Wildlife Resistant Refuse Containers* or deposited into a dumpster that is removed to an appropriate disposal site at the end of each evening’s activities. Outdoor special event sites must be kept free from the accumulation of refuse edible by wildlife. *Definition: Wildlife Resistant Refuse Container means a fully enclosed metal container with a metal lid. The lid must have a latching mechanism that prevents access to the contents by wildlife. Wildlife Resistant Refuse Wanderlust Festival Page 5 of 7 Containers must be approved by the Police Chief and Public Works Director. I. 5. Applicant is responsible for ensuring proper disposal of trash within the event site, Snowmass Mall and all event parking lots (Village Numbered Lots, Fanny Hill, and Base Village garage) after each day of the event. 6. Solid waste collection, recycling and removal shall be coordinated with the Town Solid Waste and Recycle Department (923-5110) and/or contracted with an appropriate private company. 7. All cables, wires, equipment and material shall be covered, concealed, secured and/or located in such a manner that event participants will not be placed at risk and the general public’s health, safety or welfare will not be adversely affected. 8. Any lighting and amplification shall be directed and focused so not to adversely affect surrounding residences, condominiums or businesses. Adequate lighting shall be provided when necessary for nighttime egress. Liquor Control 1. No special alcohol permit has been authorized for this event. Alcohol may not be taken outside of designated areas, pursuant to applicable federal, state and local laws. (Concerning alcohol consumption for the concert on Saturday, June 5, 2014, please refer to Attachment 2) J. Insurance and Liability 1. At all times during the term of this permit Applicant shall maintain in full force and effect a comprehensive public liability insurance policy. The amount of insurance and extent of coverage shall be established by the property owners whose land is being used for all areas of this event. If at any time during the term of this permit the Applicant's insurance coverage lapses, is canceled or suspended, this permit shall automatically terminate and the Applicant shall cease operations hereunder. A copy of the Liability Insurance with the Town listed as Additional Insured shall be forwarded to the Town Planning Department. 2. Applicant agrees to indemnify and hold the Town harmless from all cost, loss, damage, expenses (including attorney and expert fees) and claim of liability of any and every kind (collectively “Claims”) that may arise as a direct result of activities that the Applicant is engaged or over which the Applicant has control with respect to the use of the above described property pursuant to this permit. The foregoing shall obligate the Applicant to defend any claims, suits or other proceedings naming the Town as a defendant on any claim that may arise as a result of the use of the above described property pursuant to this permit or the activities authorized under this permit. Wanderlust Festival Page 6 of 7 3. Attorney Fees. In the event litigation is necessary to enforce the rights of the Town under this Agreement, the Town shall be entitled to reimbursements of its reasonable attorney fees and costs of suit, actually incurred in the litigation, as part of its judgment or award. 4. Violation of any term or condition of this permit by the Applicant, its agents or employees shall subject the permittee to the penalties set forth in Section 1-72 of the Municipal Code. In addition, where probable cause exists to suspect that a violation of any term or condition of a temporary use permit will pose a threat to public health, safety or welfare, the Chief of Police is hereby authorized to revoke a temporary use permit and to require that any activity authorized thereby cease and desist immediately.
