Arias/ Lexus Holding, Co., LLC Subdivision Smith Ridge Road (Route 123) (Sheet 20, Block 10801, Lot 162/28)
The Arias/Lexus subdivision consists of approximately 17.712 acres located on the eastern side
of Smith Ridge Road (Route 123) in the Town of Lewisboro. The site currently includes an
existing residence, garage, barn, sheds, driveway, septic and well; all of which are currently
located in the northwestern portion of the property. A wetland area is located near the central
portion of the property dividing the large unregulated upland areas on the parcel into two main
areas. Another smaller band of wetland is located along the extreme eastern edge of the
property. A third area of Town of Lewisboro regulated wetland is located along the northern
boundary of the parcel in the central portion of the property. The wetland areas on the site were
field designated by certified soil scientists Steve Coleman on the southern portion of the parcel
and Otto Theall on the northern portions, and are illustrated on the enclosed site plan. The
wetland areas encompass approximately 77,786 SF or 1.79 acres of the parcel, with land within
the regulated 100 foot wetland buffer area accounting for an additional 241,410 SF or 5.54 acres
of the site area. Both wetland areas D-45 & 7 are regulated by the NYS DEC and consist of
relatively narrow bands which drain in a southerly direction. The western portion of the site is
gently sloping with steeper areas adjacent to the wetland area in the central portion of the
property. The upland area along the eastern portion of the property slopes in both a westerly and
easterly direction towards the adjacent wetland areas. The majority of the property is wooded
with the exception of the western part of the parcel where all of the proposed construction
activity will occur.
The property is located in the R-2A single-family residence zone and is currently tiled on the
Westchester County Land Records as two separate lots. I lowever the property was not legally
subdivided, therefore it is not recognized as valid subdivision by the Town of Lewisboro. The
proposed subdivision of the property will divide the site into two building lots consisting of a
5.00 acre parcel located in the northwest corner, which would include all of the existing
structures and developed portions of the site, and a 12.712 acre currently undeveloped parcel to
the south. No development is proposed within any of the regulated wetland or buffer areas of the
site, with all proposed development occurring towards Smith Ridge Road in the western portion
of the property. Proposed Lot 50 would include approximately 111,759 SF or 2.57 acres of
contiguous buildable area with adequate room for both the existing and potential future uses.
This lot contains only a small unregulated area on the eastern side of the existing wetland.
Proposed Lot 50.1 contains approximately 101,528 SF or 2.33 acres of contiguous buildable area
in the western portion of the lot, with an additional 211,678 SF or 4.86 acres of buildable area
located in the eastern half of the parcel.

The proposed subdivision results in all development on the property occurring to the west of the
central wetland areas on the site. The enclosed plans illustrate the location of existing and
proposed residences, driveways, septic systems and wells. The wetland and buffer areas on the
property will be protected during construction by appropriate erosion control measures to be
installed as illustrated on the enclosed plans and details. These measures will minimize the
encroachment into regulated areas on the property and mitigate the potential for soi I erosion and
sedimentation to the greatest extent practicable. Upon completion or the construction and
grading activity all disturbed areas will be seeded to stabilize the site. Once all areas have been
thoroughly stabilized, the erosion controls will be removed.

We are in receipt of the memos to the Town of Lewisboro Planning Board from the Lewisboro Conservation Advisory Council; and Jan K. Johannessen, AICP and Joseph M. Cerrnele, P.E. of Kellard Sessions Consulting, P.C, both memos dated March 8, 2013.
We have reviewed these memos and submit the following comments and revisions to the
plans as noted.
Memo from Kellard Sessions Consulting, P.C. Planning and Engineering Comments for the items relevant to Site Design Consultants: 1. We have clarified the improvements for the septic system on Lot 1. The
WCHD required new testing of the septic areas on each lot since the original
testing had expired. The new testing is reflected on the WCHD chart located
on the Improvement Plan. The existing gravel driveway has been shown to be
removed where necessary. The septic area is no longer under the driveway; it
is now on both sides of the driveway. When available, we will provide copies
of the WCDH subdivision approvals.
5. The Bulk Zoning Table has been removed from Sheet 1 of 3.
6. The location of the proposed residence has been repositioned to the high point
on the site. This will be reflected on Sheet SP-I of the DeLalla and Associates
plan set.
7. The wetland area and corresponding wetland buffer has been shown.
9. We have shown the existing 2-foot contours on Lot 1 using the Westchester
County GIS database.

11. A driveway profile has been provided for Lot 2 as well as site distance
profiles from the proposed driveway looking north and south on Smith Ridge
Road.
13. NYS DOT plan has been added to the drawing set. We have received a verbal
approval from the NYS DOT on our application for renewal.
16. The bedroom count has been noted on the house footprint and in the WCHD
Chart.
18. Soil testing for the stormwater management system has been completed and
witnessed by a representative of Kellard Sessions Consulting.
22. The Planning Board signature block has been added to all our plan sheets.
As we have discussed, we are enclosing the following items of the above referenced
project for placement on the Agenda for the November 19,2013 Planning Board
Meeting.

Purpose: The full E A F is designed to help applicants and agencies determine, in an orderly manner, w hether a project or action may
be significant. The question of w hether an action may be significant is not alw ays easy to ans w er. Frequently, there are aspects of
a project that are subjective or unmeasurable. It is also understood that those w ho determine significance may have little or no formal

Description of Action:
The Arias/Lexus Holding Company LLC subdivision consists of approximately 17.712 acres located on the eastern side of Smith Ridge Road (Route 123) in the Town of
Lewisboro. The site currently includes an existing residence, garage, barn shed, driveway, septic, and well; all of which is currently located on the northern portion of the
property. A small wetland runs through the middle of the property cutting the unregulated upland areas in half. Another small wetland is location along the extreme rear of
the property. The wetland areas on the site were filed designated by Steve Coleman, certified soil scientist and Otto R. Theall, certified soil scientist on December 27,2001
and December 5, 2001 respectively. The wetland areas encompass approximately 77,786 SF. or 1.79 acres of the parcel, with land within the regulated 150 foot buffer areas
accounting for the additional 241,410 SF or 5.54 acres of the site area. The front portion of the site is fairly flat and gets steeper as it descends to the wetlands that are located
through the middle portion of the property. The upland area near the rear of the property descends on both a westerly and easterly direction towards the two wetland areas.
The majority of the property is wooded except for the extreme front part of the lot where all the proposed construction activity will occur. Currently the property is filed on the Westchester County Land Records as a 2 lot subdivision; however the property was not subdivided appropriately so it is recognized as
an illegal subdivision by the Town of Lewisboro. The proposed legalization to the subdivision of the property will divide the property into two buildable lots consisting of a
5 acre parcel to the north and a larger 12.712 acre parcel to the south. In addition no development is proposed within any of the regulated areas of the site with any
development occurring towards the front of the property. Lot 50 contains approximately 111,759 or 2.57 acres of contiguous buildable area with plenty of room for any
existing or future uses. This lot has little or no unregulated developable land on the eastern side of the existing wetland. Lot 50.1 contains approximately 101,528 SF or 2.33
acres of contiguous buildable area with an additional 211,678 SF or 4.86 acres of non regulated land none of which is currently accessible because of the existing wetland
configuration. Under the current zoning this property could be subdivided into more lots; however with the limitation of access and the steeper slope areas this would be difficult so
development is currently limited to the extreme western portions of the property to protect the existing site wetlands. In addition wetlands on the site will be protected with
the proper erosion control measures installed as illustrated on the enclosed plans which will minimize the encroachment into regulated areas on the property and mitigate the
potential for soil erosion and sedimentation to the greatest extent practicable. Upon completion of the construction and grading activity all disturbed areas will be seeded to
stabilize the site. Once all areas have been thoroughly stabilized the erosion controls will be removed.

1. The purpose of the delineation of freshwater wetland boundaries is to provide a precise identification of the regulated
wetland boundary and its 100 foot adjacent area in order to aid in the planning and design ofprojects which may affect
the wetland resource.
2. New York State regulated freshwater wetlands may be delineated by qualified consultants. However, for a delineation
to be official (e.g., for use in permit applications), it must be validated by Department of Environmental Conservation

3. In general, DEC requires that sponsors ofdevelopment projects retain licensed engineers or surveyors to accurately plot
the delineated wetland boundary on project plans. However, such surveys may not be needed for very small projects,
inquiries of a general nature, or certain iand sales.

Wetland boundary delineations as validated by the New York State Deparbnent of Environmental
Conservation remain valid for 10 years unless existing exempt activities, area hydrology, orland use practices
change (e.g., agricultural to residential). After 10 years the boundary must be revalidated by DEC staff.
Revalidation may include a new delineation and survey of the wetland boundary.
Any proposed construction, grading, filling, excavating, clearing or other regulated activity in the freshwater
wetland or within 100 feet of the wetland boundary as depicted on this plan ·requires a permit from the NYS
Department of Environmental Conservation under Article 24 of the Environmental Conservation Law
(Freshwater Wetlands Act) prior to commencement ·of work.
5. In addition to the accurate identification ofthe freshwater wetland boundary, the limit ofthe 100 foot adjacent area must
also be plotted on development plans and survey.
6. Copies ofplans or surveys containing the boundary delineation and validation block must be submitted to the appropriate
DEC staffperson as listed above in item #2 for validation and original signature before applying for a DEC permit. One
copy will be retained by DEC as a file copy. The signature and seal of the surveyor/engineer must be present prior
to requesting DEC validation.

On March 6, 2007, r returned to the site and determined that the wetland line as
flagged meets the definition of wetlands and waterco.urses in Chapter 217 of the
Code of the Town of Lewisboro. Additionally, I examined the rest of the
property. No additional wetland areas (particularly vernal pools) were found on
the property outside of the flagged wetland line.

Pink surveyor . flagging labeled "Wetland Boundary" were hung on the boundaries of each wetland/watercourse
area Each wetland was assigned a letter and sequentially numbered. The wetland delineation
was performed in accordance with Chapter. 129 Freshwater Wetlands, of the Code of the Town
of Lewisboro, New York, and suppl~mented by the technical criteria fot routine determinations
as outlined in the 1987 Army Corps of Engineers Wetland Delineation Manual. Vegetation, soils
and hydrological parameters were used to determine the outer wetland boundary limits.
Two distinct wetland areas were observed to be present oli the subj ect parcel. Both wetland
areas are linear in shape and located at the base of side slopes. Each wetland area extends onto
the adjoining parcels on both sides ofthe property to the north and south respectively. Please
refer to the attached sketch map for the location of the individual wetland areas. The topography
of the site consists ofsteep slope areas with prominent rock outcrops and surficial bedrock.

ravines and rolling slope areas ofthe property. The plant community is typical for the area
consisting predominantly of an oak-hickory-maple dominated forest.

The wetland areas that have been identified are as follows:
Wetland A:
Wetland A consists of a forested wetland that is seasonally flooded and saturated. Standing
water ofvarious depths were observed within the wetland. The source of water emanates from a
small watercourse channel to the south, and fr~m the surrounding slopes.
Dominant tree species consisted of Red Maple (Acre rubrum) and American Elm (Ulmus
Americana). The sapling/shrub layer is dominated by Spicebush (Lindera benzoin), with minor
representatives of Common Greenbriar (Smilax rotundifolia), Silky dogwood (Comus
amomum). Winterberry (Ilex verticillata), and Arrowood Viburnum (Viburnum dentatum).
Tussock sedge (Carex stricta) and Skunk Cabbage (Symplocarpus foetidius) dominated the
herbaceous layer. The wetland is interspersed with small pockets of upland areas that are
dominated by Black Birch (Betula lenta) and Red Oak (Quercus rubra).
The wetland/upland boundary is very distinct due to the steeper slopes which occur adjacent to
the wetland. Inundation or saturated soils near the surface are evident throughout the wetland. A
histic epipedon layer was present and average 12-16 inches in depth. Water stained leaves and
oxidized rhozospheres were also present near the soil surface.
A previously constructed. road bisects wetland # A on the northern property boundary. The road
travels in a west to easterly direction. An existing stone-wall essentially serves as the eastern
most boundarY of this wetland.,
Wetland A has sequentially numbered flags # 01-19.
Wetland B:
Wetland B consists of a large forested wetland that is seasonally flooded and saturated. A
perennial stream travels within and through this wetland'complex. Wetland B is part of a much
larger wetlaIJ.d area that extends to adjoining parcels to the north and south. Standing water of
various depths were observed within the wetland .. The source of water emanates from the
prominent watercourse channel. and from the surrounding slopes.
Dominant tree species within the wetland area consisted of Red Maple (Acer rubrum) and
American Elm (Ulmu~ Americana). Along the watercourse channel, several typical upland tree
species were also present. The sapling/shrub layer was dominated by Swamp Azalea.
(Rhododendron nudiflorum), Winterberry (Ilex vcerticillata), Silky dogwood (Comus amomum),
SWeet Pepperbush (Clethra a1nifolia) and Spicebush (Lindera benzoin), and Arrowood Viburnum
(Viburnum dentatum). Tussock sedge (Carex stricta) and Skunk Cabbage (Symplocarpus '
foetidius) dominated the herbaceous layer.
The watercourse channel is lined with more upland tree species such as Black Birch (Betula
lenta), Red Oak (Quercus ruhra), Tulip Tree (Liriodendron tulipifera), American Beech (Fagus
grandifolia), Black Cherry (Prunus serotina), and White Ash (Fraxinus Americana).
The wetland/upland boundary is very distinct due to the steeper slopes which occur adjacent to
the wetland. Inundation or saturated soils near the surface are evident throughout the wetland. A
histic epipedon layer was present and averaged 12-16 inches in depth. Water stained leaves and
buttressed roots on the trees were evident.
Wetland # B has sequentially numbered flags # 01-35.

office in 2001 were re-evaluated in the field. In addition, the site was investigated to
determine the presence of potential vernal pool habitat on the property and immediately
adjacent to the subject parcel. Field investigations were completed on 04-28-07 and
04-29-07. The revised wetland delineation was perfQrmed in accordance with Chapter 217
"Wetlands and Watercourses". of the Code of the Town of Lewisboro. New York.. Orange
surveyor flagging labeled "Wetland Boundary" were hung on any additional areas that may
not have been included previously. Based upon field investigation, the north end of wetland
A had a lobe that was not previously flagged that extends to the property line and confmues
on the adjacent parcel. The flag numbers were extended from flag # 19 with new flag tf!s A­
01-A-04 on the western side of the wetland and from the eastern property line with new flag
#'s B-01 -B-05 with B-05 joining previously flag # 17.
In addition a small depressional wetland that exhibits vernal pool features was observed to be
present between wetland areas A and B previously flagged. This area was flagged with C­
01-C-10 and straddles the northeastern property line and extends onto the adjacent property.
This particular area showed standing water (approximately 1 foot in depthl. water-stained
leaves, but no hydric soil features. The substrate was a rocky bottom with minimal soil that
was primarily organiC. No egg masses were present and no activity by amphibian species
were observed..
Immediately offsite to the northwest of wetland area A. a vemalpool is present that does
drain into wetland A. The pool exhibited all of the typical features of a vernal pool and egg
masses of spotted salamanders, wood frogs and spring peepers were observed in limited
quantities. Spring peepers and wood frogs were also heard calling within the pool. This area
was not flagged.
A second vernal pool is present approximately 200 feet off of the property to the northeast
above the eastern end of wetfand A This was the most active of the vernal pools and
contained visible egg masses of wood frog~, spotted salamanders, and spring peepers. This
. area does appear to drain towards wetfand A This area was not flagged.

A third vema I pool area was observed off of the property above vernal pool area C, and located approximately 250-300 feet from the property line. This area exhibits all of the features of a vernal pool and had a good amount of breeding activity. This area was not flagged.

The new flag numbers should be survey located and the wetland delineation map updated to
reflect this additional information. Also you should still reference the 2001 wetland
delineation report for general information on the wetlands. The soils, vegetation and
hydrological features identified are still valid and descriptive of site features, including the
new areas added to the delineation. Please let me know if you have any questions or require

Dear Mr. Rossi:
First, I am responding to the request by Cornerstone Associates (Item 7 in Memorandum
dated 3/22/07) for details regarding the right-of-way along the northern perimeter of the
property. I have reviewed Mr. Arias' title report issued by Old Republic National Title
Insurance Company (copy enclosed). Mr. Arias purchased his 5.001 acre parcel subject to an
existing 15± foot wide right-of-way along his northerly border.
The right-of-way was created on September 15, 1952 when Robert Edward Lee and Anne
Lee filed Map No. 7805 in the Office of the Westchester County Clerk. Said right-of-way runs

Lot 1 and the attached Schedule "B-1" and B-2" for Lot 2. The area within the buffer zone shall
be maintained in its natural state. The natural vegetation within the buffer zone shall not be
clear-cut nor shall any live trees with a diameter greater than 12 inches be removed without
permission of the Planning Board. The following activities are prohibited in the Landscape
Buffer Area: excavation, filling, removing of topsoil, construction or expansion of buildings,
structures, roadways or driveways, changing or altering topography, removing or destroying
