unable to get a clear title
applied for and received a
bonded title. Plaintiff the
repossessed the vehicle for
non-payment. In February
2014 the Plaintiff attempted
to resell the vehicle only to
discover the bonded title in
the Defendant’s name.

The state’s prison system has a capacity for about 2,550
inmates, but housed more than 2,580 inmates as of Thursday,
according to state prison officials. That means some prisons
could be doubling up inmates in some cells.
Montana has the highest rate of jail incarceration among
states in the northern Rockies and northern plains, according to
U.S. Department of Justice. The average time spent in Montana
jails is longer than in other nearby states.
The growing number of drug arrests, which rose 62 percent
between 2009 and 2015, and high rates of recidivism are helping
fuel the problem.
Mark Murphy, who represents the Montana County Attorneys Association, said his group could support changes in how
some low-level crimes are handled.
“We understand that there are cost concerns,” he said, “but
you want to take into consideration public safety at every step.”
Some of the options the Justice Center offered could require a
comprehensive adjustment in the state’s philosophical approach
to crime and the people who commit them, including a deeper
consideration of punishment and rehabilitation.
That could mean expanding deferred prosecution programs
and special problem-solving courts, such as drug courts, that
emphasize treatment not jail time. In many cases, offenders
cannot afford bail and remain behind bars even if they pose no
immediate danger to the public. Some members of the commission suggested that counties consider looking into confining
offenders in their own homes, using electronic monitoring
systems, instead of throwing them in jail.
Those considerations, Reynolds said, “doesn’t mean we’re
being soft on crime. It means being smart about crime.”

and blood tests “an arbitrary line in the sand.”
Other states that have criminalized a driver’s refusal to take
alcohol blood or breath tests include Alaska, Florida, Indiana,
Louisiana, Nebraska, Rhode Island, Tennessee, Vermont and
Virginia.
In all three cases before the high court, the challengers argued
that warrantless searches should be allowed only in “extraordinary circumstances.” They said routine drunk driving stops
count as ordinary law enforcement functions where traditional
privacy rights should apply.
State officials called the testing a legitimate condition on the
privilege of using state roads. Prosecutors argued that it was too
burdensome for police to obtain a warrant every time a driver
refused a test because some rural areas have only one judge on
call late at night or on weekends.
But during oral argument, some of the justices pointed out
that even in rural states police can call a magistrate and get a
warrant over the phone in just a few minutes.
Justice Sonia Sotomayor, joined by Justice Ruth Bader Ginsburg, wrote a separate opinion saying she would have gone
further and required search warrants for both breath and blood
alcohol tests. She said said no governmental interest makes it
impractical for an officer to get a warrant before measuring a
driver’s alcohol level.
“The Fourth Amendment prohibits such searches without a
warrant, unless exigent circumstances exist in a particular case,”
she said.
The states garnered support from Mothers Against Drunk
Driving, which argued that public safety is a compelling reason
that justified the laws. But civil liberties groups said states can’t
criminalize the assertion of a constitutional right.
Adam Vanek, national general counsel for MADD, said
his group was pleased “that the court recognized public safety
concerns far outweigh the minimal privacy concerns when it
comes to a breath test.” Vanek said the group was hopeful that
the court’s decision would encourage other states to implement
similar laws punishing refusal to take a breath test.

boat, Case said.
Kimberly contacted his brother that afternoon, saying they
were caught up in “6-foot waves and thunderstorms,” Case said.
The brother reported them missing Tuesday and the Coast
Guard immediately launched search crews by air and sea.
On Wednesday, two kayaks were found but only one was
identified as belonging to the missing family, the Coast Guard
said. During a search on Thursday morning, another kayak was
found that belonged to the Kimberly family.
