Present were Board members: Earlie Thomas, Dave Pusey, Mike DiTullio, Ed Rupert and Mike McBride. Ron Anthony was present on conference call. Also present were: Fire Chief Tom DeMint, Ann Turnquist, and recording secretary Shawn Williams. Earlie Thomas called the meeting to order at 8:55 a.m. Minutes of the Ma 12 2014 Volunteer Firefi •titer Pension Board IVIeetin • Ed Rupert made a motion to approve the May 12, 2014 Volunteer Firefighters Pension Board Minutes. Dave Pusey seconded the motion, The motion passed by unanimous vote of the Board. Years-of-Service Lum •Sum Pa ment Pro •ram Pro •oral Ann Turnquist reviewed the synopsis of ideas discussed at previous meetings. Ann stated a recommendation should be made to the Poudre Fire Authority Board for their approval to implement the program. The Pension Board agreed a joint work session with the PFA Board was needed to discuss this proposal. The Pension Board suggested that a work session is necessary to present information on the benefits of the Volunteer program, the expected time commitment by the volunteers, the policies that govern them, and that a volunteer firefighter is not an ordinary volunteer. The proposal is on the August PFA Board agenda and the request will be made to pull the item and have a discussion at a future joint work session, possibly in January 2015. Amending the Volunteer Firefighters Pension Fund Board Bylaws Ann Turnquist advised the opinion of Attorney Bob Cole has been sought on some of the language in the bylaws and if they should be included in the amendment. There has been no feedback from Bob Cole at this time. Dave Pusey made a motion to adjourn the meeting. Mike DiTullio seconded. The meeting was adjourned at 9:45 a.m. -4- Poudre Valley Fire Protection District Volunteer Firefighters Pension Board Agenda Item Date: September 22, 2014 From: Tom DeMint and Ann Turnquist Item: #2- Amending the Volunteer Firefighters Pension Fund Board Bylaws Recommendation: That the Board Read Amendment #3 to the Volunteer Firefighters Pension Fund Board Bylaws Attachments: Amendments #1, #2, and #3 to the Volunteer Firefighters Pension Fund Board Bylaws At the May 12, 2014 meeting, the Board made a motion for the current Volunteer Firefighters Pension Fund Bylaws to be amended to reinstate the plan with a $15 per year of service benefit for eligible volunteer firefighters. This would affect the benefit for two of the six individuals in the plan. Staff reviewed the Bylaws and there were questions that arose from that review. The Bylaws and the review were sent to PVFPD's Attorney Bob Cole. September 2 there was a conference call between staff and Bob to review the Bylaws. Some recommendations were made as to what should be included in Amendment #3 and those recommendations are reflected in the attached document. According to Article XVI of the Bylaws the proposed amendment must be read at two regular or specially called meetings of the Board and action can be taken at the third meeting. There needs to be two-thirds affirmative vote by a quorum of the Board in order to amend the Bylaws. -5- Amendment No. One to the Poudre Fire Authority Volunteer Firefighters Pension Fund 1, Change Article XIII Retirement Options (1)The Board may pension any volunteer firefighter having twenty years of active service and being fifty (50) years of age, such pension shall be three hundred dollars ($300) per month. Any volunteer firefighter serving twenty years and not having reached the age of fifty (50) years may be granted a leave of absence and retain all rights to pension annuity and on attaining the age of fifty (50) shall be entitled to said benefit. (2)The Board may pension any volunteer firefighter having ten (10) years of active service. Such pension shall not be paid until the volunteer firefighter attains the age of fifty (50) years and shall be prorated based upon the number of years of service not to exceed 50% of normal full retirement benefit. Date: June 20, 1990 Attest: ( AMENDMENT 42 TO THE POUDRE FIRE AUTHORITY VOLUNTEER FIREFIGHTERS PENSION FUND ARTICLE XIII - RETIREMENT OPTIONS 1. THIS PENSION PLAN AS ADOPTED ON OCTOBER 10, 1989, WILL NOT APPLY TO ANY VOLUNTEER WHO BEGINS HIS OR HER SERVICE ON OR AFTER JULY 1, 1994. 2. THOSE PEOPLE WHO ARE RETIRED ON JULY I, 1994, AND THOSE WHO ARE ELIGIBLE TO RETIRE, WILL corrum TO RECEIVE THE PENSION.TO WHICH THEY ARE ENTITLED. 3, VOLUNTEERS WITH. SERVICE BEGINNING PRIOR TO JULY 1, 1994, WILL HAVE A PENSION BASED ON $15.00 PER MONTH PER YEAR OF SERVICE. FROM DATE OF HIRE THROUGH SEPTEMBER 30, 1994. BEGINNING OCTOBER 1, 1994, THE PENSION BENEFIT WILL BE REDUCED TO $5.00 PER MONTH PER YEAR OF SERVICE. 4. EFFECTIVE FEI3R.U.A.R.Y 1, 1997. TEN YEAR VESTING WILL NOT BE AVAILABLE. (41 ATTES- t • at' -4 $- AMENDMENT #3 TO THE POUDRE FIRE AUTHORITY VOLUNTEER FIREFIGHTERS PENSION FUND 1. Change Article III Meetings of the Board: The Board shall meet no less than once a year for the purpose of reviewing the annual report from the third party investment firm. Other meetings may be called during the year to act upon applications for relief, pensions, annuities, retirement or other benefits as provided by these Rules and By-Laws. 2. Fund Management The Board has affiliated with the Fire and Police Pension Association of Colorado (FPPA) to administer- the Poudre Fire Authority Volunteer Firefighters Pension Fund. The Board may continue this affiliation or choose a different affiliation in the future that also complies with the pension statutes in the Colorado Revised Statutes. Reporting, processing of applications for benefits, payment of benefits and other matters provided by such affiliation will be consistent with the procedures of the FPPA or such future other entity, and such procedures shall control over those found in these Bylaws, to the extent of any inconsistency. 3. Amendment Two, Item 3 Item 3 of Amendment Two is repealed. Effective December 15, 2014, volunteers with service beginning prior to July 1, 1994 will have a pension based on $15.00 per year of service from their date of beginning service with a maximum benefit of $300.00 per month. The Poudre Fire Authority Volunteer Firefighters Pension Fund remains closed to any volunteer who begins his or her service on or after July 1, 1994. Article XVI1I automatically conforms the Bylaws to changes in the pension statutes, and wishing to conserve the funds of the Pension Fund the Board is only amending certain provisions as minimally necessary to conform to current practices and policies, but all other provisions of the Bylaws are deemed automatically amended as necessary to conform to existing and future statutory changes. AMENDMENT #3 TO THE POUDRE FIRE AUTHORITY VOLUNTEER FIREFIGHTERS PENSION FUND Page 2 of 2 Amendments 1 and 2 previously adopted are being read herewith, ratified and readopted as a part of this Amendment 3 as further modified by the changes that are made in Amendment 3.
