Dear New Bayside Homeowner:
Congratulations on the purchase of your new home and welcome to Bayside!
We are excited that you have made the decision to join the Bayside Community, and become a member of
the Bayside Homeowners’ Association. Following this letter is an Owner Information Guide that will provide
you with important information, some of which you may already know if you researched why Bayside is
such an outstanding community and we hope it will be an informative guide to living in our community.
We will begin by explaining that in large, planned communities it is important to have an active Homeowner
Association to oversee the community’s vision and to help protect everyone’s interests. Planned
communities begin with great intentions to create an environment where home owners do not feel restricted
in living as they desire, while at the same time they are not impacted by others in their community who are
also living how they desire. If that sounds like a difficult balance, it can be, but that is exactly the role of the
community association. It starts with the Founder (Carl M. Freeman Communities) creating the Community
Charter for the Bayside Community Association. As part of your Bayside home purchase you received a
copy of this 100+ page document. While we will not go into the details of that document here we believe it
is important (since many of us will likely never read the entire document) for you to understand some basic
tenants of the Charter. You can find these in Chapter 1 of the Bayside Community Charter, under “A
Pledge” and are summarized here:

Community Management Team
We would like to introduce you to your new Management Team! Pam Conti, CMCA, ARM, will be the
Team Leader for Bayside Community Master. Pam along with Theresa Sakalski, Onsite Manager,
will be able to answer questions you may have regarding the community. Pam and Theresa work
from our Bethany Beach Office, located at C4 Edgewater House Road in Sea Colony. Our offices are
set up so that if Pam or Theresa are out on Property their Administrative Assistant, Jessica Casey, is
available to answer owner questions. The rest of the team is comprised by, Community Watch
Inspector, Meg Lesocky, and General Manager – Amtek Maintenance Services, Steve Frisina.
Billing of HOA Fees
Your quarterly invoice for payment of Association Annual dues and fees will be sent to you via US
Mail, with a pre-addressed payment envelope enclosed. Payment is mailed to:

For your convenience, five options are available for paying quarterly assessments:
1. Lockbox Payment. Quarterly payments may be made using the statement coupons and
envelopes provided and mailed to UnionBank. Checks should contain the unit owner’s individual
account number (shown on the statement coupons). Prior to the start of each subsequent payment
period, all unit owners except those with established direct debit accounts will receive account
statements.
2. Direct Debit. Quarterly payments are debited from an owner’s bank account on the fifth day of
each period. This is the most cost-effective payment method for both the association and the owner,
as the Association is not charged a set-up fee during the transition period. If you wish to participate in
this program, please follow the instructions on the form provided with your statement.
3. Bill Payer. Quarterly payments may be also be made using an on-line bill payer service that may
be provided by your bank. It is critical that the “memo” section of the check shows your individual
account number and the correct address for the UnionBank lockbox which is shown on the payment
coupons.
4. Internet Based Credit Card. The payment portal for credit card payments may be accessed
through the Legum & Norman website Homeowners section (www.legumnorman.com). A bank
generated convenience fee is applied to each credit card transaction, and is disclosed on the credit
card payment page.

Architectural Changes
All site work, landscaping, structures, improvements and other items placed on a unit in a manner or
location visible from outside of existing structures on the unit are subject to the Architectural Design
Guidelines and the approval procedures. The “Architectural Design Guidelines” and application forms can
be found on the Bayside Intranet at www.livebayside.com by accessing the “Documents and Forms” link
under the “Bayside Owners Association” left side menu bar.
Amenities
Bayside amenities such as pools, tennis courts and golf course are managed and operated by Troon Golf
and are not under responsibility of the HOA. For all membership and amenity inquiries, please contact the
membership coordinator at 302.564.7931. The Bayside Resort Golf Club can be reached at 302.436.3400.

Beach Shuttle (Memorial Day through Labor Day)
From Memorial Weekend to the 4th of July weekend, service is provided on weekends. Effective with the 4th
of July weekend and through Labor Day, service is provided from Thursday through Sunday. Monday
service is provided on Memorial Day and Labor Day. Service hours are 10:00 am to 6:00 pm from Bayside
to Fenwick Island State Park. The shuttle leaves Bayside on the hour and returns from Fenwick Island on
the half hour dependent on traffic. There are three pick-up and drop-off areas; main entrance parking, Sun
Ridge Pool and the Commons pool. Signs are posted to indicate the specific locations at each site.
Mail
USPS mailboxes are located on the southwest corner of Lakeview Drive and Signature Boulevard as well
as adjacent to the Commons pool parking lot. If you would like a mailbox, please visit the Selbyville post
office and they will provide you with a box number and key if available. The office is located on Church
Street in downtown Selbyville and the phone number is 302-436-8044.
Trash and Recycle Service
The HOA provides residential and community trash service. Residential trash service is provided by Waste
Management. Prior to settlement, please contact Legum & Norman at 302-537-9499 to request a trash toter
if you require this service. A tote will be delivered to your residence which must be stored inside the garage
and can only be placed at curbside on a scheduled trash service day and returned to the garage after
servicing. If you do not want a tote or you will not be able to place your receptacle inside your garage after
pick-up, please use the community dumpsters. Leaving a tote at curbside or driveway is a community
violation. From Memorial Day to Labor Day, service is on Mondays and Thursdays, and from Labor Day to
Memorial Day, service is decreased to Monday only. There is currently no residential recycle service,
please use the community recycle dumpsters for this purpose. There are two community trash and recycle
locations: adjacent to the Commons pool parking lot and on West Sand Cove Road. See location map at
the end of this guide. Locations are subject to change. Please refer to the website for current locations.
Security Services
Bayside Security Patrol Services, Inc. (not affiliated with Bayside Community Association, Inc.) provides
daily security services to the residential community. They have a 24-hour contact number that owners may
call for assistance (302-827-2488). All emergency calls should still be made to 911.
Insurance
Each single family and townhouse owner must obtain their individual insurance policy. The HOA insurance
policies do not cover any part of resident property and only covers community common areas. Each
condominium owner must ensure that they obtain an individual insurance policy, and ensure that it is in
amounts sufficient to comply with restrictions of the Condominium Association. Please contact Legum &

Reporting Community Issues
Please use the website to report all community issues except irrigation reports. While Legum & Norman will
address any email or phone report, the website form guarantees that your report is logged and submitted to
the appropriate departments for proper resolution. We strongly recommend the use of website report versus
the ordinary email and phone reports. On the “Bayside Owner’s Association” left side menu, click on “Report
HOA Community Issues" link.
Reporting Irrigation Issues
All reports irrigation reports and requests must be submitted through the website. Submitting reports
through the website alerts all responsible parties of the issue being reported and logs the request. During
irrigation season (April-August) a dedicated link will be placed under the Homeowners menu called
“Irrigation Reports”.

HOA FEES
All Bayside Single Family, Townhouse and Condominium homeowners are members of the overall bayside
homeowners association and all pay an equal annual Bayside HOA fee. In addition to the HOA fee, each
owner also pays a home-type specific fee. The HOA fee for the period 01/01/15 - 12/31/15 is $1,988/year
or $497/quarter and financially supports the following association expenses:

All Townhouses and Duplex owners from time of settlement have paid a painting and power washing fee
included in the townhouse and duplex specific fee. All townhomes on the second year of initial settlement
are power washed once a year, and all townhomes are painted 8 years after construction date and then
every other 7 years after that.
The current Condominium Fee for the period 01/01/15 - 12/31/15 is $3,557.60/year or $889.40/quarter
which is paid directly to Legum Norman.

RULES AND REGULATIONS
The following Rules and Regulations shall apply to all of the Community and may be modified by the
Homeowners Association’s Board of Directors at any time. They are for the protection and benefit of the
owners, guests and renters of Bayside. Report any problems to Legum & Norman Property Management.
1.
General. The Community shall be used only for residential, recreational and related purposes
consistent with all covenants and documents of the Community.
2.
Restricted Activities. Unless expressly authorized by, and then subject to such conditions as may be
imposed by, the HOA Board, the following activities are prohibited with the Community:
(a)
On street parking is permitted at the following locations only. All other vehicles must be
parked in driveways, garages or in any general parking lots located throughout the community. Failure to
observe these parking restrictions will result in the towing of the unauthorized vehicle, at the owner’s
expense. A map of available parking areas can be found on the Community Intranet.






Daily visitor parking is available along Blue Indigo, Iris Way and Moon Beam Way on the west side of the
street ONLY. Parking in these areas are limited to short term, daily visitors. Vehicles parked in these areas
that exceed these limits will be ticketed and towed. Overflow and additional parking areas are centrally
located in each neighborhood. Any vehicles parked or partially parked on grass areas will be towed
immediately. Unless listed above, all vehicles must be parked in driveways, garages or in any general
parking lots located throughout the community. Vehicles may also be parked in the large parking lot just off
the main entrance in front of the Golf Center. Failure to observe these parking restrictions will result in the
towing of the unauthorized vehicle, at the owner’s expense.
(b)
Parking of commercial vehicles or equipment, mobile homes, recreational vehicles, golf
carts, boats and other watercraft, trailers, stored vehicles, or inoperable vehicles, in places other than
enclosed garages; provided, construction, service and delivery vehicles shall be exempt from this provision
during normal business hours for such period of time as is reasonably necessary to provide service or make
a delivery to a Unit or the Common Area, provided that no parked vehicle shall block any sidewalk within the
Community; all unauthorized vehicles will result in the towing of the unauthorized vehicle, at the owner’s
expense.
(c)
Operation of motorized vehicles on pathways or trails maintained by the
Association, except for golf carts driven in designated areas.
(d)
Vehicles parked in individual driveways must not block the sidewalk.
(e)
Raising, breeding or keeping of animals, livestock or poultry is strictly prohibited. A
reasonable number of dogs, cats or other common household pets are permitted. However, those pets that
are permitted must not roam free, make objectionable noise, endanger the health or safety of others or

constitute a nuisance or inconvenience to the occupants of other Units. If the pet owner fails to honor these
requests, the Board may remove the pet. Delaware state law requires all pets to be leashed at all times and
owners to clean up and dispose of dog waste throughout the community. Owners, renters and guests of the
community must obey this ordnance in order to protect the safety of others and provide for a clean
environment;
(f)
Any activity that emits foul or obnoxious odor outside the Unit or creates noise or other
conditions that tend to disturb the peace or threaten the safety of others;
(g)
Any activity that violates local, state or federal laws or regulations, however, the Board shall
have no obligation to take enforcement action in the event of a violation;
(h)
Pursuit of hobbies or other activities that tend to cause an unclean, unhealthy or untidy
condition to exist outside of the enclosed structures of the Unit;
(i)
Any noxious or offensive activity which in the reasonable determination of the Board tends to
cause embarrassment, discomfort, annoyance, or nuisance to persons using the Common Areas, persons
working in the Common Areas; or to others;
(j)
Outside burning of trash, leaves, debris or other materials;
(k)
Using or discharging any radio, loudspeaker, horn, whistle, bell or other sound device so as
to be audible to others, except alarm devices used exclusively for security purposes;
(l)
Using and discharging firecrackers and any type of fireworks;
(m)
Dumping grass clippings, leaves and other debris; petroleum products; fertilizers; or
potentially hazardous or toxic substances in any drainage ditch, stream, creek or pond or elsewhere within
the Community;
(n)
Accumulating rubbish, trash or garbage between regular garbage pick-ups and then only in
approved containers. Trash receptacles supplied to the owners of the single-family homes must be stored
in a place that is not visible from the street on all days other than regularly scheduled pick up days.
Townhouse and condominium owners must use their designated dumpsters. All accumulation of rubbish,
trash and debris must fit within the receptacle.
(o)
Discharge of firearm; provided, the Board shall have no obligation to take action to prevent or
stop such discharge;
(p)
On-site storage of fuel, except that a reasonable amount of fuel may be stored for the
operation of lawn equipment;
(q)
Any activity, which may disturb or destroy the vegetation, wildlife, wetlands, archaeological
sites, air quality or designated environmental habitat of the Community;
(r)
Conversion of any carport or primary garage to finished space for use as an integral part of
the living area of any Unit

(s)
Placement, construction, installation or any modification of anything, permanently or
temporarily, on the outside portions of the Unit, whether such portion is improved or unimproved, except in
strict compliance with the Community Design Guidelines as set forth by the Architectural Review
Committee. In order to maintain the architectural integrity of the community, Architectural Guidelines must
be followed and the Architectural Review Committee prior to commencement of construction must approve
any alteration or modifications to the exterior.

Vehicle maintenance on any part of a Unit other than inside an enclosed garage;
(u)
Any garage sale, moving sale, rummage sale or similar activity more than one time per year
on any Unit and with notification of such sale to the Property Management office;
(v)
Garage doors should remain closed, except during temporary or immediate use;
(w)
Blankets, towels and/or other clothing shall not be hung over the railings and clotheslines
shall be limited to the inside of the garage;
(x)
Swimming, boating, use of flotation devices or other active use of ponds;
(y)
No owner or occupant may conduct business, trade, or sell from within their home, without
approval from the Board of Directors. In any case, no signage or additional parking will be permitted.
3.
Signs. The following restrictions on signs shall apply to all homes within the Community unless
otherwise stated or approved by the Board.
(a)
All signs, including “for sale” or “for lease” signs are prohibited at any time. An “open house”
sign may be posted for a period not to exceed three days.
(b)
One sign, not exceeding 18”X 24”, containing political or similar endorsements may be
posted on a home and are permitted for a period of 45 days prior to an election or vote of referendum;
(c)
No other signs, except those required by law, including posters, circulars and billboards may
be posted on any home so as to be visible from the outside of the home.
4.
Recreational Activities. Bayside amenities such as pools, tennis courts and the golf course are
managed and operated Troon Golf. Any questions regarding these facilities can be directed to the
Membership Coordinator at 302.564.7931.
Bayside Rules for Use of Outdoor Grills
Residents may use grills on ground floor decks, patios or any area of single family and duplex homes that is
at least 10 feet from the footprint of the building in accordance with local fire codes. Grills are not permitted
on condominium units. Outdoor grills that run on gas fuel, must have been manufactured after 1999 and be
equipped with industry standard safety devices including a shut-off valve that shuts down automatically if a
fuel line breaks.

1. Use grills only where permitted. Residents may use gas grills that comply with the requirements
of paragraph 1 above, on ground floor decks, patios or any area that is at least 10 feet from the
footprint of the building in accordance with local fire codes.
2. Monitor use. It is essential that all residents using a grill watch the grill closely while it is in use. It
shall be a violation of these rules to leave a grill unattended at any time during use.
3. Keep fire extinguisher. Residents must have a five-pound ABC-type fire extinguisher on hand in
case of accidents.
4. Minimize smoke disturbances. As a courtesy to neighbors, residents must keep to a minimum all
disturbances caused by smoke coming from the grill. If smoke is drifting into neighboring units,
residents should position the grill so that the wind will carry the smoke away from windows and
doors.
5. Store only where permitted. After grilling, residents must store grills on their ground floor decks,
patios or in garages. Grills may not be stored on porches or inside units.
6. Keep grill clean. Residents must keep grills clean at all times.
The Association reserves the right to revoke all grilling privileges or to change any of the foregoing rules at
any time for any reason.
Curb Your Dogs
It is a Delaware State law that all dogs must be on leashes and that all owners are responsible for the
removal of their animal's waste. If you walk your dog in the community, please adhere to this law and also
please make sure you remove and dispose of any/all waste on your property or in the community doggie
stations.
Rental of Units
Per HOA Documents, all owners who enter agreements for a term of more than (120) consecutive days
must notify the Property Management office within (30) days and provide the tenant with copies of the
Governing Documents. All owners who rent their home for any length of time are responsible for notifying
their tenants of all applicable community rules & regulations and will be held responsible for all tenants and
guests compliance to these rules. Owners who rent are required to post this document in a prominent
location so that renters are aware of the Rules and Regulations.
Failure to comply with the Rules and Regulations of the Association may result in suspension of voting
privileges, suspension of use of recreational facilities, fines or other such penalties set forth by the Board of
Directors.

VIOLATION PROCEDURES
Parking Violation Procedures
The following Violation Policy and Procedure for failure to abide by the Parking Policies will be implemented
for all owners, their guests and tenants, who fail to adhere to the above rules and regulations:
First Observance-Violation sticker placed under vehicle’s windshield. Vehicle’s make, model and license
plate recorded.
Second Observance-Violation sticker adhered to vehicle’s driver-side window. Vehicle’s make, model and
license plate recorded.
Third Observance-Car is towed by and stored at Brasure’s Auto Repair on Route 54. Owner of the vehicle
will be charged $75 for initial towing and $30/day until car is retrieved.
A $35 fee will still be imposed in the event that between the time the tow truck is dispatched and arrives onsite and the owner of the vehicle in violation removes his/her vehicle from the illegal parking area. The
Bayside HOA and any and all of its representatives are not responsible for any costs or damage incurred by
the tow and any and all repairs and or expenses are the owner of the vehicle's responsibility. The Bayside
HOA has approved for representatives from both Legum & Norman Property Management and Bayside
Security Services to authorize towing.
All Other Violations
In the event that an owner or tenant of a unit in Bayside is in violation of any rule or regulation, the following
schedule shall control:
1st Violation
For the first violation, based on a complaint received and if deemed to be meritorious by the Association, a
written warning and notice of violation will be issued to the owner of the unit in violation and if applicable,
the rental agent and local police department. The unit owner shall be given a reasonable opportunity,
under the circumstances, to correct the violation, or if a first-time and unintentional offense, to assure the
Association to the latter’s satisfaction that the violation will not be repeated. The unit owner shall be
entitled, upon request, to a hearing before the Association or any designated committee to contest the
violation and/or fine. At such hearing, the unit owner shall have the right to be represented by legal counsel
and to have a reasonable amount of time to produce any statement, evidence and witnesses on his or her
behalf. The minutes of the hearing shall contain a written statement of the results of the hearing and the
fine, if any, that is imposed. The Association is not required to provide such notice and opportunity to be
heard for recurring or continuing violations unless no fewer than three (3) months have passed from the
time of the previous violation.

2nd Violation

Fees and Costs.- The Member shall be liable for all attorney’s fees and costs incurred by the Association
incident to the levy or collection of the fine, including appellate proceedings.
Crediting Payments.- The Association shall apply all partial payments by the Member to the Member’s
outstanding balance in the following order:
• Attorney’s fees and costs
• Late fees and interest
• Fines
• Special assessment
• Regular assessments with payment being applied to the oldest balance first
No partial payments will waive the Association’s right to pursue full payment and/or enforce its bylaws,
declaration and rules and regulations.

Intranet through the HOA & members link. Your default username and password will be set to be your first
