ClientEarth Summary Briefing of Analysis of Polish National Investment Plan for Article 10c) ETS Directive application for transitional free allowances The full analysis follows this summary briefing. Background Article 10c)(1) of Directive 2003/87/EC as amended by Directive 2009/29/EC (the ETS Directive) requires Member States wishing to apply for transitional free allowances for the power sector to submit a National Investment Plan. The same article provides certain requirements for a National Investment Plan. ClientEarth has examined the contents of Poland's National Investment Plan in order to check the extent to which it complies with the requirements of the ETS Directive. Methodology In order to determine the effect of the proposed investments on the Polish energy profile, quantitative analysis was required including breakdowns of new power investments by fuel type and by capacity. The conclusions are informed by analysis commissioned by ClientEarth. That analysis is based on official documents published at the website of the Polish Ministry of Environment (http://www.mos.gov.pl), which contain the list of 355 projects concerning various energy sources and grids. As only the titles of projects (but no other documentation) are available, the review has been supported by the analysis of some other information sources, especially websites of individual companies and press articles. Key Findings • • • • The majority of investments in the new energy sources are those related to fossil fuels: taking into account black coal, brown coal and natural gas, these comprise 146 general investments (ca. 82% of all) giving new power of ca. 26200 MW, i.e. ca. 76% of the total new power. Among the fossil fuels sector, a relatively high participation of those associated with black or brown coal occurs: these are 81 general investments (ca. 46% of all) giving new power of ca. 14900 MW, i.e. ca. 43% of the total new power. A smaller contribution is given by natural gas: these are 65 general investments (ca. 36% of all) giving new power of ca. 11300 MW, i.e. ca. 33% of the total new power. Except for biomass, for which 45 general investments (ca. 25% of all, including those with cocombustion) giving new power of ca. 2460 MW, i.e. ca. 7% of the total new power, are planned, there are no investments in renewable energy sources like wind or solar energy, besides 1 hydro power plant. This represents 1 out of 178 total investments. The remaining part of the energy mix in the NIP will be covered by nuclear energy (2 power plants), which is to provide new power of ca. 6000 MW, i.e. 17% of the total new power. 1 Percentages of new powers depending on the fuel type Percentages of total power in new energy sources - fuel type 1 2 3 4 5 1 – Black coal (13595 MW from 34670 MW): 39.2% 2 – Brown coal (1300 MW from 34670 MW): 3.7% 3 – Biomass (2460 MW from 34670 MW): 7.1% 4 – Natural gas (11315 MW from 34670 MW): 32.6% 5 – Nuclear energy (6000 MW from 34670 MW): 17.3% Conclusions: • The majority of investments in the new energy sources are those related to fossil fuels: taking into account black coal, brown coal and natural gas, these comprise 146 investment projects (approximately 82% of all 178 projects) giving rise to approximately 26200 MW. This represents 76% of the total new power proposed in the NIP . • The legal provisions of the ETS Directive required that the National Plan must provide for the diversification of the national energy mix, to the equivalent value of the total amount allowances that may be received. However, 76% of the new power capacity in the Polish application is for new fossil fuel power, and the dominant fuel here is coal (black and brown). By perpetuating the reliance and dominance of coal power, Poland's plan cannot be said to be contributing to diversification of the energy mix as required by the ETS Directive. • The ETS Directive expressly states that the National Plan must provide for investments including for clean technologies. Except for biomass, for which 45 general investments (ca. 25% of all, including those with co-combustion) giving new power of ca. 2460 MW, i.e. ca. 7% of the total new power, are planned, there are no investments in renewable energy sources like wind or solar energy, with the exception of 1 hydro power plant. Biomass combustion results in air pollution and CO2 emissions and should not be considered a 'clean technology.' 2 THE ECONOMIC-STATISTICAL ANALYSIS OF INVESTMENTS INCLUDED IN THE POLISH NATIONAL INVESTMENT PLAN ANNEXED TO THE POLISH DEROGATORY APPLICATION BASED ON THE LIST OF PROJECTS AVAILABLE AT: http://www.mos.gov.pl/konsultacje_wniosek_bezplatne_uprawnienia_do_emisji (02nd July 2012) The present document is the analysis of the Polish National Investment Plan annexed to the Polish Derogatory Application from the viewpoint of participation of investments planned by Poland in particular energy sectors. It is based on official documents published at the website of the Polish Ministry of Environment (http://www.mos.gov.pl), which contain the list of 355 projects concerning various energy sources and grids. As only the titles of projects (but no other documentation) are available, this review has been supported by the analysis of some other information sources, especially websites of individual companies and press articles. The analysis of this data exhibits that the Plan is focused mainly on modernization of existing fossil fuel energy sectors (which includes both building of new installations like the whole power plants or single energetic blocks, and modernization of old installations), these investments giving ca. 76% of the total new power (black and brown coal – ca. 43%, natural gas – ca. 33%). Except for biomass, which is to give ca. 7% of the total new power, no investments in renewable energy sources like wind or solar energy are planned. The remaining part of the energy mix will be covered by nuclear energy giving ca. 17% of the total new power. 3 I. The economic and statistical analysis of the Polish National Investment Plan (further called Plan), annexed to the Polish Derogatory Application (further called Application), requires to define the methodology. The principal problem is that both documents do not define the term “investment”, although it is widely used in the text and in the attached tables. Even a preliminary analysis of the Plan exhibits that various authors who prepared the documentation of the planned enterprises understood by the term “investment” the projects of very different types and magnitudes. The majority of them concerned energy sources, such as power plants (PPs), combined heat and power plants (CHPs) and heat plants (HPs), whereas the minority concerned grids (electricity, heat and gas networks). Thus, the term “investment” may correspond, for example, to: (a) extremely large “greenfield” enterprises like building of the whole nuclear (PL 00380039) and new conventional (PL 0047-0052, 0106, 0180, 0348) system power plants; (b) large enterprises like building of new blocks in the existing PPs (PL 0013, 0017-0018, 0026, 0042, 0053, 0065, 0114, 0125-0127, 0135-0136, 0143-0144, 0148, 0161-0162, 01750176, 0179, 0274), CHPs (PL 0029, 0034-0036, 0078, 0087-0089, 0097-0100, 0108, 0131, 0133-0134, 0145-0147, 0150-0151, 0171-0174, 0183-0185, 0195, 0197-0198, 0200-0201, 0219, 0225, 0266, 0281, 0307-0308, 0352) and HPs (PL 0264); c) medium enterprises like modernization of old blocks and building/modernization of their most principal components (power boilers, turbines, generators, gas engines/aggregates etc.) in the existing PPs (PL 0001-0012, 0016, 0019-0025, 0027, 0040-0041, 0045-0046, 00540064, 0101-0104, 0115-0120, 0121-0124, 0137-0140, 0156-0160, 0345-0346), CHPs (PL 0030-0033, 0037, 0044, 0067-0070, 0072-0077, 0079-0086, 0090-0096, 0110, 0128-0129, 0130, 0142, 0149, 0163-0170, 0178, 0181, 0186, 0188-0194, 0196, 0199, 0217-0218, 02200224, 0226-0244, 0259-0263, 0265, 0268-0271, 0273, 0275-0279, 0282, 0284-0296, 02980299, 0301-0303, 0305-0306, 0349-0351, 0353, 0354-0355) and HPs (PL 0203-0213, 02150216, 0267, 0300, 0310); (d) relatively small enterprises like building/modernization of some additional components (heat exchangers, heat accumulators, electro-filters, installations for biomass supply, burners for powder biomass, gas compressor stations etc.) in the existing installations of various types (PL 0014-0015, 0043, 0071, 0107, 0109, 0111-0113, 0132, 0141, 0182, 0297, 0347). It must be stated here that in some cases the type and range of the planned actions was not clear, as their names/descriptions were insufficient, the best examples being: PL 0028 – Modernization of combined heat and plant infrastructure PL 0066 – Modernization of unit 4 PL 0105 – Limitation of own needs PL 0202 – Co-generation system – synchronic generators propelled…{lacking info} PL 0272 – Modernization of black coal CHP PL 0280 – Change of technology, coke production PL 0304 – Garbage incinerator (more accurate data necessary) PL 0309 – Modernization of CHP Miasto {City} and power transfer (lack of description) PL 0336 – Change of fuel for communal waste Another category are the enterprises connected to grids, which are discussed separately (PL 0152-0155, 0177, 0214, 0245-0258, 0283, 0311-0335, 0337-0344). II) The main disadvantage of the Plan is the fact that even the projects of a similar type like building of a new power block (or, alternatively, modernization of an old power block) were treated by different authors in a different way. Particularly, the same actions could be regarded as either one total or a few distinct projects, depending on a given investment. For example, building of two new blocks in PP Dolna Odra by PGE was described as one project PL 0025, whereas modernization of six old blocks in the same power plant and by the same company was described as six projects PL 0019-0024. In some other cases, however, an opposite situation occurred, e.g. building of two new blocks in PP Opalenie by Vattenfall was described as two projects PL 0175-0176, whereas modernization of turbocomplexes in two blocks in CHP Chorzow by CEZ was described as one project PL 0110. Moreover, sometimes as different investments were regarded distinct variants of the same project (e.g. modernization of old blocks in PP Rybnik by EDF in the variant 1 – PL 0055-0057 versus modernization of the same blocks in the variant 2 – PL 0062-0064) or their subsequent stages (e.g. the first stage of modernization of old blocks in CHP Wroclaw by EDF – PL 0090, 0092, 0094 versus the second stage of the same modernization – PL 0091, 0093, 0095). In consequence, the term “investment” has not an uniform meaning within the Plan, and the actions described by this word are not comparable at all. Hence, the statistical analysis of such “investments”, based on their numbers, would be, from the scientific point of view, erroneous and simply unacceptable. In fact, it is evident that the real number of planned enterprises is much lower than 355, which formally corresponds to the asked projects. 5 III) The way to solve this problem is to introduce a new category, called “general investment”, which needs to be defined basing on the possibly clear and uniform criteria. This methodology can be described, more or less, in the following points: a) formally distinct but relatively similar actions (called further, for clarity, “projects” instead of the former word “investments”, each of them having in the Plan its own number, e.g. PL 0001) for different parts of the same installation, planned by the same company, in the same place and within the same energy sector, have been classified as the same “general investment”. Each “general investment” may consist of one project only (e.g. PL 0050: building of a new power plant) or a few projects (e.g. PL 0019-0025: modernization of old blocks). b) when the same company planned, even in the same place and within the same energy sector, both building of a new installation and modernization of an old installation, such actions have been classified as different “general investments” (e.g. PL 0017: building of new blocks versus PL 0016: modernization of a cooling tower in old blocks). c) when the same company planned, even in the same place but within different energy sectors, building (or, alternatively, modernization) of installations, such actions have been classified as different “general investments” (e.g. PL 0079: building of a new installation in the gas variant versus PL 0080: building of a new installation in the black coal variant). Thus, for example, twelve projects PL 0054-0065, planned in the PP Rybnik by EDF have been classified as two “general investments” (PL 0054-0064: modernization of old blocks 1-8, those of 1-3 also in some other variants versus PL 0065: building of a new block 14). The investments in grids have been treated separately and not classified at all, as they are often delocalized (e.g. PL 0152-0155: modernization and reconstruction of electric lines, transformers and stations, limitation of transformer losses). Following this approach, all 355 projects, listed in the Plan, have be divided into two principal sets: 301 in the energy sources and 54 in grids, the former being classified as 178 general investments. 6 IV) The right subordination of these 178 general investments in the energy sources to the appropriate energy sectors is discussable, as only the names of all contributing 301 projects are available, while the other documentation remains unknown. Of course, in some cases the character of a given project was explicite explained by its name (e.g. PG 0014-0015: building installation to supply biomass) or it could be easily deduced (e.g. PL 0034: a new CCGT block). Many other projects, however, were not sufficiently characterized by their names (e.g. PL 0001-0012: modernization of old blocks or PL 0013: building of a new block – both for PP Belchatow by PGE). Their right subordination to any energy sector requires the knowledge which fuel has been used in the old installation, and, moreover, which fuel will be used in the new one. This data, however, can not be extracted from the available part of the Plan and the Application. For the purpose of this analysis, a wide review of existing literature, available in the internet (www pages of the involved companies, press articles published on-line, Wikipedia etc.), has been done, as illustrated by 284 quotations (references). In this way some additional information has been collected, allowing to subordinate the planned general investments to the right energy sectors. For example, one has got to know that the projects PL 0001-0013 in PP Belchatow by PGE correspond to the brown coal sector and not to the black coal, biomass or natural gas sectors. Nevertheless, there is a question on reliability of such internet sources, which are often unofficial – especially in case of relatively small and not widely known installations (some CHPs and all HPs). This ambiguity has been seriously complicated by the curious fact that some names of the projects, available in the Table 9 of the Plan: http://www.mos.gov.pl/g2/big/2011_08/7babcc62f25fca17253ba156c891c5a2.pdf are evidently erroneous – probably due to the mistakes of some officials in the Ministry of Environment who constructed the www page of: http://www.mos.gov.pl/konsultacje_wniosek_bezplatne_uprawnienia_do_emisji In fact, many of them are not full – but cut in the half of a sentence. In consequence, sometimes it has been difficult or impossible to understand the description of a given project, which resulted in the uncertainty about its character and subordination to the energy sector. As the most characteristic examples may serve the following projects: PL 0041: Modernization of vacuum system and changes of supply t… (Modernizacja ukladu prozniowego oraz zmiany zasilania t…) PL 0126: Modernization of steam overheaters (power boilers 2 and 3) and the system of… (Modernizacja przegrzewaczy pary (kociol 2 i 3) oraz uklad…) 7 PL 0144: Building of a new heating block with a extraction-??? turbine… (Budowa nowego bloku cieplowniczego z turbina upustowo-…) PL 0202: Co-generation system – synchronic generators propelled… (Uklad kogeneracyjny – generatory synchroniczne napedza…) PL 0231: 1 stage - turbine change, 2 stage - modernization of the system pr… (1 etap - wymiana turbiny; 2 etap - modernizacja ukladu pr…) PL 0233: A turbine change from 6,7 MW to 10,85 MW and modernization of cz… (Wymiana turbiny 6,7 MW na nowa 10,85 MW, modernizacja cz…) PL 0267: A new condensation turbine, the increase of using… (Nowa turbina kondensacyjna, zwiekszenie wykorzystania…) PL 0279: Building of a new low-pressure turbine, cooperating with… (Budowa nowej turbiny niskopreznej 20 MW, wspolpracuja…) PL 0352: Building of a new unit for biomass (36MW) and w… (Budowa nowej jednostki wytworczej (36MW) - biomasa i w…). This problem has concerned also some projects related to grids, e.g.: PL 0249: Increase of electricity production efficiency in w… (Wzrost sprawnosci wytwarzania energii w…) PL 0250-0255: Decrease of CO2 emission by limitation of losses in p… (Zmniejszenie emisji CO2 poprzez ograniczenie strat na p…) PL 0256-0258: Increase of electricity production in ko… (Wzrost produkcji energii elektrycznej w ko…) Such cutting of names, obviously unacceptable in an official governmental document, is even more abundant – although sometimes it has been possible to guess the full meaning, e.g. the project PL 0322: Re-gasification terminal of LNG in Swinouj… (Terminal regazyfikacyjny gazu skroplonego LNG w Swinouj…) probably concerns the town of Swinoujscie. Moreover, sometimes even the availability of the full project documentation would probably not be helpful, as exemplified by the following names: PL 0304: Garbage incinerator (more accurate data necessary) {sic !} (Spalarnia smieci (potrzebne blizsze dane)) PL 0309: Modernization of CHP Miasto and power transfer – lack of description (sic !) (Modernizacja EC Miasto i przeniesienie mocy – brak opisu) 8 V. Nevertheless, despite these difficulties all general investments in the new energy sources have been subordinated to the following energy sectors: black coal, brown coal, black coal + biomass, brown coal + biomass, biomass, natural gas, nuclear energy and hydro energy. Then, for the majority of these general investments which are building of new units, the expected new powers have been evaluated, basing on the available internet data sources. However, for many of such general investments both subordination to the right energy sector and quantitative evaluation of the related new powers could be approximate only, due to the following reasons: 1) The reliability of some data sources is doubtful – although the following methodology has been applied: a) official websites of the concerned companies have been treated as main data sources; b) articles in press or in specialized portals have been treated as auxiliary data sources. 2) In case of some energy sources no quantitative data was available at all; however, this problem concerned rather small installations – this is why local HPs have been generally omitted during evaluation of new powers. 3) In case of modernizations the data on the related power increases were usually unavailable. 4) In case of CHPs both electric (MWe) and thermal (MWt) powers have been taken into account; however, the respective data sources sometimes provided one value only, with no explanation whether it concerned total power or electric power. 5) In case of co-combustion the energy sources have been classified into the black coal + biomass or brown coal + biomass sectors; however, the respective data sources sometimes provided variable values, e.g. describing the participation of biomass as ranging from 0 to 50% etc. In the result of such approach, 178 general investments in the energy sources have been identified, which are listed below. They will take place in the following 137 installations: A). 33 PPs – in Bedzin (PP Lagisza), Belchatow, Borek, Gryfino (PP Dolna Odra), Grudziadz, 2x Jaworzno (Jaworzno III – PP II and PP III), Kedzierzyn-Kozle (PP Blachownia), 2x Konin (PP Konin and PP Patnow I), Kozienice, Laziska Gorne (PP Laziska), Leczna, Lublin, Opalenie, Opole, 2x Ostroleka (PP Ostroleka B and PP Ostroleka C), Pelplin (PP Polnoc), Plock, Polaniec, Rybnik, Skawina, Stalowa Wola, 2x Szczecin (PP Pomorzany and PP Szczecin), Turek (PP Adamow), Turow, Walbrzych (PP Mercury Energia), 2x Wloclawek (by GdF Suez and by PKN Orlen), 2 nuclear power plants of unknown location. 9 B) 88 CHPs – in Andrychow, Bedzin, Bialystok, Bielsko-Biala, Brzeg Dolny, Bydgoszcz, Bytom, Chorzow, Ciezkowice, Czarnkow, 2x Czestochowa (by Elsen and by Fortum), 2x Dabrowa Gornicza (CHP Nowa and CHP Przyjazn), Elblag, 3x Gdansk (CHP Gdansk, CHP Lotos, CHP Port), Gdynia, Glogow, Miejska Gorka, Gorlice, Gorzow, Gostyn, 2x Grudziadz (by Energa and by OPEC), Inowroclaw, Janikowo, 2x Jastrzebie-Zdroj (CHP Moszczenica and CHP Zofiowka), Jelenia Gora, Kalisz, 3x Katowice (CHP Katowice, CHP Szopienice, CHP Wieczorek), Kedzierzyn-Kozle, 2x Krakow (by EDF and by Arcelormittal), Krasnik, Knurow, Lodz, 2x Lublin (CHP Megatem and CHP Wrotkow), Mielec, Ostroleka, Oswiecim, Pawlowice, Plock, Police, Polkowice, Poznan, Prudnik, Pruszkow, Pulawy, Radlin, Radomsko, Ropczyce, Ruda Slaska, 2x Rzeszow (by Fenice and by PGE), Siechnice, Siedlce, Skarzysko-Kamienna, Skawina, Sosnowiec, Srem, Sroda Wielkopolska, Stalowa Wola, Strzelin, Strzyzow, Suszec, Swidnica, Swiebodzice, 2x Tarnow (CHP Moscice and CHP Piaskowka), Torun, Tychy, 3x Warszawa (CHP Siekierki, CHP Ursus, CHP Zeran), Wloclawek, 2x Wroclaw (by EDF and by Fortum), Zabrze, Zdzieszowice, Zgierz, Zielona Gora, Zory. C) 16 HPs: in Cieszyn, Debno, Glinojeck, Gubin, Jaslo, Jelcz-Laskowice, Kety, Kutno, Nowa Sol, Olesno, Opole, Suwalki, Wolsztyn, Zagan, Zary and 1 in an unknown location (PL 0205). Their locations in Poland have been shown at the maps 1-6; however, they are only approximate, especially in cases when a few installations were located in the same town and needed to be drawn in the same place. In fact, this analysis is not the guidebook for sightseeing Polish PPs, CHPs and HPs, and the persons who are interested in their detailed positions must use more accurate geographical sources. In case of the black coal sector, the number of installations in the Upper Silesia (Gorny Slask) region, being the main source of this fossil fuel in Poland, is relatively large comparing to the rather small area, so it has been necessary to draw their locations on the additional map having a much larger scale. There are three principal reasons for this fact: a) the installations of the same type but in various energy sectors often differ in size (e.g. PPs in nuclear or black/brown coal sectors versus PPs in biomass or gas sectors); b) even in the same energy sector the installations may differ in size by orders of magnitude (e.g. system PPs versus local HPs; CHPs can vary in a wide range); 39 c) even in the same energy sector and for the same type of installations the planned general investments may differ in size by orders of magnitude (e.g. for PPs: building of new plants/blocks versus slight modernization of the existing infrastructure). Some further general remarks must be also added: 1) The above quantities on new powers correspond to new energy sources mentioned in the National Investment Plan, but: a) some investments will be probably not realized at all and their power data are unavailable (e.g. PP Opalenie by Vattenfall – PL 0175-0176) – thus, they have not been included in the energy balance; b) some investments, although described in the National Investment Plan as distinct, are obviously additional variants of the same enterprise in the same energy sector (e.g. PP Grudziadz – PL 0145 vs CHP Grudziadz – PL 0146, both by Energa) – thus, they have been included in the energy balance only once; c) some investments, although described in the National Investment Plan in two variants, correspond to different energy sectors (e.g. CHP Port Gdansk by EDF – the natural gas variant PL 0079 vs the black coal variant PL 0080) – thus, they have been included in the energy balance in both versions; d) some investments planned by different companies are probably alternatives (e.g. PP Leczna by GDF Suez – PL 0050 vs PP Lublin by PGE – PL 0348) – nevertheless, they have been included in the energy balance in both versions; e) some investments already started to work (PL 0013: a new block in PP Belchatow by PGE – 2011; PL 0027: a new power boiler in PP Szczecin by PGE; PL 0125: a new block Lagisza II in PP Lagisza by Tauron – 2009; PL 0201: a new block in CHP Czestochowa by Fortum – 2010) – nevertheless, they have been included in the energy balance; f) some investments will probably replace old installations which are to be closed (e.g. PL 0018: a new block in PP Turow by PGE) – nevertheless, they have been included in the energy balance. VI. Summing up the above description of new installations and new powers, one can conclude that: A) 47 general investments are planned in PPs, 115 in CHPs and 16 in HPs. A smaller contribution is given by natural gas: these are 65 general investments (ca. 36% of all) giving new power of ca. 11300 MW, i.e. ca. 33% of the total new power. 4) Except for biomass, for which 45 general investments (ca. 25% of all, including those with co-combustion) giving new power of ca. 2460 MW, i.e. ca. 7% of the total new power, are planned, there are no investments in renewable energy sources like wind or solar energy, besides 1 hydro power plant. 5) The remaining part of the energy mix will be covered by nuclear energy (2 power plants), which is to provide new power of ca. 6000 MW, i.e. 17% of the total new power. VII The investments in grids (electric, gas and heat network) have been treated separately, and are listed below, without a more detailed analysis.
