The Lexus Premium Care Extended Factory Warranty extends your Lexus factory warranty and offers a suite of additional benefits, to provide you with complete confidence and motoring peace of mind. To ensure you receive the maximum benefits of this cover, please take time to understand the terms of this Warranty, including its limitations as well as your obligations to: • have your vehicle serviced in accordance with the requirements set out on page 6 of this document; and • have any repairs duly authorised by the Lexus Premium Care Administrator. Important legal notice Your Lexus Premium Care Extended Factory Warranty Agreement is between you and Lexus Australia, a division of Toyota Motor Corporation Australia Limited ABN 64 009 686 097 (TMCA), Corner Gannons Road and Captain Cook Drive, Caringbah NSW 2229, phone 1800 023 009, email: [email protected] and is administered by Lexus Financial Services (LFS) on behalf of Lexus Australia. To obtain a claim form and for further information regarding this warranty or any of our products, please contact LFS by: • calling 1300 888 840; • emailing [email protected]; • visiting our website at lexus.com.au; or • mailing us at Lexus Premium Care, Locked Bag 980, Milsons Point NSW 1565. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits given to you by this warranty are in addition to the other rights and remedies you as a consumer have under law in relation to the goods and services to which this warranty relates. 2 Extended factory warranty Terms and conditions of our agreement Terms and Conditions Your Lexus Premium Care Extended Factory Warranty Agreement consists of two parts: • the Warranty Certificate; • this Terms and Conditions booklet. The Terms and Conditions booklet sets out the terms, conditions and limitations that apply to your Lexus Premium Care Extended Factory Warranty. Please read this document carefully so that you understand what is covered and what is not covered. If you do not understand which items are covered or not covered, please contact us – our contact details are printed on the back cover of this booklet. Note that your Lexus Premium Care Extended Factory Warranty Agreement is an important document and you should keep it in a safe and accessible place. All pages are numbered, and if any pages are missing you should contact us for a replacement. The privacy of your personal information The personal information you have provided in relation to your warranty and other personal information provided by you in connection with the administration of your warranty is collected by LFS on Lexus Australia’s behalf for purposes related to the provision and administration of your warranty and for associated planning, product development and research purposes. Lexus Australia and LFS may provide your information to its related companies, the dealer named in the contract or to third parties engaged by LFS in connection with the purposes referred to above. Lexus Australia and LFS may also use your information for marketing purposes. If at any time you no longer wish to receive marketing material from Lexus Australia or LFS, please contact us by calling LFS Customer Service on 1300 888 840 or writing to us at PO Box 1354, Macquarie Centre NSW 2113. You can access personal information Lexus Australia or LFS holds about you by contacting us on the above number or at the above address. Further information about our policy on privacy and personal information handling can be found on lexus.com.au Premium care 3 Commonly used words or expressions The following words have a specific meaning in these Terms and Conditions. Approved repair means a repair or replacement authorised by the Lexus Premium Care Administrator. Authorised repairer means a repairer recommended or approved by the Lexus Premium Care Administrator. Authorised Lexus dealer means a dealer appointed by Lexus to sell for and on behalf of Lexus, new Lexus vehicles. Dealer statutory warranty means the warranty required by law to be provided by the dealer at the time you purchased the vehicle. Extended warranty period means the period described in the section titled “Your warranty period”. Fails, failed or failure means the inability of any covered component to satisfactorily perform its intended function, but excludes reduction in operating performance due to wear and tear consistent with its age and distance travelled. Helpful benefits means the additional benefits under this warranty, which are described in the section titled “Helpful benefits”. Lexus component means any component or part of the vehicle including components authorised and marketed by Lexus as accessories, provided such accessories are fitted at the time the vehicle first entered service as a new vehicle and includes any Lexus genuine accessories fitted after vehicle delivery, but within the Lexus new vehicle warranty period. Lexus Premium Care Administrator means Lexus Financial Services (LFS), a division of Toyota Finance Australia Limited ABN 48 002 435 181 Australian Credit Licence 392536. 4 Extended factory warranty Lexus new vehicle warranty means the vehicle warranty set out in the owner’s documentation supplied with the vehicle. Market value means our determination of the value of your vehicle immediately prior to the event that leads to a claim under this warranty. Our determination will take into account such things as your vehicle’s age, condition and kilometres travelled. Owner’s documentation means the owner’s manual and warranty and service book provided by Lexus in relation to the vehicle. Repair, replace or replacement means to make good, to acceptable working condition, using parts of a like kind and quality. Parts used to repair your vehicle may be genuine new or guaranteed reconditioned. Where genuine parts are not available in Australia or where non-genuine parts have been fitted after purchase, replacement parts will be of a similar type and quality to those used in your vehicle, taking into account its age and distance travelled. Selling dealer means the Authorised Lexus dealer who sold you the vehicle and this warranty. Vehicle means the vehicle manufactured and/or marketed by Lexus and described in the warranty certificate. Warranty or Lexus Premium Care Extended Factory Warranty means this warranty contract consisting of the warranty certificate and these Terms and Conditions. We, Our, Us or Lexus means Lexus Australia; a division Toyota Motor Corporation Australia Limited ABN 64 009 686 097. You or Your means you, the purchaser of the vehicle and any subsequent person to whom this warranty is transferred in these Terms and Conditions. Premium care 5 Your obligations under this warranty This warranty is designed to replace or repair any Lexus components defective in material or workmanship which fail under normal operation and use during the extended warranty period. It is a condition of this warranty that your vehicle must be maintained to the manufacturer’s recommendations by an Authorised Lexus dealer or licensed motor vehicle repairer. These servicing requirements are outlined within your owner’s documentation. You should keep evidence of how and where your vehicle has been serviced, as it will help to minimise any delay in processing your claim. Please note that if your vehicle is inadequately maintained we may refuse your claim. Approval for warranty repairs All repairs made under this warranty require the express approval of the Lexus Premium Care Administrator, who can be contacted on the number printed on the back cover of this booklet. Apart from selling and issuing this warranty, your Selling dealer is not authorised to act as the agent for us or the Lexus Premium Care Administrator or to bind any party to any arrangement with you. If your vehicle fails and needs to be repaired outside the Lexus Premium Care Administrator’s normal office hours and cannot be approved before repairs are carried out, you must contact the Administrator as soon as possible after they re-open if you want to claim for the repairs under this warranty. 6 Extended factory warranty Your warranty period Your warranty will apply for defects that arise during the warranty period specified in your Warranty Certificate. The warranty will commence the later of: 1. the date of issue as stated in the warranty certificate; or 2. the date that the Dealer statutory warranty expires; or 3. the date that the Lexus new vehicle warranty expires. The warranty will end the earlier of: 1.the date the term in months shown on your warranty certificate has elapsed from the date the warranty commenced; or 2.when the vehicle has travelled the distance since new, as noted on your warranty certificate. What your warranty covers We warrant that within the extended warranty period we will repair or replace free of charge any Lexus component found to be defective in material or workmanship under normal operation and use in Australia, with the exception of any item listed under “What your warranty does not cover”. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits given to you by this warranty are in addition to the other rights and remedies you as a consumer have under law in relation to the goods and services to which this warranty relates. What we pay If we approve your claim, we may choose, at our option, to pay the reasonable cost of either repairing or replacing those Lexus components. Replacement parts will be of similar type and quality to the other Lexus components of your vehicle, taking into account its age, condition and distance travelled. The most we will pay under this warranty for repairing or replacing Lexus components during the extended warranty period is limited to the market value of the vehicle as at the date of repair. Premium care 7 Helpful benefits Your warranty also provides you with a number of other helpful benefits to ease the inconvenience of a failure: 1. Towing expenses We will pay for the reasonable costs you incur in towing your vehicle to the nearest Authorised Lexus dealer or licensed repairer should towing be required for the purpose of carrying out an approved repair. You must also ask the Authorised Lexus dealer or licensed repairer to tell the Lexus Premium Care Administrator if you had your vehicle towed, so that they can authorise your claim for towing expenses. The most we will pay for such towing expenses during the extended warranty period is $500 (including GST). 2. Quality guarantee If your vehicle suffers a failure during the extended warranty period, then any authorised repairs made under this warranty will be covered for the remaining extended warranty period. 4. Consumable items We will pay to replace any consumable items if they require replacement due to the failure of any other Lexus component covered by this warranty. Genuine original factory parts Every Lexus genuine original factory part is designed and constructed to original manufacturer’s specifications for maximum performance, longevity and perfect fit. Under this warranty all Lexus genuine original factory parts are warranted for the balance of the Lexus New Vehicle warranty or carry a 12 month unlimited kilometre Lexus warranty, whichever is the greater. Any Lexus genuine original factory parts fitted during the Lexus new vehicle warranty are covered under this warranty for the extended warranty period. 8 Extended factory warranty What your warranty does not cover Your warranty does not cover the following items: • Consumable items that have a limited working life, including those recommended for regular replacement within the owner’s documentation, including but not limited to: - batteries; - tyres; - filters; - hoses; or - brake pads and linings, unless these items are found to be defective in materials or workmanship or fail in circumstances referred to in clause 3 of Helpful Benefits above. • The costs of normal maintenance or service. This includes adjustments to your vehicle that are part of the scheduled servicing recommended by Lexus as described in the owner’s documentation; • Any vehicle adjustments or replacements necessary to maintain roadworthiness, insurance or registration unless they result from defective Lexus components or faulty workmanship in Lexus components; • Superficial damage, such as cosmetic or surface corrosion from stone chips or scratches in the paint; • Any consequential loss, expense or damage, including loss of time or convenience, or a reduction in the value of your vehicle; • Repairs to or replacement of components (including Lexus components) covered by any other warranty or guarantee, including: - Dealer statutory warranty; - Lexus new vehicle warranty; - Lexus recall campaigns; or - a repairer’s warranty or guarantee. • Any Lexus component that fails outside the extended warranty period. Your warranty does not cover parts that fail because: • you have neglected to properly maintain and service your vehicle; • your vehicle has been fitted with non-genuine parts, not made or supplied by Lexus; • your vehicle has been modified from Lexus factory specifications (for example, conversion to LPG operation, addition of a turbocharger, or installation of oversize pistons or valves) unless the modifications are Lexus approved and installed; • of acts of nature (for example, bushfire, earthquake, thunderstorm, hail, flood); • your vehicle is vandalised, abused, raced or used in any other competition; or • of corrosion, electrolysis or rust. Premium care 9 Your warranty does not cover the failure of any Lexus components where your vehicle is being used or has been used in circumstances other than normal operating conditions, for example: • as a rental vehicle; • as a taxi; • as a driving school vehicle; • as a courier vehicle or for mail delivery; • as a police, security or emergency vehicle; or • on mining sites. When we may refuse a claim Your warranty is designed to protect you against Lexus components which fail under normal operation and use. Accordingly we may refuse a claim if you: • fail to service your vehicle in accordance with your servicing requirements as set out in your owner’s documentation; • (or anyone using your vehicle or acting with your consent) intentionally damage your vehicle causing component failure; • do not follow the requirements for “Claiming under this warranty”; • fail to provide us with accurate information; or • make or attempt to make a fraudulent claim. Claiming under this warranty How to make a claim As soon as possible after a failure that you feel might be covered by this warranty, you must: • take reasonable steps to prevent further damage to your vehicle; • take your vehicle to the Selling dealer or, if this is not possible, to the closest Authorised Lexus dealer or licensed motor vehicle repairer; and Before any work is done to your vehicle, you must ask the Selling dealer, Authorised Lexus dealer or licensed motor vehicle repairer to read the Repairer Instructions at the rear of this booklet and to contact the Lexus Premium Care Administrator for claim authorisation. A claim form can be obtained by calling 1300 888 840 or emailing [email protected] The expense associated with making a claim under this warranty is not covered by this warranty. This means that you must bear the expense of making a claim, including contacting the Administrator. What you must not do Do not have your vehicle repaired, nor authorise repairs, unless we have expressly approved repairs by the Authorised repairer. 10 Extended factory warranty Additional terms and conditions Cancelling your warranty You may cancel your warranty at any time by writing to the Lexus Premium Care Administrator requesting cancellation. We may also cancel your warranty where you have not fully complied with the Terms and Conditions of the warranty. Transferability Only you are entitled to make a claim or receive a benefit from your warranty. At the sole discretion of the Lexus Premium Care Administrator, we may permit you to transfer your warranty upon sale of the vehicle to the purchaser. The warranty cannot be transferred if you sell your vehicle to or through a motor dealer or trader. This does not affect your rights or entitlements otherwise available at law. A transfer form can be obtained by calling 1300 888 840 or emailing [email protected] Premium care 11 Repairer Instructions DO NOT Commence REPAIRS UNLESS AUTHORISED BY THE LEXUS PREMIUM CARE ADMINISTRATOR Please contact the Lexus Premium Care Administrator on 1300 888 840 and advise them that you wish to make a claim under the warranty. A claim form can be obtained by calling 1300 888 840 or emailing [email protected] If the claim is authorised, the Lexus Premium Care Administrator will approve repairs and issue a repair authorisation number. Once repairs are completed, the Authorised repairer must forward a tax invoice to the address below for payment. Tax invoices must be addressed to the Lexus Premium Care Administrator and include the following information: 1. Lexus Premium Care authorisation number; 2. Vehicle registration number; 3. Customer’s name in full (include ABN if a company); 4. Odometer reading; 5. Breakdown of repair costs, detailing parts, labour and GST content; 6. Copies of any sublet repair invoice (when requested); 7. Name, address and ABN of the Authorised repairer; 8. Date of issue.
