President’s Report
Greetings fellow MSAA members,
Another annual convention is in the books and a HUGE thank you is due to all of
you that have participated and volunteered. The 61st installment of the MSAA annual
conference held true to tradition and was a great way to say good bye to 2011 and
hello to 2012. As always it was a group effort and the group came through!
Opening night started off with a 3 part interactive session. Thank you to MSAA
members Tim Bos, Jonathan Kraft, David Helmer, Peter Gehres and Kenny Lindsay for
sharing their expertise in the “Auction Product Blitz”. Auction industry information
was shared in a game show manner as fellow members participated in “Auction
Family Feud”. The evening was rounded off with fun and member interaction in our
first ever Auctioneer Olympics.
The rest of our seminar contributors certainly did not disappoint. Eli Detweiler, Sam
Grasso, Ken Lindsay, Mike Brandly, Machinery Pete and Rick Montgomery surpassed
our high expectations by delivering excellent seminars on a range of topics.
Special congratulations go out to our new champions of the Michigan Auctioneer
Championship and Ringman Competition. Coming out on top this year was Henry
Detweiler (MAC) and Peter Gehres (RM). Once again, tireless work and efforts of
our members helped to make the auction special and possible. Congratulations are
also in order for our entire advertising contest winners.
2012 will be another banner year for the MSAA, plans are already in the works for
Lansing 2013. But before that, let’s not forget the Midwest Auctioneers Roundup. The
2011 Roundup was a huge success for everyone involved and especially successful
for the Michigan association and our members. The 2012 offering will not disappoint
and we hope to improve on this event for years to come. In October don’t forget the
All-Star Auction, details will be in upcoming issues of the magazine.
All MSAA events prove to be successful because of our membership and extraordinary
efforts of our board and our executive director. This year we ushered in a new crop of
individuals dedicated to the Michigan auction industry and our association.
I would like to thank our retiring board members for their efforts towards the success
of the MSAA; Art Smith, Gwyn Besner, Peter Gehres and Becky Lawrence have
been good stewards of the association.
Thank you for allowing me the opportunity to serve you as the President of your great
association, it is an extremely proud moment for me. The MSAA is your association,
please address the board or myself with your ideas or concerns. Let’s strive to stay on
top as the benchmark for organized groups of auctioneers and carry our enthusiasm
and innovation forward into the future. I look forward to 2012 and years to come.

Scott Vander Kolk Jr. was born and raised in the Auction business, but that is only
partially true, the family was involved in many industries. Through most of his youth the
family was involved in selling farm implements, managing the family dairy and crop farm,
owned the local stockyards and his father Scott Sr. was an auctioneer at multiple livestock
sales. Many weekends were auction oriented, purebred cattle sales or farm auctions.
Scott spent 10 years in sales selling building materials throughout Michigan and in
2001 started conducting his own auctions as Vander Kolk’s Golden Gavel Auction Service
on weekends and when time permitted. In 2007 he took the auction business full time and
didn’t look back. Scott conducts auctions as Golden Gavel Auction Service and several a
year for M & W Inc, as well as a weekly auto auction.
Scott is the proud father of 2 children Nickolas 7 and Ava 5 and enjoys spending time
with them. He also enjoys collecting and restoring vintage farm equipment.

Status of the Michigan’s Voluntary Auctioneers Registration Act

• Registration is Voluntary
Four points of the current Registration Act are in need of
change:
• Auctioneers may use funds advanced for expenses prior
to the auction
• For any schools where training is received, there is no
accreditation requirement
• Continuing education is required only for voluntary
registrant (equivalent to other states to allow for future
reciprocity)
• Extend the grandfathering time frame
The bill to amend the registration act is currently on the State
House floor await passage. No further actions are required by the
association to have these amendment passed.
The Michigan State Auctioneers Association supports
VOLUNTARY REGISTRATION. There is currently NO plan
to pursue mandatory licensure.

Michigan Auctioneers Conference Full of Champions!
Auctioneers gathered January 24-27 for the Michigan
State Auctioneers Association 61st Annual Conference. Over
140 Auctioneers, support staff, families & exhibitors gathered
for Education, Fellowship and Fun at the 2012 Michigan State
Auctioneers Association Conference in Lansing, Michigan. The
conference provides attendees with numerous opportunities
to network with fellow auctioneers and auction firms, learn
from experts, compete with their marketing designs and test
their talent in the Michigan Auctioneer Championships and
Ringman Championships!!
Several speakers highlighted the event, including
International Champion Auctioneer, Eli Detweiler, Professional
Ringman, Sam “The Hitman” Grasso, Greg “Machinery
Pete” Peterson, instructors and well known auctioneers, Mike
Brandly, Rick Montgomery, Kenny Lindsay, Peter Gehres,
Gwyn Besner, David Helmer, Tim Bos, Jonathan Kraft and
more.
Auctioneers from across the state were awarded for their
outstanding accomplishments in marketing. There was a total
of approximately 190 entries in the 42 categories competed
for in the coveted marketing competition. The most prestigious
of the awards went to the Auction of the Year category, won
by Merritt Auctions of Greenville, Michigan; the Website
category, won by She Sold It of Lapeer, Michigan; and the
Social Media Category, won by Beth Rose Auction Company
of Maumee, Ohio.
Many MSAA Members took home marketing awards,
some members capturing multiple category championships.

Henry Detweiler, of Charlotte, Michigan won the 2012
Michigan Auctioneer Championships. 10 contestants competed
for the coveted title. The 6 finalists were Henry Detweiler
(Charlotte, Mich.), Romayne Graber (Charlotte, Mich.), Darin
Hower (Lake City, Mich.), Wade Leist (Boyne City, Mich.),
Jerry Mast (Vermontville, Mich.) and Donna Tuttle (Mio,
Mich.). For winning the title Henry received a championship
ring, trophy, and entry into the International Auctioneer
Championship in July.
Also highlighted during the event was the MSAA Ringman
Championships. Contestants were tested on their “ringing
abilities”. The contest evaluated ringmen in the following
areas: product knowledge; crowd control; performance;
communication and relaying bids to the Auctioneer. Peter
Gehres, of Hilliard, Ohio won the 2012 Michigan Ringman
Championships.
Thursday evening of the Event hosts the annual President’s
Banquet. Scott Vander Kolk Jr. of Dorr was inducted as
the 2012 MSAA President. The New Officers in the MSAA
are Dan Brodie (Farmington Hills), President elect; Kenny
Lindsay (Livonia), Vice President; Darin Hower (Lake City),
Secretary/Treasurer; Timothy H. Narhi (Byron), Chairman of
the Board. In all, there are 13 Directors and Officers.

Montgomery of Plymouth were honored for their extraordinary
service to the Auction Industry by being inducted into the
MSAA Hall of Fame. Special recognition was also given to
Tricia Wiltjer as she was honored by outgoing President Tim
Narhi with the 2012 President’s Award of Distinction. Also
honored were Joseph Phillips (Fort Gratiot, Mich.), Jason
Lamoreaux (Belding, Mich.), Steve Rottier (Fremont, Mich.)
and Ray Krakowski (Dryden, Mich.), who were presented with
the 2012 Scholarship awards.
Many MSAA Members will travel to the National
Auctioneers Association Conference & Show in July in Spokane,
Washington. This event will showcase the International
Auctioneer Championships, where many MSAA Members will
compete. January 2013 will host the 62nd Annual Conference
of the Michigan State Auctioneers Association Celebrate 25
years of the Michigan Auctioneer Championships by crowning
its 25th Michigan Auctioneer Champion. This special event
will be held in Lansing, Michigan.

Benjamin P. Glardon
2012 MSAA Hall of Fame Inductee
Ben Glardon was born and raised in the Auction Business with Glardon Auction
Service, that his father started over 70 years ago. He has lived and breathed the
auction method of selling for over 40 years. He has conducted a wide cross section
of auctions annually, including farm equipment, real estate, bankruptcy, estates,
business liquidations, personal property collections, guns, coins, fundraisers, benefit
auctions and more.
Ben is a graduate of Missouri Auction School in 1979. He has been a licensed Realtor
since 1983 and is the past President of the Shiawassee Association Board of Realtors.
He was honored to receive the Shiawassee County Realtor of the Year and the ReMax Hall of Fame. He is also a past President of the Shiawassee/Owosso Kiwanis’ Club. Ben is the President of Glardon
Auction Service and a past Director of the Michigan State Auctioneers Association.
Ben was elected to the Michigan House of Representatives for the 85th District in 2010. He currently serves on the House
Agriculture, Insurance and Commerce Committees. He also serves as Vice Chair of the Transportation Committee.
The Michigan State Auctioneers Association was honored to induct Benjamin P. Glardon into its Hall of Fame on January
26, 2012. Ben was asked to speak to the association members about his experience in the State House of Representatives
to kick off the Michigan Auctioneer Championships. He was surprised by the MSAA by being presented with the Hall of
Fame induction. Ben said “I am honored to receive this award on behalf of my entire family who has worked so hard to be
successful. The Auction world has truly been my passion.”

2012 MSAA Hall of Fame Inductee
Richard Montgomery started in the industry working with Norman Levy &
Associates as a teenager. After that he went to work with Williams & Lipton Co. for 5
years. When asked, Rick says “The auction business is the only business I know, I have
never had any other type of job (Not sure if that is good or bad!)”
R.J. MONTGOMERY & ASSOCIATES, INC. was established in 1985 and has
been servicing clients with professional auctions, appraisals, liquidation’s and various
other business functions ever since. Richard personally has been working in this same
field for over 40 years. As a graduate of the Reppert School of Auctioneering, Inc. and
the Auction Marketing Institute, he has earned the designations of Certified Auctioneer
(CAI), Certified Estate Specialist (CES), Graduate, Personal Property Appraiser (GPPA)
and earned the 60th Master, Personal Property Appraiser (MPPA) in the world. He also graduated from the International
Society of Appraisers “Specialty Course of Machinery & Equipment”.
As CEO/president of R.J. MONTGOMERY & ASSOCIATES, INC., one of the top AUCTION, APPRAISAL AND
LIQUIDATION firms in the State of Michigan, he makes it his goal to provide clients with the most thorough, efficient and
expedient services in the state.
He is a member of the National Auctioneers Association, the Michigan State Auctioneers Association (2003 President,
2004 Chairman of the Board), The Auction Marketing Institute, the International Society of Appraisers, the Machinery
Dealers National Association.
He is bonded with the United States Government and works regularly with the United States Bankruptcy Courts
conducting auctions, appraisals and liquidation’s on their behalf. Satisfied clients also include the United States Justice
Department, a large assortment of financial institutions (which include, JP Morgan Chase, Comerica, Citizens Bank, Bank
of America, Key Bank, Fifth Third Bank, Huntington Bank, etc.), municipalities/cities, many charity organizations, and a
large number of business and private clients.

Henry Detweiler of Charlotte, Michigan, won the 2012 Michigan Auctioneer Championships.
This year, the contest was held in Lansing at the Michigan State Auctioneers Association’s
61st Annual Conference. 10 contestants competed for the coveted title. The 6 finalists were Henry
Detweiler (Charlotte, Mich.), Romayne Graber (Charlotte, Mich.), Darin Hower (Lake City, Mich.),
Wade Leist (Boyne City, Mich.), Jerry Mast (Vermontville, Mich.) and Donna Tuttle (Mio, Mich.).
For winning the title Henry received a championship ring, trophy, and entry into the International
Auctioneer Championship in July.
Also taking home honors were Wade Leist and Romayne Graber. Leist was 1st runner up and
Graber was 2nd runner up.
Detweiler owns Sunrise Auction Service in Charlotte where he specializes in horses, farm
equipment, and personal property auctions along with a number of fund raising auctions each year. He has also travelled across
the state working as an Independent Contract Auctioneer for other auction companies in the past 6 years.
Detweiler is also a member of Yutzy’s Auction Team of Charlotte where he works along with Joseph Mast, Romayne Graber
and Lavern Yutzy, who owns the company.
Henry is also an avid hunter and is a member of the Rocky Mountain Elk Foundation, the National Wild Turkey Foundation
and Pheasants Forever, were he serves on chapter committees and conducts Banquet Auctions. He is also a Certified Farrier and
member of the Michigan Horseshoers Association.
He has been in the auction business since 2006 and lives in the Charlotte area with his wife, Edna Mae (Graber) Detweiler,
and daughter, Veronica Jane.
Detweiler commended the MSAA for its high standards in Ethics and Code of Conduct as well as its goal to provide a high
level of education for auctioneers. He said “I want to Thank the MSAA for helping me to reach one of my goals and for allowing
me the other of being your champion and the chance to be an ambassador for the MSAA for the next year. I also want to thank
the MSAA for helping me be all I can be as an auctioneer.”

Michigan Ringman Champion 2012
Auctioneer Peter D. Gehres was awarded the honor of 2012 Michigan Ringman Champion on
January 25, 2012 at the Michigan State Auctioneers Association Winter Convention in Lansing,
Michigan. The judges for the 2012 Championship included 2010 International Auctioneer Champion
Eli Detweiler Jr., Santo (Sam) Grasso, Greg Peterson (aka Machinery Pete), National Auctioneer
Foundation Trustee David Helmer and Kim Narhi.
This was the fourth time Gehres competed in Michigan Ringman Championship and the 20th
auctioneer or ringman contest he has entered. Peter has also won the Ohio Junior Bid Calling
contest in January 2006, the Michigan Auctioneer Championship in January 2010 and the title of
Indiana Champion Auctioneer in November 2011.
“In 2012 I look forward to representing Michigan at both the International Auctioneers
Championship in Spokane, WA and the World Automobile Auctioneers Championship in Orlando,
FL,” Gehres said. “Michigan has a special place in my heart and has played an important role in my
development as an auctioneer and ringman.”
In addition to competing in auctioneer and ringman contests across the country, Gehres recently
completed a term on the Michigan Auctioneers Association Board of Directors. He is also currently serving a second term as the
treasurer of the Ohio Auctioneers Association.
Gehres is a first generation auctioneer and Realtor currently based in Columbus, Ohio. He is the Vice President of Auction
Operations for United Country Gryphon Realty & Auction Group, the owner of Belhorn Auctions and the cofounder of The Super
Auction event. He is also a professional speaker and teaches at The Ohio Auction School, Reppert School of Auctioneering and
state and national conventions.
Gehres splits his time between Columbus, Ohio and his family farm in Van Wert which has been handed down from father to
son since 1875. In December of 2011 Peter and his wife Paige welcomed twin boys, Abraham and Oliver, into the world. He is
an active volunteer and support of the FFA, 4-H and Junior Achievement.

President’s Award of Distinction 2012

Fred S. Fissell — The Auctioneer

Fred S. Fissell was an auctioneer. He practiced in Ohio
and this story involves an advertisement he placed around
1911 in a newspaper possibly printed in Mt. Gilead, Ohio
(Morrow County.)
In the same newspaper, we see an advertisement from
W. C. F. Michel, Auctioneer for an auction to be held on
Thursday, March 16, 1911 involving the auction of various
livestock and farm implements.
Mr. Fissell placed the following advertisement, if that’s
what it was:
The Auctioneer
Comes to greet you with good cheer.
Sell at home or far away,
Sell by either night or day,
Sell by the job or on commission,
And all that’s needed is permission.
Sell in sunshine or in storm,
Be weather cold or weather warm,
In winter chill or summer heat,
With equal pleasure and ne’er retreat.
Sell your houses, sell your land,
Sell new goods or second-hand,
Sell for others and would sell yours,
In the house or out of doors.
Sell your horses, mules and cows,
Sell your wagons, carts and plows,
Sell your poultry, sheep and hogs,
Never sold cats but have sold dogs.
Sell your dry goods, groceries, drugs,
Sell your queensware, jars and jugs,
Sell your trimmings, notions too,
And when you’re ready would sell for you.
Sell your reapers, rakes and forks,
Sell your milk cans, bottles and corks,
Sell your grain and hay and straw,

Sell your chattels, but not for fun,
For that’s not why the thing is done,

As Outgoing President, Tim Narhi, honored a long
time member. Below is his speech from the conference.
Ladies and gentlemen as President I am given an
opportunity to present a special award to a person whom I
feel should get special recognition, a person whom I have
recognized as one who has gone above and beyond their
call of duty and or expectations.
I look at the membership past and present and I see a
wealth of shared knowledge and shared experiences, a ton
of support in about any form you could ask for; friends and
colleagues who provide support physically, monetarily
and who make time commitments for this association to
better this industry. I look at the Board of Directors and
see a group of people who work hard, work together and
sacrifice time from their families and businesses to better
this industry.
There are many facets to this association. It’s like a
big mechanical clock, especially at conference time. There
are many people working to make this an enjoyable event.
There are several different committees on the Board all
doing what they can to make this work.
The truth of the matter is that there is one person who
is a member that is in the Watch Tower for the Michigan
State Auctioneers Association.
A person who makes sure this
Association runs like a Swiss
Watch. This is the person who
holds “our feet to the fire” as
directors to see that our chores
get done, the same person who
fills in the gaps to prevent
something from “slipping
through the cracks” and has
helped shape this association
to become the Benchmark
of all other State Auctioneer
Associations across the United
States.
I therefore would like to present the President’s Award
of Distinction to Tricia Wiltjer.
I don’t know if Mr. Fissell wrote this poem or borrowed
it from someone else; in either case, it seemed worthy of
republication.

History of Auctions

Association published this
“history of auctions.” Here it
is in entirety:
It seems that auctions
have touched almost every
century, every industry and
every nationality, and this list
I gave you was just a small
sample. Auctions date back
so far in history, that no one
really knows for sure how they
started or who started them.
The First Auctions
Records handed down from
ancient Greek scribes document auctions occurring as far back
as 500 B.C. At that time, women were auctioned off as wives.
And, in fact, it was considered illegal to allow a daughter to be
“sold” outside the auction method.
A “descending” method was used for these auctions,
starting with a high price and going lower until the first person
to bid was the purchaser, as long as the minimum price set by
the seller was met. The buyer could get a return of money if he
and his new spouse did not get along well, but unlike a horse,
maidens could not be “tried” before auction.
Women with special beauty were subject to the most
vigorous bidding and the prices paid were high. Owners of the
less attractive women had to add dowries or other monetary
offers in order to make the sale.
In Rome, Italy, around the time of Christ, auctions were
popular for family estates and to sell war plunder. Roman
Emperor and philosopher Marcus Aurelius sold family furniture
at auctions, for months, to satisfy debts.
Roman soldiers sold war plunder at auction. The licensed
auctioneer, called “Magister Auctionarium,” drove a spear
into the ground to start the auction. Today we use an auction
gavel.
Auctions Come to America
American auctions date back to the Pilgrims’ arrival
on America’s Eastern Shores in the 1600s and continued in
popularity during colonization with the sale of crops, imports,
clapboard, livestock, tools, tobacco, slaves and even entire
farms. Selling at auction was the fastest and most efficient
means to convert assets into cash.
Fur was especially big during this time. In his book,
“Going, Going, Gone!,” Bellamy Partridge says “the Bible and
the beaver were the mainstays of the Pilgrims, the Good Book
saving their souls and the beaver paying their bills.”
Initially, the furs were collected from Native Americans
in the fall and winter, utilizing the “private treaty” method of
exchange for “wampum” (the Native American word which
meant money). The raw pelts (or hides) were transported to the
closest shipping port. In the spring of each year, the auction

method was used to sell the raw peltries to the European
merchants who arranged the transcontinental voyage to the
Old World. Once the ships returned to the port in Europe, the
peltries were auctioned to manufacturers, who would process
them for the retail market. The early fur trade was chiefly
responsible for the settlement and development of North
America.
Civil War Era
Have you ever heard an auctioneer referred to as “Colonel?”
It’s a fairly common practice, especially at auction schools
across the country. This came about during the Civil War era, a
time when auctions were beginning to flourish.
History has it that the art of auctioneering was a common
practice for Civil War Colonels who regularly auctioned off
the spoils of war and surplus. However, only officers of the
Colonel rank could conduct them, spawning the use of the term
“Colonel” by many auctioneers still today.
A short historical narrative from one of the top auction
schools details this process: “As the Civil War progressed,
many troop battalions made a practice of seizing property
of land owners and merchants as they marched. Contraband
would be collected and carried to a favorable area, then the
Colonel or commanding officer would sell the goods at public
sale. Even after the Civil War, military Colonels traveled to
sell surplus goods and seized goods. Auctioneers followed
some of the same trails and dressed similar to army Colonels
to such an extent that the public began to recognize auctioneers
as “Colonel.”
Other Names for Auctioneers
Colonel is only one name that auctioneers have been
identified with over the years. Other names include “Knights
of the Hammer,” and “Brothers”. The tools of these auctioneers
included the Colonel style hat, a cane, bell, hammer or gavel,
and a red flag. The flag, often boasting advertising, was placed
above where the auctioneer would sell on the day of the
auction.

term, the school promoted “competent instructors teaching
general merchandise, real estate and fine stock auctioneering.”
However, many auctioneers at that time did not believe an
auctioneer could be “trained.” They believed that auctioneering
was a natural ability that you were born with.
Challenges for Auctioneers
Though finding goods to sell was not a problem in those
days, auctioneers faced other challenges. There was no
amplification system for their voices and no microphones as
we know them today. So they had trouble both being heard,
and keeping their voices intact.
Because travel was more difficult, and was mostly by horse
and wagon, auctioneers enticed crowds by routinely offering
lunch to those who came to the sale. Weather often dictated the
time the auction started, as all were held outdoors.
The Great Depression
The growth of the auction industry remained until the Great
Depression of 1929. Some auctioneers traveled the country to
liquidate the estates of farmers whose farms had failed because
of drought and bank foreclosures. The decline of the auction
method of marketing followed the poor economic climate and
did not rebound until after World War II.
The 1950s
Auctioneering began to make great strides after World
War II. The sale of goods and real estate was booming. There
was a need in certain cases to move real estate and personal
property faster than the private market would allow. Thus,
the modern day auction business was born. Auctioneers were
now businessmen who dressed in suits and ties. They began
to nurture the business and raise the reputation of auctioneers.
Besides the public, auctioneers began to have links to banks,
attorneys, accountants, the court system and government
agencies.
The 1990s through Today
During the 1990s, technology was finding its way into
the auction business. Auctioneers were using computers, fax
machines, cell phones and other technology to make their
businesses run faster and more smoothly. Some auctioneers
began taking photographs of small auction items and projecting
them onto big screens so the crowds could get a closer look at
the merchandise.
Auctions burst into cyberspace in the middle of the decade.
The ever flourishing eBay was launched in 1995 and would go
on to become an “online leader” in the bidding business.
Many auctioneers today offer both live and online auctions
to meet the needs of customers near and far. Technology allows
buyers to participate in the sale without even being there.
The Future of Auctioneering
Over the years auctioneering has progressed and changed,
and today it remains more popular than ever. Most everything
thinkable has been sold by the auction method of marketing:
antiques, household items, automobiles, land, livestock,

homes, designer dresses, business equipment, and more.
And thanks to professional organizations like the National
Auctioneers Association, auctioneers are privy to countless
educational opportunities that help them to keep up on the
latest technology and learn new business traits. They network
with other auctioneers to exchange ideas and to find ways to
continue to meet the growing needs of the American public.
Auctioneers today are working to earn specialty
designations such as Graduate Personal Property Appraiser
(GPPA) , Accredited Auctioneer Real Estate (AARE), Certified
Auctioneers Institute (CAI) and Certified Estate Specialist
(CES). NAA auctioneers are also bound by a code of ethics
that protects consumers against fraud and unfair business
practices.
Auctions have been around since the beginning of time
because they are a highly efficient and effective business tool
and they meet the needs of the public. But, they also are fun,
entertaining and theatrical. Most people who attend an auction
keep wanting to go back again and again.

The third Saturday in April marks
a special day in the lives of auctioneers
every year as ‘National Auctioneers
Day’ is celebrated. This special day is
recognized by auctioneers as a day to
reflect back on one of history’s oldest
professions and celebrate the industry’s
future.
The last bastion of the competitive free enterprise
system, auctions and the age-old profession of
auctioneering continues to grow every year. It is estimated
that approximately a quarter-trillion dollars in goods and
services are sold by live auction every year in the United
States. Online or on the lawn, auctions continue to grow
in popularity with consumers. Bidders enjoy the thrill
of competition with an auction and the rush that comes
with the chase for treasures. Auctions are one of the
most effective and efficient means of turning assets into
cash quickly. Most importantly, consumers come back
to auctions time and time again because of the fun and
entertainment.

I’ve owned and operated many small businesses over the
last 25 years but auctioneering has always been my passion.
In recent years the auction business has required a full time
commitment and we have found our niche as an Estate
Auction Specialist. We also have a wealth of experience
in Farm Equipment, Machinery, Storage Lockers and Real
Estate.
How Has The MSAA Been A Benefit To You And Your
Auction Career?
Looking back to when I joined the MSAA I recognize it
was not only a smart business decision but also a chance to
support my profession and help it grow as one of the most
exciting careers available. The networking possibilities are
endless, the seminars at conventions are fantastic and I have
learned that Michigan’s group of Auctioneers are some of
the best people you will ever meet.
Based On Your Experience, What Advice Can You Give
To A New Auctioneer?
My advice to a new auctioneer is to attend as many auctions
as possible. Watch and learn as the veteran auctioneers
put on a quality sale. When it is time for your first auction
you need to strive for a smooth trouble free sale with no
confusion. And remember an auctioneer is only as good as
his reputation, keep your customers and sellers happy and
you will prosper!
What Auctioneers Have Been Most Helpful or Influential
To You In The MSAA?
The question of who was the most influential person in my
life and/or business was initially a tough one. Thinking back
I remember my first Michigan Auctioneer Convention and
walking in I had little idea of what to expect. I was wearing
this big red badge that said “new member” and no matter
how comfortable I am with people I could not help feeling
a little intimidated. These feelings were quickly erased as
auctioneer after auctioneer approached me, shook my hand

and welcomed me into the association. And these were not
just any auctioneers, these were the elite veterans and they
were offering me the “new guy” their support and friendship.
This was a turning point in my career and it gave me the
confidence to take my business to the next level.
What Are Your Long Term Goals In The Auction
Business?
This year I decided to run for the MSAA Board of Directors
and I was blessed to be elected to a 3 year term. I feel that
I can contribute to the association in many ways and look
forward to doing so. I’m sincerely honored to serve the
membership and if I can help anyone in anyway please
contact me.
Tell Us A Short Auction Story. It Can Be A Humorous
Story (preferred), interesting experience.
I was asked to finish up with a funny story and although
there are several, but one always comes to mind. Many
years ago while doing an auction in the west side of the
state I forgot to get the necessary permit to conduct the sale.
The code enforcer we will call “Debbie“ arrived and was
attempting to collect the license fee from my cashier. As I
approached Debbie to discuss this fee she noticed a piece
of furniture she liked. As you can guess, Debbie waived the
license fee and stayed to buy the furniture at a premium
price!!! Now that’s funny!!!

I would like to take this
opportunity to ‘Thank You’for
extending your confidence by
electing me to serve as your Vice
President of the Michigan State
Auctioneers Association.
I also want to thank my
wife, Lindsey for giving me
her full support to me so I can
aggressively pursue making our
association a better one. Despite having a 6 month and a 2
year old babies at home, she has never ‘shortened’ the rope
and really could not be any more supportive.
I recognize the mammoth amount of responsibility
involved and I have already rolled up my sleeves to go to
work by working closely with our Board of Directors for the
betterment of our association and the auction industry.
I bring over two decades of successful entrepreneurship,
small business management and over a decade as a full-time
professional auctioneer to the association. I understand and
know how important it is that we communicate, display our
skills effectively and continue to ‘brand’ the auctioneer in
order to stay viable and employed in the marketplace.
I wholeheartedly believe that every auctioneer in our
association can stay as busy as they want to in this industry.
The business is out there, but oftentimes, the general public
is not necessarily thinking ‘auction.’
It is with that, the theme to my Vice Presidency is
‘AUCTION FIRST!’As one of the founders of the MSAA’s
Pubic Promotions Plan, I am once again the Chairman of
this committee. Over the coming months, I will be working
with our committee to roll out some tangible material to
promote the auctioneer to the general public. However, the
strength of this project is dependent upon numbers in more
ways than one. It is with that, I will be working on increasing
our workable budget with the Public Promotions Plan so
‘AUCTION FIRST!’ is as loud and clear as possible.

“More on Agency” by Steve Proffitt
Last time I wrote about
agency principles. While an agency
relationship gives the agent certain
authority to act, it also burdens
her with responsibilities. These
responsibilities emanate from the
agent’s status as a fiduciary.
A principal appoints an
agent for the specific reason that he
trusts the agent and has confidence
in her. This trust requires the agent
to exercise the highest degree
of loyalty and good faith to the
principal on all matters within the scope of the agency. At no
time may the agent use the principal’s assets or secrets for
personal gain, nor may the agent enter into any circumstance
that is adverse to the principal.
Fiduciaries owe special duties. This month we will look at
the key duties that an agent owes her principal.
Loyalty – An agent must always be loyal to the principal.
This is an agent’s most important duty. The agent must act first
and foremost for the benefit of the principal, as defined by the
purpose of the agency relationship.
Obedience – An agent must be obedient to the principal.
While acting within the scope of the agency relationship, an
agent is always under the direction and control of the principal
and must obey the principal’s commands.
Competence – An agent must be competent and able to
perform the purpose of the agency. Less than full competence
and ability to serve would thwart the agency and harm the
principal.
Reasonable Care – An agent must exercise reasonable care
and diligence on behalf of the principal. An error, omission, or
wrongful act by an agent can result in the agent being held liable
to the principal for damages, as well as the principal being held
liable to third parties for damages caused by the agent.
Advance Interests –An agent must act to further the principal’s
interests that are the subject of the agency. Accomplishing the
principal’s goal is the essence of the agency relationship.
Incomplete Information – Where the principal lacks all of
the information that an agent possesses, the agent must do what
she reasonably believes the principal would direct her to do if
the principal knew the facts under which the agent is operating.
The test is always what course would best serve the interests of
the principal.
Adverse Interest – An agent must reveal to the principal any
interest that she has adverse to the principal or the subject of
the agency relationship. This strikes at the heart of the problem
of conflict of interests and ensures that the principal will not be
unknowingly prejudiced or damaged by an agent.
No Competition – An agent must never act for her own
benefit or compete with the principal with regard to matters
within the agency. To do so would be a clear conflict of interests
and a breach of the agent’s duty of loyalty and trust.
Disclosure and Truth – Generally, any notice received by an
agent, while acting within the scope of his authority, is the same

as notice being received directly by the principal. This is so
whether the principal actually received the information or not.
The reason for this is it is presumed the agent will fulfill her duty
to disclose information to the principal that the principal needs
or should have. An agent must always be truthful in disclosing
information and may never engage in fraud or deceit.
Self-dealing – An agent may not engage in self-dealing for
her own gain or the gain of a close relative, friend, business
associate, or other with whom she has some relationship. To do
so would breach the agent’s duty of loyalty to the principal.
Accounting – An agent must account fully and promptly to
the principal for all funds received and disbursed by the agent
during the course of the agency. Timely and accurate accounting
ensures protection of the principal’s vital interests.
Remit – An agent must timely remit all monies, and/or
deliver all assets, that are due the principal within the agency
relationship. One of the most egregious violations that an agent
can commit is the failure to timely pay or deliver to the principal
what is due.
Adhere to Authority – An agent must never act beyond
the express or implied authority that she receives from the
principal.
Confidence – An agent must always maintain strict
confidentiality of the principal’s affairs. An agent is in a position
of trust and often has access to sensitive information regarding
the principal. The agent must safeguard this information, as its
release could be harmful and damaging to the principal.
An agency is one of the most important relationships under
law. It imposes heavy burdens on the agent and should not be
entered into without a full understanding of these duties, plus the
agent’s determination to fulfill them.
The agency relationship exists for the sole benefit of the
principal. The law cares little about any advantage to the agent,
but it cares plenty about the principal’s interest being properly
served and advanced by the agent. This underscores the necessity
for the agent to fulfill her agency and fiduciary duties at all times.
Indeed, if the agent is found to have gained any advantage over
the principal through the agency, the law will presume that it
was accomplished by fraud and hold the agent liable unless the
agent can provide an acceptable explanation for what occurred.
Auctioneers can avoid the pitfall of liability to sellers by
doing two things. First, they must understand agency law and
the duties that it imposes upon them. Second, they must always
work to fulfill these duties so their sellers’ interests are protected
and well served. No professional would ever do less.

HAPPY BIRTHDAY FROM THE GRAVE?
A few years ago on my
birthday, a gentleman called to get
an authentication and appraisal on
a 19th century land deed that was
signed by former President of the
United States, Andrew Jackson.
Being a little short on cash, the
customer was a little apprehensive
about making the monetary
investment on our services. He
asked for a discount on our fees
which I was unable to reduce so he decided that he would "wait
awhile and maybe have it done sometime down the road."
Five minutes later, he called back and asked if he went
forward with the authentication & appraisal if I would not
charge him to take a look at a few historical items that were
family heirlooms that he thought may have some kind of value.
I agreed and two hours later, he met up with me in between
appointments.
I began examining the Jackson land deed and within 10
minutes or so, I had all the information I needed to proceed
with an autograph authentication and subsequent appraisal. I
then turned a large box filled with miscellaneous artifacts and
began going through them one by one.
Many auctioneers collect gavels and I happen to be one
of them. Needless to say, seeing an old gavel laying on the
bottom of this box caught my attention. I asked the gentlemen,
“What’s the deal with the gavel? Any history to it?” He says,

“My great grandfather used to be a judge in Wyandotte,
Michigan.” In complete astonishment, I took a small step back
and said, “What was his name?” He said, “Oliver San Souci.”
I exclaimed, “That’s MY great Grandfathers brother!”
Both of us just stood there in complete disbelief of what
just happened. We started comparing stories about our ancestors
and as it turns out my mother and his mother used to see one
another at family functions many decades earlier but lost touch
when the elders of the family passed away.
Oliver San Souci was a highly esteemed pioneer of
Wyandotte. Not only was he the Judge for about half a century
but he was also a prominent land,business owner, Fire Chief
and owned a mansion on Jefferson Avenue.
Then, this gentleman says, “Then you’re really going to
like this” as he pulls out this giant leather bound ledger that
once belonged to my Great Grandfathers brother which he kept
on his bench and recorded all the cases and his judgments that
came in and out of his courtroom. It was one of the coolest
things that I ever seen.
Anyway, in exchange for an appraisal, my newly discovered
‘relative’ traded me my Great Grandfather brothers gavel that
he used on the bench and the giant leather bound ledger which
I proudly display in my lighted glass showcase in my office.
So you tell me. Is this just a crazy coincidence that I inherit
an important piece of my family history on my BIRTHDAY
of all days or was this truly a Happy Birthday greeting from
beyond the grave?
I don’t believe in coincidences.

One of the calls that I field the most is from people who are looking to find an auctioneer
to dispose of a particular asset. They call the national or state association because they
want someone who is credible. They want someone who knows how to get them the best
money for their asset(s) and they believe that such a person would join their local or national
association.
When I take such a call, I talk to them about what they should look for in an auctioneer –
look at their references, look at their business, see how many auctions they have conducted,
see what kind of assets the auction company is known to sell and much more. I also explain to
them about the designations and what they are and what they mean.
I make sure that the potential client knows that the designations are not evidence that
someone is better than someone else, but it is evidence that someone cared enough to take
continuing education. Perhaps the most important function that the National Auctioneers
Association provides is education and we do it in a variety of ways.
Every month, NAA members are provided a free 30-minute web cast to take at their own convenience. Topics include
education on how to use various technologies such as Drop box or Ever note or business optimization and much, much
more. NAA members also can participate in one-of-a-kind events like the Real Estate Summit that was held in February in
Atlanta or the Benefit Auction Summit, which will be held in September in Denver.
And then there is CAI – the Certified Auctioneers Institute. This three-year program requires you to attend classes at
Indiana University in Bloomington, Indiana for one week a year. Coursework is customized for the auction professional
and the curriculum is designed to educate you to run your business more efficiently. Curriculum includes topics such as
marketing, leadership, staffing, legal and ethical issues and much, much more. The program is known throughout the
auction industry for facilitating business relationships that last for decades.
There are other designation programs that focus on education for real estate (AARE), benefit auctions (BAS), personal
property (CES), technology (ATS), and appraisals (GPPA).
And what do these designations mean to potential
clients? It only means something if you use it as a
marketing advantage – tell people what they mean, what
you had to do to obtain those designations.

before the conference in Spokane!
One final note – you probably have heard about
the recommendations from the NAA Vision 2015 Task
Force made to the NAA Board of Directors. These
are outlined in the January issue of Auctioneer and at
auctioneers.org (Member Resources/Download). These
are recommendations only; no decisions have been made.
The Board is in the process of gathering feedback from our
