CONDITIONS OF SALE
1. The highest bidder to be the Purchaser. If any dispute
arises, the Auctioneers shall have absolute discretion to
settle it and put up any disputed Lot again.
2. Such advances to be made as shall be determined upon
at the time of sale. The Auctioneers reserve the right to
refuse any bidding.
3. All lots are put up for sale subject (a) to any reserve
price imposed by the seller and (b) the Auctioneers and
Vendors reserve the right to make biddings for each Lot
and to alter the Lotting as may be considered necessary,
and to withdraw any Lot or Lots from the Sale.
4. The full purchase money for each Lot is to be paid at
the fall of the hammer, the declaration of the name of the
of the Lot, which shall be and remain in every respect at
the absolute risk of the respective purchaser or purchasers
thereof, and shall be removed from the place of sale at the
purchaser’s expense, and taken with all faults and errors
of description, the Auctioneers not holding themselves
responsible for the correctness of the description, the
genuineness or authenticity of, or any fault or defect in any
Lot. The Contract of Sale is to be deemed in all cases as
made exclusively with the Auctioneers, and the payment is
to be made to them alone.
5. NO LOT OR LOTS SHALL BE REMOVED FROM
THE PREMISES ON WHICH THE SALE IS HELD
UNTIL PAID FOR, nor shall any person be allowed
to retract his or her bidding, but give his or her name
and residence on demand. NO LOT UNDER ANY
CIRCUMSTANCES TO BE REMOVED DURING THE
HOURS OF SALE but all Lots must be taken delivery of
within two days of the sale. No relaxation whatever can be
made to this condition. Should any damage be occasioned
by any purchaser(s) to any property of the Vendor which
is either reserved of unsold, the purchaser shall make good
the same or pay a sum in damages which may be agreed
between the Auctioneers, as representing the seller, and
such purchase, or failing agreement as to said damages,
the amount shall be settled by the Auctioneers whose

8. It is hereby expressly stipulated that all sales be cash
transactions at the fall of the hammer, notwithstanding
a bill statement may be delivered to the purchaser at the
end of the sale, for the convenience of such purchaser,
no stamped receipt shall be required by such a purchaser,
except at his or her own expense.
9. If any purchaser shall fail to comply with the above
conditions or any of them, the Auctioneers shall be at
liberty to recover in full the amount of purchaser money
of the Lot or Lots bought by such purchaser, together with
5 per cent interest, and all costs, charges and expenses,
without reference to any delivery or acceptance of the
hammer, and the declaration of acceptance as before
stipulated; or to re-sell any Lot or Lots bought by such
purchaser, either by public or private sale, and the full
amount of the purchase money at the present sale, or the
with all interest, cost, charges and expenses, shall be
made good by the defaulter, at the present sale, and be
recoverable as and for liquidated damages.
10. Neither the Vendor nor the Auctioneers shall be
responsible for any loss, damages or injury occasioned to
or sustained by any person on the premises, before, during
or after the sale howsoever the sale may arise.

formerly in the Carnegie Family, the top centred with octagonal plinth
and eight hinged glazed panels set in brass frames, each opening to a
mirror backed and velvet lined interior, within beaded border, on a tapered
hexagonal stepped column and three downswept scroll and acanthus carved
supports, with hairy paw feet concealing recessed brass castors, 133cm
diameter x 84cm high.
Footnote;
The current lot has been in the drawing room of Cluny Castle, Kingussie,
when in 1888, Andrew and Louise Carnegie had rented the Castle as
a summer home. The table contained some of the Macpherson family
treasures and on the glass lid of each compartment there was a strip of
ribbon sealed to the table to prevent anyone from opening it. In the 1920’s
the table was sent to Fraser’s Auction Rooms in Inverness where, in her
own words, Mrs Carnegie “discovered the table, I felt under the edge for the
remnants of the red sealing wax and there they were!! So I knew I could not
be mistaken!- Mr Barrow attended the auction sale and to my delight the
table was mine! In due course it arrived in New York and I kept it at 2 East
91st Street” (Formerly the Carnegie’s home and now The Cooper Hewitt
National Design Museum).
