WHRHS BOARD OF EDUCATION MINUTES OF JUNE 22, 2009 I. CONVENE Dr. Seelig called the meeting to order at 7:00 p.m. A. Public Notice This is the Regular Business Session of the Board of Education for which adequate notice under the Open Public Meetings Law was provided by written notice on April 29, 2009 to the Courier-News, the Echoes Sentinel, the Star Ledger, and the Clerks of the Borough of Watchung and the Townships of Long Hill and Warren. B. Roll Call: Present: Dr. Paul Seelig, President Mr. Peter Fallon, Vice President Mr. Gerald Binder, Mr. Peter Falzarano (Arrived at 7:45 p.m.), Mrs. Sondra Fechtner, Mr. Robert Horowitz, Mrs. Laura Mandell (Arrived at 7:10 p.m.), Mr. Louis Pepe, Mr. Tzuoh-Ming Eric Sun (Arrived at 7:20 p.m.), Dr. Bernard Yaged Absent: C. Student Rep: Stephanie Schmidt Jason Riddell Also Present: Dr. Frances C. Stromsland, Superintendent Mr. Timothy M. Stys, School Business Administrator/Board Secretary Dr. Thomas DiGanci, Principal Thirty Members of the Staff Five Members of the Public Pledge of Allegiance Dr. Seelig led the Pledge of Allegiance to the Flag. II. REPORTS AND PRESENTATIONS A. Superintendent’s Comments Dr. Stromsland updated the Board on the following: - Graduation is scheduled for Wednesday, June 24, 2009. The Valedictorian is Rachel Chen and the Salutatorian is Karen Tsung. Dr. Stromsland spoke positively about these and all students. 5104 WHRHS BOARD OF EDUCATION MINUTES OF JUNE 22, 2009 - B. Dr. Stromsland discussed a NJ Star Ledger article regarding High School Redesign. The school is reaching out to parents to obtain accurate information for future additional electronic outreach. Dr. Stromsland provided an update on the H1N1 Virus. Seventeen students are out with flu like symptoms. The school is taking preventative measures such as washing down the building and equipment and distributing hand sanitizers. The nursing department is working with the county and township health department. Board President’s Comments None C. Business Administrator’s Comments Mr. Stys spoke about a transportation subcommittee meeting that he attended last week. Mr. Jerry Ford, Department of Education Transportation Director, was present as were several transportation directors throughout the county. The committee discussed regionalizing and sharing transportation sources throughout the county to save tax dollars. D. Student Representative’s Comments Ms. Schmidt and Mr. Riddell updated the Board on the following student activities: - Relay for Life raised $31,000 for the American Cancer Society. Senior award night is scheduled for the evening of June 23, 2009. Sprit week was held last week. Dr. Seelig presented gifts to the student representatives in appreciation for their service to the Board. E. Committee Reports Finance & Operations – Mr. Horowitz, Chairperson Mr. Horowitz provided an update on committee discussions as follows: - The committee discussed year end surplus and reserve deposits. - Tennis court and track resurfacing are to take place in 08/09 (savings due to favorable co-op bid pricing). - The committee is looking to replace scoreboards in the gym this school year. 5105 WHRHS BOARD OF EDUCATION MINUTES OF JUNE 22, 2009 - - The committee discussed the food service program. Mr. Horowitz spoke with New Brunswick school district about the food service program and asked the administration to look at US commodities and perform a cost benefit analysis. The classroom bid agenda item was discussed. Mr. Stys expanded on the surplus of $200,000 in capital reserve and $100,000 in a tuition reserve. The school will be looking to deposit $300,000 into reserves. Final numbers will be reviewed by the district auditors. Personnel – Mr. Fallon, Chairperson Mr. Fallon provided an update on committee discussions as follows: - The organization chart and evaluations were discussed. - The committee discussed efforts for recruiting with diversity in mind with Paul Ward. - A recommendation for the Social Studies Supervisor position was discussed and will be put forward at the next Board meeting. Buildings & Grounds – Mr. Pepe, Chairperson Mr. Pepe provided an update on committee discussions as follows: - Eating areas were discussed and are on the agenda for approval, as change of use and dual use applications. - Bids for the office renovations were discussed. The bid opening took place on Friday, June 19, 2009 and the results are on the agenda for approval. - The committee discussed the shutdown of the building over the summer on Fridays to conserve energy. - The committee discussed the McBride settlement and the settlement with the design professionals. Checks to McBride and the design professionals are on this month’s bill list. - Mr. Juliano is soliciting quotes for the new TV studio. The project will be scheduled for the summer. - Mr. Davies and Mr. Juliano worked together to provide a security improvement that is part of the agenda. It is programmable doors at a cost of $25,000. - The track and tennis court resurfacing was discussed and is on the agenda for approval. - Mr. Juliano has been working with Mr. Fiore (architect) regarding the HVAC controls. Mr. Juliano has received quotes for training on the system, system repairs, software upgrades and a maintenance contract. The committee recommended moving forward. 5106 WHRHS BOARD OF EDUCATION MINUTES OF JUNE 22, 2009 Policy & Regulation Review – Dr. Seelig, Chairperson Dr. Seelig briefly reviewed policies 6423, 6740 and 6830, and described the need for these policies. He also discussed the use of facilities policy. Principal’s Report – Dr. DiGanci, Principal Dr. DiGanci provided an update on school activities as follows: - Senior ice cream social was held inside due to the weather. Mr. Diez won the 400th baseball game and went to the state championship. The academic teams were rated as one of the top teams. Dr. Stromsland stated that the special education department successfully passed the State monitoring. III. FIRST OPPORTUNITY FOR PUBLIC COMMENT Ms. Nan Masterson spoke on behalf of the nursing department and thanked Dr. Stromsland for her leadership. Ms. Barbara Meyer, Guidance Counselor, expressed gratitude to Dr. Stromsland for her leadership. Mr. Vince Colabella of the arts department expressed gratitude to Dr. Stromsland for her leadership. Ms. Megan Finneran of the business department also expressed gratitude to Dr. Stromsland for her leadership. Mr. Harold Grossnickle, parent and president of the Touchdown club, expressed gratitude to Dr. Stromsland for her leadership as Superintendent. Ms. Patricia Tobin of family & consumer science spoke favorably of Dr. Stromsland and her leadership as Superintendent. Ms. Mary Sok spoke on behalf of the social studies department and complimented Dr. Stromsland on her leadership. Ms. Diana Jones, parent in the school district, spoke positively about Dr. Stromsland and her leadership as Superintendent. Ms. Mary Ellen Phelan, AP English teacher, spoke positively about Dr. Stromsland. Mr. Brad Commerford, World Languages department spoke positively about Dr. Stromsland. 5107 WHRHS BOARD OF EDUCATION MINUTES OF JUNE 22, 2009 IV. BOARD DISCUSSION The Board discussed policy 6423 Expenditures for Non-Employee Activities, Meals and Refreshments, 6740 Capital Reserve Account and 6830 Audit and CAFR. The Board suggested that policy 6740 be reviewed by both legal counsel and auditor. Another discussion took place regarding policy 7510 Facilities Use. The Board suggested pulling this item off the agenda due to language changes. Dr. Seelig discussed setting up another meeting in July for goal setting with Gwen Thornton. A meeting notice will be sent. V. ACTION ITEMS A. ADMINISTRATION THE SUPERINTENDENT RECOMMENDS THAT IT BE: Prior to voting, the Board split resolution A2 into A2.a and A2.b to be able to vote on certain policies separately. Motion by Mr. Fallon, seconded by Mr. Binder that the following resolution numbers A1 – A7 minus numbers A2.b be passed on a roll call vote: A1 RESOLVED, the Board of Education approves the attached fall, 2009, Adult School courses and instructors. A2.a RESOLVED, the Board of Education approves the following policies for first reading: 6740 A3 Capital Reserve Account RESOLVED, the Board of Education approves student #2144 to receive an additional five (5) hours of bedside instruction, in addition to the 20 hours previously approved on April 13, 2009, at UMDNJ at a rate of $55.00 per hour for an additional amount of $275.00 from April 1, 2009 through April 30, 2009. 5108 WHRHS BOARD OF EDUCATION MINUTES OF JUNE 22, 2009 A4 RESOLVED, the Board of Education approves the following students to attend Somerset Vocational Technical High School for the 2009/2010 school year in the Academy for Medical and Health Sciences at tuition rate of $2,000.00 each for a total of $4,000.00. Student Number: 129175 129495 Tuition: $2,000.00 $2,000.00 Transportation to be provided by Watchung Hills Regional High School using the lowest cost alternative. A5 RESOLVED, the Board of Education approves student #2423 to receive various services from the Commission for the Blind and Visually Impaired from September 1, 2009 through June 30, 2010, at a total cost not to exceed $3,900.00. A6 RESOLVED, the Board of Education approves the Watchung Hills Regional High School Marching Warrior Band to travel to Virginia Beach for an adjudicated parade competition. The dates for this event are April 15-18, 2010. Approximately 50 students, three (3) directors, a medical person and parents will be traveling with the group. The directors will be David Udell, Beth Scheiderman and Bonnie Burgdorf. The cost of the trip will not exceed $1,000.00 per student. Each student will be responsible for any and all expenses incurred on the trip. The cost for the directors, medical person and parents will be incorporated into the cost for the students. Transportation will be provided by a private charter bus company. This trip is at no cost to the Board. A7 RESOLVED, the Board of Education approves a Washington D.C. Art and Theatre Trip to occur from Saturday, March 27 through Friday, April 2, 2010 during spring break. This trip will be open to students who have taken Fine Arts, Photography or Theatre courses at WHRHS or who have participated in a theatre production at WHRHS. The current estimated cost for 40 students is $927.00 per student. If fewer than 40 students attend, the cost will be adjusted. This cost includes, all transportation, five (5) nights in hotel with breakfast and dinner each day, a tour director, guided sightseeing tours to DC landmarks, 5109 WHRHS BOARD OF EDUCATION MINUTES OF JUNE 22, 2009 guided tour of Senate and House of Representatives, visits to the Smithsonian, the National Gallery of Art, Ford’s Theatre, The Folger Shakespeare Theatre, and four theatrical performances at DC theaters. Chaperones will be determined at a later date. The district will not be responsible for any trip related costs. The above motion passed with Mr. Binder, Mr. Fallon, Mr. Falzarano, Mrs. Fechtner, Mr. Horowitz, Mrs. Mandell, Mr. Pepe, Dr. Seelig, Mr. Sun and Dr. Yaged voting in the affirmative. Motion by Mr. Binder, seconded by Mr. Fallon that the following resolution number A2.b be passed on a roll call vote: A2 RESOLVED, the Board of Education approves the following policies for first reading: 6423 6830 Expenditures for Non-Employee Activities, Meals and Refreshments Audit and Comprehensive Annual Financial Report (M) The above motion passed with Mr. Binder, Mr. Falzarano, Mrs. Fechtner, Mr. Horowitz, Mrs. Mandell, Mr. Pepe, Dr. Seelig, Mr. Sun and Dr. Yaged voting in the affirmative and Mr. Fallon voting in the negative. Policy 7510 was pulled from the agenda. B. CURRICULUM AND INSTRUCTION THE SUPERINTENDENT RECOMMENDS THAT IT BE: Motion by Mr. Binder, seconded by Mr. Fallon that the following resolution numbers B1 – B2 be passed on a roll call vote: B1 RESOLVED, the Board of Education approves the 2009 Summer Curriculum Development as per the attached list. B2 RESOLVED, the Board of Education approves the textbook and educational software applications for the 2009/2010 school year as per the attached lists. The above motion passed with Mr. Binder, Mr. Fallon, Mr. Falzarano, Mrs. Fechtner, Mr. Horowitz, Mrs. Mandell, Mr. Pepe, Dr. Seelig, Mr. Sun and Dr. Yaged voting in the affirmative. 5110 WHRHS BOARD OF EDUCATION MINUTES OF JUNE 22, 2009 C. PERSONNEL THE SUPERINTENDENT RECOMMENDS THAT IT BE: Motion by Mr. Fallon, seconded by Mr. Binder that the following resolution numbers C1 – C17 minus numbers C12 – C13 be passed on a roll call vote: C1 RESOLVED, the Board of Education accepts with regret, the resignation of Lynn Raimondo, English Teacher, effective June 30, 2009. C2 RESOLVED, the Board of Education accepts with regret, the resignation of Maria Caldarola, Cafeteria Worker, effective June 30, 2009 for reasons of retirement. C3 RESOLVED, the Board of Education approves the appointment of Gregory O’Reilly as a first year tenuretrack teacher of social studies for the 2009/2010 school year. Mr. O’Reilly will be placed on Step 3 of the MA Guide for an annual salary of $54,785. C4 RESOLVED, the Board of Education approves the appointment of Kate Griffin as a long-term substitute teacher of art for the 2009/2010 school year, pending state certification. Once certification is received, Ms. Griffin will be placed on Step 1 of the BA Guide for an annual salary of $48,920. C5 RESOLVED, the Board of Education approves the appointment of Spenser Brenn as a first year, tenure-track teacher of health and physical education for the 2009/2010 school year. Mr. Brenn will be placed on Step 1 of the BA Guide for an annual salary of $48,920. C6 RESOLVED, the Board of Education approves the appointment of Lauren Gottlieb as a first year, tenuretrack teacher of English for the 2009/2010 school year. Ms. Gottlieb will be placed on Step 8 of the MA Guide for an annual salary of $60,696. C7 RESOLVED, the Board of Education approves the appointment of James Granuzzo as a 10-month instructional aide for the 2009/2010 school year. Mr. Granuzzo will be placed on Step 1 of the Instructional Aide Guide for an annual salary of $33,495. 5111 WHRHS BOARD OF EDUCATION MINUTES OF JUNE 22, 2009 C8 RESOLVED, the Board of Education approves the appointment of Amanda Prybella as a first year, tenuretrack teacher of chemistry for the 2009/2010 school year. Ms. Prybella will be placed on Step 1 of the BA Guide for an annual salary of $48,920. C9 RESOLVED, the Board of Education approves the appointment of Eleanor Matthews as a part-time clerical assistant for student and staff information for the 2009/2010 school year. Ms. Matthews shall receive $16,244 for this work. C10 RESOLVED, the Board of Education approves the appointment of Wayne Lee as a substitute teacher for the 2009/2010 school year. C11 RESOLVED, the Board of Education approves the appointment of Nancy Yannazzone as a substitute secretary for the 2009/2010 school year. C14 RESOLVED, the Board of Education approves the employment of Moses Bobadilla as a summer Buildings & Grounds worker for the 2009/2010 school year. Mr. Bobadilla shall be compensated at the rate of $19.00 per hour. C15 RESOLVED, the Board of Education approves the summer work schedule for guidance counselors for the upcoming 2009 summer months as per the attached. They will be compensated at the rate of $25.00 per hour. They will be compensated at the rate of $10.00 per hour. D2 WHEREAS, the Board of Education meetings are scheduled for the first and third Mondays of a given month except in July and August where there is one meeting scheduled on July 20, 2009 and August 17, 2009, and WHEREAS, the bill list is normally approved at the first meeting of the month and checks to vendors are released the next day; approval of the bill list at the July 20, 2009 and August 17, 2009 Board meetings will delay all payments to vendors and may cause undue hardship. NOW, THEREFORE, BE IT RESOLVED, the Board of Education authorizes the School Business Administrator to release checks for payment to vendors for the June 30, 2009 bill list on July 1, 2009 and the July 31, 2009 bill list on August 1, 2009 prior to Board approval on July 20, 2009 and August 17, 2009 so that vendor payments are not delayed. D3 RESOLVED, the Board of Education approves the proposed Pomptonian Food Service student lunch price list for 2009/2010 school year as per the attached (changes from 2008/2009 are underlined). D4 RESOLVED, the Board of Education approves the American Recovery and Reinvestment Act (ARRA) of 2009 application for the summer, 2009, allocating $199,000.00 for the purchase of technology to support students with disabilities as per the guidelines set forth in the ARRA Act; and BE IT FURTHER RESOLVED, the Board of Education accepts the American Recovery and Reinvestment Act of 2009 IDEIA grant award in the amount of $415,000. D5 RESOLVED, the Board of Education approves additional funding for the Chapters 192/193 State Aid of $2,086.00 on May 29, 2009 for a total of $15,921.00 for the 2008/2009 school year. 5114 WHRHS BOARD OF EDUCATION MINUTES OF JUNE 22, 2009 D6 RESOLVED, the Board of Education approves an agreement with Somerset County Educational Services Commission (SCESC) to administer the Nonpublic Textbook Program pursuant to 18A:58-37-1 et seq., as amended by Chapter 121, Laws of 1984 for Mt. Saint Mary Academy in Watchung for the 2009/2010 school year. The cost of the service will be the total amount allocated by the State for the New Jersey Nonpublic School Textbook Program to be paid to SCESC on or before July 31, 2009. Any unexpended funds will be refunded to the district. D7 RESOLVED, the Board of Education approves an agreement with Somerset County Educational Services Commission (SCESC) to administer the New Jersey Nonpublic Technology Initiative Program for Mt. Saint Mary Academy in Watchung. The cost of the service will be 5% of the allocation for the Nonpublic School Technology Initiative Program to cover the SCESC’s cost for administering the program to be paid to the SCESC on or before July 31, 2009 and the 5% will be deducted by the SCESC for the administrative expenses. Any unexpended fund will be refunded to the district. D8 RESOLVED, the Board of Education approves an InterLocal Transportation Agreement between WHRHS and Educational Services Commission of Morris County for coordinated transportation services for special education, non-public and vocational students from July 1, 2009 through June 30, 2010. Transportation will be provided on an as needed basis with an administrative fee of 5%. D9 RESOLVED, the Board of Education approves a joint transportation agreement between Watchung Hills Regional High School District and Warren Township Board of Education to transport two (2) students, ID numbers 107241 and 107242 to/from Morris Union Jointure Developmental Center for the 2009/2010 Extended School Year, effective June 25, 2009 through August 6, 2009, at a per diem rate of $32.80, for a total amount not to exceed $984.00. Watchung Hills Regional High School Board of Education will pay the full cost of transportation. D10 RESOLVED, the Board of Education approves a joint transportation agreement between Watchung Hills Regional High School District and Morris Union Jointure Commission for the Extended School Year summer program for special education students from July 6, 2009 to August 14, 2009 as follows: 5115 WHRHS BOARD OF EDUCATION MINUTES OF JUNE 22, 2009 School # of Location Students Montgomery Academy, 2 Gladstone Midland School, North Branch 2 Total 4 D11 # of Days Attendant 20 30 Route Cost $3,409.84 $127.13 $8,817.25 $12,227.09 RESOLVED, the Board of Education approves a contract with Atlas Track & Tennis to resurface the running track and tennis courts at prices listed below as part of a cooperative bid with the Middlesex Regional Educational Services Commission: Total Base Proposal – Track Total Base Proposal – Tennis Courts Total Base Price $73,253.33 $31,243.85 $104,497.18 Alternate #1 – Armor Crack Repair On Control Joints, Lowering and Patching Of Catch Basin at Gate and Painting Total Contract D12 5116 $16,435.48 $120,932.66 Transfer of Current Year Surplus to Reserve WHEREAS, NJSA 18A: 7F-41 permits a Board of Education to establish and/or deposit into certain reserve accounts at year end, and WHEREAS, the aforementioned statutes authorize procedures, under the authority of the Commissioner of Education, which permit a board of education to transfer anticipated excess current revenue or unexpended appropriations into reserve accounts during the month of June by board resolution, and WHEREAS, the Watchung Hills Regional High School Board of Education wishes to deposit anticipated current year surplus into a Capital Reserve, (Up to $200,000) and Tuition Reserve (Up to $100,000) account at year end, and WHRHS BOARD OF EDUCATION MINUTES OF JUNE 22, 2009 5117 WHEREAS, the Watchung Hills Regional High School Board of Education has determined that up to $300,000 is available for such purpose of transfer; NOW THEREFORE BE IT RESOLVED by the Watchung Hills Regional High School Board of Education that it hereby authorizes the district’s School Business Administrator to make this transfer consistent with all applicable laws and regulations. D13 RESOLVED, the Board of Education awards the rental contract listed below to the vendor listed for rental of facilities for athletic events to be held at this site for the 2009/2010 school year. This contract is being awarded without competitive bidding as an Extraordinary Unspecifiable Service in compliance with N.J.S.A 18A:18A-5 (2) because: 1) It is necessary to obtain athletic facilities in proximity to the school district for transportation efficiency. This facility accomplishes this goal. 2) The facility listed offers unique equipment and arena that allow student athletes the safest and most productive environment. 3) The facility listed below needs coordination with other area school districts, making a bidding process unreasonable and not in the best interest of students. EXPENDITURES FOR NON-EMPLOYEE ACTIVITIES, MEALS, AND REFRESHMENTS There may be school district activities where expenditures for non-employee activities, meals, and refreshments may occur. Expenditures for non-employee activities, meals, and refreshments for school district activities are allowed provided the expenses are in accordance with the provisions of N.J.A.C. 6A:23A-5.8. For the purposes of this Policy, unless the context clearly indicates otherwise, “activities” means events or functions provided or held for the benefit of pupils, dignitaries, and other “non-district” employees (e.g. parents) which are paid from public funds. “Dignitary” means a notable or prominent public figure; a high level official; or one who holds a position of honor. A dignitary, for purposes of this Policy, is not a school district employee or Board of Education member. Allowable expenditures for non-employee school district activities shall include: 1. All reasonable costs, including light meals and refreshments, directly related to activities that benefit pupils and are part of the instructional program including expenditures for field trips and extracurricular programs that are not solely for entertainment. Nothing in this Policy or N.J.A.C. 6A:23A-5.8 shall preclude the district from using student activity funds or accepting donations to support pupil activities that are solely for pupil entertainment; 2. All reasonable costs directly related to activities of dignitaries and other “nondistrict” employees (e.g. parents), including light meals and refreshments and any other directly related expense. Expenditures for this purpose shall be minimal and infrequent; 3. All reasonable costs of commencement and convocation activities for pupils; and 4. Expenditures related to district employees to the extent such employees are essential to the conduct of the activity. The Board shall, at a minimum, take actions regarding pupil activities as follows: 1. Pre-approve field trip destinations; 2. Establish dollar thresholds for awards to recognize special accomplishments; and 3. Establish a budget supported by general fund revenues for each category of activity in a non-discriminatory manner (e.g. football, boys’ soccer, girls’ soccer, photography club). Student activity funds are excluded. Policy 6423 Expenditures for Non-Employee Activities, Meals and Refreshments First Reading 6-22-09 Pursuant to N.J.S.A. 18A:11-12 and State of New Jersey Department of Treasury, Office of Management and Budget Circular 08-19-OMB and 06-14-OMB, the following costs shall not be permitted using public funding: 1. Receptions, dinners, or other social functions held for or honoring any employee or group of employees of the district (e.g. breakfast, luncheon, dinner, or reception for retirees or award recipients). This does not prohibit the district from honoring employees without a social function or using public funds to support reasonable costs of employee recognition awards (e.g. teacher of the year awards, years of service awards). Use of public funds for reasonable costs of employee awards is a local discretionary expenditure; 2. Meals or refreshments served to guests at any athletic event or other games or contests; and/or 3. Expenses for alcoholic beverages. The School Business Administrator/Board Secretary and/or designee shall maintain documentation to support activities, meals, and refreshments at district events. The documentation shall include a description of the activity, the purpose/justification of the activity, expressed in terms of the goal(s) or objective(s) of the district, the make-up of the group participating in the activity, and the names and titles of Board members or employees included in the group. N.J.A.C. 6A:23A-5.8 Policy 6423 Expenditures for Non-Employee Activities, Meals and Refreshments First Reading 6-22-09 POLICY GUIDE Watchung Hills Regional High School Board of Education Finances 6740. CAPITAL RESERVE ACCOUNT The Board adopted a resolution at the October 2, 2000 Board meeting establishing a Capital Reserve Account, a copy of which has been filed with the County Superintendent of Schools. Funds in the Capital Reserve Account will only be used to implement capital projects in the district's LongRange Facilities Plan (LRFP) required pursuant to N.J.S.A. 18A:7G-4(a) and N.J.A.C. 6A:26.2.1 et seq. and may not be used for current expenses pursuant to N.J.S.A. 18A:22-8.2. The Board may appropriate funds in the district's annual budget to meet the needs of its LRFP not met by State support in accordance with N.J.A.C. 6A:26-9.1. When the district submits the LRFP to the Department of Education the Board may deposit funds into the Capital Reserve Account at any time by Board resolution. This may be completed through the transfer of undesignated, unreserved general fund balance or through the transfer of excess undesignated, unreserved general fund balance that is anticipated in the budget certified for taxes. No transfer of undesignated, unreserved fund balance shall be made subject to the provisions of N.J.A.C. 6:192.5(b). Audited excess undesignated, unreserved general fund balance shall not be deposited into a Capital Reserve Account and shall be reserved and designated in the subsequent year's budget pursuant to N.J.A.C. 6:19-2.5(c). The amount of money in the Capital Reserve Account shall not exceed the amount needed to implement the capital projects in the district's LRFP not met by State support. The amount of money in the Account must be adjusted annually in the district’s Quality Assurance Annual Report (QAAR) pursuant to N.J.A.C. 6:8-2.1. If the amount in the capital reserve exceeds the maximum amount approved, the district must withdraw the excess and reserve and designate it in the subsequent year's budget. As part of the district’s annual audit mandated by N.J.S.A. 18A:23-1, the district’s independent auditors will, pursuant to procedures developed by the Commissioner, verify the amount in the Capital Reserve Account at any time during the year does not exceed the maximum permitted amount. All excess amounts in the Capital Reserve Account identified in the annual audit shall be reserved and designated in the subsequent year's budget. Funds may be withdrawn from the Capital Reserve Account in accordance with N.J.A.C. 6A:26-9.1(e). The district may apply to the Commissioner for approval to withdraw funds from its Capital Reserve Account pursuant to N.J.A.C. 6A:26-9.1(f). To obtain Commissioner approval to withdraw funds, the district shall establish, to the satisfaction of the Commissioner, that an emergent condition exists necessitating an immediate withdrawal of Capital Reserve Account funds. The Capital Reserve Account will be established and held in accordance with Generally Accepted Accounting Principles and is subject to annual audit pursuant to N.J.S.A. 18A:23-1 et seq. 6740 Capital Reserve Account First Reading 6-22-09 If the cost to complete an approved school facilities project, not funded in whole or part by school bonds, exceeds the local share less excess costs, those costs up to ten percent above the local share less excess costs may be withdrawn from Capital Reserve in accordance with N.J.A.C. 6A:269.1(e)1. Funds withdrawn for the local share of a school facilities project not using school bonds or loan bonds for all or part of the local share which received a grant pursuant to N.J.S.A. 18A:7G-15 must be transferred to the capital projects fund and accounted for separately with the corresponding grant. Any unexpended transferred capital reserve funds remaining after completion of such school facilities projects must be reserved and designated in the subsequent year's budget. The Capital Reserve Account will be increased by the earnings attributable to the investment of the account's assets pursuant to N.J.S.A. 18A:21-3. Anticipated investment income must be included in the original annual general fund budget certified for taxes as miscellaneous income. Investment earnings shall be included in the maximum amount of capital reserve permitted in N.J.A.C. 6A:26-9.1(d). A separate account shall be established in the general fund for bookkeeping purposes only in order to account for increases to and withdrawal from the Capital Reserve Account and its balance. Funds in Capital Reserve Accounts in existence prior to July 18, 2000 are subject to Educational Facilities Construction and Financing Act (EFCFA) and N.J.A.C. 6A:26-9.1 et seq., and must be utilized for the original purpose for which the funds were deposited in accordance with N.J.A.C. 6A:26-9.1(h). N.J.A.C. 6A:26-9.1 et seq. 6740 Capital Reserve Account First Reading 6-22-09 POLICY GUIDE Watchung Hills Regional High School Board of Education Finances 6830. AUDIT AND COMPREHENSIVE ANNUAL FINANCIAL REPORT (M) M The Board of Education will prepare and publish a Comprehensive Annual Financial Report (CAFR) in accordance with the requirements of N.J.A.C. 6A:23-2.2(i). The Board shall annually cause an audit to be made of the district’s accounts and financial transactions. The audit will be conducted in accordance with law by the public school accountant appointed by the Board and will be completed within four months after the end of the school fiscal year. The Board will engage only a licensed public school accountant to conduct the audit in accordance with N.J.S.A. 18A:23-1 et seq. which has an external peer/quality report as required in N.J.A.C. 6A:23-2.2(i)1. The audit shall include test measures to assure that documentation prepared for income tax purposes complies fully with the requirements of Federal and State laws and regulations, including, but not limited to the requirements of N.J.A.C. 6A:23A-4.2, regarding compensation which is required to be reported. The Board Secretary will receive the audit report and recommendations of the public school accountant and prepare or have prepared a synopsis or a summary of the annual audit and recommendations prior to the meeting at which the report will be discussed by the Board. Copies of the summary will be available to members of the public. Within thirty days of the receipt of the audit report, the Board will, at a regularly scheduled public meeting, cause the recommendations of the public school accountant to be read and discussed and the discussion duly noted in the minutes of the Board meeting. The Board will implement the audit recommendations and report such implementation to the Commissioner. In the event the district has repeat audit findings in the Auditor’s Management Report submitted with the CAFR in any year shall, within thirty days of the CAFR submission, submit to the Executive County Superintendent or State fiscal monitor, as applicable, a specific corrective action plan for addressing the repeat audit findings in accordance with the provisions of N.J.A.C. 6A:23A4.4. The Board directs the Superintendent and other appropriate district officers and employees to cooperate fully with the public school accountant and to keep faithfully such records and reports as will assist in the audit process. This policy applies to the use of all Watchung Hills Regional High School (WHRHS) facilities, including but not limited to classrooms, cafeterias, theaters, athletic facilities, and open areas. This policy also applies to the use of all school supplies and equipment. For scheduling priority and establishing usage fees, groups or individuals are placed in one of four groups as defined below: Group 1 – WHRHS and WHRHS sponsored organizations including school related curricular and co-curricular activities that are supervised by school district staff, such as nonprofit parent organizations and clubs recognized by the Board of Education. Group 2 – Government agencies or local schools of Green Brook, Long Hill, Warren and Watchung, and the State of New Jersey. Group 3 – All non-profit civic and community organizations and community members not identified above in Groups 1 or 2, but who are within Green Brook, Long Hill, Warren and Watchung who have as one of their main purposes the provision of funds to the public schools of our sending districts For a community organization to be included in this group, 75% or more of the members must be residents of the three constituent districts of Watchung Hills Regional High School. Group 4 – All organizations and individuals not included in Group 1, 2 or 3 as defined above. The use of school facilities will not be permitted for private social functions, partisan political activity or any purpose that is prohibited by law. Charges will be made for the use of facilities and The Performing Arts Center at WHRHS (Hereinafter “WHRHSPAC”) as indicated below: Group 1 – No charge. Group 2 – The out-of-pocket custodial cost to the school for such use, plus any payments due to the use of specialized equipment belonging to the school which can only be operated by authorized employees or persons approved by the school authorities, operators of stage lights and other equipment provided by the Board that requires compensation. Group 3 – The charges due for Group 2 uses, plus where applicable, a rental fee in accordance with Appendix B or WHRHSPAC rental agreement and fees. Group 4 – A rental fee in accordance with Appendix B or WHRHSPAC rental agreement and fees, plus any charges due for Group 2. 7510 Facilities Use Revised Page 1 First Reading 6-22-09 Watchung Hills Regional High School Board of Education Policy: 7510 Certain activities in the schools or on school grounds are prohibited by law, policy of the Board of Education, or execution of the Board’s moral responsibility. Among these prohibited activities are: 1. Activities advocating governmental change by violence or promulgating any theory or doctrine subversive to the laws of the United States or any political subdivision thereof. 2. Any activity that may be contrary to goals or objectives of curriculum of Watchung Hills Regional High School, or damaging to the building, grounds or equipment. 3. Any use in conflict with school activities, except as provided by law. 4. Fund-raising campaigns except as permitted by Board of Education policy or special action of the Board 5. Activities which are discriminatory. All organizations and individuals using the school facilities must: • • • • • • Obtain approval for use of the school facilities following the defined procedure, including the execution of a contract. These procedures must require requests to be submitted to the Business Office in writing. The procedure for obtaining approval shall be the return of the Use of Facility form. Provide supervision to assure all contractual obligations are met, including supervision by the responsible person from the contracting organization during any use of the facility, Provide evidence of insurance as required by the contract. The event sponsors from the contracting organization and/or athletic coaches must wear identification badges while on site. The Business Office reserves the right to require the presence of police officers and/or other necessary personnel at any event that the district’s Director of Security deems necessary. The cost for this requirement will be borne by the organization/individuals entering into this rental agreement. The Business Office reserves the right to require the presence of EMS on-site for the duration of the event. The attached Fee Schedule (Appendix A), Facility Use Form (Appendix B) and Schedule of Personnel (Appendix C) may be revised without prior notice. Any damage or loss to the school facilities or equipment is the responsibility of the contracting organization and will require timely replacement/or restitution made to WHRHS for the damage or loss incurred. WHRHS representatives will verify correct operation of equipment before and after the use of equipment utilized that is delineated in the rental agreement. Any individual or group that is using the school facilities for profit making purposes must submit a Facility Use Form and have approval prior to engaging in any profit-making activities on campus. Individual and student use of athletic fields and tennis courts is encouraged. Use of fields or tennis courts 7510 Facilities Use Page 2 First Reading 6-22-09 Revised Watchung Hills Regional High School Board of Education Policy: 7510 by groups or individuals who charge a fee to their participants or users must complete the Facility Use Form and pay according to the established fee structure. Any individual or group that reserves the school facility is not permitted to transfer the facility use to another group without the permission of the Superintendent and/or Business Administrator. If an individual or group does not use the facility on a day scheduled for that groups use, it will be required to pay the regular fee scheduled. If an individual or group does not use the facility for three scheduled days (not necessarily consecutive days), the Superintendent and/or Business Administrator may terminate that groups contract without refund of fees, and reschedule the use of that facility. If a contracting organization needs additional support, such as but not limited to ushers, ticket booth operators, stage hands, then Watchung Hill Regional High School students will be given first priority to staff these events. Use of facilities or equipment will only be permitted by personnel with sufficient qualifications, as defined in the appropriate regulation or contract for that facility. Illegal substances, alcohol, or tobacco use is not permitted on school grounds. All facility use must comply with state and local fire, health, safety and police regulations. Scheduling For use of the facilities, the priority use is the same as the order of the groups, with Group 1 being the highest priority and Group 4 being the lowest priority. Facilities may be reserved up to one year in advance, but individuals and groups must reserve facilities at least 60 days prior to any event. This includes use of the following areas: Theaters, TV studio, Athletic fields/Tennis Courts, Gymnasiums, Classrooms, Cafeteria, Parking lots, and open areas. If an organization reserves the facility for an extended period of time, their use during the time frame in which they have reserved use, must be secondary to Group 1 usage. This may mean that previously unscheduled activities from Group 1 may cause an organization to reschedule their activities. At times conditions occur where use of a reserved facility is not possible, e.g. weather or emergency maintenance requirements. Cancellation of events will at the discretion of the Chief School Administrator or his/her designee. The next available date will be provided to the contracting organization. The Superintendent of Schools and the Business Administrator shall have full authority to refuse to grant the use of the facility whenever, in his/her judgment, there is good reason why permission should be refused. Neither the Board of Education, Superintendent of Schools nor the Business Administrator shall be required to give a reason for such refusal. Use on Sundays, holidays and vacation periods, including summer use is discouraged and will only be permitted under special circumstances. Authorization for Sunday and holiday use must be given by the Superintendent of Schools or his/her designee. Regulations and Contracts 7510 Facilities Use Revised Page 3 First Reading 6-22-09 Watchung Hills Regional High School Board of Education Policy: 7510 The Superintendent of Schools will develop the necessary regulations and contracts to cover use of supplies, equipment, and the following facilities: • Theaters, • TV studio, • Athletic fields/Tennis Courts, • Gymnasiums, • Classrooms, • Cafeteria, • Parking lots, • Open areas. If possible, a single regulation or contract may cover more than one type of facility. Regulations and contracts will be made available to every contracting organization, and that organization will be responsible for assuring that all its members who use the facilities and/or equipment are aware of any regulations. These regulations or contracts will be approved annually by the Board of Education, and will establish requirements for staffing, fees, and scheduling.
