High performance acoustic and thermal insulation made of
polyester fibre panels with various densities, containing antivibration SBR and EPDM rubber inserts inside of density 500
kg/m3.
The panel dimensions are m 1 x 0,60 and the total thickness
is 20 or 30 mm.
This product is ideal to achieve high levels of sound insulation on floating floors against impact and airborne noise.

Rewall is a pre-coupled panel comprising various
combinations of polyester fibre, rubber and plasterboard layers. The panels can be used in cavity walls
or to reinforce existing walls and ceilings for restoration
purposes.
Mustwall B is a pre-coupled panel composed of a
rubber layer of various thicknesses and a plasterboard
layer, ideal for relining existing walls or ceilings.

render services without reservation, in spite of our awareness of customer’s contradicting or divergent terms of business.
1.2.These general terms and conditions shall also apply to all future business transactions
done with customer.
2.Quotations
2.1.Our quotations shall be without obligation at all times.
2.2. All weights and measure quoted are approximate, as are illustrations or weights and
measures and suchlike given in brochures, pricelists, Internet and suchlike, and are not
therefore binding unless otherwise expressly agreed.
3.Prices
3.1.Prices quoted are subject to confirmation at all times, and are ex works loaded on road
or railway trucks, unless it is expressly agreed that freight costs shall be at our expense.
Packaging is free. Any special packaging required under customer’s regulations shall
be at customer’s expense. Customer shall pay transhipment charges, freight costs and
customs duties in advance without discount.
3.2.The prices quoted for our goods are net prices and do not include value added tax
[Mehrwertsteuer]. Value added tax at the rate applicable on the date of invoice shall be
given separately on the bill and added to such prices.
3.3.The agreed prices shall apply for a period of 3 months as from the date on which an
agreement is reached. If longer delivery periods are agreed, or if a delivery cannot be
made within 3 months of closure of the agreement for a reason for which customer is
responsible, and if the costs of materials, energy, labour and other general cost prices
have altered in the meantime, then our sales prices as in force on the date of delivery
shall apply.
4. Terms of Payment, Default in Payment, Counterclaims
4.1.Payments are due immediately on issuance of the invoice, or within the agreed payment
period. Our sales consultants, field staff and/or representatives are only allowed to accept payments if they carry with them written authorisation to this effect.
4.2.The invoice for goods supplied is issued on the same date as delivery. If customer does
not receive the invoice with the delivery, then customer is under obligation to request us
for an invoice within 8 days of delivery, failing which customer cannot deduct discount
or make any other reductions in payment.
4.3.If customer fails to make payment within 14 days of date of invoice or by the end of the
agreed payment period, then it shall be in default even if no reminder has been issued.
4.4.Customer may only offset or exercise right of retention in respect of claims which are
undisputed or have been established by a court of law. Retention of payment is excluded outright if the right of retention is based on another contract.
5. Terms of Delivery, Delivery Periods, Consequences of Default
5.1.Delivery delays are only liable if agreed in writing. Part deliveries are admissible. In case
we are delayed, the customer is entitled to adequately extend the period stipulated and,
after its fruitless expiry, to withdraw from the contract. There are no claims for default
possible.
5.2.Delivery periods shall commence on the date of our confirmation of order. If dispatch is
not possible for reasons for which we are not responsible, delivery deadlines shall be
deemed met on notification of readiness for dispatch. If customer fetches the goods
itself, the delivery periods and deadlines shall refer to the date with reference to which
we gave notification of readiness for dispatch.
5.3.If it is proved that non-observance of deadlines for deliveries and services is due to
mobilisation, war, revolt, strikes, lock-outs or the occurrence of unforeseen obstacles,
then the deadline shall be extended accordingly
6.2.In all other respects, risk – including the risk of seizure – shall pass to customer as soon
as the goods have left our factory or warehouse or have been handed over to some
means of transport, including our own transport facilities or a carrier or haulage contractor, irrespective or who is to bear the freight costs. This shall also apply if part deliveries
are made, or if we assume other services, e.g. dispatch costs or actual delivery.
7. Customer’s Claims Based on Defects, Compensation Claims
7.1.If there is any defect in the goods or services for which we are responsible, we shall be
entitled to remedy such defect or make substitute delivery at our option. We are under
obligation to bear the costs required to this end, in particular transportation, travel,
labour and material costs, insofar as such costs are not increased due to the goods or
services being transferred to a location other than the place of performance.
7.2.Customer must grant us opportunity and the time reasonably required to remedy the
defect. If he refuses to do so, then we shall be released from liability for defects.
7.3.The clause exempting from liability pursuant to Item above shall not apply if damage is
due to deliberate intent or gross negligence. Moreover, it shall not apply if we are obliged
to pay damages due to the lack of a warranted characteristic. Nor shall it apply if claims
are imposed on us due to the infliction of a personal injury or health hazard on customer.
7.4.Prescriptive period for claims based on defects and compensation claims:
• The customer’s rights of warranty require that the customer controls the goods right
upon delivery and, in case of fault, informs the vendor, immediately. Excluded from the
warranty are wear due to use, damages due to wrong handling, excessive loads, inadequate service conditions or means of production and deficient assembly conditions. If
not otherwise agreed, the warranty for our products covers 12 months beginning with
the transition of risk.
• Basically excluded are any effects caused by indirect paths of sound transmission,
influences by other sound sources or other influences which are not derivable from the
operational data. A professional processing and treatment as well as the use of faultless
material are guaranteed. We are liable for our products if they are exposed to loads under normal service conditions which result from the operational data. Higher mechanical
or chemical loads are only accepted if they were known when submitting the quotation
and confirmed in writing. We reserve the right to decide whether we fulfil our liability
either by retouching or by replacing. Should we are not prepared or not in a position to
repair the defects or to replace the product delivered, particularly if such actions were
delayed beyond an acceptable term due to our fault, or if they failed for other reasons,
the customer is entitled to choose if he demands a change (cancellation of the contract)
or a corresponding lowering of the price (reduction).
7.5.If we fail to disclose a defect with intent to deceive, the prescriptive periods laid down
by law shall apply instead of those given in Item (8.8.1.) above.
7.6.On principle, the prescriptive periods shall also apply to compensation claims and in
particular to compensation for consequential damages. However, if we are guilty of deliberate intent, and insofar as claims in tort, claims under product liability law, or claims
due to the infliction of personal injury or health hazard on customer are asserted, the
prescriptive periods laid down by law shall apply. 8. Place of Performance, Venue, Governing Law
8.1.Place of performance for both parties shall be Vicenza - Italy.
8.2.Provided customer is a registered business, Vicenza shall be venue for all and any legal
disputes involving the creation or validity of the contract or arising from the contractual
relationship. The language of the dispute is English. However, we shall also be entitled
to sue our contractual partner at the place of performance or at the court having jurisdiction over the place where customer’s business is based.
8.3.The contract shall be governed by the laws applying in Italy.
9. Other Liability
All documents made available by us, such as quotations, descriptions, drawings, and
measuring reports, etc., are subject to our ownership and copyright. If not otherwise
stipulated in the agreement, the documents elaborated by us may not be handed over
or disclosed to thirds. The knowledge and ideas contained in our documents, sketches
and drawings may not be used any further without our express, written approval.
6. Dispatch, Passing of Risk
6.1.Dispatch shall be at customer’s expense and risk. Goods in respect of which notification
of readiness for dispatch has been issued must be called up by customer without delay
on the agreed date. Otherwise risk shall immediately pass to customer, and we shall be
entitled to store the goods at our own discretion at customer’s expense.
