You should already know that the House Bill 1199 has been
awaiting signature by the Governor. What you have not
learned from our Press Release is how the process worked.
Summary:
For those of you who have been following along in our almost two
year process to correct the salvage threshold issues arising from
2008 senate bill 568, you have seen the difficulties and challenges
we were facing from the onset. How do we correct what has been
put in place?
What it took was many meetings with the Maryland Motor Vehicle
Administration (MVA) to find out how the marketplace interpretations
could be corrected either in Regulations—to be promulgated by the
MVA—or by a bill, proposed by the association.
Once it was determined that we needed a bill to correct much of the
issue, we went back to Delegate James Malone of the Environmental Matters Committee, to ask for his help. After his agreeing to
submit a bill on our behalf, the work really began. We had several
meetings with Del. Malone’s staff and the industry stakeholders, including representatives of WMABA, insurance companies, salvage
dealers, and auto dealers. Several meetings later, the amendments
to the bill began to flow.
Fast forward several meetings, bill hearings and work sessions, now
we are looking at the bill that passed the House. Moving over to the
Senate side, we faced opposition from Insurance Auto Auctions
(IAA) because of the inclusion that all vehicles—regardless of repair
values— acquired by the insurance companies would now be
marked salvage. However, in spite of their opposition, we were able
to get the bill passed on the last day of session.
WHEW! Now, once we have the bill signed we will still be meeting
with the MVA and other stakeholders to determine the correct definition language and inclusions for “Cosmetic damage”, but we are optimistic that this will curb much of the issue we’ve been facing since
2008.

MEMBERSHIP TOOLBOX
A new venture of the Washington Metropolitan Auto Body Association (WMABA) is the unveiling of the [virtual] Toolbox:
a collection of documents on their website (www.wmaba.com) that are for use in the shop for everyday business issues
or research. This undertaking, initiated by the Richmond Chapter of WMABA, was a way for us to be the source for repairers to find documents and web portals that give them valuable information they can use to properly repair vehicles,
educate adjusters, or find a better way to manage portions of their business. As an ever changing being, the Toolbox
will be a resource that all will benefit from in a perpetual manner.
As WMABA’s Executive Director, I am charged with investigating new and different ways of offering value for our membership. When this item was brought as a suggestion, I started looking into the documents that I have access to. I didn’t
realize the many items that could be compiled together, because I was so used to having them at my fingertips. The key
is to get them in an easily accessible place for the industry – members and non-members alike. The solution was to put
it on our website and get the word out.
To give you incentive to check it out, I will let you know some of what is in the Toolbox. We have compiled the laws relative to Maryland and Virginia collision repair and claims settlement practices, so that you know what the laws are as
they relate to your business. We’ve included all of the OEM service information websites and many of the OEM position
statements on issues from sectioning to airbags to reconditioned wheels. Also in the Toolbox are position statements
from the Society of Collision Repair Specialists (SCRS) on items like diminished value and deceptive referral practices,
also known as steering. A couple of flyers on procedures from Automotive Service Association (ASA) include raw vs.
primed bumpers and blend vs. new panels.
There is an abundance of information about the collision repair business in the infinite space of the internet, but they are
not always easy to find. This resource that WMABA has created will become a clearinghouse of documents that make
your business easier. Most all of the documents compiled are FREE to the industry, but as a service to the industry we
are locating them in a convenient place.
After all, that is what an association is all about: providing tools that make your business and its livelihood better.

SUBJECT: REPLACEMENT OF STRUCTURAL
PARTS ON HONDA AND ACURA VEHICLES
TORRANCE, Calif., March 22, 2010 – Honda and Acura vehicles are engineered and manufactured to exacting standards and as such, are designed to help protect vehicle occupants in the event of a collision.
All elements of a collision-energy absorption system including but not limited to any structural components
such as bumper reinforcement bars, bumper energy absorbers, frames, rails, fender aprons A-pillars, B pillars, and body panels must work in concert to protect the vehicle occupants and maintain cabin integrity.
All elements of an occupant supplemental restraint system including but not limited to air bags, side-curtain
air bags, and air bag deployment sensors must work in concert with energy absorption components to provide proper timing for air bag deployment.
Compromising any element of a collision energy absorption system or an occupant supplemental restraint
system in the repair of a collision-damaged vehicle may have an adverse effect on occupant safety in any
subsequent collision. Therefore, American Honda does not support the use of aftermarket, alternative, reverse-engineered, or anything other than original equipment Honda or Acura parts for the collision repair of
any Honda or Acura vehicle.
Further, American Honda does not support the use or re-use of structural components that have been removed and salvaged or recycled from an existing vehicle that has been previously damaged. Although the
parts may appear equivalent, it may be difficult to tell if the part(s) have been previously replaced with a
non-OE part, or if the part has received collateral damage as the result of a prior collision. Further, the part
may have been subjected to severe weathering, rust, or other detrimental environmental exposure.

that any repairs be performed by an experienced professional using only new Nissan Genuine original
equipment replacement parts designated for the use on the specific Nissan vehicle supplemental restraint system. Following this recommendation, vehicle owners and repairers can best ensure that the
supplemental restraint system parts used in the repair of the Nissan vehicle will help protect vehicle
occupants in a possible future crash.
Parts Warranty
Nissan North America factory warranty, replacement parts warranty or extended warranties do not
apply to any part other than a Nissan Genuine original equipment replacement part.
