Recently I had the pleasure of visiting in Sturgis with our gallant leader of the MRF. No one works harder, or smarter, or travels farther for the MRF
than Kirk “Hardtail” Willard. He is truly the unsung hero of motorcyclists in this country, and probably worldwide. (And no one gets more miles out of a
Harley engine either. He delights in daring his trusty iron steed to crap out on him in the middle of nowhere, and it seems to work. And I only thought
Kentuckians could do that.)
In our conversation, I brought up the subject of the State of the Union as far as we bikers are concerned. I suggested that I had not heard about pressing
issues in Congress or of scary legislation being rolled about on Capitol Hill. I continued to probe “Hardtail” as to the hue and cry from those that want to
“take care of us”. With his intense focus, he cut me to the quick and posed the following, “do you have any idea as to how much work it takes to keep
Washington D.C. and its collection of do-gooders quiet concerning proposed bills regarding motorcycle rights?”
With that quick elegant question he had made his point. I had become so hardened to expect one adverse motorcycle piece of legislation after another
being proposed that I had lost track of the point. That we did not want any bills out there being kicked around that impact us adversely -period. The
moral of the story is, that because it is “Quiet on the Western Front”, it is also no time to relax. “Quiet” is hard work. Thank you Hardtail and all of the
folks at the MRF for what you do. In my many years on this earth, I have noticed that talented people get surrounded by talented people. And that does
not happen by accident. Take Hardtail for example. One of his jobs for us at the MRF is to hire good people to do our bidding in DC. And that he does.
Through a brilliant stroke of genius he managed to hire one of our best ever – Jeff Hennie. Jeff is like a beagle in a forty acre field when it comes to
Capitol Hill. There is no bush in that part of the country that he has not sniffed or pissed on.
Our rights would not be the same with out them. As their and Paladin’s card said, “Have gun will travel”. And we need to wire them $$$$, lots and lots
of money. Before I met those guys I thought I worked hard for motorcycle rights, but I feel lazy by comparison.

ABATE of North Idaho BOD Meeting Minutes January 8th, 2012
Silver Saddle, Potlatch, Idaho
Meeting Called to order at 1205 hrs.
There was a quorum and the agenda was approved.
Minutes of the prior meeting were approved.
Treasurer’ Report: ABATE of North Idaho finished the year in a much stronger financial position than the prior year. The cash flow analysis was distributed to the BOD.
All chapters were given a status report of their monthly financial submittals.
Coordinator’s Report: The primary focus of the chapters this year should be growth of membership. This is important not only from a financial position but also it gives
ANI a more significant representation of motorcycle riders in north Idaho. Each chapter should set membership growth goals.
Deputy Coordinator’s Report: Membership retention is as important as growth in new members. Lets keep our members with a phone call or two. Let’s recruit prior
members.
We as a BOD owe an apology to our members for not properly vetting the candidates for last fall’s election.
Secretary’s Report: none
Membership Secretary’s Report: Chapter officer roster was requested from each chapter. Chapter rosters were distributed and corrections requested. Current
membership was 232 chapter affiliated members.
Chapter Reports:
Clearwater Chapter: Clearwater’s membership grew. The chapter had two holiday families this past Christmas. PSAs have been established with KORT radio out of
Grangeville, 92.7 FM. KORT can distribute the PSAs throughout the radio broadcast community.
Hoodoo Chapter: Membership ride will be a poker walk rather than a poker run. The POW/MIA run has changed it name to honor All Veteran’s Support run. The
anniversary party will be big this year.
Kootenai Chapter: Had a great year. Membership grew throughout the year. Toy Run was a success; The Marines served 2430+ kids and Kootenai chapter provided
more than 3000 toys. They are by far the largest toy contributor to the Marines. Each child received at least one toy from a biker. The chapter had a holiday family this
past Christmas.
St. Joe Chapter: Membership is growing. The chapter participated in the St. Maries Christmas Parade in below freezing temperatures. They are planning on attending
drivers ed classes. They have business meetings before the monthly social meeting.
Hell’s Canyon: The Military Welcome Home Party was a success as quite a dinner party. The Halloween party was great for the Kids. They had their New Year’s Day
ride. They have already started working on the Easter egg Hunt. It gets bigger each year so the effort starts earlier each year.
Committee Reports: Newsletter: We have had net costs for the past two issues and thus we need more ads. The chapter that brings in the most new ads before
the May issue cutoff date wins two free tickets to the Spring Opener. Debby H. so moved and Dan E. seconded. The motion passed. A motion was made by
Pauline D. to mail the EAGLE via stamps rather than a bulk mail permit, seconded by Mike T. The motion passed. The mailings will be by stamps in the future.
The current savings is about $19 per issue but it currently takes 2 extra hours of the editor’s time.
Legislative Report: The session starts on Jan 9th in Boise. There maybe a “no texting” bill in the session. The driver that rear ended Dave B. last summer admitted to
texting when he hit Dave B. The Feds are pushing for all states to pass a no texting bill. in the Highway transportation bill. We may have a call to action for this issue.

Safety and Education Report: The Best of the West of the MRF will be held in Las Vegas the second weekend of June, 15 – 17 .
By Laws Report: Refinements to the bylaws covering representation of members at the BOD meetings (para: 3.2.5.1 & 3.2.5.1) and the nomination process of State
officer nominations for officer elections (para: 2.6 & 5.3.1 & 5.3.2) were discussed. These issues were discussed at each of the chapters during the last quarter. The
changes were approved unanimously by the BOD. The changes will be reflected in the revised bylaws currently being prepared by the bylaw committee and chair.
Products Report: The inventory of product on-hand was distributed. Flag pins will be pursued by Dan E.
Guest Speaker: none
On going Business: Runs and events: Sanction forms were submitted and there are more to be sent in to be included in the annual events calendar.
New Business:
Spring Opener: Mike Thacker of the Clearwater Chapter volunteered to be the Chairman of the Spring Opener Committee. He will form the committee. He wants at
least three volunteers from each chapter. This year there will be an entertainment passes beginning at 1500 hrs (3PM) for sale at the gate for $15 each. This pass will not
include camping Saturday night. The gate prices will remain the same as last year for both the advanced tickets and tickets purchased at the gate.
2012 Budget: The budget as presented was not approved. The revenue budget was changed. A motion was made to raise ABATE dues to $25/yr for all members
and new members by Rick M and seconded by Dan E. The motion was amended by Debby H. and seconded by Mike T and passed, to make the effective date

of the dues increase, April 1 , 2012,The motion and amendment passed.
Nominations/Appointments of MRF Rep: Dave Cazel was nominated to continue as the Idaho MRF Rep. He accepted.
Establish a petty cash fund: A motion was made by Dave C. to establish a $50 petty cash fund, seconded by Pauline D. The motion passed.

Statement of Purpose:
The purpose of the organization is to form an educational, charitable, and political
groups, to provide motorcycle safety, education, freedom of choice legislation and
to provide a more favorable environment for motorcycle riders and the
communities in which they live. since i am a member of Clearwater chapter this
past year, we went to the Orofino and timberline high school drivers ed class[s]
with a motorcycle awareness cd sponsored by the star program , to help our new
drivers to" look twice saves lives motorcycles are everywhere". its all about safety
and sharing the road with motorcyclist. we help our local VFW post 3296 in putting
out flags and taking down flags during the year , we also raise money to help
support the free annual Easter egg hunt in the city park, highway clean
up..........road signs saying. cleaned by motorcyclist. we helped support the local
4-h robotics teams not only with money donations but also being able to judge
events that happened here in Orofino and Moscow, this yr we had 3 teams from
Orofino... 2 made it to the state tournament. we supported the local logger cross
races by using our logo on all staff member t-shirts during the races, passed out
info about looking twice saves lives motorcycles are everywhere.
we adopted 2 families this yr during the holiday time. not only did we as a chapter
raise money , our local businesses were awesome in stepping up and adding to
the pot! thanks to everyone for such a awesome gift .
We, also, hosted the A.B.A.T.E. Friendship run on Labor day weekend. with live
music, food, vendors , free camping in city park and motorcycles rides to
surrounding areas, poker ride to Boville's pig roast. Visited residents at Brookside
landing, parade of bikes down Michigan Ave.
As of course we escort ed VFW during our lumberjack parade day. the guys set up
a booth in the exhibit building with tons of motorcycle freebies to give away,
highlighting many of the activities through out the yr. it was nice to have them on
hand for questions, and offering to help when asked by those visiting. they also
did a funny for the time capsule.
we also purchased a calendar ad for the historical museum here in town , our
page was MAY that’s motorcycle awareness month. this yr we hope to have a
larger ad for ABATE with those funds coming from all the abate chapters.
Last week in the Lewiston news paper i believe it was Friday Jan 6th there was an
article about bikers? at random this guy calls and who did he get? our Orofino
chapter coordinator Mike Thacker... awesome article supporting ABATE. Mike
also does radio segments on ABATE, motorcycle safety, sharing the road , as well
our local events.... these are some highlights and im sure im missing something. I
am very proud to say i am part of this great group of motorcycle riders, we want
everyone to know , its about motorcycle safety and sharing the road... this year
looks very exciting for us ! at present the Clearwater Chapter has 46 members
and we want to grow..............

2012 Legislative Session

As the 2012 legislative session approaches, the ICMS has its ever watchful eye on the lookout for legislation that
has the potential to affect the motorcyclists of Idaho.
We believe we will see another run at distracted driving legislation. Texting and cell phone use continue to concern
the bikers we talk to. Driver distractions of all types threaten our safety. Texting and cell phone use are but a part of
the problem but continue to be the most egregious of violations. Some legislators and members of law enforcement
believe that current inattentive laws are enough to combat the problem while others see this as an after the fact tool
and not a preventative law. They maintain that the only effective solution is to get a “hands free” law on the books.
ICMS is concerned for our safety and our rights. Because we want both protected we have not endorsed either
stand. It does seem hard for many of us to try to protect the rights of some so that they may endanger the lives and
safety of others. We will wait and see what comes from our legislators and if there is something there that we can
support, we will do so. This may require compromises on our part. It seems to be extremely hard to find a bill that
does everything for everybody.
At the tail end of last year’s session a bill was brought forward that would have effectively killed state subsidized
youth driver education programs and eliminated oversight of all programs. The ICMS took a stand against this
legislation. We feel that low income families would put off driver education for their children thus depriving them of
the educational process that teaches them about safety around motorcycles. Should this legislation reappear, the
ICMS will most likely oppose it.
The ICMS and ABATE of North Idaho are considering legislation to add a “hold harmless” clause into the
motorcycle rider training code. This would allow the owners of property suitable for a rider education range freedom
from any lawsuit in the event of a crash or similar mishap. It is hoped that such a clause would open up more
training sites in Idaho. Some counties now refuse the use of their properties for fear of lawsuits.
As of this writing we have not heard of any helmet legislation in the works nor do we expect any. The main focus of
this year’s session is expected to be the budget and health care issues. There is always potential for motorcycle
issues to arise within those discussions. You can count on the ICMS to be there for you.
Thank you for 27 Years of Service
ICMS would like to thank Chuc Coulter for dedicating 27 years to ICMS and
our fight for motorcyclist rights in the great State of Idaho. Your years of
dedication to this State Motorcycle Rights Organization have been greatly
appreciated and you will be greatly missed. Missed but not forgotten. Even
though Chuc will not be on the Board of Directors for ICMS he still has and
will be working with ICMS to help protect your motorcycle freedoms. His last
request as a Board Member, to the ICMS Board of Directors, was that his
seat be replaced with Kim Young for the remainder of his term which ends
December of 2012. This request was made with the intent of ensuring that
ICMS would move forward with yet another strong leader in its ranks. The
Board of Directors felt the same and immediately put the request up for a
vote which passed unanimously. This is just one of the many things that
Chuc has done to help ensure that your motorcycle rights will be protected
in the future. Chuc will be greatly missed but ICMS looks forward to working
with him in the future to protect your motorcycle freedoms.

ILLINOIS MOTORCYCLISTS CAN NOW LEGALLY RUN RED LIGHTS
Motorcyclists in Illinois will no longer be stuck indefinitely at stoplights, as effective January 1st the Land of Lincoln joined eleven other states that allow riders to proceed
through malfunctioning red lights.
Sensors that trigger light changes often aren't sensitive enough to detect motorcycles, which prompted the Illinois legislature to pass HB S860, supported by ABATE of
Illinois, which allows motorcycles stopped at a red light to go through the light if it doesn't turn green after a "reasonable" amount of time.
Illinois Governor Pat Quinn vetoed the bill, claiming it "endangers our motorists" because it allows the motorcyclist to determine how long is "reasonable," but both the
House and Senate voted to override the veto and the original bill became law.
The new law, as now on the books, states: "After stopping, the driver of a motorcycle or bicycle facing a steady red signal which fails to change to a green signal within a
reasonable period of time because of a signal malfunction or because the signal has failed to detect the arrival of the motorcycle or bicycle due to the vehicle’s size or
weight, shall have the right to proceed subject to the rules applicable after making a stop at a stop sign as required by section 11-1204 of this code."
The law applies only to municipalities with a population of less than two million, so the city of Chicago is exempted.
Similar so-called "dead red" laws have been enacted in Minnesota (2002), Tennessee (2003), Arkansas (2005), Idaho (2006), Wisconsin (2006), North Carolina (2007),
South Carolina (2008), Missouri (2008), Oklahoma (2010), Kansas (2011) and Virginia (2011). In Texas and California, state law requires stoplights to be fitted with
sensors that detect motorcycles.
LAS VEGAS CLUBS SUE OVER POLICE HARASSMENT
A group of Nevada motorcycle clubs is suing Metro Police, accusing the Las Vegas police department of violating the constitutional rights of bikers. The Confederation of
Clubs and Scoundrels Pub filed the lawsuit Wednesday, January 11, claiming that "The police are interfering with private business and telling private businesses that they
cannot allow certain motorcycle clubs inside their private businesses."
Their attorney says Metro Police officers harassed bikers and threatened to pull liquor licenses at local biker bars, like Scoundrels, based solely on the businesses'
clientele.
The lawsuit includes a letter Metro PD sent to Scoundrels Pub last June that states an event involving the Vagos Motorcycle Club violated Clark County code and could
put the pub's liquor license at risk.
"We've not asked for a penny. We don't want money. We just want to get recognition of the situation and get the Metro Police Department to give us our constitutional
rights. That's all we're asking for," said Bandido Motorcycle Club Las Vegas President Rich Novicelli in an interview with CBS-affiliate 8NewsNow. Metro declined to
comment.
JUDGE BARS N.H. TOWNS FROM ENACTING STRICTER NOISE LAWS
New Hampshire cities and towns cannot impose limits on motorcycle noise that are stricter than what state law allows, a Rockingham County judge has ruled.
"If each town in New Hampshire had the authority to enact different noise emission ordinances, the state would be subject to a checkerboard pattern of laws," ruled
Superior Court Judge Kenneth McHugh on Dec. 9. "For example, a motorcyclist who complies with the state noise emission limit could be precluded from driving through
a town because that town enacted a lower noise emission limit than the state."
The judge's decision comes in response to a lawsuit filed by the Seacoast Harley-Davidson dealership, which filed suit against the town of North Hampton, successfully
arguing the town did not have legal authority to adopt its own motorcycle noise ordinance.
North Hampton adopted a noise ordinance at a May 2010 Town Meeting, requiring all motorcycles operated in the town to have exhaust noise limited to 80 decibels.
State law permits motorcycles to reach 106 dB.
After the ordinance passed, the local police chief refused to enforce the ordinance, describing it as unconstitutional and explaining that law enforcement and the town
could face legal action if they enforced a lower noise threshold than state law allows. Similarly, McHugh found the local ordinance to be "in direct conflict" with state law
and ruled the town of North Hampton "is hereby prohibited from adopting or enforcing the ordinance."
In granting the permanent injunction, the judge noted in his decision that the N.H. House of Representatives' Transportation Committee rejected a bill to enact a law that
was similar to the North Hampton ordinance.
McHugh also noted that the town administrator was notified by the federal Environmental Protection Agency that it does not grant cities and towns "any additional
authority to control environmental noise beyond that available to them under state and local law."
House Bill 1442 has since been introduced in an attempt to lower the state's motorcycle noise limit to the federal standard of 80 dB and would require that any motorcycle
brought in for servicing to have EPA-compliant mufflers installed at that time. Similar measures have failed to pass three times in the past four years due to what the bill’s
sponsor calls “fierce” opposition from the powerful motorcycle lobby.
LIVE FREE AND RIDE
A New Hampshire legislator wants his state’s “Live Free or Die” slogan emblazoned across motorcycle license plates. While he hasn’t straddled a bike in some years,
State Rep. Tim Copeland (R-Stratham) said "it's a great saying" that shouldn't be limited to license plates on cars and trucks.
He said the idea was hatched at a convention for lawmakers where candy trays were sold that were made by inmates out of defective license plates. While looking at
those candy dishes, Copeland wondered why the quote — from a toast made in 1809 by General John Stark — isn't celebrated on the backs of motorcycles.
Rep. Copeland said there would be no additional cost to the state and he's been told there's nothing logistical to prevent stamping the state slogan onto the smaller
motorcycle plates.
Copeland's bill is with the House Transportation Committee and proposes replacing the word "motorcycle" at the top of all motorcycle plates with the state motto.
SOUTH CAROLINA GOVERNOR PROMISES TO VETO A HELMET LAW
Less than two years after a State Supreme Court ruling barred the city of Myrtle Beach, S.C. from enforcing a mandatory helmet law stricter than the state’s requirement
for riders under 21 to wear them, a helmet law for all motorcyclists statewide has been introduced in the South Carolina legislature.
Senate Bill 1046 was read in Senate for the first time Tuesday and has been referred to the transportation committee. South Carolina required all riders to wear helmets
from 1967 until 1980 when the legal mandate was limited to young riders. The attempt to change back to a comprehensive helmet law is opposed by groups such ABATE
of South Carolina which is challenging the bill saying that they have no problem with helmets, but don't agree that it’s the government’s responsibility to police personal
safety.

continuing problem of impaired riding. Titled the 3Rs, Wayne has presented this program at the MRF
Meeting of the Minds in Michigan and also for ABATE of Oklahoma. Wayne will be presenting this
powerful tool to the riders of Idaho on Wednesday March 14th at 6:30 PM at Happy Trail Products in
their upstairs meeting room. While it is a fact that most of us choose not to drink and ride, we have all
run across that one rider that has had too much to drink. This presentation is designed to help us help
that rider. Nearly a third of all motorcycle rider fatalities in Idaho are the result of rider impairment.

Q: My local chapter might have a big problem. We sponsor a charity ride every year, and we insist that all riders
and passengers sign a release and waiver. This year, we had somebody jump the gate and get injured during
the ride. He has said he is going to sue us for failing to provide a safe ride. Since he didn’t sign a release and
waiver, are we screwed? - ABATE MEMBER
A: As I have long said, the best thing you can do to protect your organization is to have a release and waiver
signed by each participant and make sure you have procedures in place to make sure that everyone signs it.
Sometimes, however, someone will slip over the gate and get into the ride without signing the release, despite
the best efforts of the organizers. Always one of my big fears.
A recent opinion by the California Court of Appeals may provide you some breathing room. In that case, a
couple injured in a recreational motorcycle ride sued because the ride did not have a police escort. The Plaintiff
was an experienced rider and had signed waivers for previous rides, but somehow got in the ride without
signing a waiver, including previous years of the same ride in which they were injured. The Court of Appeals
ruled that the injured couple “assumed the risk” of the ride.
The couple on the ride were injured when a van swerved into their lane causing a collision. The court ruled that
the couple had waived any right to sue even though they had not signed a waiver for this ride but had signed
such waivers in previous rides. (As I said earlier, waivers are still needed but this case helps with those that
sneak into an event without signing a waiver) The court held that the risk of participating in a motorcycle ride
with a large number of participants along public highways is self-evident, and that the risk of being injured while
in a motorcycle procession is well known as all rides do not have police escorts. The rule is that a voluntary
participant in a recreational activity cannot recover damages for injury from a co-participant or organizer if the
injury arises from a risk inherent in the activity and defendant does nothing to increase that risk. The court held
that the lack of police escorts did not increase the risk of injury on a public highway.

easier with this court decision if it becomes the trend in all states.

This year, 100 bikers showed up to do both. OK, it wasn’t really too cold at 28F, but a 10-mile cruise to Higgins
Point & back was enough to get chilled.
