The President’s Perspective
Those who attended last
week’s meeting saw firsthand
how a governing body functions.
Some came with preconceived
notions. Some came with an
agenda. There were proponents
and opponents. Who had the
better argument depends on who
you ask. Some thought it was
trivial and some thought it was
important. But when the smoke
settled and the drum beats from
the tribe quieted, the victor was
the process. The process which
allows a person who feels aggrieved by another, to state his
case to our deliberative body for
a resolution. By the same token,
the person accused of misconduct also has the chance to fully
state his or her case to the judges
of the facts. The final verdict is
determined by reasonable people
listening, thinking and deliberating to make the decision each
individually thinks is in the best
interest of the lake. So, whether
you thought the issue was significant or not, it was a model of
how the system is supposed to
work. Knowing the board members as I do, I believe the same
result would have been obtained
whether the meeting had been
held in the usual closed session
or, as it was this time, in open
session at the responding party’s
request. As I reflect back on
the event, in a larger sense, it
doesn’t matter as much which
side carried the day as it does
that our system for dispute resolution was publicly tested, albeit
unexpectedly, and functioned as
it should. Both sides had ample
opportunity to speak their truth
and let the chips fall where they
may. The result in this case will
not make or break our community, but the winner, in my judgment was the process that let us
speak boldly and calmly decide.
Whether win, lose or draw we
move forward for a better community.

A meeting of the Board of Directors for Cherokee Water Company
was held at 6:00 pm on Thursday,
July 17, 2014, at NK 20 Lake Cherokee, Longview Texas 75603 with
the following Directors present:
Gary Mapes, President
Tommy Visage, Vice President
Mike Lee, Treasurer
Mike Pemberton, Secretary

Also present was Rick Faulkner.
President Gary Mapes called the
meeting to order.
Secretary Mike Pemberton pronounced a quorum.
A MOTION was made by Sue Wilson and seconded by Darrell Wolven
to approve the Minutes of the June
19, 2014 Board of Directors meeting.
The motion passed unanimously.
Mike Lee presented the Treasurer’s Report. The financial statements for the nine months ending
June 30, 2014, were reviewed in
detail at the committee meeting on
Monday, July 14, 2014. The Balance Sheet continues to remain in
very good condition, with cash/cash
equivalents being 94% of current
assets and 53% of total assets. The
liabilities represent normal operating
expenses with no unusual items.
The operating income is tracking in line with the budget at 78%
for the first nine months. Oil & gas
income is 11% over the budget, but
is still $6,830 less than last year at
this time. If the Oil & Gas income
continues at the current monthly rate,
it could equal last year’s income
and be the first time in six years
not to decline. All of the expense
categories are within budget or have
been previously explained. The total
expenses are 66% of the budget which
is 9% under the budgeted amount.
The net income from operations is
14.8% of the operating revenue.
A change in payment of payables from weekly to bi-weekly was
reviewed which would reduce costs
and retain cash for approximately
seven days. A review to put some
payables on automatic draft was
discussed. The changes would not
affect any review process or internal
controls. The change does not require
a motion for approval by the board,
but the CWC staff and the Treasurer
wanted to review the change with
the board for their knowledge and
comments. The change will take
effect when the pay dates and payroll
dates match, so that the changes
could be done all at once, but it is
anticipated that the change will be
completed with the next thirty days.
A MOTION was made by Mike
Lee and seconded by Lynda Whalen to approve the June 30, 2014,
financial statements and certify the
bills paid for the first nine months
ending June 30, 2014. The motion passed unanimously.
Ned Muse presented the Manager’s
Report
1. Phase I of the new website
is complete. It will be changing as an on-going process.
2. Samson has
expressed interest
in another water
contract. The same
terms were offered to them
as the previous sale and
those terms were accepted.
3. The Texas Water Development
Board has received Corps of Engineers staff approval on financial
support for the siltation study. CWC
will pay 1/2 for the study and the
Corps of Engineers will pay 1/2
(via the City of Longview).
Sue Wilson, Chair of the
Long Range Planning Committee,
presented that the Committee did
meet this month and had no action
items to bring before the Board.
Sue did report that the interactive portion of the web-site will
be through the Facebook page.

Darrell Wolven, Chair of
the Property and Rules Committee, reported that the Committee did meet. They reviewed 1
variance request to be approved
to bring before the Board.
A MOTION was made by Darrell
Wolven and seconded by Dickens
Wilkinson that the Board accept the
recommendations of the committee
to approve the following variance:
1. Leslie Maurer, SP-13, to add
an open deck extension to an existing deck and stairs that will be
closer than 75’ from shoreline.
The motion passed unanimously.

the Natural Resource Committee, reported that the Committee
did meet and had no action items
to bring before the Board.
Tommy Visage, Chair of the Building and Grounds Committee,
reported that the Committee did
meet this month and had no action
items to bring before the Board.

reported that the Committee did not
meet this month and had no action
items to bring before the Board.
Mapes presented, according to Article V, Section 8 of the By Laws, “An
officer or director may be removed for
cause by a vote of two-thirds of the
entire board (excluding vacant positions) at a duly called meeting of the
board of directors at which a quorum
is present.” Because there are eleven
Board Members, it would take 8 votes
to remove a director from the board.
A MOTION was made by
Lynda Whalen and seconded by
Randall Latch to take any vote

FM 2204 going toward Kilgore at
about 9:30 in the morning. Official reports show that the driver of
the other vehicle involved failed to
yield the right of way. As I write
this, Martin is still in the hospital
recovering. I know all of you join
me in praying that Martin and the
other driver both have a swift and
full recovery.

Retaining an attorney that sent a
letter to CWC stating any continual
attempt to collect on the CWC invoice
sent to the Latch’s will force them to
file suit against the Cherokee Water
Company and members of the Board.
The MOTION failed.
Being no further business, the meeting was adjourned at 7:30 pm.

I need to express CWC’s appreciation to all of the individuals and
agencies that came to Martin’s aid.
The vehicle was totaled by the impact
and it took first responders some time
to extricate him from the wreck. This
was a serious incident that could have
been so much worse without their efforts.
We are expecting that it will be
several weeks before Martin returns to
work. If you want to send him good
wishes, you can do so at [email protected] .

change order to the contract that will
allow for the replacement of a large
section of culvert in the NT section.

Miller Construction has begun
working on the maintenance and repair
of the lake roads. They began their
work in early July. This is the start
of what we hope will be a continuous
effort to maintain the 49 miles of Lake
roads. Under the current contract,
Miller will make both major and minor repairs to the roads. These items
were identified in a study of road conditions that was undertaken in April,
2013. This includes everything from
drainage and pot holes to major repairs
of the road base and surface in some
areas. After this phase is completed,
we then plan on a continuous program

CWC BOARD ELECTION COMING UP
It is nearing that time of year again when we have our election to fill four slots on the CWC Board
of Directors. The applications to be a candidate will be available at the CWC office on September 2nd.
According to the By-Laws, the CWC office cannot accept a completed application before September 16th,
or after September 30th.
This year, the three-year term expires for Mike Lee, Gary Mapes and Mike Pemberton. In addition, a
fourth director will be elected to fill a vacancy created by the resignation of a director for which the Board
did not appoint a replacement. All three Directors are eligible to run for re-election.

A Personal Watercraft (PWC)
is defined as a type of motorboat
which is specifically designed to
be operated by a person or persons
sitting, standing, or kneeling ON
the vessel rather than INSIDE the
vessel. Includes jet skis, wet bikes,
wave runners, etc.
All equipment requirements for
regular motorboats also apply to
PWC. In addition to those requirements:

Hope that everyone had a fabulous fourth
of July. The boat parade, the fireworks, fun
on Firecracker Park, so many special things
that make this lake extraordinary. Our visitors are always very impressed with our community.
The new shipment of red and green
navigational lights are in! The Maintenance
department has installed some blinking lights
at the traffic circle at the opening to Lee’s
Creek. They will begin installation soon
for the Lee’s and Mud Creek area. It really
helped with the boat traffic over the fourth,
especially after the fireworks on Friday night.

We have extended the deadlines for entries for the Kid’s Art Contest and Photos for
the Lake Cherokee calendar. We will be accepting entries until August 31st. Please send

The Chili Fest has been changed to November 8, 2014 because of conflicts with the
previous date. The chillier weather should
whet our Chili appetites.
We are pleased to announce our new
project, Family Fun Fest on Labor Day. Everyone enjoyed the two previous celebrations
that were sponsored by the CWC. So we
thought that we would try it. Put it on your
calendars for Saturday, August 30th at Firecracker Park. There will be fun and games
for the kids. A homemade ice cream contest
with prizes for the adults. And of course food
and drinks for all! Check out the new Facebook page for The Lake Cherokee Preservation Club for changes and announcements.

Invitation to Come to
KFT – September 9th
This is an open invitation to all
residents and friends of Lake Cherokee folks to enjoy each other’s company, have a wonderful meal, and be
entertained during the meetings by
various talented people. Knife, Fork,
and Trowel meets the 2nd Tuesday of
every month except January and the
summer months.
I had no idea what KFT was until
I went to my first dinner (at the insistence of a wonderful friend ) and loved
meeting new people and heaping too
much food on my plate. I thought that
it was a “garden” club but I was
sorely mistaken. Besides eating and gathering every month,
the good folks at Lake Cherokee collect canned goods for
Thanksgiving and also have a toy and
food drive for Christmas benefitting
the Presbyterian Children’s Ministry
in Kilgore. I was truly amazed at the
generosity of the KFT folks.
So please mark your calendar to
share in the first meeting/dinner this
fall which is Tuesday, September
9th. Everyone usually starts coming
around 5:30 but the action starts at
6:00 pm. As I said, the food is great
and the fee is nominal. If you have
been coming and have a friend or
neighbor who doesn’t, please take
the time to extend an invitation.

Free Golf In August

The Firecracker tournament was
great! There were 15 teams of 4 and
the format was a blind 9. The 9 holes
are drawn by someone who isn’t
playing in the tournament. Then
once the scores start coming in the 9
holes that were drawn are placed on
the cards and the teams who scored
the best on those holes are the winners. For example here are some
of the “real scores” -10, -9, -8, etc.
Well the winner ended up being -6,
and 4 teams tied for 2nd with -5.
1st place team players were:

(sorry full names were put on sign
up sheet) and the team won: $200.00
($40.00 each).
The 4 teams that won 2nd ($87.00

donating the fireworks. The decorations (there were none) Peggy &
Glen Kernohan who always sets up
the meeting room with great decorations were not able to make it (Peggy
went into hospital night before and
NO ONE can take her place). Peggy
is now out of the hospital and everyone wishes her a speedy recovery.
The next tournament is an eve-
ning tournament on Saturday August
9th. 4 person mixed scramble. This
is a par 3 tournament – all holes are
par 3 – example on hole #6 the tee
area will be moved up. This will
make play faster since the weather
is a lot hotter. Snacks will be provided. Hope to see everyone there.
The sign up sheet will be in the pro
shop. Deadline is Friday August 8th

INVASIVE SPECIES HIDE HERE.
TRANSPORTING ZEBRA MUSSELS IS ILLEGAL
Possession or transportation of zebra mussels in Texas is a
Class C misdemeanor for the first offense, punishable by a
fine of up to $500. Repeat offenses can be elevated to a Class
B misdemeanor, punishable by a fine of up to $2,000, jail time
up to 180 days, or both.
In addition, the TPW commission has approved expanding
from 47 counties to statewide, the rule requiring boaters to
drain all water from their vessel, including live wells, bilges,
motors and any other receptacles, before approaching or
leaving a water body. This applies to all types and sizes of
boats used on fresh waters, effective July 1.
GIANT SALVINIA. What is it?
An invasive, free-floating aquatic fern that can
double in size in a few days and form a mat
three feet thick, taking over lakes and other
Water bodies. It is in many lakes already.
Why should I care? It prevents light from
entering the water, stopping growth of tiny
organisms that form the base of the food chain
and choking out all life below. It can damage
ecosystems and make fishing, boating and
other water recreation impossible.
What to do? CLEAN, DRAIN AND DRY.
Remove all plants from your boat and trailer and
discard them in the trash.
ZEBRA MUSSELS. What are they?
Small, freshwater mussels-the larvae are
microscopic and adults are usually less than
1 1/2 inches long. They’re already in Lake
Texoma and are spread from lake to lake by
unsuspecting boaters.
Why should I care? They cling to boat hulls
and plug your motor’s cooling system. They
hinder water recreation, destroy aquatic
ecosystems, ruin beaches, and damage
municipal water supplies and intake structures.
What to do? CLEAN, DRAIN AND DRY.
Remove all debris from the boat and trailer.
Drain all water from the boat, engine and bait
bucket. Then let the boat dry for at least a week
or wash it with high-pressure, hot, soapy water
before boating on another water body.

51 people signed in for the meeting and all chairs but just a few were
filled, so we may have had close
to sixty people at the July meeting.
We had two guest and they were
Ashlee Redwine, granddaughter of
Pete and Carol Staiti and Ashlee’s
friend Mackenzie Watters. The two
young ladies were visiting from
Oklahoma. We welcomed our 137th
member to the club who is Mike
Burk and appreciate Mike’s interest
in and joining our club. Some of
our shareholder members do not live
full-time on the lake and some even
live quite a distance from this area.
However, when they do get time to
be here on the lake, we get to enjoy
their company at our meetings.
With such a large turnout for the
meeting, our Cookie People did an
outstanding job of providing food
and desserts to our members and
guest. Special thanks goes out to
Keryl Kalb, Genia Holland, Mayre
Drennan, Brenda Wyche, Bob Tippitt, Bonnie Haynes, and Sharon
Lakey.

Brown announced that some lucky
person in the room was going to win a
guided trip to Lake Fork with Rick. Our
total number of people that signed in
was 51 and Rick picked the number 11
to be the winner of the guided trip. The
name in that number spot belonged to
Brenda Wyche. She did not hesitate to
point to her husband Regan and said he
could go on the trip. Regan and Steve
Brown will be taking the trip sometime
in 2015. I will also go on the trip and do
video of the entire trip.

advise the ponds are now full of fish
and he has been keeping circulation of
water in the ponds to make sure we have
plenty of dissolved oxygen in the water
during this hot season.

provided articles on hunting and
fishing in sports magazines, he used
to have a fishing show on television
named “The Honey Hole’ and has
been on numerous fishing shows
currently on television. He was very
knowledgeable on fishing and I
will go to that later but I wanted
to write something about Rick
that is not widely known or
published. After the 9/11 terror attack in New York, a duck
hunting guide was taking a
group of New York firefighter,
that had been the first responders, on a trip to Stuttgart,

All fish MUST be caught on Lake Cherokee by
Lake Cherokee shareholders.
When? The 30th day of each month. April-September The monthly
contest closes at 6:00 pm the 29th of each month and a new contest
begins at 5:00 the 30th of each month.
Who? Lake Cherokee Shareholders and eligible privilege card holders.
Contest Rules: All contestants MUST abide by the current CWC Rules &
Regulations and of the Texas Parks & Wildlife. All fish MUST be weighed
in alive. Please practice catch and release. Weigh-in stations: Skinners in
Lakeport, Lee’s Creek Grocery & Cherokee Country Golf. Weigh-in
receipts MUST be turned in at the Cherokee Water
Company, NK 20 with the date, fish, weight, name, lot and number.
Winners will be listed in the Chatter monthly.
In case of a tie, the 1st entry weighed is the prize winner.
