CPHCCA’s Chapter attorney Ned McNaughton discussed a recent court decision that may have farreaching effects on warranties currently being given by the members. The Case in question is Christie v. Hartley Construction, Inc., NC Court of Appeals case No. COA121385.Seven years after the completion of their custom home, the homeowners complained that the ‘GrailCoat’ exterior finish system was not waterproof, as repreCONTINUED on PAGE 8A A good friend recently found that his insurance had been cancelled and became one of the first people to attempt to navigate the maze of the Affordable Health Care Act of 2013. He said the process was much quicker than he’d anticipated. The enrollment process only took a little over 6 hours. Notification arrived that he had been assigned a doctor. That’s right- assigned a doctor. He made an appointment for a visit the following day. I wasn’t allowed to accompany him so I insisted he stealthily record the visit. He agreed. However, upon his arrival at the doctor’s office, his recorder was seized. The following is his recollection of his introductory meeting. The office was located in an exclusive industrial park which was no surprise. The décor of the office was just as elegant and impressive. My friend (we’ll call him Al) was surprised to see diplomas for a BS in Political Science, and Masters in Community Organization proudly displayed rather than the usual medical degrees. This was a prophetic precursor to the initial interview with the good doctor. It went as follows: Al enters the office and greeted the receptionist. “Good morning I’m Al Jackson here to see Dr. Holliday.” He hears a thumping sound from the doctor’s office. “Is everything Ok in there?” “Oh yeah”, she replies. That’s just his golf balls missing the cup. After the new plan was introduced a lot of doctors retired. Now, how can I help you? Al: But you’re not really a doctor. Doc: No, but I had to read several books on the subject, some were over 100 pages long. And, I have an iPad with internet access to WebMD. What else do I need? So, what can I do for you? Al lifts his shirt and reveals an ugly rash. Al: What does this look like to you? Doc: Wow, I’ve never seen anything like that before. Oh, now I see. Al: See what? Doc: I see what it looks like- sort of like a sunset in the mountains. Al: I mean what type of rash does it look like? Doc: Medically speaking. I don’t know, I’ve never seen anything like it. Al: What kind of answer is that? Doc: Well I haven’t, but then again I don’t know that many people. Well, make sure you don’t scratch it. Al: Don’t worry it doesn’t itch. Your answer doesn’t help. What should I do? Doc: Probably not think about it. Al: WHAT? Doc: You know try to think about something else- like a good joke or a riddle. Al: Are you serious? Doc: Oh yeah, like one of my favorites is “What has 18 arms & legs & catches flies? Tough one, isn’t it? Al: Thanks a lot, Doc. By the way, I need you to look at my ankle. Doc: Well, let me see it. Al shows the swollen ankle to the doctor. Doc: Huh oh. Al: What do you mean huh oh? Doc: I think you should stay off of it for a month or two. Al: It’s my foot- I can’t stay off of it for a month or 2. I travel for a living. Doc: Just find something to do sitting down. Why not try Sodoku or crossword puzzles, they can can take up a couple of hours easily. Is there anything else I can help you with? Al: You haven’t helped me yet. You just told me not to scratch something that doesn’t itch, to take my mind off of a problem by thinking about some stupid riddle and to avoid walking to heal a swollen ankle- you call that help? Doc: I think that’s a lot of Page 3A good advice in just an hour’s visit to my office. Al: An hour, I haven’t been here 20 minutes and you haven’t helped me at all. Doc: I know it hasn’t been an hour but you insurance plan states that any part of an hour is rounded up to a full hour. Al: You mean you’re charging me for this and you’re rushing me out so you can make your tee time. Doc: I’m not rushing you out for my tee time, I have another appointment in 30 minutes. Al: Lunch. Right? Doc: Right. After giving the receptionist/secretary/nurse his insurance card & credit card to pay $750 for nothing, Al hears the Doc call out, “By the way – A baseball team . Al: Excuse me. What about a baseball team? Doc: It’s the answer to the riddle. Al:No kidding, Doc. Doc: And remember, don’t scratch that ankle. I don’t know about you, but this example certainly gives me confidence that our health care system is in good hands. The suppliers had booth sessions, where they meet with all of the Murray Supply associates to discuss sales, marketing and training goals for the upcoming year. A Shotgun Start was scheduled for 1pm but prior to starting the event, CNT Plumbing, Inc. recognized two wonderful people who were asked to speak on behalf of these organizations. First to speak was Laura Renegar who is the Team Captain for the Primax Pink Warriors Making Strides team and Carey Fissel from The American Cancer Society. Laura spoke on how she started the team, Primax Pink Warriors with 12 walkers in memory of her own Mother who she lost to Breast Cancer and is now the largest team in the City of Charlotte with over 185 walkers. She also shared her very own personal diagnosis of Breast Cancer and how early detection is so very important. Carey shared some of the many programs offered by The American Cancer Society and thanked the group for their participation and the efforts of CNT Plumbing to raise money for these wonderful charities. This was a "fun" tournament and CNT Plumbing, Inc. chose 1st place, 8th place and 16th place to be the winners of the tournament and awarded them Outback Steak House and Dick's Sporting Goods gift cards. Attendees were served lunch just prior to the tournament at the Birkdale Pavillion which consisted of Hamburgers, Hot Dogs, Potato Salad, Baked Beans and Chips with all the fixings. Carl and Nancy Travis, Owners of CNT Plumbing, Inc., have had many people they love affected by cancer. Initially, Carl and Nancy got involved with these two organizations when their sisterin-law, Rita Horton was diagnosed with breast cancer three years ago. Today, Carl and Nancy can report that both Rita and Laura are now cancer survivors due to early detection and treatment. After supporting these two organizations for several years, Carl and Nancy decided they wanted to do something more and decided to sponsor this charity golf tournament to benefit The American Cancer Society and Making Strides Against Breast Cancer. Already in the planning stages, sadly, Carl lost his sister Donna to cancer in June 2013. Then only four short weeks later, Carl's Mother, Margaret was diagnosed with breast cancer and is currently undergoing aggressive treatment. Nancy Travis stated, "The goal of this event was to raise money for The American Cancer Society and Making Strides Against Breast Cancer in addition to raising awareness of breast cancer, not only for women, but men as well. The homeowners are appealing the decision to the NC Supreme Court, which should take less than a year. Until then, however, the Christie decision is the law in North Carolina. ASPE became an ANSIaccredited standards developer in May 2012, and its first initiative was submitting ASPE 45, originally published in 2007, for approval as an American National Standard. The Working Group headed by Chair Peter Kraut, PE, utilized ASPE’s ANSI-accredited standards development procedures and public review to thoroughly revise the standard for publication. “The group worked tirelessly for more than a year, discussing and debating the best practices from our collective experiences. We had representation from engineering, manufacturing, and contracting as well as professionals involved in other national standards,” says Peter, who is President of South Coast Engineering Group, Inc. in Calabasas, California. “The final product is an exemplary standard that clearly defines the way siphonic roof drainage should be designed. I am extremely proud of the Working Group, ASPE's Main Design Standards Committee, and all of the volunteers and staff at ASPE who made this happen.” This new American National Standard establishes the minimum performance specifications for siphonic roof drainage systems and is intended to provide designers, installers, and code officials with a standard of practice for the proper application of siphonic roof drainage. ASPE/ANSI 45 applies to engineered siphonic roof drainage systems intended to prime and operate fullbore through proper pipe dimensioning and the use of siphonic roof drains.
