Originally begun as a committee of the Massachusetts Bar Association, MCLE was incorporated in 1969 as a joint venture of the MBA and the Boston Bar Association. In 1976, we merged with the New England Law Institute, bringing to our operation a history of CLE dating from 1953. From our Board President I am pleased to report that despite a second straight year of challenging economic times for Massachusetts and its legal community, MCLE has remained not only fiscally sound, but has managed to do so while making significant progress toward realizing the goals of its longrange plan. Through continued vigilance over spending and careful planning, our organization remains optimistic about weathering the uncertainties of a still-unsettled business environment throughout the coming year. As a central part of its long-range plan, MCLE has continued its efforts to reach out to our state’s newest lawyers. In response to the challenges that recently-admitted bar members are encountering upon entering the legal job market in Massachusetts, MCLE is intent on bridging the transition from law school to law practice with educational opportunities that will assist lawyers in becoming professionals. In addition to the wide selection of courses targeting new lawyers within its BasicsPlus!® curriculum, in the spring of 2010, MCLE collaborated with the Massachusetts and Boston Bar Associations and all nine Massachusetts law schools to welcome law students and recent graduates into the Massachusetts legal community by offering them a free program on Pathways to Practice. More than 250 registrants, either attending the seminar at MCLE in Boston or viewing the webcast at one of the law school co-sponsors, received practical advice from a panel of experts on available opportunities for those just starting out on their careers. Further, under the guidance of the Office of Bar Counsel, MCLE has developed Practicing with Professionalism, a proposed program for all newlyadmitted lawyers intended to familiarize them with the expectations and rules governing the ethical and professional practice of law in Massachusetts, so that they may be sensitive to the highest aspirations of our legal profession. It is envisioned that the Practicing with Professionalism program will provide new Massachusetts lawyers with a shared experience and common base of information, as well as serve to orient them to the support and resources available to them. We are currently reaching out to the Massachusetts and Boston Bar Associations to gain their support for and further develop this important communitybuilding initiative. During the past year, MCLE further established its print and electronic footprint by publishing its first books in Rhode Island and New Hampshire and increasing the number of programs it offers via webcast, thereby making MCLE products accessible beyond Massachusetts’ borders. This MCLE | New England® initiative provides instructive resources to lawyers throughout the region, while at the same time showcases the unsurpassed expertise of our volunteers to a larger audience and opens up new opportunities for the organization. As a result of the continuing generosity of our many donors, MCLE’s scholarship endowment made considerable strides. More than 290 new gifts and pledges, totaling nearly $270,000, were received during the past year. By year-end, cumulative giving levels were approaching $2 million, bringing our organization within sight of realizing our $2.5 million campaign goal. MCLE is honored to be recognized within the legal community as a donor-worthy organization. I close on a note of sadness, remembering Massachusetts lawyer and MCLE Trustee Emeritus, Walter H. McLaughlin, Jr., who died in June 2010. With his passing, MCLE bids farewell to one of its original incorporators, upon whose collective vision MCLE’s success has been built. Phyllis E. Presenting programs, publishin 2009–2010 in review Growth in online programming D uring the past year, 18,375 registrants attended nearly 290 MCLE programs, in a variety of in-person and online formats, either live or on-demand. In an effort to reach practitioners from all corners of the state—and beyond—these programs covered every practice area at every level and were presented live more than 450 times in Boston, around Massachusetts, and via webcasts. Nevertheless, MCLE has not been immune to the economic downturn. Although total registrations are slightly up from last year, particularly due to MCLE’s collaboration with WestLegalEdcenter and the increase in webcast participation, in-person registrations, totaling 11,195, are down 10%, likely reflecting a shift in how lawyers consume their CLE from in-person to online. Although suppressed in-person registrations impacted most programs, lower registrations were particularly felt in seminars developed for new lawyers who have been practicing for five or fewer years. Overall, new lawyer registrations decreased 25% from the previous year. In particular, registrations for MCLE’s BasicsPlus!® programming, intensive one- and two-day courses designed for entry-level specialists, were down 17%. MCLE’s signature annual practice-area conferences provided mixed results. Not unexpectedly, MCLE’s annual Real Estate Conference was hit the hardest. However, conferences in the areas of family law, criminal law, municipal law, and personal injury law continued to fare well and, in some cases, actually exceeded registrations from previous years. MCLE continued to offer cutting-edge, timely CLE on new developments in the law by responding with “fast track” programs that are conceived, planned, scheduled and marketed at an accelerated pace, and delivered when practitioners need guidance most. During 2010, MCLE’s fast-track programs in the areas of estate tax, health law, the new RESPA rules, lobbying law, and campaign finance law were among its most successful programs of the year. Over 11,000 customers attended MCLE programs in person during the past year, while an additional 7,000 opted for online or audio programs. One area of steady growth has been in the online delivery of programs via webcasts. To adapt to varied and changing lawyer preferences for where and when they get their CLE, MCLE increased the number of webcasts over the past year by 25%, from 110 to 137. In 2010, webcasts of MCLE programs, either independently or through MCLE’s collaboration with WestLegalEdcenter, accounted for almost 6,000 customers, or 32% of total registrations, an increase of nearly double from last year. Plans are already in place to webcast even more programs in the coming year to both local and national audiences. As a result of the successful webcasting of MCLE programs, MCLE is experimenting with program formats that use technology and the borderless Internet to bring cutting-edge topics and expert faculty to virtual classrooms in homes and offices around the region. In March 2010, MCLE piloted its first fully web-based course, Paul Kane Online: A Dialog on Complex Divorce-Related Issues, in which everything—presentations, materials, ongoing discussions among participants—is conducted online. This virtual discussion forum lends itself particularly well to sophisticated practitioners who, as students, actively contribute to the program through their questions and ongoing dialog over a three-week period. Our second foray into the virtual classroom, scheduled for February 2011 in conjunction with the Committee for Public Counsel Services (CPCS), will address crossexamination in criminal cases and blend online instruction and brainstorming sessions around a featured case hypothetical with hands-on, in-person trial skills training and critique at MCLE’s Boston conference center Advancing the Court’s message The past twelve months has been a year for developing our organizational strengths, and one such strength is our close relationship with the state and federal courts as they administer justice in the Commonwealth. Last year, 219 judges from various trial and appellate courts provided practical insight into law, practice and policy by serving on MCLE program faculties and as contributors to our books. In addition to including judges on many of our programs and books, several specific initiatives are particularly noteworthy. First, on the invitation of the United States District Court for the District of Massachusetts, MCLE developed and offered a free program on criminal discovery practice and procedure in the federal court. This well-received training was hosted at the federal courthouse and attended by over 200 practitioners and judges. Second, on the occasion of its 150th anniversary year, justices of the Massachusetts Superior Court, in a project spearheaded by Hon. Paul A. Chernoff, worked with MCLE to provide a year-long Keep raising the bar. | MCLE ANNUAL REPORT 2009–2010 3 ng books, fostering excellence series of weekly video tips from more than 50 Superior Court judges, past and present, educating the trial bar on Superior Court practice. Pushed each week over the Internet to all Massachusetts trial lawyers, an archived library of these informative tips is available on MCLE’s website. Finally, MCLE has been privileged to assist the Probate and Family Court in educating the bar on two important changes in the law. This was the second year of a three-year period in which MCLE partnered with the Court to offer programs throughout the state on the implementation of the new MCLE collaborated with Judge Massachusetts Uniform Probate Code, Paul A. Chernoff and dozens of one of the most significant pieces of justices of the Massachusetts legislation of the past 25 years. MCLE looks forward to continuing its collaboration with the Court in 2011 on these UPC and GAL training initiatives. Training those who advocate for the poor During these difficult economic times, the demand for legal, social and health services for the poor is higher than ever. Yet, while called upon to do more, providers of these services have seen their budgets cut, staffs reduced, and funds for training eliminated. Understanding the vital role these advocates play, in 2010 MCLE reaffirmed its commitment to training legal services lawyers, pro bono practitioners, and other professionals who serve the poor by making MCLE programs accessible to them through our collaboration with the Massachusetts Law Reform Institute (MLRI) and our far-reaching scholarship program. For the third consecutive year, MCLE worked closely with MLRI to offer a series of 11 public benefits trainings for lawyers and non-lawyer advocates covering a spectrum of topics, knowledge of which is essential to assisting low-income Massachusetts residents in qualifying for and receiving public benefits, such as MassHealth, food stamps, Social Security and disability, emergency assistance shelter, transitional cash assistance, unemployment, and veterans benefits. A record number of more than 1,000 registrants attended these programs during the past year. Moreover, in partnership with 35 of the organizations around the state that provide legal services to the poor or assign pro bono cases, MCLE awarded over 1,200 scholarships to its programs throughout the year to help train their staff attorneys or recruit, train and retain private practitioners to accept pro bono cases. These scholarships free up those organizations’ limited resources for direct client services. As a result of an additional 400 needs-based scholarships awarded to other deserving private and public-sector lawyers, MCLE’s scholarship program funded 14% of total in-person registrations. By underwriting the cost of the MLRI public benefits trainings and providing scholarship assistance to lawyers who serve the public interest, MCLE continues to make critical training accessible to thousands of practitioners. Expanding into other New England states Despite 33% fewer sales in books and supplements, MCLE Press had a productive year, during which it introduced five new titles to its collection of nearly 150 practice manuals and updated more than 45 others to help keep practitioners from Massachusetts and around New England current in every practice area. Although lower sales suggest that, given the current business climate, lawyers are more likely to purchase books when they need them rather than in anticipation of needing them, MCLE Press’ diligence over the past year promises that, as the economy improves and lawyers buying practices adapt, MCLE will be prepared. MCLE’s new statespecific books are being well-received in other New England states. Within six months of its release, A Practical Guide to Divorce in Rhode Island, the first book in the MCLE | New England collection, has been cited by the Rhode Island courts. Most notably, the past year saw the expansion of MCLE’s publication expertise into other New England states through the introduction of a new publishing imprint, MCLE | New England®, under which it is developing state-specific collections of practice manuals. Under this imprint, books on divorce, civil discovery, evidence and DWI have been published in New Hampshire and Rhode Island, and other titles, including the first ones in Connecticut and Maine, are expected to publish throughout the next year. To help promote these titles, MCLE is developing relationships with relevant bar and professional associations. To date, MCLE has entered into collaboration agreements with the Rhode Island Bar Association and the New Hampshire Association of Criminal Defense Lawyers to help introduce MCLE books to their respective members. Volunteer… To love what you do and feel that it matters—how could anything be more fun? —Katherine Graham Bringing Passion to Pedagogy Each year some two thousand lawyers, judges and other professionals volunteer for MCLE. They lecture, lead workshops, conduct demonstrations, moderate panel discussions, answer questions during—and immediately after—seminars, author and review monographs, edit and update book chapters, serve on MCLE’s board and offer advice on its curriculum. Many of them, in addition to serving on faculty panels or editing or authoring publications, attend seminars as registrants or refer to MCLE books in their practices. They do what they love, and they make it count. Inspiring Others The volunteer experience at MCLE reflects both a rich past and a vibrant present. For over four decades MCLE volunteers have been developing and presenting seminars, preparing rich collections of written materials, and generally “raising the bar” for legal practice in the Commonwealth. Indeed, a number of today’s most current and useful publications, such as the Massachusetts Basic Practice Manual, began as seminar handouts in the distant past—updated, augmented and reworked as new generations of seminar faculty and registrants have added their perspectives. The fingerprints of past MCLE volunteers are everywhere, including on the makeup of our present-day faculty panels and author rosters, as our more experienced volunteers continue to recruit, nominate and inspire others to contribute their time and energy to legal education. Creating the Perfect Storm MCLE volunteers bring an extraordinarily broad range of experiences, talents and insights to the educational process. MCLE created the Scholar-Mentor Awards to honor four MCLE volunteers each year who have “raised the bar” through their outstanding contributions to legal education, and to acknowledge their exceptional service to the legal profession and their demonstration of the following qualities and characteristics: Excellence in teaching or writing for MCLE programs and publications. Give… Helping to Give Voice MCLE is committed not only to keeping lawyers current in their fields, but also to ensuring that our system of justice is fair and accessible to everyone. MCLE helps advance these objectives by: offering scholarships to every legal services staff attorney in the Commonwealth, freeing up legal services funds for direct client representation; working with pro bono organizations throughout the state to make scholarships available as a tool to recruit, train, and retain pro bono volunteers; and providing needs-based scholarships to practitioners who have little or no budget for continuing education. Over the past year, MCLE awarded a record-high 1,640 scholarships—or 14% of all in-person seminar registrations—to support the training of lawyers who otherwise would not be able to attend MCLE programs. In addition to 406 needs-based scholarships, MCLE distributed 1,234 vouchers to 35 organizations that provide legal services to the poor or assign pro bono cases in Massachusetts to assist them in training their staff attorneys or in recruiting and training private counsel who accept cases on a pro bono basis. These lawyers are vital to ensuring that the most vulnerable members of our society have a voice in our legal system. Building a Culture of Giving In order to sustain our practice of awarding scholarships to MCLE programs, MCLE’s Board of Trustees voted in 2005 to create a scholarship endowment by raising $2.5 million to endow 1,000 scholarships in perpetuity. Due to the generosity of over 700 lawyers and firms, the Campaign for Endowed Scholarships is approaching the 80% mark, having raised nearly $1,970,000 for either the general scholarship endowment or one of several named scholarship funds that provide a lasting and meaningful way for family, friends, and colleagues to pay tribute to outstanding members of the legal community whose lives and work exemplify the best of Massachusetts’ rich legal history.
