At the next City Council meeting, City Manager Burn will present a Resolution which formally designates the Waxahachie Daily Light as the official newspaper of the City. 9. Attached to this memo is a resolution designating the Waxahachie Daily Light as the official newspaper. I recommend that you approve Resolution No. R-14-180. 6 RETURN TO AGENDA CITY OF FERRIS RESOLUTION NO. R-14-180 WHEREAS, Texas Local Government Code 52.004 requires the governing body to designate an official newspaper of its municipality as soon as practicable after the beginning of each municipal year, and WHEREAS, in this official newspaper shall be published each ordinance, notice, or other matter required by law or ordinance to be published, and WHEREAS, this newspaper shall have a general circulation within the city, and WHEREAS, The City Council of Ferris, Texas desires to comply with Texas Local Government Code 52.004, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FERRIS, TEXAS: The City Council of the City of Ferris hereby desires to contract with the "Waxahachie Daily Light" as the official newspaper of the City of Ferris to publish each ordinance, notice, or other matter required by law or ordinance, until another official newspaper is selected or until the end of the fiscal year on September 30, 2015, whichever shall first occur. Please review the packet for all the information that was presented to the Commission at their meeting. Mr. Harris has requested a variance to our Subdivision Ordinance that requires a sidewalk to be constructed along his development at 208 N. Central Street. TxDOT does not require a sidewalk if the City does not require a sidewalk. However, if the City does require a sidewalk, then TxDOT requirements for drainage and sidewalk improvements are stringent and Mr. Harris feels that the additional cost would be exorbitant. Planning and Zoning Commission unanimously approved the variance request which would not require construction of a sidewalk North Central Street. This is an action item that requires a vote. The action to be taken is to either (1) agree with the Planning and Zoning Commission decision to not require sidewalk construction along North Central Street or (2) disagree with the Planning and Zoning Commission decision and require sidewalk construction along North Central Street. 8 RETURN TO AGENDA MEMORANDUM DATE: FROM: TO: 9-25-2014 Chief Building Official, Bill Jordan Planning & Zoning Commission SUBJECT: Consideration of approving a waiver of Article 10.200 Section 10.202(h), and 10.400 “Sidewalks”, of the Ferris Subdivision Ordinance to waive the requirement of a sidewalk parallel to N. Central St. and adjacent to new construction located at Lot: East 85 feet of 3 & All 4-5, Block 15, O. T. Ferris-Revised more commonly known as 208 N. Central St., Ferris, Texas. SUMMARY: Reference: Article 10.200 Section 10.202(h) and 10.400 of the Ferris Subdivision Ordinance regulates where and when sidewalks must be constructed, and their minimum construction methods. Background: The Ferris Subdivision Ordinance requires all new commercial construction on a vacant lot to include sidewalks along the property line abutting the frontage; and if a corner lot, both frontages. The property at 208 N. Central St. meets this criteria as it is new commercial construction on a vacant lot and has two frontages; one on N. Central St. and one on E. 3rd St. The construction of the sidewalk along the N. Central St. side of the property has been difficult because of a large drainage ditch running between the roadway the property line. To assist in facilitating the sidewalk’s construction, staff approved the sidewalk to be built along the roadway as there was no room in the prescribed location along the property line due to the draining ditch. This approval was contingent upon approval from TXDOT as N. Central St. is a TXDOT maintained highway. The contractor, Kelley Harris, submitted an approval request to TXDOT, however, TXDOT rejected the proposal and recommended improving the drainage with culverts, filling the ditch, and constructing the sidewalk in the original prescribed location. 9 RETURN TO AGENDA Mr. Harris, communicated that the TXDOT requirements were cost prohibitive and wanted to seek a waiver to the sidewalk requirement along N. Section 10.132 “Waivers from Subdivision Standards and Design Standards” of the Ferris Subdivision Ordinance RECOMMENDATION: Sidewalks along a major thoroughfare are required. Most other improved commercial properties along this corridor have, at a minimum, a level walking surface that is outside the travel lanes. Alternatively, the plans were initially approved without the addition of sidewalks. While the omission was corrected before construction began, staff understands that improvement and reconstruction of the storm water system adjacent to the property adds a sizeable sum to the project that was not initially accounted for. There are properties in Ferris that were not required to install a sidewalk along TXDOT frontage. Hospice is a great care option for those in need of this quality service. The event will be held at Mutz Park starting at 6:00 PM. The event is hosted by our Police and Fire Departments and is to increase public awareness of their efforts that they make to improve our community. Special recognition of Police Chief Sam Love, Police Sergeant James Fischetti and Police Officer Angela Barnes is made for their efforts in making this event a success. I recommend that the City Council authorize Mayor Micheal Driggars to sign the attached proclamation. 29 RETURN TO AGENDA PROCLAMATION FERRIS NATIONAL NIGHT OUT Whereas, police-community partnerships, neighborhood watch, safety, awareness, anti-crime efforts and cooperation are important themes of the National Night Out program held annually the first Tuesday of August since 1984 across America; and Whereas, Texas has the option to use the alternate date of the first Tuesday in October to avoid hot weather, Ferris will host Ferris National Night Out on Tuesday, October 7, 2014; and Whereas, Whereas, Ferris National Night Out is meant to increase awareness about police programs in the community, such as drug prevention, town watch, neighborhood watch, and other anti-crime efforts; and, Whereas, the Police Department in conjunction with the Fire Department, hosts a fun and informative event complete with door prizes, face painting, and bounce houses, free food and refreshments, as well as music. Both fire fighters have previously been volunteers in the department. The two new full time fire fighters are Mr. Tanner Caffee and Mr. Arturo Hernandez. The Fire Department, due to a vacancy, has hired a new part time fire fighter. This part time fire fighter has also previously been a volunteer in the department. The new part time fire fighter is Mr. Brad Reneau. Please join me in welcoming Mr. Caffee, Mr. Hernandez and Mr. Reneau to the Ferris Fire Department. 32
