Discussion, consideration, and action as may be appropriate regarding
Ordinance No. O-14-766 adopting the budget for the City of Ferris for the
fiscal year beginning October 1, 2014 and ending September 30, 2015.
Mayor Pro Tem Starr moved to approve Ordinance No. O-14-766. Seconded by
Alderman Wright. For: Starr, Walsh, Bruner, Ross, and Wright. Opposed:
None. Motion carried 5-0-0.

Discussion, consideration, and action as may be appropriate regarding
Resolution No. R-14-179 approving the 2014-2015 tax rolls as submitted by
Dallas County and Ellis County.
Alderman Wright moved to approve Resolution No. R-14-179. Seconded by
Alderman Bruner. For: Starr, Walsh, Bruner, Ross, and Wright. Opposed:
None. Motion carried 5-0-0.

Discussion, consideration, and action as may be appropriate regarding
Ordinance No. O-14-767 levying an Ad Valorem Property Tax rate for the
City of Ferris for the fiscal year 2014-2015 and providing for collection of Ad
Valorem taxes.
Alderman Ross moved to approve the Maintenance and Operations ($.422427)
portion of O-14-767. Seconded by Alderman Walsh. For: Starr, Walsh,
Driggars, Ross, and Wright. Opposed: None. Motion carried 5-0-0.

Alderman Walsh moved to approve the Principal and Interest ($.264707) portion
of O-14-767. Seconded by Alderman Bruner. For: Starr, Walsh, Driggars, Ross,
and Wright. Opposed: None. Motion carried 5-0-0.
Alderman Wright moved to approve Ordinance No. O-14-767 setting the Ad
Valorem Property Tax rate as $.687134 per one hundred dollars of assessed
valuation. Seconded by Alderman Ross. For: Starr, Walsh, Driggars, Ross, and
Wright. Opposed: None. Motion carried 5-0-0.

Discussion, consideration, and action as may be appropriate regarding
improvements to the soccer fields on Ferris Road.
Alderman Ross moved to allow City Manager Burn to advertise and receive
competitive sealed bids for the improvements to the soccer fields on Ferris Road.
Seconded by Mayor Pro Tem Starr. For: Unanimous. Motion carried 5-0-0.
NEW BUSINESS

Discussion, consideration, and action as may be appropriate regarding the
designation of an official newspaper of the City of Ferris.
Alderman Wright moved to recommend the Waxahachie Daily Light as the
official newspaper of the City of Ferris. Seconded by Alderman Bruner. For:
Unanimous. Motion carried 5-0-0. At the next City Council meeting, City
Manager Burn will present a Resolution which formally designates the
Waxahachie Daily Light as the official newspaper of the City.

Discussion, consideration, and action as may be appropriate regarding the
Texas Municipal League Intergovernmental Risk Pool Board of Trustees
Election.
Alderman Wright moved to elect Robert T. Herrera for Place 1, John W. Fullen
for Place 2, George Shackelford for Place 3, and Rona Stringfellow for Place 4.
Seconded by Mayor Pro Tem Starr. For: Unanimous. Motion carried 5-0-0.

At the September 2, 2014 City Council meeting the City Council
with a unanimous vote declared the Waxahachie Daily Light as
the official newspaper of the City of Ferris.
Attached to this memo is a resolution designating the
Waxahachie Daily Light as the official newspaper.
I recommend that you approve Resolution No. R-14-180.

RESOLUTION NO. R-14-180
WHEREAS, Texas Local Government Code 52.004 requires the governing body to
designate an official newspaper of its municipality as soon as practicable after the beginning of
each municipal year, and
WHEREAS, in this official newspaper shall be published each ordinance, notice, or
other matter required by law or ordinance to be published, and
WHEREAS, this newspaper shall have a general circulation within the city, and
WHEREAS, The City Council of Ferris, Texas desires to comply with Texas Local
Government Code 52.004,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FERRIS, TEXAS:
The City Council of the City of Ferris hereby desires to contract with the "Waxahachie
Daily Light" as the official newspaper of the City of Ferris to publish each ordinance, notice, or
other matter required by law or ordinance, until another official newspaper is selected or until the
end of the fiscal year on September 30, 2015, whichever shall first occur.

SUBJECT: September 25, 2014 Planning and Zoning Commission
Sidewalk Variance – Mr. Kelly Harris
At the September 25, 2014 Planning and Zoning Commission
meeting the attached information was presented by staff. Please
review the packet for all the information that was presented to
the Commission at their meeting. Mr. Harris has requested a
variance to our Subdivision Ordinance that requires a sidewalk to
be constructed along his development at 208 N. Central Street.
TxDOT does not require a sidewalk if the City does not require a
sidewalk. However, if the City does require a sidewalk, then
TxDOT requirements for drainage and sidewalk improvements
are stringent and Mr. Harris feels that the additional cost would
be exorbitant.
Planning and Zoning Commission unanimously approved the
variance request which would not require construction of a
sidewalk North Central Street.
This is an action item that requires a vote. The action to be
taken is to either (1) agree with the Planning and Zoning
Commission decision to not require sidewalk construction along
North Central Street or (2) disagree with the Planning and Zoning
Commission decision and require sidewalk construction along
North Central Street.

SUBJECT: Consideration of approving a waiver of Article 10.200 Section 10.202(h), and
10.400 “Sidewalks”, of the Ferris Subdivision Ordinance to waive the requirement of a
sidewalk parallel to N. Central St. and adjacent to new construction located at Lot: East
85 feet of 3 & All 4-5, Block 15, O. T. Ferris-Revised more commonly known as 208 N.
Central St., Ferris, Texas.
SUMMARY:
Reference: Article 10.200 Section 10.202(h) and 10.400 of the Ferris Subdivision
Ordinance regulates where and when sidewalks must be constructed, and their minimum
construction methods.
Background: The Ferris Subdivision Ordinance requires all new commercial construction
on a vacant lot to include sidewalks along the property line abutting the frontage; and if a
corner lot, both frontages. The property at 208 N. Central St. meets this criteria as it is
new commercial construction on a vacant lot and has two frontages; one on N. Central
St. and one on E. 3rd St.
The construction of the sidewalk along the N. Central St. side of the property has been
difficult because of a large drainage ditch running between the roadway the property line.
To assist in facilitating the sidewalk’s construction, staff approved the sidewalk to be built
along the roadway as there was no room in the prescribed location along the property line
due to the draining ditch. This approval was contingent upon approval from TXDOT as
N. Central St. is a TXDOT maintained highway. The contractor, Kelley Harris, submitted
an approval request to TXDOT, however, TXDOT rejected the proposal and
recommended improving the drainage with culverts, filling the ditch, and constructing the
sidewalk in the original prescribed location.

Mr. Harris, communicated that the TXDOT requirements were cost prohibitive and wanted
to seek a waiver to the sidewalk requirement along N. Central St.

RECOMMENDATION: Sidewalks along a major thoroughfare are required. Most other
improved commercial properties along this corridor have, at a minimum, a level walking
surface that is outside the travel lanes.
Alternatively, the plans were initially approved without the addition of sidewalks. While
the omission was corrected before construction began, staff understands that
improvement and reconstruction of the storm water system adjacent to the property adds
a sizeable sum to the project that was not initially accounted for.
There are properties in Ferris that were not required to install a sidewalk along TXDOT
frontage. Staff recommends that a waiver be granted and that no sidewalk along TXDOT
frontage be required.

This agenda item includes a proclamation for November 2014 to
be National Hospice and Palliative Care Month. Hospice is a
great care option for those in need of this quality service.
I recommend that the City Council authorize the Mayor to sign
the proclamation establishing November 2014 as National
Hospice and Palliative Care Month.

WHEREAS, Family First Hospice and Palliative Home Care provides patients and
families the highest quality care during life-limiting illness and at the end of life, through pain management
and symptom control, caregiver training and assistance, and emotional and spiritual support, allowing
patients to fully live until the final moments, surrounded and supported by loved ones, friends, and
committed caregivers; and
WHEREAS, every year, more than 1.5 million Americans living with life-limiting illness,
and their families, received care from the nation’s hospice programs in communities throughout the United
States;
WHEREAS, professional and compassionate Family First Hospice and Palliative Home
Care staff, including physicians, nurses, social workers, therapists, counselors, health aids, and clergy,
provide comprehensive care focused on the wishes of each individual patient; and
WHEREAS, more than 468,000 trained volunteers contribute 22 million hours of service
to hospice programs annually;
WHEREAS, providing high-quality hospice and palliative care reaffirms our belief in the
essential dignity of every person, regardless of age, health, or social status, and that every stage of human
life deserve to be treated with utmost respect and care; and
WHEREAS, Family First Hospice and Palliative Home Care has been a part of the Ferris
community for over 10 years providing compassionate hospice care to all those facing the many challenges of
advanced illnesses; and
WHEREAS, the care providers of Family First Hospice and Palliative Home Care
encourage all people to learn more about options of care and to share their wishes with family, loved ones
and healthcare professionals.
NOW, THEREFORE, I, Micheal L. Driggars, Mayor of the City of Ferris, and on behalf
of the Ferris City Council, do hereby proclaim the month of November 2014 as
“NATIONAL HOSPICE & PALLIATIVE CARE MONTH”
in the City of Ferris, Texas and encourage citizens to increase their understanding and awareness of care at
the end of life and to observe this month with appropriate activities and programs.

SUBJECT: National Night Out
Tuesday, October 7, 2014 is National Night Out. The event will
be held at Mutz Park starting at 6:00 PM. The event is hosted by
our Police and Fire Departments and is to increase public
awareness of their efforts that they make to improve our
community.
Special recognition of Police Chief Sam Love, Police Sergeant
James Fischetti and Police Officer Angela Barnes is made for
their efforts in making this event a success.
I recommend that the City Council authorize Mayor Micheal
Driggars to sign the attached proclamation.

FERRIS NATIONAL NIGHT OUT
Whereas, police-community partnerships, neighborhood watch, safety, awareness,
anti-crime efforts and cooperation are important themes of the National Night Out program
held annually the first Tuesday of August since 1984 across America; and
Whereas, Texas has the option to use the alternate date of the first Tuesday in
October to avoid hot weather, Ferris will host Ferris National Night Out on Tuesday, October
7, 2014; and
Whereas,
Whereas, Ferris National Night Out is meant to increase awareness about police
programs in the community, such as drug prevention, town watch, neighborhood watch, and
other anti-crime efforts; and,
Whereas, the Police Department in conjunction with the Fire Department, hosts a fun
and informative event complete with door prizes, face painting, and bounce houses, free
food and refreshments, as well as music.
NOW THEREFORE,

SUBJECT: New Fire Fighters
The Fire Department, per the approved 2014-2015 Budget, has
hired two new full time fire fighters. Both fire fighters have
previously been volunteers in the department. The two new full
time fire fighters are Mr. Tanner Caffee and Mr. Arturo
Hernandez.
The Fire Department, due to a vacancy, has hired a new part time
fire fighter. This part time fire fighter has also previously been a
volunteer in the department. The new part time fire fighter is Mr.
Brad Reneau.
Please join me in welcoming Mr. Caffee, Mr. Hernandez and Mr.
Reneau to the Ferris Fire Department.
