Acetylated Southern Yellow Pine Wood Products Limited Warranty
10 Year Limited Residential Warranty & 5 Year Commercial Warranty against rot, decay, and movement
Scope of Coverage:
Snavely Forest Products (“SFP”)provides the warranties set forth below to
the original residential or commercial purchaser (“Purchaser”) of Kimberly
Bay Acetylated SYP Wood Products (deck boards, porch, & balusters) (the
“KB Acetylated Products”) in any of the 48 Continental United States for
the specified time periods from the date of original purchase as shown on
the invoice, and only under normal residential or commercial uses in above
ground application with only Stainless Steels hardware used as connectors
or fasteners. Purchaser is solely responsible for determining whether KB
Acetylated Products are suitable, fit, safe, and effective for the Purchasers
intended use.
Limited Warranty (the “Warranty)
For a period of (i) 10 years for residential Purchasers and 5 years for
commercial Purchasers, SFP warrants that the KB Acetylated Products
will:
(1) be free from material defects in workmanship and materials, and shall
not suffer material damage from rot or decay such that the wood does not
perform its intended function.
THE WARRANTY SET FORTH HEREIN IS EXCLUSIVE AND IN LIEU OF ALL OTHER
WARRANTIES WHETHER STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT
NOT LIMITED TO ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE AND ALL WARRANTIES ARISING FROM COURSE OF
DEALING OR USAGE OF TRADE). IN NO EVENT SHALL SFP BE LIABLE TO
PURCHASER FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR
PUNITIVE DAMAGES FOR ANY CLAIM, WHETHER IN CONTRACT, IN TORT
(INCLUDING WITHOUT LIMITATION, NEGLIGENCE OR STRICT LIABILITY),
INDEMNIFICATION OR OTHERWISE. SFP’S LIABILITY IN CONNECTION WITH
THIS WARRANTY SHALL IN NO EVENT EVER EXCEED THE REPLACEMENT COST
OR REFUND COST OF THE KB ACETYLATED PRODUCTS GIVING RISE TO A
WARRANTY CLAIM. COSTS OF DISMANTLING, INSTALLATION, OR LABOR ARE
NOT INCLUDED WITHIN THIS WARRANTY AND ARE THE SOLE RESPONSIBILITY
OF THE PURCHASER. SFP ASSUME NO LIABILITY FOR ANY PERSON PROPERTY
DAMAGE, BODILY INJURY OR DEATH WHICH OCCURS WHILE INSTALLING KB
ACETYLATED PRODUCTS.
Claims
Warranty Duties and Period
The Warranty begins on the date of initial purchase as shown on the
invoice and registered within 30 days of the invoice. SFP, at its sole
election, will replace the damaged items only or refund against original
purchase price of KB Acetylated Products only according to the
following schedule:
(2) not change size due to swelling or shrinking in one direction (width or
thickness) greater than 10% during normal use.
For the purpose of this Warranty, a residential Purchaser is a single family
residential homeowner and a commercial Purchaser is anyone other than a
residential Purchaser. This Warranty is not transferable from the original
Purchaser of the KB Acetylated Products.

Purchaser must download the warranty registration card available on
www.snavelyforest.com , complete, and mail to the following address
within 30 days of purchase:

Definitions, Exclusions, Limitations, and Rights:
SFP does not warrant against and is not responsible for, and no implied
warranty shall be deemed to cover, any condition attributable to:
KB Acetylated Products that are not registered within 30 days of invoice purchase.
Use of metallic fastener or connector other than Stainless Steel.
Mildew, mild, natural scratches, marks, wear, rust, checks, cracks, and/or other
changes that occur after purchase.
Installation that is not in accordance with installation guidelines provided at
www.snavelyforest.com
Use of coating that is not recommended with Acetylated wood or failure to coat
acetylated wood product purchased within 30 days after purchase.
Damage incurred during power washing, and damage from interaction between
non-stainless steel products.
Modifications, ordinary wear and tear, improper storage, transport, and excessive
loading not in accordance with ICC ESR 1690.
Ground Contact or any installation not in accordance with local building codes.
Any act of God, including without limitation, fire, flood, tornado, earthquake,
hurricane, terrorist attack, or other causes beyond SFP’s control.
Movement due to unsettling ground.
Failure to abide by care and cleaning guidelines available on www.snavelyforest.com.
KB Acetylated Products that have not been stored or installed in conditions other than
those described in American Wood Protection Association (AWPA) sue categories UC1,
UC2, UC3, and UC3B. For details visit: www.awpa.com/standard/ucs.asp
This Warranty does not cover, and SFP shall not be responsible for recommended
maintenance of KB acetylated Products as provided for in the installation guide available
on www.snavelyforest.com.
If a defect occurs within the Warranty period, the Purchaser must notify
SFP in writing within 30 days of defect discovery, and failure to provide
such written notice shall make this Warranty null and void and of no force
or effect. SFP reserves the right to inspect any claimed defect. If SFP
agrees that there is a defect required to be covered under this Warranty and
Purchaser has otherwise complied with this Warranty, SFP responsibility
shall be, at its sole discretion, either to replace the defective item or
reimburse Purchaser in accordance with then chart above. SFP has 90
days to make its election once complete written notice is received, as
defined below.
To make claim under this Warranty, Purchaser must have completed
registration of the KB Acetylated Products within 30 days of original
purchase and Purchaser must notify SFP in writing of any defect within
30 days of occurrence. The written notice must include, a picture,
description of the claimed defect and proof of purchase, and must be
submitted to:
Replacement of KB Acetylated Products may be of similar or equivalent
type from a product range available at the time of warranty claim.
No person or entity is authorized by SFP to make, and SFP shall not be
bound by any statement or representation as to the quality of performance
of KB Acetylated Products other than as contained in this Warranty.
Choice of Law:
Pennsylvania law shall govern the terms of this limited warranty and any
claim arising from it.
Warranty is effective for purchased made on or after May 1, 2014.
