DENVER (AP): A federal
appeals court last Monday
reinstated a lawsuit filed by
seven Hispanic U.S. Postal
Service managers in four
states who accused the
agency of discrimination.
The 10th U.S. Circuit
Court of Appeals overruled a
federal district court, which
had dismissed the suit in 2002
on grounds the plaintiffs had
not exhausted all administrative steps before suing.
The plaintiffs, who work
in Colorado, Texas, Nebraska
and New Mexico, accused
the Postal Service of failing
to inform them of advancement opportunities, granting
merit raises and bonuses unequally and retaliating
against them when they complained of alleged discrimination.
They filed grievances with
the Postal Service and the
Equal Employment Opportunity Commission in 1996.
After 180 days passed without a decision by either
agency, the workers filed suit
in U.S. District Court in Denver in 1997.
The plaintiffs are Longino
Monreal, Felix Figueroa and
Lorenzo Ortiz of Texas;
David Medina and Ernest
Candelaria of Denver; Richard Sánchez of Omaha, Neb.;
and David Naranjo of
Española, N.M.
The Denver-based 10th
Circuit denied the plaintiffs’
request for class-action status, which would have allowed others to join the lawsuit.

Iraq could wind up as central
Kerry already has drawn
election issue criticism
from Republicans

WASHINGTON(AP),May
15: The turmoil in Iraq is
changing the political equation for President Bush and
Democratic rival John Kerry.
While the war is eroding
public support for Bush, it is
also making it harder for Kerry
to define himself for voters or
promote his domestic priorities.
Strategists from both parties had suggested the election probably would come
down to a few states, perhaps
turning on different issues in
different states.
Some analysts now are suggesting the race could broaden
into a national referendum on
Bush’s Iraq policy.
As president, Bush has the
ability to drive Iraq news coverage; for example, his decision to send his embattled defense secretary, Donald H.
Rumsfeld to Iraq for a surprise
visit last week.
With fewer options as the
challenger, Kerry has called
for Rumsfeld’s resignation and
accused Bush of running an
“extraordinarily mismanaged
and ineptly prosecuted war.”
Those in Kerry’s camp have
expressed delight at recent
polls showing Bush’s approval rating at the lowest of
his presidency. But Bush’s
drop in the polls has not translated directly into a surge for
Kerry.
Also, the Massachusetts
senator has had to walk a cautious line as he decides how
hard to go after Bush as commander in chief without risking a backlash.

week stressing domestic issues. Bush campaigned on education, Kerry on health care.
It was hard for their message to get out when local and
regional news increasingly is
influenced by pictures and stories from Iraq.
A story on Rumsfeld’s visit
to Baghdad was the top frontpage story, for instance, in
Friday’s Arkansas DemocratGazette. An account of Kerry’s
visit to Little Rock on Thursday received lesser billing.
Working to Kerry’s apparent advantage, and to Bush’s
disadvantage: Some conservative lawmakers and commentators have been expressing misgivings over the Iraq
mission, citing intelligence
lapses and Pentagon decisionmaking.

Mexican, U.S. lawmakers: U.S. unlikely to pass
migration reform legislation this year

GUADALAJARA,
Mexico (AP): Mexican and
U.S. lawmakers experienced
firsthand the difficulty of talking about migration issues
during a two-day meeting that
illustrated how the two sides
often see the problem from
very different perspectives.
For many of the 11 U.S.
congressmen and senators,
migration is wrapped up in
concerns about crime, terrorism and border security; for
the 20 Mexican legislators
who attended, it’s simply an
issue of national dignity.
“There are many things
México can help us on,” said
Rep. Jim Kolbe, R-Ariz.
“Working against polleros
and coyotes, what they call
people-smugglers, is chief
among them.”
U.S. officials have implicated migrant smugglers in a
host of other crimes, ranging
from kidnapping and drugtrafficking to the deaths of
smuggled migrants.
But the Mexicans maintained that the migration of
millions of undocumented
Mexican workers to the United
States is an economic and political issue, not a criminal one.
“We expressed to them our
concern about the tendency
to automatically link the migration issue to organized
crime,” said Mexican Rep.
Rodrigo Ivan Cortes, of the
conservative National Action
Party. “Up to now, we don’t
have one single case in which
migration issues have been
linked to terrorism.”
Mexican lawmakers noted
that migration is fueled by the
fact that 25 percent of México’s
population depends on the
rapidly shrinking farm sector.
In the United States, where only
2.7 percent of the population
works on farms, employers are
hard-pressed to fill jobs with
native U.S. citizens.
Both sides acknowledged
that it was highly unlikely the
U.S. Congress would pass a
migration accord during this
highly charged election year.
Kolbe noted that as much
as either side might want an
accord, “this issue more than
other issues doesn’t get solved
at the bilateral level.”
“It’s up to each congress to
legislate it,” he said. “Therefore, we can only exchange
ideas.”
Sen. Christopher J. Dodd,
D-Conn., agreed that there was
little chance for the U.S. Congress to make progress on various migration reform bills—
proposed both by President
Bush and a host of U.S. legislators—that would legalize millions of undocumented Mexicans while providing opportunities for additional Mexicans who want to work in the
United States.
“You have to be bipartisan.
You have to work across
aisles,” Dodd said. “You’ve
got to work at it, and there’s an
absence of that mentality (in
the U.S. Congress) that’s causing us serious problems on any
of these issues.”
But representatives from
both sides of the border said it
was important to keep trying
to bring both perspectives together.
“We have to learn to use
enormous creativity to view
this (migration) issue,” said
Mexican
Sen.
Silvia
Hernández, adding it can’t be
resolved “with infrared sensors or troops on the border.”
Visiting from Washington
were eight representatives and
three senators, including six
Republicans, four Democrats,
and one Independent.
Headed by Kolbe, the U.S.
delegation also included lawmakers from Alabama, California, Illinois, New Mexico,
North Carolina, Ohio, and
Texas.
For the Mexican side, 12
members of the lower house
and eight senators attended.
Delegations of U.S. and
Mexican lawmakers have held
annual meetings nearly every
year since 1960.
Terrorism, trade and
México’s steadfast opposition
to capital punishment were
other topics at the meeting,
which ended Saturday.

Five Latino politicians explain what it means to them
to be Democratic leaders in
two new television commercials launched in four states
last Tuesday by a group of
centrist Democrats.
The message: under
Democrats, Latinos will
“have a better life.”
The New Democrat
Network’s latest wave of
Spanish-language TV ads
will run on local stations in
10 media markets in New
Mexico, Arizona, Florida,
and Nevada.
The new commercials, a
30-second spot and a 60-second spot, feature testimonials by: Rep. Bob Menéndez
of New Jersey; Rep. Loretta
Sánchez of California; Raul
Martínez, mayor of Hialeah,
Fla.; Adolfo Carrion, county
executive of the Bronx borough in New York City; and
New Mexico Gov. Bill
Richardson.
Richardson says in the
longer version: “As a Democrat, my priority has always
been to help our community
so that all Hispanics can have
a better life.”
Martínez adds: “I support
our public schools, for they
are the vehicle for our children to obtain a good education.”
The group has spent at
least $1 million so far on ads
since March, part of what it
hopes will end up being a $5
million TV and radio ad campaign targeting Latinos, arguably the nation’s most volatile voting demographic.

is going to bat for former rival
John Kerry’s presidential campaign.
Dean sent an e-mail to prospective donors urging them
to help raise $500,000 over
the Internet in one day for the
presumptive Democratic
nominee. The Kerry campaign marked the drive’s
progress on its Web site using
a bat icon similar to the one
Dean’s campaign used to
track money during the primary race.
“Today the famous fundraising bat is in your hands to
help Senator Kerry take his
message to the American
people,” Dean wrote. The email closed with a link to the
Web site for Dean’s new
group, Democracy for
America.
_President Bush’s campaign is making a list—and
checking it monthly—to
rank its most active volunteers.
The campaign is promising those most prolific in
sending e-mails, recruiting
additional volunteers, writing letters to newspapers,
calling talk-radio programs
or registering voters on
Bush’s behalf a “special campaign memento.”
“I want you to get credit
for it!” Terry Nelson, the Bush
campaign’s national political director, told volunteers
in an e-mail Monday night.
“To make sure your efforts
are recognized, I’ve created
the Volunteer Leaderboard.”
The leaderboard will
show national volunteer
rankings. At the end of each
month, the top 5 percent
overall and for each activity
will get a campaign souvenir, Nelson wrote.

white teens, taken to the
woods, beaten and robbed of
hundreds of dollars.
Two other Latino workers
before him were allegedly attacked by some of the same
kids.
The accused attackers include the grandson of a prominent couple who helped found
the county’s Republican Party
and whose ties to two judges
and the district attorney led
them to recuse themselves from
the case.
Now the teens may be
charged with hate crimes for
deliberately seeking out immigrants who often carry large
amounts of cash, speak little
English and are willing to get
in anyone’s car if promised a
job.
“It obviously grew out of
the fact that they were Hispanics,” said Joe Beasley, Southeast director for the Rainbow/
PUSH Coalition. “They know
Hispanics are vulnerable because many of them don’t speak
English.”
Vargas, a 55-year-old Guatemalan legal immigrant, said
he was outside a grocery store
in Canton, about 35 miles
north of Atlanta, when four
boys pulled up in a green truck,
offering work for $9 an hour.
He got in and was driven to a
remote area, where the boys
told him to empty trash bags
out of the back of the truck.
As Vargas got to work, one
of the boys hit him with a large

Georgia beatings reveal vulnerability of Latino

head of the county’s Republican Party who is now secretary for the Georgia Re-

There was no rhyme or reason

The muggings have raised
questions about whether
there are deeper rifts in the
area between the white majority and a largely undocumented Latino day laborer
population, which waits on
street corners for contractors
to offer work.
Some people speculate
there may have been other
Latino beatings that have
gone unreported because the
victims fear repercussions if
they come forward.
“People just are afraid. If
they’re undocumented,
they’re afraid to say anything
because they don’t want to
ruffle the feathers or be obvious in any way, so they don’t
say anything,” said Maria
Teresa Fraser, honorary consul for Guatemala in Atlanta.
That makes the Latino
able to predators who believe they can get away with
providing little pay or job
safety.
“You can understand the
dangers these workers face
every day seeking work,”
said Joel Alvarado, a policy
analyst for the Mexican
American Legal Defense and
Educational Fund. “The way
they were able to entice these
individuals to get into these
vehicles was the promise of
work.”
Vargas, whose arm is still
wrapped in a brace, said he
doesn’t understand what led
to his beating.
“I would think it’s because I am a stranger in this
country and they’re envious
in some way,” he said. “To
this day, I don’t know why
they chose me, but I was very
happy to be on my way to
work, and I had no idea that
they were thieves.”

likely to be working but less
access to health care

18: Immigrant parents in California are more likely to be
both married and working full
time than native-born parents, yet their children are
less likely to have access to
health care and more likely to
live in poverty, according to
a report by a child advocacy
group.
Nearly 185,000 children
in immigrant families live in
or near the urban areas of
Fresno and Bakersfield, according to the report by Children Now. In Fresno, 42 percent of children live in immigrant families. In the southern San Joaquin Valley city
of Bakersfield, 37 percent
have at least one immigrant
parent.
Statewide, 48 percent of
all children have at least one
parent who was born outside
of the United States, according to the report.
“We’re really talking
about the typical California
child. I think that might surprise people,” said Sarah
Grossman-Swenson, one of
the authors of the “California
Report Card 2004: Focus on
Children in Immigrant Families.”
The report says 84 percent
of children in immigrant families have at least one parent
who works full time, but just
43 percent of immigrant families have job-based health insurance, compared with 73
percent of children in native
families.
And those children who
have an undocumented parent are the most likely to be
without employer-based
health insurance—only 16
percent of these children of
working parents are covered.

Ray Vargas and Gil Yanez
Gil Yanez honored with city
council resolution
Gil Yanez, arguably Toledo’s greatest boxer, was
honored last week by Toledo City Council with its
presentation of a resolution honoring Yanez and his
boxing achievements.
Yanez was a Golden Gloves champion in 1958-59 [in
the 112# division] and was recently inducted into the
National Golden Gloves Hall of Fame in Kansas City.
Yanez also won the U.S. Amateur Boxing division in 1959
[in the 112# division].
Yanez is one of Devin Vargas’ coaches, along with
Devin’s father, Ray. Yanez had nothing but praise for
Vargas, who is a golden gloves champion for 2000-2001
[heavyweight division].
Yanez will be at Vargas’ side in Greece this summer for
the 2004 Olympics.
Latinos and Toledo Sports Club in vigorous soccer competition at Schneider Soccer Complex in south Toledo last
Sunday. Toledo Sports Club was victorius, 3 to 1. The scores of all the matches are listed below. Michigan and Manchester
did not play and it will be determined at this week’s meeting at Latins United at 5PM about rescheduling that game.

Gloria Anzaldúa dead at 61,
Latina author helped define
borderland culture

May 21: Funeral services were
held Friday for Gloria
Anzaldúa, a Mexican-American writer acclaimed for works
that explored the sometimes
prickly blend of culture along
the Texas-México border.
Anzaldúa died May 15 of
complications from diabetes.
She was 61.
“It’s a devastating loss,”
said AnaLouise Keating, a
professor at Texas Woman’s
University in Denton who published a book about Anzaldúa
and attended the service in
Hargill, about 60 miles northwest of Brownsville. “She was
a groundbreaking author, a
revolutionary author. Her
work is read and taught internationally.”
According to The Americas Review, “Propelled by a
strong indigenous current,
Anzaldúa assumed a prophetic voice to mythic, spiritual, mystic, intuitive, and
imaginative means—a new
vision.”
Cristina Balli, a director at
the Narciso Martínez Cultural
Arts Center in San Benito, said
one of Anzaldúa’s books
helped her decode her own
confusion about being between cultures.
“We get a lot of confusing
messages,” she said. “Some of
the messages are very Mexican, some are very American,
and they don’t always go together ... The spirit knows that
but the mind doesn’t and
Gloria’s book explains that.”
Anzaldúa was born in a
ranching area of rural
Raymondville. She earned a
bachelor’s degree from the
University of Texas-Pan American University and a master’s
degree from the University of
Texas at Austin. She was working on a doctorate degree at
University of Santa Cruz-California when she died.
She was best known for two
books about being a woman on
the border: “This Bridge Called
My Back: Writings of Radical
Women of Culture” and “Borderlands/La Frontera: The New
Mestiza,” which Hungry Mind
Review and Utne Reader called
one of the 100 Best Books of
the Century. The latter book
combines Spanish and English
poetry, memoir, and historical
analysis, and was chosen as one
of the 38 Best Books of 1987 by
the Literary Journal.
Beyond being considered a
pioneer in cultural theory,
Anzaldúa was followed in feminist circles as the first openly
lesbian Chicana writer. She
published children’s books as
well as poetry, essays, and
short stories, and was the editor or coeditor of three anthologies.
Her awards included the
National Endowment for the
Arts Fiction Award, the American Studies Association Lifetime Achievement Award, the
Before Columbus Foundation American Book Award,
the Lamda Lesbian Association Small Book Press Award,
and the Sappho Award of Distinction.
“I think she gave a voice to
biculturalism
and
multiculturalism, opened our
eyes about what language is
and the various interactions
that occur when languages
come in contact and when
cultures come in contact,’’
said Teresa Cadena, an associate professor at the University of Texas-Brownsville.
“And of course, she showed
us the view from the Mexican, Chicana, women’s, female perspective.”

The Metroparks of the Toledo Area has an opening for a Historical Interpretation - Intern and a Historical Interpretation Fallen Timbers - Intern.
The Historical Interpretation - Intern must have completed at least half of a
four-year degree in History or related field and be currently enrolled as a student.
This is an hourly position 20-40 hours per week at $9.15 per hour and will assist with
special programs, research and maintenance of the Ludwig Mill, canal boat and the
Bicentennial exhibit. Must be physically able to fulfill job requirements and have

Immigrants send more than
$1.5 billion home
CHICAGO (AP): Illinois
immigrants will send more
than $1.5 billion to their family members in Latin America
this year, banking officials
said.
According the InterAmerican Development
Bank, the average adult immigrant in Illinois will send
about $1,800 back home this
year. The typical immigrant
sends money abroad about
once a month in amounts
averaging about $225.
The bank, which is a regional lending institution
similar to the World Bank,
released the figures Monday.
The study drew from a threemonth survey of 3,800 adult
immigrants nationwide.
Researches say the report
provides detailed evidence
of how low-income workers
such as busboys and gardeners have great economic
clout.
“It’s something that has
been with us for a long time,
but it’s been accelerating,”
said Don Terry, manager of
the bank’s Multilateral Investment Fund. “These family ties are extraordinary.”
The data is based on interviews with 3,800 households

N.C.’s Latino residents
send foreign families $830
million
The study found that
North Carolina’s Latino residents will send more than
$830 million to their families and friends in Latin
America.
North Carolina’s contribution ranked behind only
seven other states in terms of
overall remittances—including California, Texas,
and Florida. But it topped
the list in terms of the proportion of Latinos—84 percent—who send money
home regularly.
Overall, Latinos contribute an estimated $450 billion annually to the U.S.
economy.
DENVER (AP): Rep. Tom
Tancredo, R-Colo., is considering using a tax to recoup
some of the money Latinos
send outside U.S. borders.
The congressman, a strong
supporter of strict immigration enforcement, said he will
spend the next few months
developing a plan.
Tancredo’s idea was
prompted by a report on the
estimated $30 billion in remittance sent to Latin American countries each year.
“After looking at this
data—indicating that immigrants shipped $30 billion out
of the country last year
alone—I don’t see how anyone can still say that illegal
immigration only contributes
to the U.S. economy,”

nations open free trade talks

with the United States Tuesday as anti-riot police clashed
with protesters who say the
pact would lead to job losses
in the South American nations.
Some 2,000 people
marched through the Caribbean port city of Cartagena
toward the conference center
where the talks took place,
holding signs that read “Colombia is not for sale” and
“No free trade deal.”
Police fired tear gas to prevent the crowd from reaching
the negotiators, but protesters responded by throwing
rocks. At least one person was
injured, though no arrests
were made, police said.

El sargento Camilo Mejía,
de nacionalidad costarricense
y soldado de infantería de la
Guardia Nacional de la
Florida, está acusado de
deserción por no volver a su
unidad en Irak después de un
permiso de dos semanas en
octubre.
Mejía
dijo
anteriormente que buscó
asesoría legal para declararse
objetor de conciencia.
«Pensé que tenía todo el
derecho a ser dado de baja,
pero el ejército, por alguna
razón, no quiere respetar la
ley military», dijo Mejía.
«Convencido de que no
cometí crimen alguno,
busqué ayuda por fuera del
ejército».
Mejía, de 28 años, enfrenta
un año de prisión y baja por
mala conducta si lo declaran
culpable de deserción. La ley
militar define la deserción
como dejar al ejército sin
intención de regresar, o para
“evitar un deber peligroso o
eludir
un
servicio
importante”. El soldado entró
al ejército en 1995 y se unió
a la Guardia Nacional en 1998.
Mejía, que no es
ciudadano estadounidense,
dice tener doble nacionalidad,
de Costa Rica y Nicaragua.
El soldado señaló en su
testimonio que varios
oficiales de la Guardia
Nacional de Florida le
hablaron
sobre
una
regulación en la que los
soldados que no son
ciudadanos estadounidenses
deben ser dados de baja tras
ocho años.
Los abogados trataron de
presentar pruebas sobre esa
norma, pero el juez no lo
aceptó.
Mejía también señaló que
su experiencia en la guerra lo
convenció de que no quería
combatir más.
«Tuve problemas en Irak»,
dijo Mejía. «No creo que tenga
derecho a hablar de muchas
cosas aquí, pero no estaba de
acuerdo con muchas cosas».
Mejía había señalado
anteriormente que estaba
perturbado al ver civiles
heridos por disparos durante
una emboscada contra su
unidad. También se refirió a
la muerte de un niño iraquí en
medio de una discusión sobre
qué médico militar debería
tratarlo.
En su solicitud de
convertirse en un objetor de
conciencia, entregada el 16
de marzo, también señaló que
