Is it hot enough for you?
I’m not just talking about the weeks of triple digit heat. In 2011 the heat is on
in the building industry - the ever-changing landscape of the housing market
has had to combat credit tightening, government debate about ending policies
that promote homeownership, and the list goes on. It is definitely a busy -- and
historic -- time in the home building industry, and the issues surrounding the
business continue to get hotter and hotter.
One way to beat the heat is to dive into your membership here at the HBA. The
Association is here to help its members navigate through the challenges that we
are facing everyday. We are continually working at all levels of government
to keep pro-housing issues at the top of the priority list, and working to combat
those regulations that threaten to negatively impact the industry.
In addition, in Tulsa we are actively promoting the importance of selecting an
HBA member for building, remodeling or any home improvement project. This
will help to ensure people are making the best decision to protect their largest
investment, their homes. Hopefully, by now you have seen the latest HBA
advertising campaign on TV or in the Tulsa World. Even more importantly,
hopefully your customers have seen it, too.
Bringing the home building and affiliated industries together into one dynamic
organization to help the industry as a whole is one of the founding principles of the
HBA. Did you know that Tulsa was one of the first Home Builders Associations
in the country? I can’t help but wonder if back in 1942, any of the members could
have anticipated the extent that they would shape the future of Green Country, or
the significance the industry would have on the economy, jobs and the evolution
of the countryside here in Tulsa. Yet, thanks to their groundwork, and in part to
the influence they weaved through this organization, here we are nearly 70 years
later in this wonderful place to call home.
I mentioned this topic in my report a couple months ago, but if you have knowledge
or simply an interest in the HBAs history, particularly the last 30 years, we would
appreciate your involvement on a special committee being formed to help us
celebrate our upcoming anniversary. Please send a note to vheritage@tulsahba.
com to volunteer, and we contact you regarding future meetings. I look forward
to hearing from you.
Thanks for your continued dedication, even through these hot months, to the
industry and the HBA. To cool off and learn more about what the organization is
doing for you, sit back, perhaps enjoy a frosty beverage, and take a dip into this
issue of Home Building News. It also doubles as a great fan.
I’m no meteorologist, but I predict that the hot weather and the hot building
issues are here to stay for a bit longer, at least for the next couple months. But
hopefully, some of the sizzle will translate into new home construction and
we start to see some increased activity. June was a stable but slower month
than usual, however, overall, Tulsa is still ahead of most parts of the rest of the
country, and I still consider myself lucky to be in this market.

There has been almost no time in memorable history when the impact of government on the
building industry has been more prevalent. At the federal level we have the banking regulators,
who are relentlessly cracking down on banks. Even here in the Tulsa area, where property values
have remained relatively stable and housing demand is still alive, the federal banking regulators
are tying the hands of our local banks and their ability to loan money for new construction.

Then there’s the EPA. Everyone knows (or should know) about the lead-based paint rules which
affect work done on homes built before 1978. What you may not know is that the EPA is already
changing those rules, and you are expected to know what those rules are. NAHB has filed a
lawsuit against the EPA over many of these issues.
The EPA doesn’t stop there. There are new guidelines and regulations on storm water management.
These regulations affect not only the quality of the water coming off any particular property,
but the quantity of it as well. Under these regulations, any water running off property during the
course of development must actually be cleaner than the waters naturally running through our
creeks and rivers.
And of course there’s the Occupational Safety and Health Administration (OSHA). We have
heard that OSHA is planning an enforcement blitz in the State of Oklahoma soon. By the
time this article goes to press, the blitz may have already occurred. The new fall protection
guidelines are strict and likely to catch many off guard. NAHB has requested OSHA to delay
enforcement of the fall protection guidelines and have met with some level of success. There is
also an effort by several HBAs to bring about reformation of how OSHA works with companies;
allowing OSHA to take a more consultative (rather than punitive) role. This effort is believed
to get national attention at the NAHB Fall Board Meeting in September.
The Oklahoma State HBA (OSHBA) is also facing government issues. The City of Coweta
has adopted a building code which mandates fire sprinklers in all new residential construction,
regardless of home size. The OSHBA has expressed concerns with the legalities of how this
new code came about and is considering legal action. Fortunately, the new adopted statewide
building code does not mandate fire sprinklers throughout the state. This is purely an issue in
one municipality. But it could easily blossom into a much broader issue.
Locally, we are turning our attention to the upcoming City Council elections in Tulsa. Perhaps
for the last time, we will have an opportunity to vote on all nine council seats in one election.
After this year, there will be elections every year for three different seats. This promises to be
a very interesting year in city council elections. Some councilors have decided not to run again
(Christiansen, Westcott and Eagleton); others are running, but with an opponent (Turner, Henderson, Trail, Barnes and Mautino);
and one is running again, unopposed (Bynum).
What do all of these issues have in common? They involve governmental matters which impact the residential construction
industry. They also all involve matters which require money by the HBA. Whether it’s supporting a business-friendly candidate
or financing a lawsuit against a governmental entity which has over-stepped its boundaries, these things cannot happen without
money.
To state it quite plainly and directly: We need your help. Even though housing starts are down, the need to stay in the game
with government entities and politicians has not slowed down. As I have heard it said many times, “If you’re not at the table,
then you’re on the menu!” And it costs money to stay at the table. Candidly, our local BuildPAC account is not as well funded
as we wish it was. Please make a donation to BuildPAC. Naturally, we in Tulsa are concerned about our local political action
committee. But as you can see from this article, the needs exist at all levels (local, state and national). Giving is quite simple.

The latest on lead paint

We haven’t covered much on the new lead paint rule this year,
and I am happy to report that the latest news is positive. The
Environmental Protection Agency has recently rejected a proposal
to add third-party clearance testing to the Lead: Renovation,
Repair and Painting Rule (RRP).
At NAHB’s request, this regulation was selected for review by
the EPA under the Presidential Executive Order for Regulatory
Review (Improving Regulation and Regulatory Review, 76 FR
3821 issued on Jan. 21) concerning the impact of federal rules
on small businesses and job creation. NAHBs request voiced the
concerns of the remodeling industry about the extreme costs of the
proposed clearance testing.
The third-party clearance proposal would have required contractors
to hire EPA-accredited dust samplers to collect several samples
after a renovation and send them to an EPA-accredited lab for lead
testing. Because of the cost of this as well as the waiting period for
test results and the limited number of accredited labs nationwide,
there was a great deal of concern about homeowners’ willingness
to undergo the process.
As a result of this latest development, homeowners will now be
spared the added expense of lead testing, helping to keep remodeling
more affordable. Further, homeowners will not sacrifice safety.
Homeowners can simply hire an EPA-certified renovator to keep
them safe from lead dust hazards during renovation. Under the
lead paint rule, contractors are required to wipe down the project
area after completing remodeling or renovation work and match
the result to an EPA-approved card to determine whether lead
paint dust is still present – a process that the EPA says is “effective
at reducing dust lead levels below the dust-lead hazard standard.”
The lead rule applies to homes built before 1978 and requires
renovator training and certification, following lead-safe work
practices, containing and cleaning dust, and record keeping.
In spite of this step forward, several problems with the rule still
remain. The EPA has yet to recognize an efficient, low-cost lead
test kit that meets the requirements of the regulation. And last year
the agency removed a key consumer choice measure – the optout provision – which allowed homeowners with no children or
pregnant women in residence to waive the rule’s requirement. In
this down economy, consumers are still balking at the extra costs
of the rule and often choose to reduce the amount of work done on
their homes, hire uncertified contractors, or endanger themselves
by attempting the work themselves.

Industry Update
Triple digit temps and triple digit starts in June
Like recent temperatures, the housing market was
stagnant in June, with 129 new home starts reported for the
month in metro Tulsa, according to permit-tracking service
New Orders Weekly. The total is a 24 percent decrease over
starts reported in June 2010, and . It is a 12 percent decrease
from the 147 starts in May of this year.
Activity in the Tulsa housing market continues to outpace
most of the country. Housing starts from January through
June totaled 865, 31 percent less than starts during the same
period in 2010.
The pace of new residential construction has slowed,
but the latest member feedback from the annual Parade of
Homes event conveys that there is still strong demand for
new homes locally and that motivated and qualified buyers
are in the market. The new home showcase event, held in
June, was well-attended with considerable interest from
buyers in homes at a variety of price levels, and more than
20 homes reported sold through the event. Over 60 percent
of builders rated the quality of leads as excellent or good.
Broken Arrow recorded 23 starts in June, bringing the
city’s total number of starts for the year to 142, the highest in
the metro area. Tulsa has 154 starts for year, with 19 permits
issued this month. Owasso also had 19 starts in June, and 106
year-to-date.
Local housing start figures reflect permit information
for the entire Tulsa metro area, which includes Bartlesville,
Bixby, Broken Arrow, Catoosa, Collinsville, Claremore,
Coweta, Glenpool, Jenks, Kiefer, Muskogee, Owasso, Sand
Springs, Sapulpa, Skiatook, Tulsa, Verdigris, and Wagoner
along with Tulsa, Rogers and Wagoner Counties.

variety of new tools and information, including the HBA online

To access your member information, go to the TulsaHBA.com
and log in at the top of the screen (if you have not registered,
login information is the first letter of your first name, and your
last name - i.e., jsmith - and the default password is: fusion.)
Once you are signed in, you can click on “Update Membership
Information” in the Members Only section of the web site to
view your current contact information.
In addition to company contact info, if you wish to have a
FREE link to your company web site, you can enter the web
site information in your profile, and the link will be active as
soon as you submit your changes/updates. Associate members can also include their name in up to four different product and
service categories. If you would like to be added or removed from a category, just send a request to the HBA office.
The information that you see online will also be used to compile the 2012 HBA Membership Directory, so be sure to access
and update your membership record by the end of September to ensure that all of the information is correct. Printed notices

The HBA is working for you at all levels of government.
Nationally, the NAHB staff works with Capitol Hill leaders to educate federal legislators and regulators on the
importance of home building and remodeling to the nation’s economic well-being. NAHB has the strength in
numbers to defeat excessive regulations and defend affordable housing initiatives – saving Remodeler and Builder
members time and money. Through the grassroots strength of its 160,000 members, the Association is able to
defeat excessive regulations and defend affordable housing initiatives on Capitol Hill.
The NAHBs Political Action Committee, BUILD-PAC, the organization is able to help lay the groundwork to
benefit the industry for generations to come. As a result of member commitment during the 2009-2010 election
cycle, BUILD-PAC was able to support over 350 pro-housing candidates for Congress. The 2011-2012 cycle
is proving to be an even more competitive one and NAHB is working aggressively to raise the necessary funds
to keep pro-housing candidates in Congress. Housing is neither a Democratic nor a Republican issue. It is an
American issue. By supporting housing-friendly candidates on both sides of the aisle, BUILD-PAC will continue
to open doors on Capitol Hill and will remain one of the most powerful political action committees in Washington,
D.C..

Back to School: HBA continues support of Disney and Ryal students
Another school year will be starting soon, and with
that, the Tulsa HBA will continue its education outreach
initiative. The HBA currently supports two partner schools,
Disney Elementary in Tulsa, and the Ryal School in Henryetta,
Okla. Education is a major part of the philanthropic activity
of the Association, with both schools receiving financial
donations annually to benefit the students.
The HBA partnership with Disney Elementary School
began in 2007 via the Partners in Education program.
Through the course of the partnership, the Association has
donated more than $12,500 to the school, which includes
a donation of $1665 that will be made at the start of the
coming school year. The funds have helped to provide
everything from playground equipment to extra uniforms
for the students, based on the
needs expressed by the school.
In addition, the HBA sponsors
a mentoring program that pairs
HBA members and students for
tutoring. Disney Elementary
School typically has around
1,000 students enrolled in grades
K-5.
In contrast, the HBA’s other
partner, the Ryal School, has
about 100 students in Pre-K

through 8th grade. If you have been a member of the Tulsa
HBA for a while, you are probably very familiar with the
history of the organization’s involvement with the Ryal
School, which dates back to 1969. This December will
be the 42nd year for the annual Christmas party the HBA
hosts for the students, which features gifts, a pizza party,
entertainment - and even an appearance by Santa Claus
himself! This event costs about $7500 each year, and is
in most cases, the largest holiday celebration the children
receive. In addition to the funds required to put on the event,
HBA volunteers also donate their time to shop with students
at Wal-Mart, and help them to celebrate at the party back at
the HBA afterward.
