The Corporation of the TOWN OF MILTON Report To: Council From: Barbara Koopmans, Director of Planning and Development Date: June 27, 2016 Report No: PD-027-16 Subject: Public Meeting and Initial Report: Zoning By-law Amendment Application by Westport Management Corporation applicable to lands legally described as Lot 12 and Part Lot 13, Registered Plan 20M-451 and known municipally as 8025 Lawson Road, Town of Milton, Regional Municipality of Halton. (Town File: Z03/16). Recommendation: THAT Planning and Development Report PD-027-16 BE RECEIVED FOR INFORMATION. EXECUTIVE SUMMARY The applicant is seeking to rezone the subject lands from the current Employment (EMP-2) zone to a site specific Employment (EMP-2*XXX) zone to permit a motor vehicle dealership and to allow a motor vehicle rental agency as an accessory use to a motor vehicle dealership. The application is complete pursuant to the requirements of the Planning Act and is being processed accordingly. Upon completion of the consultation and review process, a Technical Report, including recommendations, will be prepared and brought forward for consideration by Council. The Technical Report will address issues raised through the consultation and review process. REPORT Background Owner: Westport Management Corporation, 383 Main Street East, Milton ON. L9T 8K8 Applicant: Wellings Planning Consultants Inc., 513 Locust Street, Burlington, ON. L7S 1V3 Location/Description: The subject lands are located on the east side of Lawson Road abutting James Snow Parkway, north of Steeles Avenue and are known municipally as 8025 Lawson Road. The Corporation of the TOWN OF MILTON Report #: PD-027-16 Page 2 of 4 Surrounding land uses include employment uses to the north and west, and an existing motor vehicle dealership to the south (Toyota and Hyundai). Proposal: The application seeks to rezone the subject lands from an existing Employment (EMP2) zone to a site specific Employment (EMP-2*XXX) zone to accommodate a motor vehicle dealership and to allow a motor vehicle rental agency as an accessory use to a motor vehicle dealership in addition to the uses permitted in the EMP-2 zone. The subject lands are currently owned by Westport Management Corporation with the sale of the lands to AGCG Holdings Inc. scheduled to close in August of 2016. AGCG Holdings Inc. currently owns and operates the existing motor vehicle dealerships located to the south of the subject lands. Figure 2 illustrates the proposed concept plan. The application proposes a two storey 2700 square metre building with associated parking. Access to the site is provided by a proposed full moves access from Lawson Road and a right-in right-out access to James Snow Parkway. The following reports have been submitted in support of this Zoning By-law Amendment: x x x Planning Justification Report, prepared by Wellings Planning Consultants Inc., dated May 4, 2016. Functional Servicing and Stormwater Management Report, prepared by Amec Foster Wheeler Environment & Infrastructure, dated April 2016. Traffic Impact Study, prepared by Crozier & Associates Consulting Engineers, dated April 2016. Discussion Planning Policy The subject lands are designated Industrial Area on Schedule B – Urban Area Land Use Plan of the Town’s Official Plan. The Industrial Area is an employment designation which applies to areas where a full range of light and general industrial uses will be permitted. Additionally, the lands are located within the Milton 401 Industrial/Business Park Secondary Plan and are further designated Employment Area as shown on Schedule C.2.B – Milton 401 Industrial/Business Park Secondary Plan – Land Use Plan. The Employment Area designation permits auto sales and service uses. While a full review of the applicable planning policies will be undertaken as part of the The Corporation of the TOWN OF MILTON Report #: PD-027-16 Page 3 of 4 review of the application, based on the information provided, staff is satisfied that an Official Plan Amendment is not required. Zoning By-law 016-2014, as amended: The subject lands are currently zoned Employment (EMP-2). The EMP-2 zone permits a variety of uses as described under Table 8A of the Zoning By-law but does not permit a motor vehicle dealership nor a motor vehicle rental agency as an accessory use to a motor vehicle dealership. The application seeks to rezone the subject lands to a site specific Employment (EMP-2*XXX) zone to accommodate the proposed uses in addition to the uses permitted in the EMP-2 zone. The site specific zoning also proposes a reduction in the interior side yard setback with the intent of facilitating an integrated development with the existing motor vehicle dealerships to the south. Site Plan Control: Should the application be approved, the applicant will require site plan approval prior to the commencement of any development. Public Consultation and Review Process: Notice for the public meeting was provided pursuant to the requirements of the Planning Act on June 7, 2016. Staff has identified the following issues to be reviewed: x Urban/Site Design and Landscaping x Traffic/Access A technical report with recommendations will be brought forward for Council consideration upon completion of the evaluation of the application. FIGURE 2 PD-027-16 APPENDIX 1 PD-027-16 THE CORPORATION OF THE TOWN OF MILTON BY-LAW NO. 0XX-2016 BEING A BY-LAW TO AMEND THE TOWN OF MILTON COMPREHENSIVE ZONING BY-LAW 016-2014, AS AMENDED, PURSUANT TO SECTION 34 OF THE PLANNING ACT IN RESPECT OF THE LANDS DESCRIBED AS LOT 12 AND PART OF LOT 13, REGISTERED PLAN 20M-451, AND PARTS 7-10, REFERENCE PLAN 20R-20357, GEOGRAPHIC TOWNSHIP OF TRAFALGAR, TOWN OF MILTON (TOWN FILE: Z-03/16). WHEREAS the Council of the Corporation of the Town of Milton deems it appropriate to amend Comprehensive Zoning By-law 016-2014, as amended; AND WHEREAS the Town of Milton Official Plan provides for the lands affected by this By-law to be zoned as set forth in this By-law; NOW THEREFORE the Council of the Corporation of the Town of Milton hereby enacts as follows: 1.0 THAT Schedule A to Comprehensive Zoning By-law 016-2014, as amended, is hereby further amended by changing the existing Employment (EMP-2) Zone to a site specific Employment (EMP-2*XXX) Zone as shown on Schedule A attached hereto. 2.0 THAT Section 13.1.1.XXX is hereby further amended to read as follows: Notwithstanding any provisions of the By-law to the contrary for lands zoned Employment (EMP-2*XXX) Zone, the following provisions shall apply: i) Additional Permitted Uses: a) Motor Vehicle Dealership b) Motor Vehicle Rental Agency (only permitted as accessory to a Motor Vehicle Dealership) ii) Special Zone Standards: a) Minimum Interior Side Yard Setback (southern): 0.0 metres 3.0 If no appeal is filed pursuant to Section 34(19) of the Planning Act, R.S.O. 1990, c. P.13, as amended, or if an appeal is filed and the Ontario Municipal Board dismisses the appeal, this by-law shall come into force on the day of its passing. If the Ontario Municipal Board amends the by-law pursuant to Section 34(26) of the Planning Act, as amended, the part or parts so amended come into force upon the day the Board’s Order is issued directing the amendment or amendments.
