Fending Off Foreclosure
The government’s newest foreclosurealternative program, HAFA, aims to
make restructuring loans an attractive
option for mortgage providers

In its continued effort to stem the tide of
rising foreclosures, the government has
attempted to come to the rescue again - this
time with the letters “HAFA” emblazoned
across his chest.
HAFA - the Home Affordable Foreclosure
Alternatives Program - was recently
instituted by the U.S. Treasury to
supplement the government’s existing Home
Affordable Modification Program
(MakingHomeAffordable.gov), for which
very few homeowners seeking to restructure
their mortgage loans have thus far been able
to qualify or make their payments.
HAFA prevents foreclosure by providing
incentives for loan servicers and eligible
borrowers to engage in a short sale or deed
in lieu foreclosure, says Monica Sloboda, an
attorney with Morgan Miller Blair in Walnut
Creek, Calif. With the former, the lender
agrees to let the borrower list and sell the
mortgaged property, with the understanding
that the lender will collect less than what is
owed on the loan and the borrower is
released from any future debt liability. With
the latter, the borrower voluntarily transfers
ownership of the mortgaged property to the
lender in full satisfaction of the total amount
due on the first mortgage.
“Both options will save homeowners’ credit
and loan implications of a foreclosure, and it
is a cost-conscious alternative for a lender,”
says Ethan Ewing of Bills.com, San Mateo,
Calif.
Each of these foreclosure alternatives aids
lenders, who can sidestep typically costly
and lengthy foreclosure proceedings. They
also safeguard the property by reducing the
time it is empty and vulnerable to potential
deterioration and possible vandalism.
Sloboda says HAFA’s advantages are
plentiful. Borrowers, for example, receive
$1,500 in relocation expenses, while loan
servicers receive $1,000. And the second
lien holder gets up to $3,000 of the sale
proceeds for releasing their liens.
Also, with HAFA, borrowers will have a
clearer understanding of the right price to
list their home at for a short sale, says Kathy
Conley, housing specialist with GreenPath
Debt Solutions, Farmington Hills, Mich.
“And if a signed purchase agreement is
obtained and submitted they will have an
approval or disapproval within 10 business
days - no more months of waiting.”
To better understand HAFA’s real world
benefits, Sloboda suggested the following
hypothetical:
“The Smiths are a family of four with a total
gross income of $90,000 per year,” she says.
“They purchased their dream house in 2006
for $450,000 and their mortgage payments
are $3,030 per month. Mr. Smith loses his
job ... and the Smiths’ total gross income is
suddenly reduced to $40,000 per year.”
Even with HAMP assistance to lower their
monthly mortgage payments, “the Smiths
will likely not be able to keep up,” Sloboda
says. “Their best alternative may be to sell
their house. But in the current market, the
Smiths may not be able to find a buyer
willing to pay more than $330,000. If the
Smiths need $355,000 to cover the balance
of their mortgage, their real estate agent’s
fee and other closing costs, the Smiths
would be left with a $25,000 shortfall.
HAFA can help by allowing them to sell
their house for less than they owe on it, or
by transferring ownership of the house to
their lender with a deed in lieu of foreclosure
if they can’t find a buyer, while being
released from the remaining mortgage
obligations and receiving $1,500 in
relocation assistance.”
HAFA stipulations apply, including the fact
that borrowers must also be eligible for
HAMP; the program doesn’t apply to
mortgages owned/guaranteed by Fannie Mae
or Freddie Mac; the property must be the
borrower’s principal residence; and the
borrower’s total monthly mortgage payment
must exceed 31 percent of his/her gross
income. Additionally, the program takes
effect on April 5, 2010 (although loan
servicers may implement HAFA before then
if certain requirements are met) and expires
on Dec. 31, 2012.

Improvements to
Attract Buyers
(ARA) - Real estate pros often coach their clients on the value of making “curb
appeal” improvements to help sell their homes. Outside painting and minor repairs
signal that the house has been well cared for. That’s a great marketing tactic, but an
even better advantage is offering multiple bathrooms. So if you’re planning to put
your house on the market and want to make it stand out, consider going a step
further and adding a new bathroom.
A spare bath is a great investment. Second only to kitchen remodels for recouping
resale value, bathroom additions boast a 63.5 percent rate of return, according to
Remodeling Magazine’s 2008-2009 “Cost vs. Value” report. And when an upflushing, macerating toilet - or “up toilet” - is used for the project, its comparatively
low installed-cost makes a bathroom
addition very affordable.
An up toilet can be installed virtually
anywhere in the home. That’s because
this type of plumbing system operates
above the floor, using small-diameter
piping to pump waste and water up,
not down, and into sewer or septic
lines. As a consequence, there is no
need for the mess and heavy expense
of
digging
through
flooring,
especially the concrete variety in the
basement. “An up toilet is a super
alternative, and it can go where
traditional plumbing cannot,” says
Mike Coletto, an independent
plumbing, heating, cooling and
electrical contractor in Illinois with
extensive experience installing and
servicing up toilets manufactured by
SFA Saniflo. Macerating technology
is ideal for adding a bath in tight
spots, Coletto notes, such as under a
stairway or inside a closet. The simple
installation process drives the cost
savings. “With no digging,” says
Coletto, “I can install a Saniflo system
in about half a day.”
Best of all, this type of home
renovation reaps instant rewards,
improving the quality of life now and
paying dividends later. So, if you are thinking of selling your home, now is the time
to plan your new bath installation. Last year’s federal, first-time homebuyer tax
credit fueled an impressive increase in the home-resale market. The incentive helped
drive year-over-year gains for nine straight months in 2009, according to the
National Association of Realtors (NAR). Thanks to an extension and expansion of
the program for those signing before April 30, many expect a similar increase in
existing home sales during early 2010.
In addition to readying your home with a bathroom addition, here is a checklist of
other ways you can easily increase the curb appeal of your home:
* Remove broken toys and tools that may have collected in the yard.
* Pick up debris and store trash cans out of view.
* Install new bulbs in porch and security lighting.
* Check bricks and pavers for cracks: Replace them and reset any that are loose.
* Patch worn or cracked asphalt or cement in the driveway.
* Edge grass and remove weeds that may have grown over walkways.
* Repaint the front door and freshen up chipped and peeling paint trim.
* Clean and polish the brass on doorknobs and lock housings, or replace them
if severely tarnished.
* Replace any broken glass panes.
* Clean out gutters and downspouts.
* If you have a post mailbox, make sure it is upright and sturdy.

New Tax Credit

Homeowners
(NAPSI)- Many current homeowners can now qualify for up to a $6,500 home
buyer tax credit. The initial success of the $8,000 first-time home buyer
tax credit convinced Washington to expand the program and extend it until
April 30, 2010. This extension, however, will be the last.
Under the extended home buyer tax
credit, current homeowners are eligible
as long as they have lived in their
present residence for five consecutive
years within the past eight. First-time
home buyers who haven’t owned a
home in the past three years are still
eligible for up to an $8,000 tax credit.
Singles who make up to $125,000 and
married couples who make up to
$225,000 can qualify for the full credit.
Those who exceed those income limits
may qualify for a reduced amount.
“The new provisions and modifications
make an already enticing real estate
market even more attractive and
accessible. Interest rates are low and
home prices are more affordable now
than they have been in decades,” said
National Association of RealtorsR
(NAR) Chief Economist Lawrence
Yun.
“There’s never been a better time for
potential buyers to invest in their
future through homeownership.”
Many areas are already seeing a rise in
home prices and demand, with
multiple bids on properties becoming
more common. According to the NAR
Profile of Home Buyers and Sellers,
first-time home buyers became
homeowners
in record numbers over the past year, comprising 47 percent of all home
sales between July 2008 and June 2009. This flood of activity helped shrink
housing inventory levels. Reduced inventory is a sign the market is
returning to a more balanced state and helps sustain home values.
Yun said that while the housing crisis isn’t over, the extended and expanded
tax credit is a step in the right direction.
“The bottom line is that the housing market is doing much better now than
one year ago, and the home purchases using the tax credit should continue to
reduce inventory to acceptable levels. The extension is a big win for
consumers, but to take advantage of this rare opportunity, would-be buyers
need to get the ball rolling and contact a RealtorR who can help them on the
path toward owning a home.”

You’ve made the decision to sell your home. But before you put the”for sale”
sign in the yard, make sure it’s ready to make a good impression on prospective
buyers and clearly stands out among the many other homes on the market.
There are many easy and inexpensive ways to clearly differentiate your home so
that it appeals to a wide range of buyers ... and in return, yields a fast and profitable
sale. To begin, purge. Nothing makes a home look smaller than cluttered countertops,
cupboards and closets. Plus, buyers want to envision a home with their own
possessions - not yours. As you start cleaning, sort items in three categories: donate,
sell or keep. Soon, your home will look neater and you may add some cash to your
wallet or gain a tax write-off.
Next, consider tackling projects that are easy, fast and inexpensive - but will
significantly boost your home’s appeal. Magazines are a great source of inspiration,
and brands such as Krylon even have Web sites (http://www.beamoverandshaker.com
) that offer practical advice and dozens of projects specifically designed to stage your
home for sale. Some indoor and outdoor projects that are quick, inexpensive and
guaranteed to get your home noticed include:
Focal point finishes: Lighting fixtures are the focal point of many rooms - but
replacing them can cost hundreds of dollars. With a little elbow grease, $20 and less
than two hours, you can update your existing ones with a new, more attractive and
popular stainless steel finish.
Directions: Cover your work area with newspaper and disassemble the fixture.
Clean the pieces and tape off areas that don’t need to be painted. Following the
instructions, apply indoor/outdoor primer followed by the new metallic paint. Once
dry, remove the tape and reassemble the chandelier.
Cover the smallest details: When sprucing up your home for sale, sometimes it’s
the small details that can make the biggest impact. Painting dull, dirty or chipped
register covers or light switch plates can give any room a quick pick-me-up, in less
than an hour.
Directions: Remove register covers or light switch plates and place them on
newspaper. Sand the surface lightly and wipe clean. Clean all pieces to remove any
built up dust and grime. Following instructions, apply a number of light coats of
primer, followed by a couple coats of gloss or metallic spray paint. Once dry, reinstall
and enjoy.
So, who needs a Property Manager anyway?
I have always believed that if you need information you go to the expert. This month I’ve
done just that in the topic of Property Management. Stefanie Joss, Licensed Real Estate Salesperson
and Property Manager of Husky Property Management, owned by David Barron, Licensed Real Estate
Broker, shares her thoughts with us on just what is entailed in property management.
“If you own an Investment Property, you probably already know how important a good
Property Management Company is. Your money, your property, your profit all depend on the
individuals you put in charge of the day to day details of a prosperous rental investment. There are a
lot of investors out there who receive that long awaited monthly Owner Draw check, but few really
understand what goes into making that payment possible.
Once you enlist the help of a professional Property Manager, you leave in their hands the
selection, screening and processing of a tenant. Property Managers serve as a buffer between Owner
and Tenant. Sure, they collect rents, but they also handle tenant concerns about maintenance, repairs,
and cleanliness of the rentals, while at the same time balancing what the Owner can and cannot
reasonably do.
Property Management is more than just the Tenants. In addition to the managing of the
tenants, some management companies can handle basic maintenance. This takes a huge burden off the
property owner. Other services may include:

Illuminate the exterior: Exterior lighting showcases the beauty of your home, so
make sure that your light fixtures are just as attractive. Update faded, rusty or
outdated finishes with a fresh new finish for a minimal price and maximum impact.
Michael Siptrott, Licensed Real Estate Broker and owner of Conley Rental Management,
adds: “Property management is an important arm in the whole of the real estate world. Apartment
complex owners and out of state home owners who decide the rent their homes, rely on quality
property managers to manage tenants and maintain the value of their real property investment. If the
property manager fails, the consequences can be the loss of some, most or all of the owner’s
investment. This can easily equal tens of thousands of dollars.
Directions: Turn off power to the lights and detach the fixture from the house.
Remove the light bulb and mask off any parts that should not be painted - including
wires. Place the fixture on newspaper and lightly sand. Clean all pieces and wipe dry.
Following the directions on the can, spray several light coats of Krylon’s Outdoor
Spaces Metallic Finish. Make sure to evenly apply paint to the entire fixture. Once
paint is completely dry, reattach the parts, reconnect the lightning fixture and turn the
power back on.
A requirement that will protect the owner when hiring a property manager is licensure.
New York State Real Property Law 12A requires that anyone who collects monies, signs leases and
shows apartments for more than one owner, must possess a NYS Real Estate Broker’s license or be a
NYS licensed salesperson working for a broker. The NY Department of State issues Real Estate
Broker licenses and provides oversight of the licensees to ensure a level of quality for the property
owner. Licensees are trained to assist the owner with developing a quality lease, advising on
minimum standards for housing and providing a local representative to direct property repairs and
maintenance.
Freshen up with flowers: The right landscaping and use of plants and flowers can
greatly improve your home’s curb appeal for prospective buyers. Brightening up your
flower boxes is a quick and easy way
to add some color to the front of your
home in just a few hours.
When considering property manages, owners should look for experience and ability. For
how long and how many properties have the manager managed? Does the broker own any investment
property himself? A quality manager will also be interested in the long and short term goals of the
property owner. And since the owner will also be working closely with the broker, having similar and
comprehensive values is also important. Management fees vary from broker to broker. But don’t hire
a management company based on price alone; there’s too much at risk. “

favorite color. Once dry, the box is
ready to display your favorite flowers.
Finally, there are several laws landlords as well as property managers must abide by. The
Fair Housing Act prohibits discrimination in rentals the same way it does in the sale of real property.
New York State makes it illegal for landlords to discriminate on the basis of race, color, religion, sex,
national origin, familial status, physical or mental handicap, presence of children in the family (or
discrimination against women who are pregnant), sexual orientation or the military. This also passes
to mobile homes and mobile home parks as well. The landlord may not refuse to rent a dwelling or
make a dwelling unavailable on the above grounds. They may not impose different rental charges,
impose different qualifications or applications, use different provisions in leases, evict tenants because
of their protected class, delay maintenance or repairs, limit information about a rental, and many other
issues as well merely because of someone’s protected class.
