Blackburn, Editor March 2006 Dear Editor: In July 2005 an editor of a magazine, contacted me via e-mail requesting permission to use some photos I had taken of an aircraft which had made an emergency landing in a bay of the Hudson River at Haverstraw, NY. The photos were of the search and retrieval of that aircraft from the bay. The editor requested I send a CD of the photos taken and offered to pay for the use of any photos selected. I did so. Several months passed without hearing any more from anyone at the magazine, so I assumed they were not interested in using my photos. Imagine my surprise this year when my wife did an internet search on my name and came up with a match for photos published in 2005 -- in that magazine! Further research found three of my photos in an article. I was a little dismayed as to why I was not notified that my photos were being used. The offer to pay for the use of the photos aside, I felt that an e-mail, or even some form letter notifying me of the use of my photos would have been the considerate, and professional, thing to do. At least a complimentary copy of that issue with the article for my portfolio would have been helpful. Apparently, that’s not the practice at that magazine. I can understand a magazine with a large number of contributing photographers, having one ‘slip through the cracks’. With that in mind, I sent an e-mail to the editor stating my feelings on the subject. To date, no reply. I must assume from their lack of response that they have no intention of paying a use fee or acting in a professional or honorable manner. My intentions for this letter are merely to make other unsuspecting photographers aware that there are some who may take advantage of an opportunity at your expense. Possibly, in some upcoming issue of Today’s Photographer, you could address the subject of how photographers might protect themselves and the use of their photos, and the recourse action in the event his work is used outside mutually agreed upon guidelines. Luckily, this publication turned out to be very reliable although late to pay. Unnamed Editor should have stated exactly when and how much the photographer would be paid per image used. Once an agreement was reached, the written terms should have been included in the package with the CD. To Protect The Use of Your Photos Photos and Correspondencr by John (Jack) Lagomarsino IFPO, Milford, Pennsylvania Too many times over the years a photographer has called or written to report that his or her photos have been used without permission, or with permission but without payment, photo credit or other related problems. In ninety-nine percent of the reports the problems could have been avoided by using a cover letter or a simple agreement in writing or using an IFPO Business Form. The following steps should provide protection for most situations. 1) Copyrights are inherent to the photographer. However, an inventory list of images with the copyright notice (Ex :©2006) is a friendly reminder that the work is protected by copyright laws. Also a short notice such as, “May be reproduced only with written permission of the author” could be added. 2) Each time a photo or digital image leaves your possession, it should be accompanied by signed and dated permission for use with terms and conditions stated. This is the first step to a contract for use -- even if no payment is involved. 3) Digital images require even more protection. NEVER send your original files. Not even just for someone to consider. Send a copy of digital images along with text files of the first two items above. 4) Follow up by phone or email within 5-8 business days to see if your images arrived and if there is interest etc. Mention that complete information is in the package. 5) A L W A Y S send a postage paid return envelope when submitting by mail if you expect your work to be returned. 6) Submissions by email are just “out there” in an unknown domain. It is much safer to mail a disc with your name and copyright notice on the disc. We are not suggesting that you never email an image but you should know and trust the receiver and believe that terms for an agreement can be made. 7) Once there is an agreement for an image is to be used, the terms must be set before the use occurs. Example: One photo may be used once for $25 or any amount that is satisfactory. You may even want the benefit of having your photos published without payment. If so, that should be agreed upon up front. 8) Others conditions must also be met. Will you get photo credit? Will you get a copy of the work published? Can you buy extra copies if you need them? 9) When is payment made? Upon publication? Within 30 days? At the end of the publishing cycle? It really doesn’t matter as long as you understand and agree to it. 10) Finally, all terms and conditions should be confirmed in writing and signed by both parties. Sounds like too much work? Not so. Two copies of a simple cover letter can do the job for you. Simple business forms can do the job for you even better. Contact the user. Try to work through the steps listed here. Most everyone understands that copyright infringement can be serious business. In most situations, something fair and equitable can be negotiated even after photos have been used. It’s much easier to take the simple steps required to protect your work at the time it leaves your possession than to try to get control of it after use. Keeping a log of photo packages, digital images etc that are in the hands of potential users helps you track usage, payments and packages that should be returned. It also serves as a reminder of where often your best work is located and where and why you should submit it elsewhere. Using business forms designed especially for photographers not only help protect your work, it’s a short cut to learning about copyrights, rights to use, terms and conditions. Just select the form that seems to match your job and complete it! You should never have to worry about protecting the use of your photos again.! This adventure started when a photographer friend of mine told me about an Air Show taking place at Republic Airport and Jones Beach in May 2006. We had planned to shoot together for sometime and this looked like an opportunity. While I was making numerous calls trying to figure out the best times and places to shoot, I ended up speaking to Officer Barry Snokhousone of the Blue Angels. He was very friendly and answered all my questions to the point that I began to feel there might be an opportunity beyond shooting the air show. So I pressed him further asking if I could get an exclusive with the men and planes. Then I got the idea that one of my models Lisa Fontanarosa would love to go on such a shoot because she loves planes. I mentioned this to Officer Snokhousone and told him I would try to get these photos pub- lished. He loved the idea of helping the girl and getting his men and their planes in print. He told me he would let me know when and where to go. True to his word he called me to tell me that his crew would be at Islip Airport from noon to 1:30 p.m. on Friday. I could get my exclusive at that time. Wow! On Thursday I drove to Islip Airport to work through any remaining red tape and to make sure I knew exactly where to go on Friday. Good thing I did this because it was hard finding the right spot and the red tape was tough as one might imagine. But when I finished I knew I was ready for the next day. A Friday 11:00 a.m. appointment ran over and it was noon by the time I got to Lisa. She was ready to go and looked beautiful. She was really excited about seeing the planes. We met the Blue Angel team at 12:30 p.m. They gave Lisa a real treat by allowing her in the cockpit and on the wing. I think the guys got a kick out of posing with her and their planes. It was truly a win-win situation -- and we decided that Lisa should work for the USO. I got great photos. The men and Lisa all signed releases with the hope of publication. I want to thank Barry, Jose, all the other Blue Angels and of course my beautiful model Lisa and IFPO. ! I used a monopod for some shots, others a 70-300 zoom on my Nikon D-70. I was actually close enough to use my 18-70mm as well. Having worked as Chief Photographer for the Dothan Eagle newspaper in the mid 80’s, I knew the name of the game was fire away -- you only have once to get that one perfect picture that may mean only seconds in capturing that “Kodak Moment.” I pulled out all the stops; I felt almost as if I were synchronized with the performer. I unleashed several volleys of fire in my allotted time. Having a chance to represent Today’s Photographer magazine again and capture in photos “B. B. Kings 80th Birthday Farewell Tour” was another chance of a lifetime for me. Perhaps the most entertaining concert I have ever attended, this one was a record breaking sellout at the Birmingham Alabama Theatre. Little did a boy by the name of Riley B. King know what a huge success he would become when he hitchhiked to Memphis as a young kid with only $2.50 in his pocket so many years ago. He set out with a dream in his head and so many songs unsung in his heart to give it his best shot and in the end became known as B. B. King, America’s best blues singer. The Crabb Family Gospel Singers When I first started shooting for Today’s Photographer magazine, I decided that I was going to become diversified and shoot many different assignments to build my own portfolio and grow as a photographer. With that in mind I approached as many venues as I could work into my busy schedule as a psychiatric ward nurse. My passion for photography and love of music drove me to cover some of the best loved stars in the business. I joined the IFPO press program specifically to gain access to the Willie Nelson Concert in Ozark, Alabama just a week away. I spoke with editor Vonda Blackburn for instructions on how to get started. The very same day she was able to fax a letter to the promoter and within 30 minutes I was given the green light!!! (I’ve learned since that it’s not always this easy but I’ve done very well.) At the arena I was given full access to the foot of the stage along with my assistant. I was the only photographer allowed access that close. I got many Inside the Alabama Theatre, I was worried about the lighting due to the restrictions of no flash and a limit to shooting only the first three songs. However, my long zoom lens with the wide aperture suited the lighting problem wonderfully. The pink spot light that cast a warm hue on this magnificent performer made for some nice shots. Due to the first two pieces being instrumentals without the star on stage, my shots were all rushed during the third and final song allowed. This is when an assistant really comes in handy for quick lens changes to facilitate the shooting in an expedient manner to allow the paying customers the quality entertainment they expect to enjoy. While King plans to retire from touring this year, the thrill is not gone and never will be. His music and the legend of “Lucille,” his beloved guitar, will continue to live on and on for the enjoyment of generations to come. To stay true to my commitment to diversify, other assignments have taken me other high profile events as well as lesser know ones such as a Christian Band and a Bike Rally -two distinctly different tickets to branching out. You’ve probably read in this magazine many times about taking your camera to work. I take my passion for photography to work also. As a Psychiatric Ward nurse, I often teach classes as night about pursuing your dreams when the odds are stacked against you. The article mentions events such as NBA games, great concerts like Carlos Santana, Pink Floyd, and how I became the official photographer for Uriah Heep, the United Colors of Benetton professional basketball team and their Nike Summer League. All of these opportunities were attributed to my IFPO membership. Things were going really going well then and still are even though there have been a few bumps along the way. I hit a big bump with the United Colors of Benetton gig. Let’s just say, if I may, that they decided not to play by the copyright rules and got caught double dribbling! We finally settled our dispute and I received a lump sum but, a promising professional relationship was broken forever. All I can say to fellow photographers is, "Get all agreements in writing!" That one bump in the road never stopped other successes from knocking on my door. To date, with the support of the IFPO press program I have covered more than 140 concerts plus other events such as the World Wrestling Entertainment (WWE), and here in Italy the New Wrestling Evolution (NWE). I have had the privilege to photograph world class wrestlers like The Undertaker, "King" Booker T, Batista, Matt Hardy, Chris Benoit, Kane, RVD, Bobby Lashley, the biggest names in the world of wrestling. Exposure to the world of professional wrestling led to a paid gig for a week of travel with the NWE. I was also the official photographer for Destiny Tour 2006. My travels stretched all over Italy as far south as Sicily. This agreement allowed me all rights to my images which is quite unusual. Most of my time now is consumed by photography. As an IFPO photographer and Model Consultant since 1988 one thing has not changed ... models can be found almost anywhere there is a client base of support. In the old days we typed models in categories such as runway, editorial, catalog, print, tea room, body parts, trade show, convention, and even voice models. They built their portfolios from such assignments to promote themselves in the future. Now we are seeing web models emerging. Web models are basically the same types of freelance models but they are promoting themselves via the internet on model web hosting sites which anyone can access instantly. Fellow photographer Robert Grantham, owner of Vincent Photography in Kansas City, and I decided to see if we could take the above information to create the Kansas City Model Networking Event that would attract models and photographers. The first thing we did was to identify a location which was a “for lease” space in the Indian Springs Shopping Mall in Kansas City. The mall allowed us to use over fifty thousand square feet of space. Our association with Today’s Photographer Magazine and Vincent Photography gave us the creditability we needed to negotiate with the mall for such an event. Next we emailed web models and photographers on a few of those web hosting sites in to notify them of our upcom- ing event. The responses for acceptance were phenomenal. To make the event as professional as possible we invited a range of companies that are interrelated to photography and the modeling industry to answer questions. Most event promoters charge outside vendors to participate in their shows. We decided to let everyone in free to test our business plan and to bring more people into the show. Our reasoning was that if the event turned out to be successful, everyone including the the promoters would get a lot of word of mouth advertising through these businesses and vendors. Furthermore, this test was only to see if we could really create a popular event through networking via the internet. Making a profit could wait for another day. Never interfere A press photographer’s reputation is often based on his own code of ethics. Although getting the story is the ultimate goal, ethical standards can “make or break” a career. As a press photographer, it is your duty to document newsworthy happenings — never altering circumstances or interfering with action to enhance your photographs. Your photos should tell a story just as it happened. Meeting the high standards of good press photography requires patience, determination and a strong set of ethics which can be the difference between success and failure. First, foremost and always remember that Press access is a privilege not to be abused. Use the following Code of Ethics to guide you: • Arrive early — at least 45 minutes to an hour before the event is scheduled to begin — in order to check in, find the press area, check out the stage or facility lay-out and choose a vantage point. • Never show up for an event unprepared. Not only should you have all the proper equipment, you should have a basic knowledge and understanding of the event. Do your homework! • Try to work with promoters and authorized officials rather than against them. • Conduct yourself in a professional manner at all times. Photographers who complain or cause problems aren’t likely to be admitted again. • Don’t just start shooting. Take time to think about what you’re covering. 48 Today's Photographer International with the action, criticize a player or performer or interrupt an authorized official. • Have patience. Resist the urge to inconvenience other photographers by changing spots. Your opportunity will come. • Although it can be necessary to fight for a good position, always be courteous. You’ll find other photographers are usually willing to share their space -- if you offer them the same courtesy. Try your best to get along with other members of the press. • Always live up to your obligations to promoters and publications. • If you agree not to sell the photos commercially, DO NOT break this agreement. • Always clean up after yourself -- film wrappers, etc. • Never photograph anyone in a compromising situation (backstage, locker rooms) unless it’s a public figure in a public place which qualifies for news. Don’t abuse the privileges you have been granted. • Always remember you are a photographer on the job -- not a spectator. Finally, the nature of breaking news makes preparation impossible. However, when you arrive on the scene, you are a press photographer -- expected to live up to the same ethical standards you have learned to display at scheduled media events.
