December Message from
2009 SCA President Don Sams
What a great year this has been
for me as president of the Sacramento Claims Association! While
it often was a challenge to take care
of my business, my family obligations and complete the duties of the
SCA- it was always a pleasure to
do so. I know that I echo the sentiments of all of the prior presidents 2009 SCA President Don Sams
when I tell you that I feel that I have received much satisfaction
from my term so far.
The new members of the Board of Directors will be voted
upon. I am very excited at the influx of new ideas that our new
board members will bring to the table. Who knows what possibilities are in store for our members?
We have had a great year and I feel that there is more to
accomplish in the future. In a struggling economy, we have
been able to provide significant assistance to a local service organization that makes a real difference to young moms and their
children. I am very proud that the SCA stepped up for a small
group of dedicated people and helped them to continue their
valuable work. Our vice-president, Chris Yaw, organized donations for the victims of the Auburn fires are tirelessly worked to
collect and distribute the clothing, money and household goods
that our people provided.
The board of directors has recommitted to our mandate
for education and is looking at fulfilling that promise in new
ways. Last month’s speaker, Elaine Lundberg, was terrific and
a delightful change of pace – providing great information in an
unorthodox way. The SCA seminar that has languished in recent
years is revived and planned for the spring of 2010. It is a huge
commitment for the education committee but one that they hope
will fill a gap in our educations and continuing education credits.
It’s closing in on time to finalize the plans for the Winter
Party. This is a chance for the SCA to thank the membership by
throwing a fantastic party with great food and an opportunity
to ‘boogie ‘til the cows come home’ at a price you couldn’t get
anywhere else. There are hotel rooms on the grounds available
at great rates for your convenience and face it, safety. The Lionsgate even includes breakfast if you stay the night so it really is
an unbeatable deal. There are, unfortunately, a limited amount
of tickets available because of the size of the ballroom so if you
haven’t been able to purchase tickets for this year’s event, be

Low, Ball & Lynch Sacramento Legal Seminar
Covers a lot of Ground in Afternoon Setting
By Bryan Harrison, Association News Network, Inc.
A good crowd of claims
industry professionals turned
out for the annual Sacramento
Legal Seminar put on by the
law offices of Low, Ball &
Lynch Thursday, November 12,
2009. Held at the Sacramento
Hilton, the afternoon-long
seminar featured sessions presented by various members of the
LBL team, along with guest presenter Michael D. Belote, a partner
in California Advocates, Inc. Organized by LBL’s Monterey office
partner Christine Reed, the event was followed by a cocktail reception including a fine spread of food immediately upon its conclusion.
Mr. Belote kicked-off the seminar with a discussion of a wide
array of Legislative issues and hot topics. His material included a
voluminous number of Assembly Bill summaries.
LBL’s Charles Redfield and Robert Frassetto then teamed-up
to give an update on the MediCare Secondary payer issue. They
included a complete user’s guide in their material.

family business shines through. “The support that comes with a
family-related business is great. I have gone into this field understanding what is needed in the industry and what strengths I can bring to
the table. I believe we are offering something in the pairing of DY
Calison / Smitho Engineering that is exceptional,” she states. It’s
a “One call does it all” concept: “Consulting in the Construction,
Engineering and Plumbing fields. Our customers know that when
they call they will receive top of the line service and now we can
carry that reputation over in what can be expected of D.Y. Calison
Inc / Smitho Engineering.
“I love talking to people and getting to know who they are. I
hope to build great working relationships through the quality of
work we do but also personal relationships because of the person I
am,” she says.

SCA Member December Profile:
Tami McLarty - Home for the Holidays
By Joan Barrett, Market Share
Tami McLarty can’t stop smiling these days. She
has been receiving warm welcomes back to Sequoia
Insurance, a regional carrier she reluctantly left
when they closed their Sacramento office, this time
as a remote casualty adjuster based in her home
office in Sacramento, and she couldn’t be happier.
“Everyone has been so welcoming it is just wonderful,” Tami
explains. “It is a huge compliment to be given this opportunity and
I truly feel like I’m coming home. Not just coming back to the job,
but to people I respect and admire who are committed to the success
of this program. Lola Hogan is one I consider my claims mentor,
I learned so much from her. It’s a thrill to be reporting to her once
again and to be working in an area that I’m passionate about.”
Coming from a true multi-line background, Tami started her
adjusting career with State Farm and has always been intrigued
with the investigative aspect of claims. She cites her father’s job
as a California Highway Patrol Captain with instilling that quest
to discover the cause of an event
in her as she grew, and later in her
career she found a field working
with litigated files that she “loves, loves, loves!”.
“The art of negotiation is another challenge I enjoy,” Tami went
on. “Sometimes it isn’t about the money. I’ve learned to think
outside the dollar amounts and really try to listen to what will make
the claimants feel that a wrong has been atoned. Sometimes it is a
written apology - it could be that a bench commemorating their loved
one is what success looks like to the claimant. One only learns by

Humor Therapy with Elaine Lundberg
at November SCA
Elaine Lundberg, Humor Therapist, brought a fun,
sometimes wacky but very poignant, presentation to the
November 12, 2009 Sacramento Claims Association
luncheon crowd.
She opened with a quote from “a famous person:
‘Peace begins with a smile’,” and sought out the answer
to who that person was. No one got it right, though she rewarded some for trying. “It was Mother Teresa,” she said.
“How often do we laugh out loud?,” she asked the November special guest speaker Elaine SCA Vice President Chris Yaw, Elaine Lundberg,
crowd rhetorically. “10-12 times a day,” she stated. “400- Lundberg brought laughter from the start, with and SCA Board member and Speaker Committee

various exercises, and generally kept the crowd
laughing, while making the point clear of the
value of laughing more in our lives. “How
many of you have tears rolling down your
cheeks? You’re the healthiest people in the
room right now,” she said.
“The more you laugh, the more you cry,
the more T-cells (anti-cancer cells) you generate. Work your way up to 100 ‘ha-ha’s a day.”

careful listening,” she says thoughtfully. “Furthermore, I believe
in mediation. I think it is smart claims handling. I like to become
involved in the mediation process and the attorneys that I work with
respect that I’m not impassive about the process,” she states.
“I’m excited to know that Sequoia will be supporting continuing
education even though, like with all companies, budgets are under
scrutiny and reserves are closely watched. It’s great to know that
we will be able to stay on top of changes in legislation and technology. It is technology that opened the window to allow me to work
in a paperless environment that features real-time file handling in
order to take this job.”
Tami juggles two cell phones, one for business and one personal
phone and clearly gets a kick out of the features that each provide.
Tall and athletic, Tami excels at sports from golf to snow and
water skiing. She takes the time to explain the nuances of knee
boarding behind a ski boat on the river. “People scoff when I say I
love knee boarding,” she says, “but when I come off of a wake and
catch another wake, they wave and cheer and I love it. But then I
get to pay for it in pain in my joints for the next week.”
Tami and her Kerry Blue terrier, Truman, like to hang around
the kitchen. Tami cooking with passion (imagine that!) and Truman
waiting to catch any goodies that may fall during the process. An
imaginative cook, Tami’s signature dish is Beef Wellington and she
has made it so many times that she loves to improvise the ingredients
surrounding the filet for variety.

MINGUS ANNOUNCES
GEM SEARCH GROUP
Gary E. Mingus is very pleased to
announce the formation of GEM Search
Group. Having laid the ground-work
back in April, 2009, Mr. Mingus brings
his 20-plus years of experience in the Gary E. Mingus
claims industry to the fore, handling temporary and permanent job
placements for Property, Casualty and Workers’ Comp. adjusters
throughout the United States.
Starting out strong, but modestly, as President of GEM Search
Group, Mingus manages a staff of three. His years in the industry
have been primarily focused on staffing efforts, following some years

thorough update of coverage issues following a brief break.
He brought particular
attention to a case now in
review by the California
Supreme Court: State of
California v. Continental
Insurance Company, 169
Cal.App.4th 1114 (2009).
The Appellate Court’s decision brings into effect
what’s known as “stacking” of limits of all policies
triggered by a continuing
loss, which the appellate
court determined to be the
result of a single “occurrence.”
“It doesn’t matter when
the damage occurred, if
your policy is triggered
you’re liable for all sums,”
Coates explained. Further,
the court ruled that “all
policies ‘stack’. “This is a huge huge issue that will affect... cases
across the country,” he said.
Karen Moore, Esq, an Associate in the San Francisco office of
LBL, and Christine Reed, Esq, Partner in the Monterey office, did
a nice job of teaming-up to round-out the afternoon with an update
on California Law.
Amongst those in the crowd were SCA members Joy Potter
and Larry Nelson, from Bragg & Associates; Mid-Valley Claims
members Jerry Inman, of JD Inman Investigations, and Donna Wong,
from Golden Bear Insurance; East Bay Claims member Colleen Abney, of Nova Pro Risk Services; and Sharon Richards, AVP Claims
Director at C.V. Starr & Company. Ms. Richards, as it turns out,
was the very first-ever female president of the East Bay Adjusters
Association back in the early 1980s.
