on’t even get me started…
I want to talk about hypocrisy for a minute. I don’t mean the
everyday, run-of-the-mill stuff that
we see all the time. I am talking
about the “height” of hypocrisy here.
We’ve all had to deal with those
folks who hate us… you know the
ones who say how bad fraced gas
is for the environment just before
they leave to drive home to their
warm house, gas stove and motorized lawn equipment. Actually, I do
want to share a
story about that
convictions
scenario…
as his wallet...
I was at a
professional
after-work function in Buffalo and
met an attorney who asked what I
did for a living. After telling him, he
said I probably shouldn’t talk with
his wife because she is a nurse and
they have both driven to Dimock,
PA to witness first-hand the destruction and injury to people caused by
our industry. He said they are both
staunchly opposed to fracing and
the use of fraced natural gas.
Upon hearing this, I asked him
why he supports our
industry every single day.
He looked bewildered,
and said he “has to” as
an attorney representing
certain clients. I quickly clarified my question
and said that I mean him
personally – why did HE
support us every day?
Now he was confused by
my question and had a
puzzled look on his face.
I explained that every
day he drives his car and
heats his home, mows
...
his lawn, snow-blows his driveway,
uses Tupperware, pops pills, and a
host of other activities, he is supporting the oil and gas industry. To
be specific, I asked how he heats
his home and he confirmed with
natural gas. I asked why he doesn’t
convert to solar, wind, or wood?
He responded by saying that he
couldn’t do that. Why? Because the
costs were exorbitant. Really?!!! I immediately said that he is an attorney
and doing very well for himself, and
if anyone could
run only as deep afford to partially
switch to renewables, he could! I
also pointed out
that his wish for everyone to be
off the grid would severely impact
most of society who couldn’t afford
to switch as easily as he could. I
ended our conversation by pointing
out that his convictions run only as
deep as his wallet and that is hypocritical. Needless to say, he never
circled back around to where I was
standing all evening and he never
brought his wife over to meet me.
Hypocrisy never fails to amaze
me. Take Walmart’s story. The elite
liberal left loved to hate Walmart
for its corporate greed, capitalistic
views, and indifference toward
its workers, screaming that they
weren’t paying enough and weren’t
taking care of the employees. Twice,
Walmart raised its wages and benefits in response to public pressure,
and despite their concessions,
Walmart was still the bad guy. In
April 2015 they raised wages for a
half million workers, then again for
this year they will raise their wages

for 1.2 million workers. But folks are
still not happy, so now that Walmart
is closing almost two-hundred
stores and laying off thousands of
workers, you would think the oppositionists would be happy to have
eliminated this greedy behemoth
from certain localities. They should
be dancing in the streets because
they got rid of the evil giant! But of
course, you know that they are now
painting Walmart as the bad guy
once again saying they are insensitive and terrible because they are
forced to lay off workers and close
stores. When someone is hypocritical,
they will always play both sides,
conveniently justifying their actions
no matter what – all while turning
away from the mirror.
I could also mention Sanders,
Hillary, Cuomo, and Obama stating
with conviction that the constitution
is clear and shouldn’t be conveniently
interpreted when it comes to the
president nominating a supreme
court justice during his last year in
office. I agree that the constitution
shouldn’t be conveniently interpreted
for this purpose… or for the second
amendment! But they conveniently
are not consistent on these two
issues. Yep – hypocrisy at its finest.
Or Hillary stating that large
campaign contributions don’t sway
policymaking, and pointing out that
Obama went after Wall Street after
the 2008 banking meltdown despite
having received large funding from
Wall Street. She also defended
her speaking fees (aka campaign
contributions) from Goldman Sachs
and others, saying that these large
political donors do not impact policy.
But, just listen to what she says
about the Koch Brothers, or about
the NRA on the Republican side –
again… terribly hypocritical.
But, I said I wanted to talk about
the “height of hypocrisy” so here it
is. IOGANY receives a magazine
called City and State. It is a largely
left-leaning political publication out
of Albany that highlights politicians
and influential people in New York,
legislation, social programs, etc.
We subscribe to it because I believe

we should always be educated about
the mindset and activities of our
adversaries.
In the last issue there is a q&a
interview of the actor James Cromwell.
Cromwell played the farmer in the
movie “Babe”, starred in “American
Horror Story: Asylum” and has made
other movies. He is also an activist,
protested the Vietnam war, and most
recently got arrested for blocking
the entrance to a natural gas power
plant under construction in Orange
County, NY.
First question: “Why are you
opposing this power plant?”
Answer: “It affects not only my community and where I live in Warwick,
but it also affects the health and
well-being of the people of Orange
County and to some degree, the people of the State of New York and the
entire country and the entire world.”
(he forgot the solar system… and the
universe… and parallel universes)
He went on to talk about how the
power plant “is fraught with the possibility of disaster and endangerment
of local people.” He also said the
movement to ban fracking was “incredibly well-organized (can’t argue
that) and supported, but also because of some politics up in Albany.
But they left out the “use” of fracked
gas. It doesn’t make any sense to
me or to anybody in this community why you would ban fracking
and then turn around and use the
product of fracking to run a power
plant in New York.” He went on to
say that we don’t need fracked gas to
produce electricity “because we have
a surplus.” Ughhh! But wait, it gets
even better!
Second question: “So you’re
saying New York is being hypocritical by banning fracking but
allowing the use of fracked gas in
the state?”
Answer: “It is hypocritical, but
you have to look at the money.”
UGGGHHHHHHH!!!!!!! The height
of hypocrisy to me is when a person
points out hypocrisy without look2
ing in the mirror! He accuses New
York of being hypocritical because
they banned fracing and still use the
energy produced from fracing (I agree
- that is hypocritical), but he never
acknowledges that he and millions of
New Yorkers and people all over the
country and the world (and parallel
universes) are doing the same thing!
He drives, heats his home, mows his
lawn, uses Tupperware, enjoys the
warmth of shopping malls and uses
his eco-friendly products that have
been manufactured using natural gas
as a feedstock energy source, and
never points out his own hypocrisy!
IOGANY has spent countless
dollars and man-hours fighting our
regulatory and legislative battles over
the last seven years. We have lost
temporarily to the well-organized and
well-funded opposition groups. But
we now hope to do what we can to
expose the hypocrisy of actors like
Cromwell and others, but mostly the
hypocrisy of the every-day people
across the state who benefit daily
from the very product they disdain.
I am not sure how we’re going to do
it, but we are working on some ideas
that we’ll share with the members
when the time is right. We have no
delusions of victory or even making a
big dent in the situation here in New
York. But, if we can make even a
small impact and get people talking
about the reality of natural gas use
in New York, and how it makes no
sense to oppose something that you
use regularly and heavily rely upon
every day, then we can at least say
we tried.
I just wish more people, like that
attorney I enlightened, would at least
come to realize the positive impacts
on their lives that natural gas and
oil have made through the years. I
recently talked with Mark Mathis, a
film producer who I met years ago
and have grown to respect, both
personally, and for the quality of his
work. Mark just completed his latest
film project – a movie titled “Fractured; Language, Lies, and Energy”.
I watched the film and it brings up
some very good points about how

naïve the general public is about energy and how their lives
wouldn’t be the same without it. We hope to host a showing
of this film at an upcoming meeting, and plan to have copies
of it available for purchase to support Mark’s efforts.
So, let’s all continue doing what we can individually in the
course of our everyday lives when we engage people who
don’t understand our industry. Let’s point out the hypocrisy
that each of them engage in when they bash fossil fuels in
favor of renewables. At least we stand proudly in support of
our industry and aren’t afraid to look in the mirror!!

natural gas oversupply situation is

favorable economics of coal-to-gas
switching, are the two major reasons
power burn is up despite warmer temperatures.
According to a report from Bentek
Energy, “Assuming the retired coal
plants were previously running at a
60% capacity
factor, and that
the new replacement gas
operates at a
7.5 MMBtu/MWh
heat rate, about
1.63 Bcf/d of the
increased gas
demand is from
gas-fired power
plants filling in for
the lost baseload
coal capacity.”
This means that
just under half of
the increase can be
attributed to the 15
MW of coal capacity
retirements in 2016,
and the other half,

currently burning 71% more natural gas to generate power than

demand for natural
gas than it did last

The increased
demand for natural
gas in the power sector has certainly has a tremendous economic
effect on the cost of electricity for
the end user. With coal and nuclear
facilities continuing to be shut down
across the country, natural gas’ role
in power generation will continue
to grow. With ample supply, and an
increasingly solidified infrastructure,
electricity will continue to be supplied
reliably, and at low cost, for years to
come.

ecent market conditions
and low energy prices have
created significant financial pressure
on many companies in the oil and
gas industry, both in New York and
nationally. As a result, some oil and
gas production companies have
filed for bankruptcy and others may
be forced to consider that option in
coming months. One factor that a
company considering bankruptcy
needs to be aware of is that well
plugging liability under the New York
State Environmental Conservation
Law (“ECL”) may survive a filing for
federal bankruptcy protection, and
can become the personal liability of
the principal owners or officers of a
bankrupt company.
Article 23 of the ECL and Title 6
of the NY Codes, Rules and Regulations states that it is “unlawful for
any owner or operator to abandon
any well, wells or lease without
having plugged and abandoned such
well…” (6 NYCRR §555.1). The cost
of properly plugging and abandoning an oil or gas well can be quite
significant, and may far exceed the
financial security bond or deposit
that well operators are required to
maintain with the New York State
Department of Environmental Conservation (“DEC”). If a struggling oil
and gas production company files
for bankruptcy, the cost of plugging
its uneconomic wells may exceed
the amount of both the financial
security and the available assets of
its bankruptcy estate. The federal
bankruptcy code will shield owners

from most debts of a company that
files for protection, but does not address liabilities for compliance with
laws and regulations. Such liabilities
can potentially survive bankruptcy,
and may attach to individuals who
are responsible for the company’s
compliance.
The DEC has not issued regulations or clear policies addressing
whether it will pursue individual
owners or officers of a bankrupt
company for unfunded plugging
liability. However, the unofficial position that the DEC takes is that failure
... “responsible officers” can be
held liable.
to properly plug and abandon an oil
or gas well is a violation of the ECL,
for which both a business and its
“responsible officers” can be held liable. If a violation of the ECL requires
cleanup or remediation, the DEC
will first pursue the business, but
will also seek an enforcement action
against any potentially responsible
persons or parties with significant
assets. Several decisions of the
DEC commissioner illustrate this
approach (In the Matter of Carney’s
Restaurant, Inc., DEC Case No. R520070221-671; and In the Matter of
Supreme Energy Corporation, DEC
Case No. 7-1780), where individual
business owners were found liable
for penalties and remediation costs
for violations of the ECL by the business.
These cases did not involve oil and
gas production, but demonstrate a
willingness by the DEC to pursue
owners for environmental liabilities of their businesses. The DEC
has also commenced enforcement
actions against the individual owner
of a dissolved company that was
the last registered operator of an
unplugged well, asserting various
violations of the ECL relating to
reporting, financial security and well
operations.
The DEC’s argument is that the
“responsible officer doctrine,” also
sometimes known as the “responsible corporate officer doctrine,” applies to make individual officers with
significant control over the actions
of a corporate entity jointly liable for
strict liability offenses by the company. This doctrine is an established
feature of federal common law and

Joint Landowners Coalition of NY
(JLCNY), took place on Saturday,
January 23rd, at The River Club of
Afton, Afton, New York.
The turnout was terrific with nearly
400 attending from Labor,
Landowners, the Business Community, and
Local and State Leadership. Eleven spoke representing the attendees.

The Afton rally followed
a vigorous ‘Postcard to
Cuomo’ campaign which
saw almost 13,000 postcards signed
and sent to the governor in support
of the Constitution Pipeline.
This project means jobs for idle labor union members, some of which
are running out of their unemployment insurance. In fact, 2400 jobs
and $130 million in labor income
would be generated from the Constitution Pipeline project.
It will also generate $13 million in
annual property tax revenue. Approximately 60% will be paid directly
to benefit local school districts along
the Constitution Pipeline route, lowering the tax burden for residents.
There are 2.5 million miles of
pipeline in the US. The NYS Energy
Plan states that NY needs additional
pipelines, and the 125-mile Constitution Pipeline is part of that plan.

by Leatherstocking Gas Company,
LLC. This will benefit homes, businesses, and schools in New York’s
Southern Tier as increased natural
gas use has in Northern PA.
The Constitution Pipeline received
Federal Energy Regulatory Commission (FERC) approval for the project
on 12-02-14. The project is currently
awaiting the Section 401 Water Quality Certification from the NYS DEC
and the Clean Water Act Section 404
permit from the US Army Corps of
Engineers.
On 02-03-16, FERC authorized the
limited tree felling activities along the
pipeline right-of-way in PA. FERC
has not yet authorized tree felling for
the NY portion of the project. This
construction work space to fell trees
is between November 1st and March
31st. Missing this window is more
needless delay.

a letter recently submitted to Governor Cuomo by Armand Sabitoni,
LiUNA’s General Secretary Treasurer
and New England Regional Manager. In his letter, Sabitoni states: “I

voluminous reports clearly justify
the issuance of the appropriate NYS
DEC permits for this project.”

job. He said, “The Mission of the DEC
is to protect the environment AND
maintain a vital healthy economy. They
are not mutually exclusive, they are

spend 10’s of millions of dollars in PA.

Obama’s proposed $10-per-barrel tax on oil is not going to
happen during his presidency, if Sanders were to become
president, it is possible circumstances could arise that would
allow him to implement that tax, which of course would be
extremely damaging to oil companies. Sanders is also in
favor of a tax on carbon emissions which would have wide
ranging impacts for numerous businesses across a variety of industries. By and large then, a Sanders presidency
would likely be harmful for most major U.S. manufactures
and energy companies.
Michael Bloomberg
If Michael Bloomberg does end up entering the race and
running for President it could certainly throw both political
parties into turmoil. Should Bloomberg become President,
it’s likely that he would represent a middle ground between
anti-renewables policies of the Republicans and anti-conventional energy policies of the Democrats. Bloomberg has
certainly shown support for climate initiatives and environmental concerns. The coal industry, however, would not be
spared. Bloomberg has spent a lot of money trying to kill off
coal plants in the United States.
However, Bloomberg has also shown a steak of non-ideological pragmatism that includes being willing to approve
the Keystone XL pipeline under certain conditions. Given
that pragmatism and his reputation as a centrist, Bloomberg
would likely have a positive impact on both conventional
energy companies and renewables firms alike.

ecent market conditions
and low energy prices have
created significant financial pressure
on many companies in the oil and
gas industry, both in New York and
nationally. As a result, some oil and
gas production companies have
filed for bankruptcy and others may
be forced to consider that option in
coming months. One factor that a
company considering bankruptcy
needs to be aware of is that well
plugging liability under the New York
State Environmental Conservation
Law (“ECL”) may survive a filing for
federal bankruptcy protection, and
can become the personal liability of
the principal owners or officers of a
bankrupt company.
Article 23 of the ECL and Title 6
of the NY Codes, Rules and Regulations states that it is “unlawful for
any owner or operator to abandon
any well, wells or lease without
having plugged and abandoned such
well…” (6 NYCRR §555.1). The cost
of properly plugging and abandoning an oil or gas well can be quite
significant, and may far exceed the
financial security bond or deposit
that well operators are required to
maintain with the New York State
Department of Environmental Conservation (“DEC”). If a struggling oil
and gas production company files
for bankruptcy, the cost of plugging
its uneconomic wells may exceed
the amount of both the financial
security and the available assets of
its bankruptcy estate. The federal
bankruptcy code will shield owners

for violations of the ECL by the business.
These cases did not involve oil and
gas production, but demonstrate a
willingness by the DEC to pursue
owners for environmental liabilities of their businesses. The DEC
has also commenced enforcement
actions against the individual owner
of a dissolved company that was
the last registered operator of an
unplugged well, asserting various
violations of the ECL relating to
reporting, financial security and well
operations.
The DEC’s argument is that the
“responsible officer doctrine,” also
sometimes known as the “responsible corporate officer doctrine,” applies to make individual officers with
significant control over the actions
of a corporate entity jointly liable for

for 1.2 million workers. But folks are
still not happy, so now that Walmart
is closing almost two-hundred
stores and laying off thousands of
workers, you would think the oppositionists would be happy to have
eliminated this greedy behemoth
from certain localities. They should
be dancing in the streets because
they got rid of the evil giant! But of
course, you know that they are now
painting Walmart as the bad guy
once again saying they are insensitive and terrible because they are
forced to lay off workers and close
stores. When someone is hypocritical,
they will always play both sides,
conveniently justifying their actions
no matter what – all while turning
away from the mirror.
I could also mention Sanders,
Hillary, Cuomo, and Obama stating
with conviction that the constitution
is clear and shouldn’t be conveniently
interpreted when it comes to the
president nominating a supreme
court justice during his last year in
office. I agree that the constitution
shouldn’t be conveniently interpreted
for this purpose… or for the second
amendment! But they conveniently
are not consistent on these two
issues. Yep – hypocrisy at its finest.
Or Hillary stating that large
campaign contributions don’t sway
policymaking, and pointing out that
Obama went after Wall Street after
the 2008 banking meltdown despite
having received large funding from
Wall Street. She also defended
her speaking fees (aka campaign
contributions) from Goldman Sachs
and others, saying that these large
political donors do not impact policy.
But, just listen to what she says
about the Koch Brothers, or about
the NRA on the Republican side –
again… terribly hypocritical.
But, I said I wanted to talk about
the “height of hypocrisy” so here it
is. IOGANY receives a magazine
called City and State. It is a largely
left-leaning political publication out
of Albany that highlights politicians
and influential people in New York,
legislation, social programs, etc.
We subscribe to it because I believe

we should always be educated about
the mindset and activities of our
adversaries.
In the last issue there is a q&a
interview of the actor James Cromwell.
Cromwell played the farmer in the
movie “Babe”, starred in “American
Horror Story: Asylum” and has made
other movies. He is also an activist,
protested the Vietnam war, and most
recently got arrested for blocking
the entrance to a natural gas power
plant under construction in Orange
County, NY.
First question: “Why are you
opposing this power plant?”
Answer: “It affects not only my community and where I live in Warwick,
but it also affects the health and
well-being of the people of Orange
County and to some degree, the people of the State of New York and the
entire country and the entire world.”
(he forgot the solar system… and the
universe… and parallel universes)
He went on to talk about how the
power plant “is fraught with the possibility of disaster and endangerment
of local people.” He also said the
movement to ban fracking was “incredibly well-organized (can’t argue
that) and supported, but also because of some politics up in Albany.
But they left out the “use” of fracked
gas. It doesn’t make any sense to
me or to anybody in this community why you would ban fracking
and then turn around and use the
product of fracking to run a power
plant in New York.” He went on to
say that we don’t need fracked gas to
produce electricity “because we have
a surplus.” Ughhh! But wait, it gets
even better!
Second question: “So you’re
saying New York is being hypocritical by banning fracking but
allowing the use of fracked gas in
the state?”
Answer: “It is hypocritical, but
you have to look at the money.”
UGGGHHHHHHH!!!!!!! The height
of hypocrisy to me is when a person
points out hypocrisy without look2
ing in the mirror! He accuses New
York of being hypocritical because
they banned fracing and still use the
energy produced from fracing (I agree
- that is hypocritical), but he never
acknowledges that he and millions of
New Yorkers and people all over the
country and the world (and parallel
universes) are doing the same thing!
He drives, heats his home, mows his
lawn, uses Tupperware, enjoys the
warmth of shopping malls and uses
his eco-friendly products that have
been manufactured using natural gas
as a feedstock energy source, and
never points out his own hypocrisy!
IOGANY has spent countless
dollars and man-hours fighting our
regulatory and legislative battles over
the last seven years. We have lost
temporarily to the well-organized and
well-funded opposition groups. But
we now hope to do what we can to
expose the hypocrisy of actors like
Cromwell and others, but mostly the
hypocrisy of the every-day people
across the state who benefit daily
from the very product they disdain.
I am not sure how we’re going to do
it, but we are working on some ideas
that we’ll share with the members
when the time is right. We have no
delusions of victory or even making a
big dent in the situation here in New
York. But, if we can make even a
small impact and get people talking
about the reality of natural gas use
in New York, and how it makes no
sense to oppose something that you
use regularly and heavily rely upon
every day, then we can at least say
we tried.
I just wish more people, like that
attorney I enlightened, would at least
come to realize the positive impacts
on their lives that natural gas and
oil have made through the years. I
recently talked with Mark Mathis, a
film producer who I met years ago
and have grown to respect, both
personally, and for the quality of his
work. Mark just completed his latest
film project – a movie titled “Fractured; Language, Lies, and Energy”.

on’t even get me started…
I want to talk about hypocrisy for a minute. I don’t mean the
everyday, run-of-the-mill stuff that
we see all the time. I am talking
about the “height” of hypocrisy here.
We’ve all had to deal with those
folks who hate us… you know the
ones who say how bad fraced gas
is for the environment just before
they leave to drive home to their
warm house, gas stove and motorized lawn equipment. Actually, I do
want to share a
story about that
convictions
scenario…
as his wallet...
I was at a
professional
after-work function in Buffalo and
met an attorney who asked what I
did for a living. After telling him, he
said I probably shouldn’t talk with
his wife because she is a nurse and
they have both driven to Dimock,
PA to witness first-hand the destruction and injury to people caused by
our industry. He said they are both
staunchly opposed to fracing and
the use of fraced natural gas.
Upon hearing this, I asked him
why he supports our
industry every single day.
He looked bewildered,
and said he “has to” as
an attorney representing
certain clients. I quickly clarified my question
and said that I mean him
personally – why did HE
support us every day?
Now he was confused by
my question and had a
puzzled look on his face.
I explained that every
day he drives his car and
heats his home, mows
...
his lawn, snow-blows his driveway,
uses Tupperware, pops pills, and a
host of other activities, he is supporting the oil and gas industry. To
be specific, I asked how he heats
his home and he confirmed with
natural gas. I asked why he doesn’t
convert to solar, wind, or wood?
He responded by saying that he
couldn’t do that. Why? Because the
costs were exorbitant. Really?!!! I immediately said that he is an attorney
and doing very well for himself, and
if anyone could
run only as deep afford to partially
switch to renewables, he could! I
also pointed out
that his wish for everyone to be
off the grid would severely impact
most of society who couldn’t afford
to switch as easily as he could. I
ended our conversation by pointing
out that his convictions run only as
deep as his wallet and that is hypocritical. Needless to say, he never
circled back around to where I was
standing all evening and he never
brought his wife over to meet me.
Hypocrisy never fails to amaze
me. Take Walmart’s story. The elite
liberal left loved to hate Walmart
for its corporate greed, capitalistic
views, and indifference toward
its workers, screaming that they
weren’t paying enough and weren’t
taking care of the employees. Twice,
Walmart raised its wages and benefits in response to public pressure,
and despite their concessions,
Walmart was still the bad guy. In
April 2015 they raised wages for a
half million workers, then again for
this year they will raise their wages
