PLANNING COMMISSION STAFF REPORT MEETING DATE: APPLICANT: ADDRESS: REQUEST: ZONE: FILE NUMBER: 18 June 2015 The Thackeray Garn Company Fine Drive between 700 West and Approximately 1100 West Subdivision Plat Amendment Adding 3 Lots to the Existing Riverfront Master Planned Mixed Use Subdivision Master Planned Mixed Use S-15-005 SYNOPSIS: On June 5, 2015, the Thackeray Garn Company filed an application to amend a subdivision plat for the Riverfront Master Plan Mixed Use Subdivision, initially approved by the Planning Commission on 5 June 2014. The amendment proposes a further subdivision of the flex office space, lot 2 on the north side of Fine Drive, into three lots, to allow for sale to future end-users of the flex office space. This petition is in response to a minor modification to the Riverfront MPMU site plan, which will eliminate the need for angled parking in front of the flex office space. The applicant will be required to vacate excess right-of-way along Fine Drive established in the initial subdivision. Right-of-way vacations are subject to approval of the City Council, which will need to happen prior to recording of the amended subdivision plat. This application falls under the requirements of a subdivision plat amendment as found in §15.12.490 of the South Salt Lake City Municipal Code. Section 17.07.040 of the code establishes the Planning Commission as the Land Use Authority over subdivision plat approvals. SUMMARY: The amendment will further subdivide Lot 2 of the Riverfront Master Plan Mixed Use subdivision into 3 lots. Splitting the lot will improve the situation for current businesses in the City and is compatible with the General Plan and supports goal ES-2. Recording of the amended plat will require vacation of a portion of Fine Drive. Staff recommends approval. Staff Recommendation: Staff recommends approval of the amended Riverfront Master Planned Mixed Use Subdivision, subject to following conditions: 1. The applicant will continue to work with City staff to make all technical corrections necessary for recording. 2. The applicant will record a street vacation of a portion of Fine Drive prior to recording the subdivision plat. 3. All items of the staff report. General Information: Location: Fine Drive between 700 West and Approximately 1100 West Size: The existing property is approximately 4.5 acres. The proposed Lot 1, fronting 300 West, will be 1.5 acres. Proposed Lot 2, fronting 3300 South, will be 2.98 acres. Surrounding Zoning and Land Uses: North: Light Industrial / UTA Facility South: Master Planned Mixed Use / Riverfront Apartments East: Master Planned Mixed Use / Riverfront Flex Office Lot 1A West: Master Planned Mixed Use / Riverfront Flex Office Lot 3A. Access: The new Lots 2A through 2C will have access via Fine Drive, Carlisle Avenue, and 900 West. Compatibility with the General Plan and the Riverfront MPMU Design Standards: The future land use map designates this area as future mixed use/transit-oriented development. Additionally, the Plan includes a goal (ES-2) that states, “Improve the economic situation of the residents and employees by working to increase disposable incomes and assets; and improve the situation of businesses in South Salt Lake by working to increase their profitability and expansion potentials.” The purpose of this subdivision is to create buildable lots for sale to developers of flex-office space, allowing them to plan build-to-suit projects for end users. The Riverfront MPMU Design Standards, an adopted master plan and ordinance, will apply to all new construction in the Riverfront development. Lot Requirements: Lot requirements for all developments are established in §15.12.640 of the South Salt Lake City Municipal Code. All developments are required to result in the creation of lots or building sites which are developable and capable of being built upon. A development should not create lots or building sites which would make improvement impractical. This subdivision does not alter the existing frontages or access on either property. Water: Provided by the Jordan Valley Water Conservancy District. Sewer: Provided by the Mount Olympus Improvement District. Site and Building Requirements: Any new construction on the parcel will be subject to the commercial design review requirements, the landscape standards, parking standards, and site development standards found in the Riverfront MPMU Design Standards and South Salt Lake City Municipal Code. Fire Code Requirements: The South Salt Lake Fire Marshal reviewed a concept plan for the subdivision, and evaluated the status of the existing strip mall on 300 West, the back wall of which is on a property line. The rear wall has been found to have an appropriate fire rating for a building that sits on a property line. The final plat will be subject to review by the South Salt Lake Fire Marshal. Requirements: 17.07.040. Land use authority designations. Pursuant to state law, the following administrative land use authority designations are made: C. Planning Commission. The planning commission is the land use authority on issues of: subdivision and subdivision plat approval, except planned unit developments; vacating, altering or amending a subdivision plat; category II conditional use applications; and the issuance of a building or demolition permit in a historic and landmark district. 15.12.520 - Requirements. A. Except as noted herein, minor developments must meet all applicable ordinance and specification requirements. Development approved variations from city ordinances or specifications may only be accomplished by approval as a PUD or other specific development type. B. The development plan must be in compliance with all city ordinances, specifications or regulations, or a variance must be granted from such requirements by the administrative law judge. The planning commission may approve a minor development subject to obtaining a specific variance from the administrative law judge. If such specific variance is not obtained, the approval is null and void. C. The planning commission may require as part of the approval of the minor development any improvements and/or public facility and/or utility or access easements that are required of other developments, as set forth in this chapter. Such easements or dedications must be recorded prior to the issuance of any permits for the development and before any improvements are commenced. D. The development must still comply with all other relevant portions of this title including bonding requirements. 15.12.640 - Lots and building sites. A. All developments should result in the creation of lots or building sites which are developable and capable of being built upon. A development should not create lots or building sites which would make improvement impractical due to size, shape, steepness of terrain, location of watercourses, problems of sewerage, driveway grades, or other physical conditions. B. All lots or parcels created by a development shall have frontage on a public or private street, improved to standards hereinafter required, equal to at least the street's minimum required width. Land designated as public or private street right-of-way shall be separate and distinct from lots adjoining such street right-of-way and not be included in the area of such lots. C. For purposes of all new improvements, all lots shall be considered to have yard areas which shall meet the requirements of the respective zones and such yard area designations shall be made by the community development department for all lots in the city at the time of any requested improvement of said lot. Staff Analysis: The proposed subdivision meets the standards for a minor commercial subdivision. Staff finds that by creating buildable parcels aligned with current uses, the proposed amendment is in compliance with the South Salt Lake Municipal Code, the Riverfront MPMU Design Standards, and General Plan Goals. Staff Recommendation Staff recommends approval of the amended Riverfront Master Planned Mixed Use Subdivision, subject to following conditions: 1.
