Present: Mayor Foster, Vice Mayor Jewitt, Council Member Anderson, Council Member Kelley,
Council Member Crooks, Council Member Workman, Council Member Orgeron.
APPROVAL/AMENDMENT OF AGENDA:
Motion: Approve agenda as presented, Action: Approve, Moved by Vice Mayor Jewitt,
Seconded by Council Member Anderson.

REPORTS & ANNOUNCEMENTS:
Mayor Foster Welcomed Council Member Kelley back.
Council Member Anderson commented on the parade that it was short and sweet and she would
like to thank those who attended and the grand opening of the Community Center. Hours for the
community Center will be 8 am to 8 pm.
Vice Mayor Jewitt stated that Zumba classes were already being held there.
CONSENT AGENDA:
1. Approve ledger of accounts paid (Check Series 34903-34953/total = $89,779.93).
2. Approve Minutes of Special Meeting January 2, 2013

1. Executive Session
• An executive session pursuant to A.R.S. 38-431.03(A)(l) for discussion or
consideration of the employment and appeal of dismissal of Martin Brannan as Town
Attorney.
• An executive session pursuant to A.R.S. 38-431.03(A)(3) for legal advice with
special counsel for the Town regarding the appeal of dismissal and terms of the
employment contract of Martin Brannan as Town Attorney.
• An executive session pursuant to A.R.S. 38-431.03(A)(4) for discussion and
consultation with special counsel for the Town regarding the Town's position and to

instruct special counsel regarding the employment contract of Martin Brannan as
Town Attorney.

Motion: To adjourn into executive session, Action: Approve, Moved by Vice Mayor Jewitt,
Seconded by Council Member Anderson. Council Member Workman made comment to make a
recording and have a permanent record preserved until the matter is settled with Martin Brannan.
Council Member Workman's Motion: The Council preserve the audio recording of this proposed
Executive session for future litigation purposes and thereby protect the potential due process
review and rights of a terminated employee, until such time as the matter of Martin Brannan
determination and all litigation matters. Second by Mayor Foster. Interim Town Manager stated
that the Executive sessions were recorded and has been since she spoke to the Attorney
General's Office. Council Member Workman removed her motion. Mayor Foster asked for a
second on Vice Mayor Jewitt's first motion. Second by Council Member Crooks.

Meeting was called to order at 3:06PM by Chairman Bruce Swart.
Present were: Chairman Bruce Swart, Vice Chairman Kay Mooring, Board
Members; Deanna (Dee) Sheehan, Eileen Lunsford and Sandy Scott. Also
present was Staff; Dinice Ross, Guests; Floyd Anderson, Councilwoman Pat
Anderson and Special Guest; Emmett Brinkerhoff from Public Works.
Absent were Board Members; Art Larsen and PJ Bettmann.
No one had November 5th, 2012 meeting minutes. This item will be put on
January's Agenda to be read and approved.
OLD BUSINESS:
1. Kofa Entrance -Emmett Brinkerhoff was here to discuss the
Entrance off of Kofa into the Cemetery. Discussed was the design
of the entrance. Before he can go forward with the design, the
board members will have to clarify one specific design so the
engineers can draw up the specifics. Also discussed was how
much is budgeted for the road in and entrance - if we still have the
grant money available and if there are other funds available. Dinice
Ross will find out about the grant money, how much it is and when
it expires. Bruce Swart made the motion to postpone this item
until next meeting or to call an emergency meeting to act upon if
time is short with the grant. Eileen Lunsford seconded the motion.

2. BLM Expansion. Dinice Ross reported that she and Town
Manager Laura Bruno had a phone conference Friday November
30th at 1:30PM in Laura's office with BLM officials regarding the
65 acre cemetery expansion. The application will have to be
redone eliminating wording that has to do with "park". BLM
would like more mapping that shows the correlation to the town of
Quartzsite- as soon as possible so they can get it on their 2013
calendar. This item will be put on the Agenda as it goes forward.

Cemetery Pioneer ??? . He also suggested bringing in a person
from the audience to interact with the player. Every board member
had good ideas and input. It was also suggested that a couple of
rehearsals would help. Motion passed unanimously.
REPORTS

used during the Veterans Day service worked fine. Art Larsen had
called her and said the problem with it during the service was a
cord - not the system.
2. Dee Sheehan gave the Cemetery Board $46.50 for the Cactus sale
from Rainbow Acres October 16th at Kathy Ennis's. This money
was split with the Garden Club - Dinice Ross gave Eileen
Lunsford $20.00 of this for the Garden Clubs participation. That
left $26.50 for the Cemetery donation fund. Dee Sheehan reported
that there is more cactus left after Joann Winer came and got 2
truck loads- Dee said it is "growing". Dinice Ross will check
with Joann Winer to see if she would like to take more cactus.

Lawrence King dated November 1, 2011, the parties intend to renew the agreement for additional

The Art Guild would like to be placed on Jan. 22 Council Agenda. We have 11
3X4' Art Boards that we painted for Arizona's Centennial. These boards were
placed at strategic locations, mostly on Main Street, to represent the areas around
Quartzsite. We would like the Council to accept these donated Art Boards to the
town for the inside walls of the new Community Center. We would also like to
retain the copy rights to donate to future town projects- examples- cards to raise

Permit was necessary to give out candy at the Fair.

and safety codes and fairground policies.

All exhibits must be completely set up by 12:00 noon on Thursday, March 14, 2013. The
exhibit hall will be open Monday, March 11,2013 to Wednesday, March 13, 2013 from
9:00 a.m. to 6:00p.m. for set-up. At that time exhibitors may drive into the fair grounds.
Thursday, March 14, 2013 all items needed for booth space will have to be walked in
through the main entrance.

Violation of this rule may automatically preclude an exhibitor from obtaining an
application for the 2014 La Paz County Fair. Exhibitor may be subject to a deposit of
$1 00 or more in future years.

Exhibitor agrees to cooperate with the adjoining Exhibitors. Ifhe/she creates a
disturbance or interferes with the rights of others in any manner, he/she will be required
to give up his/her exhibitor space. Additionally, the La Paz County Fair Association
reserves the right to regulate appropriate noise levels. There will be NO SOLICITING
OUTSIDE OF YOUR ASSIGNED SPACE.
9.
The La Paz County Fair will provide one ( 1) pass to the Fair space, NO EXCEPTIONS.
If more passes are needed, they can be purchased for full price at the Fair Office. Each
exhibitor will have to assume the responsibility of issuing passes to their workers. Passes
will be checked at the gate on a daily basis.

Exhibitors shall remove all property and equipment within forty-eight (48) hours from
6:00p.m., Sunday, March 14, 2013, the day after the closing of the Fair. Any property
left after that time will become the sole property of the La Paz County Fair Association
and will be disposed of accordingly.

The La Paz County Fair Association will not be responsible for any loss and/or damage
to any exhibit or person. The Exhibitor agrees to hold the La Paz County Fair
Association, its ' agents and employees harmless from any loss, risk, cost, and expenses,
including attorney's fees, arising out of or relating to the contract, or any of the actions or
activities of the Exhibitor or any occurrences or claims associated with or arising out of
the Exhibitor's activities or occupancy of the rental space at the Fair.
12.
Exhibitors accept total responsibility for their exhibit and its safety in relation to fire,
robbery, accident or other destructive cause and to injury to the public which might occur
within the confines of the exhibit rounds. Insurance which exhibitor may desire to cover
such contingencies will be placed by exhibitor at own expense.
13.
CANCELLATIONS :
No refunds to any vendors who are accepted after February 1, 2013.
14.
Failure to meet any terms of this Agreement will result in forfeiture of space.

The La Paz County Fair Association shall have full power in interpretation and
enforcement of all terms and rules contained herein and such further rules and regulations

General Character of the Neighborhood: An inspection of the general vicinity near the subject
parcel reveals that the area consists of both SR and Commercial C-2. Therefore the applicant's
request is consistent with the general makeup of the area.
Recommendation of Town Staff: Town Staff recommends approval with the following
stipulations, conditions, and requirements:
1. Town of Quartzsite Development Procedures Ordinance Article II "Procedures" All of
Section 1.
2. Town Code Chapter 10 "Health and Sanitation" Article 10, Sections 10-1 and 10-2 apply
and will be strictly enforced. No trash, clutter, garbage or misc. materials stored, stacked
or piled on the property.
3. Town Code Chapter 12 "Traffic Motor Vehicles" Article 3-5, 4-1, 4-2, 4-3 , 5-l , 5-2, 5-3
and Article 5-5 Paragraph B will be strictly enforced. No large trucks/Semi-trucks on the
road- the road is NOT a truck route.
4. No spray painting of any vehicle or manufactures container will be allowed on the
property will be strictly enforced.
5. Noise abatement, no working noise will be allowed from 5:00PM to 8:00AM seven days
a week will also be strictly enforced.
6. Six foot high solid fencing around entire property for sound and sight barrier will be
strictly enforced.
7. The Quartzsite fire Department to do a complete inspection of the property. If their
inspection comes back with anything major, vital, or crucial issues or problems, the
Conditional Use will not be approved until the issues are addressed.
8. No paint or toxic chemicals will be stored outside of a fire proof container. Proper
disposal of toxic chemicals must be maintained at all times.
9. This Conditional Use does not stay with the property. It becomes null and void when the
property is sold. This conditional Use also, does not go with Guff and Jennifer Brown
should he move to another location.

Violet Kiss a9ked that it be put in the minutes that she asked Jesse Hearne what he meant by 25 years
licensed general contractor. " Since you stated you were a general contractor what states were you licensed
in". His reply was he was a Jogger contractor and she thinks this should be brought up to the Council.
Motion passed unanimously!
REPORTS:
Report by Beth Praast on work sessions on the Planning and Zoning Development Procedures, Planning
and Zoning Ordinances, do we want to raise current fees, do we want to update Codes from the 2006 to
the 2008 codes, and review of the General Plan.
Steve is to review the current codes and check the difference between the 2006 and 2008 codes.
Work session scheduled for Tuesday, January 29, 2012 at 4pm on ordinances that are conflicting.

Discussion/Possible Action
Douglas Ross asked GuffBrown to explain the shelters. Jim Murphy asked what the weight of the shelter
was. Douglas Ross asked if they would be stored on property or shipped out. GuffBrown stated they
would be shipped out. Dennis Kuehl asked what they would come in on. Guff Brown state a flatbed
trailer. Star asked if the autos restoration would be for him or others. He stated it was a hobby but he does
barter work for others. Bearcat asked about noise. Guff said most of the drilling would be inside a
building and not cause much noise. Starr ask about the weight of the shelter. Beth stated that Guff said
there would not be any semis on the road. Beth stated she wondered what he wasn't in compliance with
and stated it was to comply with materials at his address. The shelter pieces are about one foot wide.
Does the town get any sales tax for this.(Starr Bearcat) This is not for resale. Beth Praast read the
restriction set in the conditional use permit. Violet Kissed requested a fire inspection report be done.
Dennis Kuehl asked if he would be manufacturing or assembling. Mr. Brown said it would be
assembling. Starr Bearcat would like to have fireproof storage for flammable or toxic products. Starr
asked for a sunset clause (if he sells the property it goes back to SR). Jim Murphy stated he driv es by 3-5
times a day and never hears anything.

Discussion and Interview of Applicants to serve on the Planning
and Zoning Commission
Summary:
The Planning and Zoning Commission consists of 7 members.
Member terms are for a period of three years, with the terms
staggered such that the terms of no more than three members shall
expire in any one year.
Currently, two seats are open due to expired terms.
In addition, in February 2012, the Council approved the filling of
another seat with no stated term end date. Normally, this would
have been a three-year term, with a stated end date of January
2015.
