working to strengthen the housing market and protect our profession.

to allow bulk sales of foreclosures to investors. C.A.R. prefers that
homes are sold by REALTORS® to private parties one at a time for
the correct appraised value, rather than to investors as ‘bulk sales’
with blanket appraisals. This is a compromise position that C.A.R.
is willing to take.
That C.A.R. not oppose the sale of FHA distressed notes, and
seek amendments that a 2 year sunset date be applied to the
program. FHA has been a successful program, but there are some
distressed notes. This is a 2 year plan that seeks to make FHA healthy.

Property owners facing foreclosure often worry whether a lender
can seek a deficiency judgment against them. A deficiency is the
difference between the loan balance and the value of the property
as of the day of foreclosure. For property which is under water, the
amount of a deficiency judgment can be significant. For example,
if on the day of foreclosure the loan balance was $500,000, but the
value of the property was $400,000, the lender, under certain
circumstances, could bring legal action against the borrower for the
deficiency of $100,000.
2013. SB 1069 does not change the law relating to antideficiency
protections for purchase money loans, but amends the law applicable to refinancing purchase money loans.
The new statute expressly states that no deficiency judgment is
available on any loan, refinance, or other credit transaction that is
used to refinance a purchase money loan. This exemption applies
to subsequent refinances of the refinanced loan. Additionally, the
costs of refinancing (fees, costs, and related expenses) are also
exempt from deficiency. However, a cash-out is not given antideficiency protection, but the presence of a cash-out portion does not
completely eliminate antideficiency protection. The end result of
a transaction involving a "cash out" is that a refinanced loan may
have a portion which has antideficiency protection, and a portion
which does not have antideficiency protection.

the rules applicable to purchase money loans, a lender cannot seek
a deficiency judgment against the borrower if the lender forecloses

In the past you have been asked to “donate” or “contribute” to
our REALTOR® Action Fund (RAF). This year I am asking
you to INVEST in the REALTOR® Action Fund. We INVEST
in our businesses to insure that we stay healthy. The same is
necessary for our industry. When times are good cities, counties, state and legislators look to real estate as a money
solution. When times are bad cities, counties, state and legislators look to real estate as a money solution. The dollars you

protecting private property rights and the preserving the ability for unburdened property ownership, whether it is residential or commercial.

RANCHO DEL MAR CENTER – Aptos Safeway Project
The LGR Committee of the Santa Cruz County Association of
REALTORS® hosts an informational update on the Rancho Del
Mar Center – Aptos Safeway project on Friday. We hosted the first
one this past June. Charles Eadie from Hamilton Swift Land Use &
Development made the presentation. They are seeking REALTOR®
input as they progress.

MORE THAN 241 TAX AND BOND MEASURES ON LOCAL BALLOTS IN NOVEMBER
According to the California Taxpayers Association, when Californians go to the polls November 6, they will decide the fate of more
than 241 local bond and tax measures, including proposed taxes on
property, sales, hotel bills, marijuana, utilities, card rooms and

It’s a trifecta! The Giants won the World Series, The Forty-Niner’s
are in first place in their division, and the Santa Cruz County
Association of REALTORS® Oktoberfest went off without a
hitch! On Thursday, October 11th, REALTORS® and Affiliates
gathered to celebrate the season and enjoyed live music, sausages,
beer, and camaraderie with fellow members. The stein holding
contest was enthusiastically contested with five strong men and
five strong women vying for wins in their respective classes. Try
as they might they could not outlast last year’s winners, Jose
Mendoza, and Jennifer Lyng Watson who held on for the repeat
win. I for one decided it’s time for some shoulder work at the gym!
Events such as this really go a long way towards creating community and fellowship, and they cannot happen without countless
volunteers organizing, setting up, cooking, serving, and cleaning up. I must say we have an awesome group of people from the
Association that get these events done, and done well!
And speaking of volunteers and community service, October provided some prime examples of our REALTOR® community serving those in need. The Women’s Council of REALTORS® held a
fundraising event in conjunction with Hot Rods at the Beach to
raise funds for the family of Carrie McCoid. The Women’s Council
of REALTORS® should be commended for doing a great job and
providing assistance to Carrie’s family. The Santa Cruz Association of REALTORS® Housing Foundation held their fundraising
event, ‘A Taste of Santa Cruz’ at the Cocoanut Grove Ballroom on
October 25th to raise funds to help first time home buyers in Santa
Cruz County cover closing costs. Events like these speak volumes
regarding the level of volunteerism and community service our
industry puts forth and we should all be proud of ourselves, our
friends, and our community!

New Policy Implemented for Square Footage Data
This summer, the MLSListings’ Rules Committee and Board of
Directors approved a policy change requiring a building’s square
footage be included when listing a residential property in the MLS.
Brokers and agents will be responsible for ensuring this information accompanies any listing that is entered in the MLSListings
service.
MLSListings’ technical staff is in the process of implementing the
necessary system changes to facilitate the input of square foot
information during the listing input process. The change is slated
to take effect mid-October, and Brokers will be notified once this
is in place.
Previously, the MLS system would auto-populate a property’s
building square footage by “Assessor” for the APN. However, this
data was not always available in the tax data that MLSListings
uses. If it was not available, the MLS would not publish any value
and the listing would show “—“ or ‘no value.’
those searching for properties by square footage – and those who
search this way for statistical purposes – were not seeing these
listings.
With the required addition of building square footage, an agent will
not be able to submit a listing until they enter a reliable value in the
data field. When entering a listing on the system, the property’s
APN will auto-populate from tax data if the MLS has it from the
County. The agent also can request that MLSListings use the
Realist data as “by Assessor” if the listing does not auto-populate
but the data is available in the Realist application. Please note that
this request will take at least 48 hours to process.
However, the listing agent can change the source of the data they
enter to “by seller,” “by agent” or “by paid vendor.” Additionally,
a disclaimer, such as “square footage not verified,” will be added
to all listings.
This is an important policy change that will make the MLS data

Homes & Land, are two such individuals that have both of these qualities.
Jeff McCormac , on the left in the photo to the left, always has the Foundation in mind. This
year alone he has contributed funds via Wells Fargo’s Matching Fund Program , Ping Pong
Fundraising Event, and by sponsoring our ‘A Taste of Santa Cruz ‘ fundraising event at the
Gold Level. Jeff additionally contributed much time and effort to promoting and encouraging
ticket sales.
Lela Willet has consistently contributed funds via our Escrow Contribution Program over
the years and sponsored ‘ A Taste of Santa Cruz. Serving as a Foundation Trustee, Lela
knows what a difference these contributions make.
Both of these individuals make it a point to put the effort into helping our neighborhoods
become stronger by helping first time homebuyers achieve the dream of homeownership.
