It may be the fastest and most efficient way of sending information in a given situation. Reports show that texting among physicians is widespread and that they are texting clinical information — whether it is legal to do so or not. Physicians who text each other clinical information risk exposing themselves to privacy and security violations of the Health Insurance Portability and Accountability Act (HIPAA.) HIPAA-compliant text messaging Message content can include patient information, such as diagnosis, test results, or medical history. Physicians can also add a high-resolution image of an EKG, an x-ray, lab report, or anything that can be photographed with a smartphone to the message. DocBookMD is a physicians-only smartphone app that allows physicians to: • sendHIPAA-complianttextmessages and photos; • assignanurgencysettingtooutgoing text messages; • searchalocalpharmacydirectory;and • searchalocalcountymedicalsociety directory (including email addresses and photos). Messages can be sent using the app’s messaging priority system. Physicians can assign each message a 5-minute, 30-minute, or normal response time. “If the recipient does not answer the message within 5 minutes or if the message does not get to the doctor, you will then get a message back stating that it did not make it,” says Dr. Gueramy. “You can see thatthemessageyoureceiveisdifferent from any other text.” All messages sent using DocBookMD meet HIPAA’s requirements for encryption and the security of protected health information. This is accomplished through technology that keeps everything encrypted on the DocBookMD server. Messages are not downloaded to the phone, but are viewed from the phone. “DocBookMD allows you to look up another doctor at the point of care. Handler Executive Vice President, Dade County Medical Association D octor Beny Rub’s year as your president was over on June 16, 2012, when Doctor Elizabeth Etkin-Kramer took over as the President of the Dade County Medical Association. a combination of all of the above – and more. Each president is unique and brings a unique perspective to the presidency and how to do what is best for the medical profession and patients. What impels a physician to be President of the DCMA? This year went by very quickly. It was an exciting year, and a lot was accomplished – most notably the interaction with hospital medical staffs. Doctor Rub and others on the DCMA Board and Executive Committee attended every hospital medical staff meeting that welcomed DCMA leadership to address physicians. Doctor Etkin-Kramer’s goal is to do the same. The DCMA wants to keep you educated, informed and engaged. If given the opportunity, I hope you will thank Doctor Rub for all he has done, and will continue to do; and thank Doctor Etkin-Kramer for her commitment to work hard on your behalf over the next year. Is it faith that what you are doing is right, and that right always wins out in the long run? Is it the belief that the actions taken during your presidency will benefit physicians and patients alike? Perhaps it is the loyalty and love of the profession of medicine and your patients? Or is it all of these . . . and more? Not sure what Doctors, Etkin-Kramer, Rub and other past presidents feel impelled them to be DCMA President, but from my perspective it is The best way to predict the future is to create it yourself! That means you need to do your part. First off, please be sure to read Miami Medicine every month; DCMA is one of a handful of medical associations still publishing a monthly magazine. The contents are carefully chosen with you in mind. Next, please read the emails sent to you. Again, they are chosen with you and your practice in mind. They also educate and keep you informed. Less frequently, faxes are sent to you. But those are important also. Everyone likes a different form of communication and the DCMA goal is to give you a little of each. Some DCMA communications advise on seminars and events designed to educate your staff, pass those along to your office manager. Go to the DCMA website – www.miamimed.com – the site contains a myriad of information about the DCMA, benefits, events, vendors of choice, etc. Many vendors provide significant savings for you in your practice. Last, but not least, how about you getting involved in the DCMA? Voice your opinions and ideas, and speak out on behalf of organized medicine and your patients; make a commitment to serve on a DCMA committee. Encourage your colleagues to join. and formulate legislative issues of concern to physicians in Miami-Dade County. Meet as a group 2-3 times a year. The effectiveness of the DCMA in meeting your needs depends, to a great extent, on membership and committees. Political Action Committee - This is an independent, autonomous organization. The 25 member Board of Directors is appointed by the DCMA Board of Directors. The DCMA PAC Board meets as needed, most often during election years. Candidates running for a Florida legislative seat from Miami-Dade County are interviewed by the DCMA PAC Board, and the PAC Board determines financial campaign contributions and voting recommendations to the membership. Committees include: Continuing Medical Education Committee - This committee is responsible for joint sponsoring/ accrediting quality continuing medical education programs with outside entities such as hospitals, medical facilities, specialty societies, etc. Most work is done at your own office or home. The committee meets on an as needed basis. Key Contact Physicians/Legislative Committee This committee has 2 components. Key Contact Physicians are physicians who are knowledgeable about the DCMA/FMA legislative agenda and are assigned to meet with a specific legislator(s) during the year and during the Florida legislative session. Generally these physicians are known to the legislator, or establish a relationship with the legislator such that the legislator has an open mind/ ear to listen to the concerns of organized medicine. The Legislative Committee is an extension of the Key Contact Physicians and these physicians help identify Membership Recruitment and Retention Committee - This committee is the heart and soul of the DCMA. Meets every other month (more or less meetings can be held as deemed appropriate by the committee) to enhance the DCMA Vendors of Choice program and to develop strategies to increase/retain membership in the DCMA. DCMA Delegates to FMA - Meet twice a year and attend the 2-3 day Annual Meeting/House of Delegates Sessions of the Florida Medical Association. This is the policy making body of the FMA and gives Miami-Dade County a voice at the FMA level. I am interested in serving on the _____________________________________________Committee. HIPAA Notice of Privacy Practices Question: I have been told that it is not sufficient to simply advise the patient that our office has a HIPAA Notice of Privacy Practices. When must I provide the HIPAA Notice of Privacy Practices to my patients? Answer: As you may be aware, under HIPAA, patients have the right to adequate notice of the uses and disclosures of their Protected Health Information (“PHI”), as well as their rights and the provider’s legal duties with respect to protecting their PHI.3 A covered health care provider who has a direct treatment relationship with patients must provide a written HIPAA Notice of Privacy Practices (“Notice”) to each patient, no later than the date of the first service delivered. In an event of emergency treatment, the provider must provide the Notice as soon as reasonably practicable after rendering treatment. If the first service delivered was via electronic means, then the provider must provide electronic Notice automatically and contemporaneously in response to the individual’s first request for service. When Notice is first provided to a patient, a good faith effort must be made to obtain the patient’s acknowledgment of receipt of the Notice. Usually, a provider will request that the patient sign an acknowledgment that the Notice was provided to them. The provider should also keep records of all acknowledgments and Notices issued. If acknowledgment is not obtained, and good faith efforts were made, such should be documented, as well as the reason why acknowledgement was not obtained. If a provider maintains an office where medical services are delivered, then the Notice must be posted in a clear and prominent location where it is reasonable to expect that the patients will be able to read it. The office should also keep extra copies of the Notice, in case a patient at any time requests a copy of the current Notice. If the provider maintains a website, then the Notice must be posted on the website and be made electronically available to patients through the website. A provider may provide the Notice by e-mail if the patient agreed to receive the Notice by e-mail. However, if the provider knows that the e-mail transmission failed, then a paper copy of the Notice must be provided to the patient. Anyone who received an electronic Notice has the right to request a paper copy upon request. Finally, because the Notice requirement has been in effect since 2003, some physicians and practices have become complacent about its importance to HIPAA compliance. You and your staff should be familiar with the content of your Notice, as you are obligated to comply with it at all times. “Board Eligible” Question: I have yet to obtain Board Certification in my specialty and my specialty board has not set any timeframe for obtaining certification. Can I use the term “Board Eligible” indefinitely? Answer: Not for long. The American Board of Medical Specialties (ABMS) has never defined the term “Board Eligible,” although the term has been widely adopted by the physician community. Some specialty boards have had established time limits for obtaining certification but many had not done so until now. The ABMS adopted a policy, effective January 1, 2012, that rejects the concept of unrestricted Board Eligible status and determined that all of its 24 Member Boards must limit the time that physicians can undergo board certification after completing their residency. Each Member Board is to establish a transition plan for candidates who have completed residency but not obtained certification as of the policy’s effective date. Under the plan, candidates will have at least until January 1, 2015, but not later than January 1, 2019, to achieve Board Certification. According to the ABMS, physicians who do not obtain certification within their Q: & A: Board’s set timeframe will have to cease and desist from making any representations of Board Eligibility. In addition, the physician will no longer be eligible for certification in that specialty without first completing all requirements for re-entry into the certification process established by the applicable Member Board. These restrictions will be of importance, not only to affected physicians, but to their employers and other affiliated entities. Student Loan Defaults Question: Is there any risk with Medicare if I am in default on my health education student loans? Answer: Yes. Generally, student loans such as Health Education Assistance Loans (HEAL) may not be discharged and there is no statute of limitation. The U.S. Department of Health & Human Services’ Office of Inspector General has discretionary authority to exclude a physician for defaulting on health education loan or scholarship obligations. Excluded physicians may not bill directly for providing services to Medicare or Medicaid beneficiaries nor may their services to those patients be billed indirectly through their employer or group practice. While the government does have to provide adequate notice to the provider and provide opportunities to remedy the default, that patience only goes so far. You should not just ignore default notices and other correspondence from the government related to a default. Recently, a U.S. Attorney announced a settlement with a provider relating to a defaulted HEAL loan. The promissory note was signed in 1995 but, according to the U.S. Attorney’s office, payments were never made on the loan, which went into default in 2007. Eventually, in 2011, the provider responded to a notice of exclusion from all federal health care programs and, in 2012, settled with the government for an amount nearly double the amount of the initial loan, including interest, penalties and fees. Federal Prosecution of Fraud involving Commercial Carriers Question: Our practice has intentionally avoided treating Medicare or Medicaid patients. I don’t think we are doing anything fraudulent, but am I correct that we don’t have to worry about Federal investigations since we have a “non-government” practice? Answer: There is no “safe harbor” in not taking Medicare or Medicaid patients. Under the Federal health care fraud statute, it is a federal crime to defraud any health care benefit program. The scope of that statute is not limited to Federal health care programs like Medicare. Fraud involving a private health insurer falls within the statute’s reach. A conviction under the statute can lead to financial penalties as well as a prison term. State insurance fraud statutes cover fraud against private insurers, as well. And private insurers have their own investigators who work with the state and federal agencies. The best way to protect yourself and your practice is to implement an effective compliance program and train your physicians and staff on the importance of medical necessity, good documentation, and compliant referral relationships, regardless of payor. Please fax back to 888.235.5008 6 MIAMI MEDICINE ✚ July 2012 Importing Medications from Foreign Countries By: Cliff Rapp, LHRM, Vice President, Risk Management, The Doctors Company/FPIC A struggling economy, an absence of health insurance, and the rising cost of medications are common reasons for individuals to seek more affordable options when it comes to prescription medications. It should be emphasized to all patients, however, that since medications imported from foreign countries are not subject to the Food and Drug Administration (FDA) oversight and monitoring, they may lack the quality controls that ensure drug safety. In response to recent cases of drug shortage, the FDA has approved re-importation of select oncology medications. Physicians are cautioned against participating in patients’ endeavors to obtain medications from foreign countries, despite claims of potential monetary savings. Safety Concerns The FDA cannot ensure the safety of drugs purchased from foreign sources. Medications may lack quality controls in all aspects⎯manufacturing, packaging and labeling, handling, dispensing, and monitoring outcome. Imported medications may not even contain the same ingredients as products approved by the FDA. They may be manufactured, packaged, and stored in unsanitary conditions. Drugs may not be labeled properly, may contain harmful ingredients, may not be tamper-resistant or tamper-evident, and may contain different dosing than the FDA-approved counterparts. All of these aspects create the potential for adverse reactions to imported medications and may make it difficult for physicians to safely manage the medication regime. Potential Problems • Dangerous drug interactions or side effects due to drug contamination. • Inadequate treatment due to counterfeit, sub-potent or superpotent products, or inert ingredients. • Some products may not contain any medicine at all. • Some imported medicines may be addictive. • Lack of information may make it difficult to monitor the patient’s response to medication and/or treat adverse reactions. •Treatment could be delayed or made more difficult unless there is sufficient information available about the product. • No recourse in the event of adverse reaction⎯the seller is beyond the consumer’s reach or the seller may have required release of liability prior to selling⎯since the product is not under FDA jurisdiction. Legal Issues • It is illegal under the Federal Food, Drug, and Cosmetic Act to import into the United States any unapproved, misbranded, adulterated, or foreign versions of medications approved in the United States. • It is illegal for anyone other than a drug’s manufacturer to re-import a prescription drug originally manufactured in the United States. • Medications imported from other countries may trigger MIAMI MEDICINE ✚ July 2012 coverage exclusions in many medical professional liability policies. Risk Management Guidelines • Obtain and update each patient’s medication history and determine whether the patient is taking imported medications. • Encourage patients to use one pharmacist as a means to help prevent drug interactions when combining medications. One pharmacist will maintain a current medication profile listing all medications prescribed from any and all prescribers, thus increasing detection and prevention of potential problems. • Inform patients of the risks of obtaining drugs from foreign sources. • Pursue financial considerations and alternatives when prescribing medications. Many pharmaceutical companies offer drug assistance programs. Some pharmacy chain programs offer generic prescriptions at a cost of $4 each. Florida’s Response Florida Board of Medicine: Although there is no specific law or ruling on the matter, the Florida Board of Medicine is opposed to physicians assisting patients to obtain medications from Canada or other foreign sources. The board does not believe that it is the best practice of medicine. Consequently, the potential for disciplinary action could arise. Florida Medical Association (FMA): The FMA Legal Department has issued the following statement regarding prescriptions written by a Florida physician to be filled in Canada: “Canadian law does not allow a Canadian pharmacist to fill a prescription written by a physician licensed only in the United States. A Canadian physician must issue the prescription (in fact, the Canadian province may require that the physician be licensed in that province.) Some Canadian physicians have been signing off en masse on U.S.-issued prescriptions that are being brought into Canada to be filled, but Canadian medical authorities have started investigating the Canadian physicians who are doing this without an adequate examination of the patient. While it is not illegal for a Florida physician to write a prescription that the patient is going to have filled in Canada, Florida physicians should refrain from giving any advice on the matter to their patients.” Florida Statutes: FS 465.0197(2) requires that an Internet pharmacy must obtain a permit in order to dispense medications to persons in Florida. Florida Board of Pharmacy: The Florida Board of Pharmacy’s opinion is that it is unlawful for any business enterprise in Florida to offer services to the public by which members of the public may be induced to use the services of a non-registered, non-Florida resident pharmacy, and it will subject the persons and entities involved to criminal and civil penalties. (Florida Administrative Code 456.0156) Although patients may be desperate to obtain medications from cheaper sources, physicians should be alert to the potential risks and problems associated with imported medications-and the resulting increased exposure to malpractice claims. 7 Xxxxxx?
