Jacksonville couple hopes HGTV picks up pilot

When HGTV asked John and Whitney
Spinks to reprise last summer’s “Flipping
the Block” success, the couple was particularly excited by one part it.
The new show would be filmed in their
hometown of Jacksonville. The show follows a San Marco flip with potential for an
update but a hidden problem in the roof.
It follows the usual formula of whether
the home will sell without losing money.
But this time instead of seasoned pros,
viewers follow the angst of young entrepreneurs struggling to launch their business.
The pilot for “Florida Flippers” aired
June 21. For those who missed it, HGTV
will re-run the episode up to eight times.
If it gains traction, Jacksonville’s favorite young-couple-makes-good renovation
team could film 12 more episodes and
their hometown could have its first reality
TV series.
John Spinks said he liked the chance to
pitch Jacksonville. “Shows like this usually
happen in Orlando or Miami,” he said.
With beaches at one end and historic district revitalization at the other, the
city made good fodder for TV renovation
drama, the couple said.
Last summer the couple won hearts as
the underdogs on “Flipping the Block,” a
show where four teams competed to earn
the most money rehabbing and selling
identical units in a condo complex.
Where other contestants already had
their construction-design businesses
up and running, the Spinkses had their
dreams.

Customers of the Duval County Clerk of
Courts will have to adjust their payment
preferences beginning Monday, when the
clerk no longer will accept personal checks
for payment of fees or fines.
Public Information Officer Charlie Broward said the change is an “operational
decision,” based on the risks and costs
associated with accepting personal checks.
Broward said the office spends $25,000
per year to process and verify availability of funds for personal check payments,
though there is no guarantee the funds will
be available when the check is presented
to the bank.
He also cited costs associated with bank
and mailing fees as well as the time spent
by staff processing and attempting to collect bounced checks.

on to say that personal checks “have
the highest propensity for fraud” and
the clerk’s office has
very little recourse to
recover on personal
checks that bounce.
The issue is made
more
significant,
Broward said, due to Fussell
the type of payments
for which personal checks were accepted,
such as fees for certified copies of records
or payment of traffic fines.
Asked to provide the number of personal
checks processed by the clerk’s office on a
monthly or annual basis, and the percentage of checks that are returned for insufficient funds, Broward said, “We do not
have that available on hand.”
Other forms of payment, including cash,
credit cards, certified checks, cashier’s
checks, money orders and checks drawn
against a business checking account will
continue to be accepted.
For credit card payments, a 3.5 percent
service charge is assessed by the state
vendor, MyFloridaCounty.com. The clerk’s
office accepts payments by debit cards that
can be run as a credit card, but the office
does not accept PIN-based debit card payments.

Convention center, Downtown on draft for Curry
It looks as if a convention center might make the cut.
Mayor Lenny Curry can expect
about a dozen recommendations
about where to focus his economic-development efforts, and
a “rough draft” list includes the
project.
“The City needs to develop a
plan to develop an expanded or
new Convention Center,” says
the draft put together by former
Mayor John Delaney.
Delaney chairs Curry’s economic-development transition subcommittee, which met Monday.
He said after the meeting to

“It needs to move up the priority list,” he said.
He also repeated what he has
said in previous meetings: Finding $200 million to $500 million to
pay for a center will be the issue.
Another top priority will be the
urban core.
“A solid Downtown needs to
be a major focus,” Delaney said.

outline,” culled from previous

The draft also includes recommendations to:
• Retain former Mayor Alvin
Brown’s economic-development
structure: Office of Economic
Development; the independent
Downtown Investment Author-
ity; the mayor’s Office of Sports
and Entertainment, which works
with the nonprofit Jacksonville
Sports Council; and the private
JAX Chamber. “It appears that all
of the four entities cooperate and
work well together,” it said.
• Develop a “progressive”
matrix so that the city can score
the value of deals seeking economic-development incentives
and also create an ongoing way
to measure the results.
• Focus efforts on improving
low wages, and also on neighborhoods in decline or transition.

in assessing a project’s worth,
although “exceptions and discretion should not overwhelm the
rule.”
• Ensure that an annual report
card be issued to measure the
changes in the city’s gross domestic product, tax base, employment, wages, capital investment,
tourism and other factors.
• Create a brand identity for
the city. “Jacksonville has a limited national brand,” he wrote.
• Asset-mapping governmentowned properties in La Villa,
Mayport and Downtown, especially the old courthouse and City
Hall annex, and create a plan to
move those assets to “highest and
best use.”
• Address the need to speed
permitting and regulatory review.
• Change the city’s economicdevelopment process regarding
the largest deals. The chamber
reported that the larger the deal,
the less competitive Jacksonville
is. Delaney wrote that Jacksonville has been the “bridesmaid”
many times. “Such is unacceptable, and warrants the development of plan to overhaul ED processes for mega-projects.”
The 18-member group also
reviewed a separate presentation
by member Aaron Zahn, president and CEO of BCR Environmental Corp.
Zahn created a report called
“An Economic Development
Strategy Framework” for the city.
He suggested the city consider branding itself as the “global
leader in infrastructure innovation for the future,” citing the
possibilities of the $9 trillion
expected to be spent worldwide
by 2025 on capital projects and
infrastructure.
He said Jacksonville already is
a center of excellence because of
its rail system, health care facili-
ties, aerospace development, port
and utilities.
Recruiting and supporting
companies and jobs in the industries of extraction, utilities, manufacturing, transport and hospitals/schools would make sense,
he said.
With a brand such as global infrastructure leader, “you’d
be able to increase high-skillset
jobs,” he said.
The group also made more
suggestions during discussion.
Ceree Harden said a longterm capital improvement plan
is needed for Downtown. He said
that when the city commits to
improving infrastructure, such as
streets, drainage and utilities, private companies are more likely to
want to create jobs there.
Members also focused on
accountability and oversight.
Several debated how to create an
entity or determine an individual
to monitor the progress of the recommendations and to champion
the causes.
Two members said funding
is critical, and one said at least
a statement about it should be
included in the recommendations.
Harden said a 2011 Jacksonville Civic Council report about
Downtown Northbank redevelopment offered “some good suggestions” on where money might
be generated for the urban core.
That report suggested consideration of a Tourism Investment
District, tax increment financing,
grants, proceeds from disposing
of city-owned Downtown properties, public-private partnerships, a Utility Revenues Finance
District, private funds and the
city general fund, among others.
Delaney’s list also noted ongoing projects, such as the Port Task
Force; the Metro Jacksonville/
Northeast Florida Global Cities
Initiative Export Plan; Community Wealth Building; the Cecil
Commerce Center Vertical Integration Study and the Shipyards.
Delaney asked Zahn to combine their respective recommendations and incorporate suggestions sent by the committee. He
wants to discuss that list Thursday.
While the group was scheduled
to wrap up Thursday, Delaney
extended the work until next
week.
Delaney said he spoke Sunday
with Curry and Thursday with
Chief Administrative Officer Sam
Mousa about the subcommittee’s
progress. “They like the thinking.
The mayor likes the amount of
effort everybody’s put into this,”
Delaney said.
Curry spokesman Bill Spann
said Mousa and Delaney generically discussed how the subcommittee’s report should be formatted and other items, such as the
report’s structure, recommended
changes and any focus on jobs
and wages.
Spann said Curry’s recommendations will be formulated as his
transition subcommittees make
their reports and the budget process continues. Curry must submit his first budget to City Council by July 20.
Meanwhile, the city has posted
a job opening for an economic development officer. Former
Office of Economic Development
Executive Director Ted Carter left
the position with the change in
administration.

“We heard from a lot of people
that they thought we were the
most relatable,” Whitney Spinks
said.
Since finishing the series, the
couple has launched 27 South
Design Group, casting their sights
in a couple of directions. They’ve
picked up remodeling and design
contracts, opened a home décor
resale shop and scoured the market for homes to flip.
Television fame brought
unusual opportunities. Since last
summer the couple has appeared
across the country as paid guest
speakers for home and garden
expos.
HGTV didn’t pick out the San
Marco house for “Florida Flippers” or help fund the deal, Whitney Spinks said.
“It was just like anybody else
who wasn’t doing a show,” she
said. “It’s, ‘how did we come up
with the money to do that?’”
Beyond their personal story,
the couple claims an interesting
market niche.
It’s not a fix-it-up-and-paint-itbeige rehab.
They renovate with an eye to
design, keeping the 1944 home’s
original hardwood floors and oak
trim and opting for level-four
quartzite countertops rather than
level-one granite.
“A lot of people our age are
extremely educated and they’re
upset when they’re given things
like look-alike entrances to a
house,” Johns Spinks said.
There’s an emerging market of
people who are willing to pay a
little bit more for unique features,

that had character and charm and was a little bit different. Mostly,
the San Marco home needed an update.

it,” Johns Spinks said. “It really
is us.”

Judge says busing not required by charter school

Pointing to choices made by parents,
a state judge has ruled that a Southeast
Florida school district cannot require a
charter school to provide bus transportation to students.
Administrative Law Judge Darren
Schwartz, in a 45-page order issued last
week, sided with Renaissance Charter
School at Tradition in a long-running dispute with the St. Lucie County School
Board.
The case focused, in part, on a state law
that effectively requires districts to provide
bus transportation to students who live
two miles or more from school.
Also, St. Lucie County school officials
argued that the charter school violated a
contract by not providing transportation
to students.
But Schwartz pointed to a state charter-
school law that gives more leeway on
transportation issues.
“(To) conclude that Renaissance Charter
School at Tradition is required by the charter school statute to provide regular school
bus transportation to all students residing more than two miles from the charter
school would violate one of the fundamental principles of the charter school statute,
which is to provide charter schools greater
flexibility,’’ Schwartz wrote.
“The Legislature specifically recognized
that charter schools should have greater
flexibility than traditional public schools.
Parents choose to send their children to
charter schools, knowing full-well that
they may reside more than two miles from
the charter school, and that their traditional
public school may be located much closer
to their residence than the charter school,”
the judge continued.
Charter schools are public schools,
though they are often run by private man-
agement companies. As part of a schoolchoice movement heavily backed by state
Republican leaders, charter schools do not
have to operate under all of the same
requirements as more-traditional public
schools.
The St. Lucie County School Board
approved a contract in 2013 for Renaissance Charter School at Tradition. But later
that year, the school board sent a notice
alleging that the charter school was not
complying with contract requirements for
student transportation, according to documents filed in the case.
The charter school last year filed a petition at the state Division of Administrative
Hearings to resolve the dispute.
In part, the petition said that since its
“inception, (the school) has had more students enrolled than it projected and the
charter school currently has a waiting list
of students hoping to matriculate there
despite the fact that it does not offer regu-
lar busing to its students absent exceptional circumstances required by law (as is
the case, upon information and belief, with
most charter schools in Florida).”
But in response, the school board argued
that a lack of transportation could prevent
some students from attending the charter
school.
Schwartz’s order alluded to student
demand for the school. The order said the
school opened for the 2013-14 academic
year as a kindergarten- through sixthgrade school with 695 students.
It grew to 890 students as it opened
for the 2014-15 academic year, serving
students in kindergarten through seventh
grade.
“Parents of students enrolled at Renaissance Charter School at Tradition recognize
that the decision to enroll their children at
Renaissance Charter School at Tradition is
a personal choice and not a privilege,’’ the
order said.
Doctors call for more state Medical malpractice
oversight after infant deaths caps take another hit

After the deaths of five infants,
a team of doctors from across the
state was asked in 2014 to review
a Palm Beach County hospital’s
highly specialized program for
doing heart surgeries on children.
The team’s recommendation:
St. Mary’s Medical Center should
not perform heart surgeries
on babies under 6 months old
because the program did not handle enough cases to maintain the
expertise needed for quality care.
But surgeries continued at St.
Mary’s. And the issue has drawn
national attention in recent weeks
after CNN reported that eight
infants died following heart surgery at the hospital over four
years — with another dying June
2, after the first CNN report aired
on television.
St. Mary’s and a state agency dispute CNN’s findings. But
some doctors are calling for the
state to exert more control over
the quality of hospitals that perform such life-and-death procedures.
The debate is tangled in discussions about the role of a longrunning state program known as
Children’s Medical Services.
The program oversees care for
tens of thousands of children
with special health-care needs.
Behind the scenes, it also has
standards of care that hospitals
can choose to meet.
The team of pediatric cardiologists who went to St. Mary’s in
2014 was told the hospital could
decide whether to upgrade its
infant cardiac program to Children’s Medical Services standards
voluntarily, based on the doctors’
findings. The hospital says it has
made a number of improvements
as a result of the visit and could
make more.
But in seeking more state control over such programs, some
doctors want the standards put
into state law, as was the case
before 2001.
“During my tenure, I
recall having at least
one or two facilities
issued warnings, and
we saw the effectiveness of the actions
they put into place
with subsequent data
and peer review.”

Such standards would have
required the St. Mary’s program,
in part, to reach a certain volume
of infant cardiac surgeries.
In a June 4 email to a state
Department of Health official,
Children’s Medical Services cardiac consultant Bill Blanchard
urged the state to respond to the
deaths at St. Mary’s by “adopting the already existing CMS
standards into law.” Children’s
Medical Services is housed at the
Department of Health.
Blanchard also advised the
department to require any new
program given what is known
as a “certificate of need” to meet
Children’s Medical Services standards within three years.
Certificates of need are part of a
separate state regulatory process
that helps determine whether
hospitals can be built or expanded and whether they can offer
certain types of programs.
Shelly Weiss, a spokeswoman
for Tenet Healthcare Corp., which
owns St. Mary’s, said the hospital
has begun “exploring opportunities for formal partnerships” with
other providers and conducting
weekly presentations to a multidisciplinary group of physicians.
The team of cardiologists that
visited St. Mary’s last year sat
on a Children’s Medical Services
advisory panel for pediatric cardiology. The panel’s chairman,
Jeffrey Jacobs, confirmed to The
News Service of Florida that the
Department of Health told the
panel in August 2014 that members could not conduct site visits
or peer reviews of any infant
cardiac surgery programs unless
hospitals wanted such visits.
Department of Health spokeswoman Tiffany Cowie said in an
email that neither the department
nor the panel has “any independent legal authority to conduct
site visits of pediatric cardiovascular programs. However, if a
hospital voluntarily requests a
site visit, Children’s Medical Services may offer the expertise of
highly qualified cardiac professionals from the CTAP (panel) to
fulfill the hospital’s request.”
Phyllis Sloyer, who directed
Children’s Medical Services from
1998 to 2011, said hospitals that
were cited in peer reviews during
that time had complied to keep
the designation of meeting the
program’s standards of care.
“During my tenure, I recall
having at least one or two facilities issued warnings, and we saw
the effectiveness of the actions
they put into place with subsequent data and peer review,”
Sloyer said. “And that’s what’s so
important in continuing to look
at the quality of care for children
who have significant chronic illnesses.”
St. Mary’s says it is has stopped
performing elective infant heart
surgeries until it has completed
“a comprehensive review of our
pediatric cardiovascular program
to reinforce the community’s confidence.”
Although St. Mary’s treats children enrolled in Children’s Medical Services, its infant heart surgery program has not chosen to
seek the designation of meeting
CMS standards.
“We are utilizing CMS standards as one basis for our internal
review of our program,” Weiss
wrote in an email.

for carpal-tunnel syndrome and
ended up suffering a perforated
esophagus.
Now, nearly eight years later,
the case could be another blow
to a controversial 2003 law that
limited the amounts of money
injured patients can receive in
medical-malpractice cases.
A South Florida appeals court
ruled last week that the law’s limits on pain-and-suffering damages — known in legal parlance
as non-economic damages — are
unconstitutional in personalinjury cases, such as the case of
Susan Kalitan, who was injured
after tubes were inserted into her
mouth and esophagus as part of
an anesthesia process.
The 4th District Court of
Appeal’s decision followed a
Florida Supreme Court opinion
last year that similarly rejected the malpractice law’s limits
on non-economic damages in
wrongful-death cases.
The appeals court cited the
Supreme Court’s opinion and
said the damage limits violate
equal-protection rights under the
state Constitution.
The 14-page decision, issued by
a three-judge panel of the appeals
court, said the “caps are unconstitutional not only in wrongful
death actions, but also in personal
injury suits as they violate equal
protection.”
The ruling, written by appealscourt Judge Alan Forst and joined
by Chief Judge Cory Ciklin and
Judge W. Matthew Stevenson,
said the appeal presented an
issue of “first impression,” which
means it is the first time the constitutional question has been
decided. Defendants in the case
can ask for a rehearing or appeal.

hospitals and their legislative
supporters argued that the caps
were needed because of soaring
malpractice-insurance costs.
But opponents, including
plaintiffs’ attorneys, contended
that limiting damages was unfair
to injured patients.
Under the law, damages were
capped at different amounts,
depending on factors such as the
numbers of claimants in lawsuits
and the types of defendants.
For example, part of the law
included $500,000 and $1 million
damage caps for physicians, with
lower amounts when the cases
involve emergency care.
Kalitan filed the malpractice
case in 2008 in Broward County
and named a series of defendants,
including the North Broward
Hospital District, an anesthesiologist, a certified registered nurse
anesthetist and a company that
contracted to provide anesthesiologists and staff to the hospital
district.
A brief filed in the appeals
court by Kalitan’s attorneys said
anesthesia was used to put her
“to sleep” for the outpatient carpal-tunnel surgery.
When she awoke, she complained of chest and back pain
but was later sent home. The brief
said she was rushed to the hospital the next day, with an infection
from the perforated esophagus
and had to undergo chest and
neck surgery. She was place in
a drug-induced coma for three
weeks while recovering.
A jury awarded Kalitan about
$4.7 million, with $4 million of
that in non-economic damages,
according to court records. But a
circuit judge, applying the caps
from the 2003 law, reduced the
non-economic damages award by
about $2 million, which included
amounts to be paid by various
parties and a finding that Kalitan
suffered a “catastrophic injury.”
Such a finding can lead to larger
damage amounts than in other
malpractice cases.
