Dear NOAA Members,
Recently Bob Sorin and I participated in a
process called mediation. In the interest of full
disclosure, our mediation had nothing to do
with NOAA but rather for a Board we sit on
together. This mediation was, strangely enough,
between a large group of people who are
friends and remained friends throughout and
after the process.
As I think about the experience there is a lot
to learn about business in going through one
of these. Ours was expertly handled by an
attorney from Ulmer Berne who’s made a bit
of a name for himself in this arena, although it
is a small part of what he does for a living.
The day started with the two groups in
separate Ulmer Berne llp conference rooms
replete with sodas, coffee and ice water. Ulmer
Berne was a good host and the site proved
more than workable. The mediator started the
day with what I thought were a couple of corny
plaques with inspiring sayings that he pulled
from his office wall. They were supposed to
set the mood and prepare us for the day.
But like all business negations, the real
inspiration is showing up prepared for the task
at hand, which in this case meant knowing what
you want – what they want and understanding
where the middle ground might be.
As the day progressed, we formed a joint
session and put some basic facts and principles
on the table. We briefly argued to support our
role as they did theirs. The next logical step is
to explore an understanding and this is where
having a mediator comes in handy.
When you are nearly two million dollars apart,
at the start it seems like an impossible task to
explore and understand the other side of an
issue, even if you are all friends.
Our mediator was very good at giving us
and them the signal that we were both open
and ready to start sharing our thoughts and
explore reaching across the wide seven figure
gap. We had our principles and they had
theirs. About five hours passed when we
really started to question our stand. We feel
that they reached a similar place in about the
same time span.
The next stage was exchanging packages of
information. Most of the information was
emotional wrapped in facts, but these were
used to substantiate our claims and offers.
They countered with different sets of claims,
facts and dollar figures. Time wore on. We
were now closing in on eight hours of sitting in
this conference room. The room seemed to be
growing smaller.
Sometime in the next hour or so we got close
enough that we all thought we were not going
to spend the night together in this room which
we now disdained. They gave, we gave, they
gave and finally we reached a deal we both
thought we could sustain.
Bob and I are both glad to be out of that room.
We closed the deal and have moved on. We
are all still friends.
Our home for the past 3 years. A new five year lease extension will make
this our home for the future.
Thank you to our mediator Michael Ungar with
Ulmer Berne llp. He taught me a lesson. There
are deliberately a large number of steps in the
process of mediation. Each step is designed
to break down one’s resistance to settlement.
Each step gives you an appreciation of what
the other side needs and wants, and allows you
time to consider their emotional issues with
the disagreement.
The lesson: You can teach old dogs new
tricks. I went into this process a skeptic and
came out a fan.

Should You Be Concerned About Your Residents’ Bathroom Safety?

With the rising number of baby boomers
retiring, the apartment industry is pivoting to
cater to this growing population of renters.
Senior living apartments that cater to 55+
residents are one of the fastest growing trend
in the country, however, capitalizing on these
stable renters is causing Apartment Managers
to alter their communities to assure that they
are providing the needs that fit their clientele.
One of managements biggest concern has
to be safety. No room poses a bigger threat
to safety than the bathroom. Slip and fall
accidents when entering and exiting the
bathtub or shower contribute to nearly
25% of hospital admissions, especially among
people age 65 and older, and the most
common result is a hip fracture.

Casino Bus Trip

The money started flowing on the two and a half hour bus trip
to Seneca Allegany Casino in New York. Bingo and instant pull
tabs warmed members up for the real gambling. 50 NOAA
members took the day trip with their hearts set on winning
big. Kurt Karuse did just that. In the first 15 minutes he pulled
the right slot machine lever at just the right time, winning over
$1,000! Everyone who went received $25 for slots, $10 for
food and all new patrons to the casino received and extra $10
for slots. All of this for a $25 bus ticket!

In traditional East Cleveland hospitality the city of
Bratenahl welcomed arriving guests with snow. The
atmosphere inside, however, was warm. The Shoreby Club hosted a
night of excellent food, drink and live music. After dinner the 2012
Executive Committee was sworn in by Cleveland Housing Court
Judge Raymond Pianka.

Anchors of the neighborhood - community leaders who
trace their roots there to the turn-of-the-century, Our
Lady of Mount Carmel Church, long-time residents accept where they’ve been, know where they stand and
have worked incredibly hard to set a course on where
they hope to go.
“There are people who have choices who are
choosing to live here,’’ said Cleveland Housing Court
Judge Ray Pianka, a lifelong resident and former city
councilman for the neighborhood that spans from
West 45th to West 85th streets, north of Interstate
90 to the lakefront.
It’s those passing by without so much as a glance
who overlook this view and vision, and they might be
stunned to learn what they’ve been missing:
Recent momentum has put Detroit Shoreway in the
spotlight for all the right reasons. But it wasn’t so long
ago that Pianka’s observation would have been as
likely as a Cleveland sports championship.

and financially diverse as you’ll find in the city.
By 1990, the neighborhood had a 40 percent poverty
rate, the median home price had slipped to $16,000
and the list of ailments read like a menu for the
downtrodden.
“It got pretty bad,’’ recalled Ward 15 Councilman Matt
Zone, whose family has lived in Detroit Shoreway for
four generations.
“We virtually had no retail on Detroit Avenue. Lorain
Avenue was starting to get run down. We had a lot
of resale shops and a heavy concentration of illegal
activity and some undesirable bars that were festering
a lot of problems.
“We had a lot of irresponsible property owners. We
had a day hotel at 65th and Detroit that was just a
haven for prostitution, and it was like an all-time low
in the mid-’90s.’’
It took much pulling in the same direction, from longtime stakeholders and fresh visionaries who bought
into the potential, to reverse the decline that wracks
so many American cities.
A comprehensive community master plan in 2002 - a
three-headed plan, actually, that considered Detroit
Shoreway as a whole, with separate conceptions for a
Gordon Square Arts District and an environmentally
innovative Cleveland EcoVillage - inspired residents
to take ownership and developed a self-identity and
neighborhood pride that had been missing.
“That,’’ Zone said, “was a real turning point for our
neighborhood.’’
the 1890s, said attendance at the Capitol increased 14
percent last year at a time when most movie houses
saw business decline.
Developers hope to break ground this year on the
Near West Theatre and complete renovations on the
Cleveland Public Theatre, which features original plays
by local and international playwrights.
When completed in 2013, the arts district will have
resulted in 950 permanent jobs.
Better yet, the reopening of the Capitol Theatre
and $3 million in streetscape improvements (wider
sidewalks for street cafes, public art, new street lights)
on Oct. 1, 2009, inspired 60 new businesses to open.
Among them was Spice Kitchen and Bar, a bricks-andmortar offshoot of the popular Spice of Life Catering
Co., which opened in mid-January at West 58th Street
and Detroit Avenue.
While scouting locations, owner Ben Bebenroth
was urged to take a look at the historic building
he’s now in.
“I just thought it was such an iconic piece of
architecture,’’ he said.
“This was the first space that actually gave us a
restaurant, a storefront, retail space and a street-level
presence.’’
As he shopped locations and learned more about
Detroit Shoreway, Bebenroth said he was impressed
with how clean it was, “and that the arts was not just
something they trucked in as an attraction, it was the
driving force of the neighborhood.’’
Likewise, when Jeff Moreau opened Sweet Moses,
a 1920’s-40’s vintage soda shop in March 2011, he
sought an old traditional storefront in a neighborhood
rather than a suburban lifestyle center.
With its home-made, from-scratch ice creams,
chocolates, toppings - even their own root beer - a
soda fountain from the 1940s and a back bar that’s
about 100 years old, Sweet Moses pulls in an afterdinner, after-show crowd from downtown, Tremont,
Ohio City and points beyond.
A decade later, the area five minutes west of
downtown Cleveland is a model of reinvention - built
on the sturdy foundation and architectural character
of what was already there.
The arts has provided perhaps the biggest impact.
Where some neighborhoods create what becomes
an almost faux-like pass at culture, Detroit Shoreway
stakeholders chose to use arts and culture as an
economic development tool.
Roughly $25 million of an ambitious $30 million
capital campaign has been raised to create the
Gordon Square Arts District, a bustling strip of
restaurants, shops, galleries and theaters that runs
from the Reinberger Auditorium at West 52nd
Street to the West 78th Street Studios, the former
American Greetings creative studios turned artists’
studios and galleries.
The district’s nexus is found at West 65th Street and
Detroit Avenue, where the restored Capitol Theatre
draws 50,000 film aficionados a year.
Developers defied skeptics who believed standalone theaters couldn’t make it by partnering with
the two other theaters (Near West Theatre and
Cleveland Public Theatre) and making it an anchor of
a comprehensive arts district.
Developers preserved the grandeur of the 1920’s
movie palace on the ground floor, while splitting the
balcony into two 100-seat theaters. The Capitol’s
three screens show everything from arts and
independent films to first-run Hollywood movies to
a Sunday classics brunch series.

open embrace. Community leaders, from Ramsey
to Zone to Pianka, sounded a consistent theme:

“melting pot:’’ A fourth of the population is
Hispanic, another fourth African-American,
and another fourth for which English is
their second language. There are strong
pockets of Italian, Vietnamese, German, Irish,
Slovenian, Laotian, and now, Zone said, the
neighborhood is seeing a whole new group of
immigrants from Africa.

While social services is a priority, the Detroit
Shoreway Community Development Organization is
also in the real estate business.
The nonprofit owns and manages 50,000 square
feet of commercial space and 210 apartment units
in 13 buildings, all of them historic renovation
projects by way of the district’s designation on
the National Register of Historic Places.
The most recent rental undertaking is the
Sylvia Building on Franklin Boulevard, a $3
million, 1920’s-era renovation of 18 units set to
open in May.
“It’s not just rehabbing a building for the
sake of a profit,’’ said Ramsey, who was
a Realtor with the upstart Progressive
Urban Real Estate, a pioneer in urban
living in Cleveland, before joining the
Detroit Shoreway organization as a
development specialist in 1987.

“We’re rehabbing it for the benefit of the community,
creating assets for the community, bringing jobs to
the neighborhood, businesses to the neighborhood,
services that people need,’’ he said. “So it’s
development with a purpose.’’
And for profit, which helps ride through economic
downturns and offset cuts across the board in public
funding for community development corporations.
DSCDO earns about $1.5 million a year in rental
income and, in any given year, may be involved in $3
million to $5 million in development activity.
The apartment portfolio ranges in age from the 1898
Courtland Building, centered with a two-story atrium,
at West 54th Street, to the Detroit Chateau on West
80th, which was built in 1927.
Rental prices range from income-based federal public
housing to two-bedroom loft-style apartments with
lake views that lease for about $1,500 per month.
While the bulk of Detroit Shoreway’s apartment
projects serve working-class residents, essentially
those on annual incomes of about $14,000 to $34,000,
high-end, market-rate housing is also finding its way
into the neighborhood.
The very ambitious Battery Park is rising between
West 73rd and 76th streets, just south of
Edgewater Park, on the site of the old Eveready
Battery factory site.

have sold since the project was
launched in 2006, spurred by
plans to remake the Shoreway as
a boulevard.
But among what Ramsey is most
proud of is that such development
is designed to complement rather
than replace.
“We have brought investment
to neighborhoods that are
underserved and still have
maintained the character of the
communities as diverse, mixedincome communities,’’ he said.
“Some
neighborhoods, they
define success as gentrification get rid of all the poor people and
you solve all your problems. That’s
not what we believe. We believe
that a healthy community is one
where there is opportunity for
all income levels, for employment,
for housing, for services, and
that’s what we try to do.’’

of its stock of homes in foreclosure.
The housing market remains a potent drag on the economy

4 Easy Ways to Avoid Getting an Avalanche of Spam

Warning: Spam e-mails are not only annoying
and time consuming, but they’re also becoming
more dangerous to your personal privacy
and the security of your computer. Millions of
computers users are getting infected, spoofed,
and tricked by spam e-mails every year, forcing
the user to pay hefty fees to clean and restore
their PCs back to working order.
There are 3 NEW dangers that all computer
users must be aware of:
1. An increase in hijacked and
spoofed e-mail addresses. Spammers
have discovered new ways to make it appear
as though their spam e-mail is coming from
YOUR computer. This could result in having
your Internet connection terminated or
put on hold by your ISP - all without your
knowledge. That is why good spam blocking
software will not only block inbound spam
from your inbox, but also unauthorized
outbound spam from your serves.
2. An increase in viruses-carrying
spam. Accidentally open a spam e-mail
carrying a nasty virus and you can end up with
big problems ranging from the slowing of your
system to more serious threats such as system
crashes, data loss, identity theft, redirecting
your web browser to porn sites, and more.
3. Phishing spam. A phishing e-mail appears
to be a legitimate e-mail from a bank, vendor,
friend, or other trusted source. The purpose is
to trick you into giving confidential information
such as bank accounts, social security numbers,
passwords, and credit card information.You’ve
probably already received a
PayPal or bank spam e-mail
that said your account was
going to be closed unless you
verified your information. It
then directs you to a very
convincing web site where you
input certain information the
spammer is trying to glean. In
reality, this is a malicious third
party that is going to use your
information to open credit
card accounts, access your
account, steal money, and cause
you other major identity and
financial problems.
So what can we do
about this?
First and foremost, it’s
absolutely critical that you
get a quality spam blocking
software installed as a first

line of defense. New government regulations
haven’t done a single thing towards preventing
or stopping spammers so the responsibility
lies on your shoulders. As you probably already
know from firsthand experience, once you’re
on a spammer’s list, it’s impossible to get off;
and changing your e-mail address can be a
major inconvenience especially if you rely on it
to stay in touch with important business and
personal contacts. To reduce the chances of
your e-mail address getting on a spammers list,
here are 4 simple preventative measures you
can take that will go a long way in keeping notso-delicious spam out of your in-box.
1. Use a disposable e-mail address.
If you buy products online or occasionally
subscribe to web sites that interest you,
chances are you’re going to get spammed.
To avoid your main e-mail address from ending
up on their broadcast list, set up a free Internet
e-mail address with Hotmail or Juno and use it
when buying or opting in to online newsletters.
3. Don’t post your main e-mail
address on your website, web forums,
or newsgroups. Spammers have special
programs that can glean e-mail addresses
from websites without your permission. If you
are posting to a web forum or newsgroup,
use your disposable e-mail address instead of
your main e-mail address. If you want to post
an e-mail address on your home page, use
“info@” and have all replies forwarded to a
folder in your in-box that won’t interfere with
your main address.
4. Don’t open, reply to or try to optout of obvious spam e-mails. Opening,
replying to, or even clicking a bogus opt-out
link in an obvious spam e-mail signals that your
e-mail address is active, and more spam will
follow. The only time it is safe to click on the
opt-out link or reply to the e-mail is when the
message was sent from a company you know
or do business with (for example, a company
that you purchase from or a newsletter you
subscribed to).
2. Pay attention to check boxes that
automatically opt you in.
Whenever you subscribe to a website or make
a purchase online, be very watchful of small,
pre-checked boxes that say, “Yes! I want to
receive offers from third party companies.” If
you do not un-check the box to opt-out, your
e-mail address can (and will) be sold to every
online advertiser. To avoid this from happening,
simply take a closer look at every online form
you fill out.
