Section 106 Overview
• Section 106 of the National Historic Preservation Act of
1966 (NHPA) requires federal agencies to take into
account the effects of their undertakings on historic
properties, and afford the Advisory Council on Historic
Preservation (ACHP) and various interested parties a
reasonable opportunity to comment.

Section 106 Process
• Initiate Section 106 process
• Identify historic properties
– Survey
– Determine eligibility for the National Register of Historic Places (NRHP)
• Determine and resolve adverse effects
– Determine effects of undertakings on historic properties listed or eligible for
listing in the NRHP
– Document efforts to avoid or minimize adverse effects
– If unable to avoid, mitigate adverse effects
– Often requires a Memorandum of Agreement or Programmatic Agreement
• Implementation of MOA or PA
• Public Involvement
– Advisory Council on Historic Preservation if necessary
– Tribes
– Local interest groups (historical societies, for example)
