Legal Driving Limit
Otsego County Raids
Lansing: Last month the Michigan House voted 107-1 in
favor of creating a commission to research and recommend a
limit for THC bodily content, similar to that of alcohol in which
bodily content of the substance cannot be above 0.08. Unlike
other substances, marijuana can be detected in the body
long after the “impairing effects” have worn off. This makes it
difficult for law enforcement officers to determine who may
be safe to drive and who may be driving impaired. It also
puts a strain on patients who might be safe to drive, though
their blood still contains traces of the drug. Rep. Peter Lucido,
who sponsored the bill, said members of the commission
will be appointed by Governor Snyder and will include
law enforcement officers as well as medical and science
professionals. Recommendations for the policy are expected
within the next year.
Gaylord: Chad Morrow, owner of Cloud 45, was arrested
in April, following a raid at his home, his business, and
his medical grow facility. According to 9&10 News, Straits
Area Narcotics Enforcement (S.A.N.E) found edibles, 40
marijuana plants, and more than 4 pounds of marijuana.
He will face felony charges of delivering and maintaining
a drug house. Morrow told the news outlet, “We do not
respect the fact that the state police, S.A.N.E, and Mike
Rola want to waste tax payers’ dollars and want to go after
medical marijuana patients, medical marijuana caregivers
and not the meth, not the heroin and not the real problems
in this town.” Otsego County Prosecutor, Mike Rola, says
the Medical Marijuana Act is clear and caregivers are
knowingly breaking the law; he expects more arrests will
be coming. Morrow, who will be back in court in early May,
says he will continue to fight because patients deserve
access to their medicine.
NORML Endorses MI Legalize
Lansing: The National Organization for the Reform of
Marijuana Laws (NORML) has announced its endorsement of
the MI Legalize 2016 initiative. MI Legalize (also known as the
Michigan Comprehensive Cannabis Law Reform Committee)
began gathering petition signatures in June and has collected
more than 270,000 signatures from registered voters in an
effort to legalize marijuana in the state. The goal of both
groups is to legalize the use, production, and retail sale of
marijuana, making Michigan the first state in the Midwest to
allow adults to use the drug recreationally. Many believe if
the initiative makes it onto the ballot, and is approved, it will
be the “most liberal marijuana legalization law in the United
States.”

Former Lawmaker Sentenced
Grand Rapids: A former Michigan Representative, Roy
Schmidt, was sentenced to 45 days in jail as the result of
a June 2015 raid on two homes connected to him. Law
enforcement officers found 3 pounds of usable marijuana and
71 plants, more than allowed by state laws. Schmidt’s lawyer,
Joshua Covert, explained that the former rep. was about to
have extensive back surgery, which would require prolonged
recovery, and he would not be able to cultivate and harvest
during that time so he was just trying to “get ahead”. Judge
Johnston took Schmidt’s 20 years of public service into account,
“Your years of public service are in some regard a two-edged
sword,” acknowledging the medical marijuana law is difficult
for many to understand. “It puts you in a position above what
the average citizen might be of knowledge and involvement
with the law. You plainly realized you were outside the limits.”
The judge sentenced Schmidt to 45 days in jail, ordering him
to show up the Friday following sentencing and allowing him
4 days to get his family matters in order.

Dispensary Moratorium
Argentine Twp.: The Board of Trustees in Argentine
Township had unanimous approval last month to put a
one-year moratorium on medical marijuana dispensaries.
The moratorium forbids any dispensary from opening shop
in the area. The supervisor of the meeting, Bob Cole, asked
the township attorney to clarify what was being voted on
as the Michigan Medical Marijuana Act already prohibits
any state-licensed facilities from selling the medication.
The attorney, David Lattie, explained that the current
marijuana law in Michigan left a gap between patient and
caregiver, which has allowed dispensaries to open citing
a loophole. If the business claims they are caregivers that
only sell to their registered patients, they are harder to shut
down. The board approved the moratorium and has said
it will study the existing federal law to consider possible
regulation of dispensaries in the area.

Parma: In 1999 Kevin Arntz murdered his
wife, dismembered her body, and cooked
some of the pieces before being caught.
While the case is old, it was the topic
of discussion during a question-answer
session following a court-to-school event
in Parma. Judge Joseph Filip relayed details
of the crime to the students in an effort to
warn them of the dangers of marijuana as
Arntz, unsuccessfully, appealed his murder
conviction on the grounds that he was in a
marijuana induced psychosis when the crime
took place. “So the argument that marijuana
doesn’t hurt anybody,” Filip told the students,
“yeah, Kevin Arntz cooked his wife because he
was hallucinating over marijuana, thought she
was the she-devil, at least that’s what he told
people.” Filip made it clear to his audience that he
believes people turn to harder drugs because alcohol
and marijuana “soften” the brain. Filip used an extreme
case, with very little evidence (aside from small amounts
of marijuana found at the crime scene), to express his
opposition to the idea of legalization while attempting to
persuade students that marijuana is a gateway drug, and
will lead to harsher substances, such as heroin or pills.

Pennsylvania Joins the Green Side
Housing Guru: Connecting Growers and Landlords
Colorado Releases First Official Data
Denver: Landlords and tenants alike ran into problems when
marijuana cultivation became legalized in Colorado. Landlords
would find tenants had created a grow in the house they were
renting, often making holes in the walls for ventilation. While
tenants who had created their own garden would sometimes find
themselves locked out by a landlord who was against the plant and
had never authorized the grow room in the home. Home Guru was
started as a result of these issues. The company connects tenants
who would like to grow legally with landlords willing to allow
them to grow. Housing Guru acts as a property manager – checking
on the property, making repairs, and taking care of any issues that
may come up. It also checks out prospective tenants for verifiable
income, references, good rental history, and a legal background
check. The company has had more landlords approaching them
for assistance in renting their properties after learning that most
tenants are willing to pay higher than market rent to be able to
grow in their home with the landlord’s approval and knowledge.
Dan Fortune, a landlord who uses Housing Guru for his 20
properties throughout the state, claims that the tenants ‘who grow
in his properties are among the best he has had. Because they are
engaged in an activity that many people frown upon, they are quiet.’
Colorado Springs: Colorado released its first
report containing local, state, and federal data this
month. The Colorado Department of Public Safety
gathered the information to show how legalization
has affected public safety, marijuana-related arrests,
adult and teen usage, and hospital visits related to
ingestion of the plant. The data shows that marijuanarelated arrests have been cut in half and arrests for
marijuana sales have decreased by 24 percent. The
report also shows that marijuana use has increased
among adults in the state, jumping from 21 percent of
people ages 18-25 to 31 percent, but has decreased
by a little over 3 percent among high school students.
Marijuana-related hospital visits were also covered in
the document, stating hospital visits of this type have
tripled since legalization. Before legalization 800 of
every 100,000 visits were due to the plant, since it was
legalized, however, 2,400 of every 100,000 involves
marijuana. Colorado’s DPS stated that these are early
statistics and it is too soon to come to any conclusions
about the effects of legalizing marijuana.
Pennsylvania: Governor Tom Wolf signed a bill at the
end of April, making Pennsylvania the 24th state to legalize
marijuana for medical use. The new legislation will allow
any person with one of the seventeen qualifying conditions
to receive and use medical marijuana to treat their ailment.
Some of the conditions approved include epilepsy, cancer,
PTSD, autism, and various neurological and gastrointestinal
disorders. It will take about 18 months to get the program into
place before medicine will be able to be dispensed to patients.
Governor Wolf addressed the crowd before signing the bill,
stating, “This is really a great day for Pennsylvania. This is a
really great day for all of us.”
Arizona: Two men were arrested last month in
connection with a grow operation that contained over
1,100 plants. Authorities describe the discovery as a “very
high-tech indoor grow operation”. Inside the house, officers
found a hash processing room and industrial equipment
that would allow the men to process a high volume of
plants after they are harvested. At another house, owned
by one of the men, detectives found processed cannabis
in sealed bags, ready to be distributed. Patrick McDonald
and Kyle Sorensen were arrested and face charges of
manufacturing, possession with intent to sell/transport,
and possession of over 2 pounds of marijuana. Authorities
said the operation could’ve produced about 4,000 pounds
of marijuana per year, which is a potential $10 million in
street value.
Sore Losers
Grow Operation Found at Crime Scene
Piketon, OH: Eight family members, in four different houses, were
brutally murdered execution style as they slept in their beds in late April.
Authorities believe the Rhoden family was specifically targeted and have
cautioned other members of the family living in the area that they could
be potential targets. So far 50-60 people have been interviewed, over 100
tips have been received and are being investigated, and over five search
warrants issued and completed in the case. Authorities commented, “This
was a pre-planned execution of eight individuals. It was a sophisticated
operation and those who carried it out were trying to do everything they
could to hinder the investigation and their prosecution.” While officials
would not release how many guns were used, the type used, or whether
the family members were involved in criminal activity, they did state
that marijuana grow operations were found at three of the four crime
scenes. As the investigation is ongoing, officers would not comment as to
whether the grows had anything to do with the murders.

Nebraska and Oklahoma: After their lawsuit against
Colorado was dismissed by the US Supreme Court last month,
Nebraska and Oklahoma are trying again, in the 10th US
Circuit Court of Appeals, asking to combine their lawsuit with
another already brought against the state. The case they are
hoping to be added to is a consolidation of two separate
appeals filed by a group of county sheriffs and owners of
a property next to a marijuana grow operation, supported
by anti-legalization groups, whose lawsuits were dismissed
in lower courts. All three lawsuits are based on the idea
that federal laws criminalizing marijuana should override
any state laws. Nebraska and Oklahoma continue to argue
that legalization in Colorado “violates their sovereignty and
requires them to spend more money arresting, jailing and
prosecuting an increasing number of people caught bringing
pot into their states.” There is not a time line for the Circuit
judge to make a decision on the states’ request.
Trial for Marijuana Mom
Colorado: The trial for a 39 year old, northern Colorado
mother accused of buying and selling a marijuana brownie,
and witness tampering, began late last month. Julieane
Joblonski has been charged with illegally transferring
a marijuana concentrate and witness tampering after
selling a pot brownie to her son’s roommate, then telling
him to lie about where he got it after speaking to police.
According to police reports, Joblonski’s son, Austin Essig,
consumed the brownie, bought from his mother by his
roommate, before jumping from a third story window.
Essig suffered serious injuries in the fall but survived.
The defense argues that while she did buy and supply the
marijuana, she never told the teenager to lie on her behalf.

convicted she could face prison time

Canada to Start Legalization Process
Canada: When Prime Minister Justin Trudeau
took office last year, he made the promise to
legalize marijuana in the country. Now the Liberal
Canadian government has announced it will start
putting the promise into action starting next
spring. Health Minister Jane Philpott informed
the United Nations that the government plans
to introduce legislation in the spring of 2017.
While she gave no details of the bill itself, she
did state that it will “challenge the status quo” of
drug policies in other countries and that it will be
approached from a “scientific and evidence-based”
view. Philpott believes the move to legalization
would likely bring a decrease in drug-related
crime and the abuse of more harmful substances.
Although legalization will be coming, law
enforcement will still be cracking down on
dispensaries and possession of marijuana until
the bill comes into law.
England: Anastasia James, a 37
year old mother from Braunstone,
has been charged with ‘causing
death by careless driving when unfit
through drugs’ and sentenced to four
years in prison after slamming into a
tree, killing her 14 year old daughter
and her son’s 18 year old girlfriend
two years ago. James, her daughter,
her son, and his girlfriend were on
their way home from a birthday party when James lost control of her
vehicle at 70mph and flew off the road into the tree. Her daughter and
her son’s girlfriend were declared dead at the scene, while her son
suffered a broken leg and James walked away with only minor injuries.
At her trial forensic scientist, David Berry, informed the court that the
traces of THC found in James’ blood would have been enough to impair
her driving. James, however, has maintained her innocence, claiming
she did not smoke anything the day of the accident and a defect in her
car had been behind the crash. The judge at her sentencing had no
pity on the woman stating, “‘For the sake of a few drags of cannabis,
the lives of these young people were extinguished. The forensic
evidence is absolutely clear - it was not a legal high as you still insist,
and the cannabis impaired your ability to drive. You knew what your
responsibility was to the young people in your car. I absolutely have to
bear in mind the devastating effect this has had on Megan’s parents,
as well as you. You still maintain your innocence to the probation
service. As I said during the trial, there are no winners in this case, on
either side.” James, who has a previous conviction for the possession
of cannabis, is also prohibited from driving for two years after she is
released.
Croatia Begins Medical Sales
Croatia: Last October Croatia legalized marijuana for medical
use to protect patients from the illegal sale of marijuana, which
officials believe often has uncertain quality. Now the free sale of the
medication will be allowed, but it will have to be paid for out of the
patients’ own pocket. Experts in the country believe cannabis will
only relieve symptoms, not cure or treat the ailment itself, this is the
reasoning behind the health authorities declining to allow insurance
to cover the cost of medication, which will cost patients between
EUR 200-270 a month. The marijuana will not be grown in Croatia,
but will be imported from Canada and sold in the form of capsules to
registered medical patients who suffer from multiple sclerosis, cancer,
or HIV/AIDS.

Re-Criminalization in Canada?
Don’t Decriminalize, Legalize
Jamaica: Professor Errol Morrison, chairman of the
University Diabetes Outreach Programme (UDOP) and the
director general of the National Commission on Science and
Technology, spoke at a press conference with the principal
of the University of the West Indies Professor Archibald
McDonald calling on the Jamaica Labour Party Administration
to legalize marijuana. Morrison acknowledges that the
decriminalization of marijuana last February was a good
move, but it is not enough. Morrison and McDonald are urging
the administration to be bolder than the last and feel the
restrictions surrounding the drug are actually economically
related and not about protecting the people from the evils of
drug use as has been claimed. McDonald claims the reason the
government is being so tentative about legalization is due to
fear of United States interference, stating, “Let me assure you
that where we are now… the truth is the United States will
not interfere with us, and this is why they are not interfering
with their states. They realize that the word is out, they have
the information on cannabis, [and] they realize they can no
longer protect that information. There are too many countries
in the world, not just Jamaica, who now are doing research
on ganja and have that information. The Federal Government
of the United States is not stupid and know that they can no
longer continue this deception. So, if a country like Jamaica
were to move forward, nothing will happen to us.” Both men
believe that legalization could bring much needed revenue to
the country and possibly make Jamaica the ‘mecca for health
tourism’.
Canada: Kellie Leitch, a candidate for the Conservative
Party leadership, stated recently that, if ever elected prime
minister, she would re-criminalize marijuana. Huffington
Post reports that her ‘experience as pediatric surgeon
has shown her that the plan to legalize the drug will put
minors at risk’ as studies have shown marijuana can have a
large impact on a developing brain. “I don’t want to see any
child put in harm’s way by having access to a dangerous
drug,” she stated. While she feels that full legalization will
make the substance more attainable for adolescents, she
does agree that marijuana should be available to patients
who need it for medicinal reasons.
Growers Released on
Technicality
Scotland: Three Vietnamese
men were arrested in Fife
on April 22nd on charges of
producing cannabis and ‘perverting the course of justice’, by
giving false birth dates while being questioned by officers.
However, a few days after being arrested the men were set
free due to the unavailability of an interpreter. Lawyers for
the men claim they were unable to assist their clients in
pleading to a lesser charge, which carried a maximum one
year sentence, before the charges were changed to more
serious offenses and carried a sentence up to 14 years. The
Crown agreed with the petition and threw out the charges.
A spokesman for the Crown Office and Procurator Fiscal
Service stated, “The case could not go ahead as police were
unable to provide an interpreter in the time available. The
outcome does not prevent future criminal proceedings.”
Asylum Seeker, Weed Distributor
Denmark: A man living in Denmark’s largest asylum center,
a public institution used for housing refugees whose asylum
application is being processed, has been arrested for the one
ton marijuana distribution operation he ran out of the center.
Police believe he came into the country with falsified papers
and that about 100kg of the stash made its way to the streets
of Copenhagen, while the rest went to Sweden. The 26 year
old is facing charges of selling 835kg through the asylum
center, carrying a street value of about 15.5 million kroner ($2.3
million), which could end in deportation or prison time.

While attending a seminar in Gaylord, put together by Michael
Thule, Grannies for Grass and OrganiBliss, we had the pleasure
of listening to one of Michigan’s most famous growers. Winner of
Cannabis Cup Hightimes in Amsterdam, DJ Short has become a
legend.
During his seminar, he discussed many subjects but one that
I really thought was interesting was the use of hop-houses for
outdoor cultivation. He explained how many growers are using light
deprivation, to force budding on plants early. By using thick tarps and
other light shielding fabrics, hop houses can be covered every day in
the evening and uncovered in the late morning thus creating a twelve
hour light cycle.
“By bringing plants into final weeks of budding in July and August
when the sun is at the summer peak of brightness, we can produce
buds that are at their climax of quality.”

MI Legalize, MCC,
or None of the Above?
With raids continuing on
dispensaries and caregivers across
the state, and no relief in site
from house bill 4209, the Medical
Marijuana Facilities Licensing Act,
many remain hopefully optimistic
that legalization will come to
Michigan via the ballot box.
Committee to Ban Fracking and MI
Legalize have been thwarted by the
state board of canvassers in their
attempt to implement a change
in the 180 day rule for validating
petition signatures. Regardless,
until June 1st the two petitions
to legalize by means of statutory
initiatives from MI Legalize and the
Michigan Cannabis Coalition (MCC)
will continue to raise funds and pay
for professional signature crews
and dominate the mainstream news
coverage.
What most people don’t know
is what progress these ballot
committees have actually made
regarding actual signature turn ins
and validity rates. Both MI Legalize
and the MCC have non-disclosure
polices regarding aspects of their
two campaigns. Interesting enough,
neither group has demonstrated
a likelihood of actually making
the ballot in 2016. Both groups
have long passed the initial turnin deadline, which was last year,
are burning money to try and start
virtually new campaigns in regards
to signature gathering, due to the
fact that signatures turned in prior
to December of last year are stale
and void according to the current
election law.
So why would the MCC and
MI Legalize run underfunded
campaigns against each other? MCC

seems positioned to drive the cost
of professional signature gathering
just high enough to be able to keep
other groups from making their
final goal. Both groups seem more
to be positioning themselves for
a rematch in the year that follows.
With the death of Paul Welday, the
Michigan Responsibility Council
(MRC) and their members will
remain a mystery. Other then Tim
Beck and Adam Macdonald, no
other associates of the MRC have
disclosed their political agenda for
the Michigan medical marijuana
industry.
Robin Schneider reported that
she and the National Patient Rights
Association (NPRA) met with MRC
last year. It was reported that the
MRC was looking at a six-company
monopoly for cultivation of all
cannabis in Michigan. When conflict
with the zoning laws prevented
a statewide ballot initiative from
being viable, the MRC focused their
attention on passing a corporate

Meanwhile, Adam Macdonald
and Board Members of MI Legalize
led a failed joint referendum
campaign to overturn the Detroit
dispensary ordinance. Botching the
signature gathering and turning
them in late ended up working
well for Macdonald’s dispensary
Natures Alternative, which will be
able to apply for a variance during
the approval process. Terrence
Mansour, Robin Schneider and
Adam Macdonald went on record,
advocating the need to restrict
new dispensaries in Detroit.
Defector from Michigan Cannabis
Development Association, George
Brikho, has sounded the whistle
about Terrence’s greedy attempt
to take over large portions of the
medical marijuana market, with
the help of the owner of Wild Bill’s
Tobacco and other Lansing insiders
using this three-tiered approach to
medical marijuana.
After establishing a play-to-play
policy for dispensaries in Detroit,
Nature’s Alternative opened a
second location in Lansing. Last
month, Lansing Mayor Virg Bernero
surprised everyone by announcing a
moratorium on new dispensaries in
Lansing
and expressed
concerned about too many
dispensaries in the capital. Although
the attempt to place restrictive
dispensary legislation has failed for
right now, the fight to control local
markets is on.
Considering how much influence
various dispensary groups like the
NPRA and the MCDA have on board
members of MI Legalize, as well as
state and local medical marijuana
policies, many have pointed out
a legitimate conflict of interest. If
the NPRA willingly sabotaged an
effort to referendum the Detroit
dispensary ordinance in exchange
for special consideration will they
do the same in Lansing? Are their
agents on the Board of MI Legalize
playing both sides of the MRC
to position their friends in the
industry, and secretly controlling
the legalization movement to
manipulate the system? If that were
true, players like Adam Macdonald
and the NPRA can support both
MI Legalize and MRC, skillfully
manipulating both.
This really is no surprise to
those from those who have seen
this coming for some time. Back
in 2010, then Grand Rapids City
Attorney, Catherine Mish, explained
the plan to use case law to go after

caregivers and patients and erode
the MMMA. Why did Jamie Lowell
and Robin Schneider, at that time
working with Michigan Association
of Compassion Centers (MACC), not
work to build a coalition to defeat
this legal tactic? All the so-called
marijuana lawyers knew all about
it, but never came together to
mount a legitimate resistance. No
collective effort was made to unite
the medical marijuana industry, but
rather every time a unification effort
took place, like with the Cannabis
Stakeholders Group, the agents of
MACC would infiltrate and disrupt
any progress to protect patients and
caregivers.
If there has been one thing the
MI Legalize has accomplished is to
have meeting with the NPRA, MRC
and prevent any unification for
medical marijuana professionals.
Is MI Legalize just another one
of our efforts to end the war on
marijuana users to be infiltrated
and disrupted by the big money
people of Michigan? Obviously, the
establishment in Michigan has been
eyeing marijuana as a big prize and
certain organizations like the NPRA
and MCDA have been seduced by
dreams of massive wealth creation
to join forces with the powers that
be in Michigan.
Tim Beck, from Coalition for
a Safer Michigan, has been very
plain in explaining his motivation.
“I only have so much time,” Beck
explains. “I want very badly for
this (legalization) to happen in
my lifetime. I cannot work with an
underfunded campaign. Remember
the golden rule: He who has the
gold makes the rules.”

make your choice, buy your medicine and

ighest greetings from Detroit, where
I’m spending my last week before crossing
the ocean to appear at a Detroit Artists
Workshop exhibition in London and then
on to Amsterdam for as long as I can get
away with it.
April is always a great time for me to be
in Michigan, and except for the day-long
snowfall at the Hash Bash in Ann Arbor at
the top of the month, which didn’t really
seem to dampen too many spirits out on
the Diag and on Monroe Street for the
festivities, I’ve had a great time celebrating
the sacred weed in various settings all
month.
Following the Monroe Street Fair there
was the annual Hash Bash celebration at
the Blind Pig where I get to perform with
Brennan Andes and Ross Huff from the
Macpodz and their musical comrades for
the occasion. Oh yeah, and there was the
before party hosted by the Third Coast
people from Ypsilanti at a big house in
the country where I had the pleasure of
hanging out with Dan Skye, editor of High
Times, listening to music by an impromptu
ensemble headed by my old pal Muruga,
and then spending the night in one of their
splendid guest rooms so I could make it to
the Diag on time the next morning.

On April 16 I had the privilege of
attending a water purification ceremony
organized by Native Americans from
the area and conducted by elders and
spirit leaders of the Potawatomie nation.
This beautiful ritual culminated with the
passing of the sacred pipe among all the
participants and the offering of traditional
Potawatomie prayers for the cleansing of
the river and all waters.
As the pipe was offered to each person
and passed from the pipe carriers to the
people one by one, I was reminded that this
is where our practice of toking and passing
the joint came from in the first place and
how toking and smoking together have
their origins in spiritual communion with
all our relations and the universe itself.
The sharing of marijuana has become
farther and farther removed from its
spiritual roots as the cannabis culture has
become more and more commodified and
commercialized over the past half century
since we were first introduced to weed by
our brothers in the ghetto and supplied
with our sacrament by growers in Mexico
and our intrepid comrades who brought
it to us despite the incredible obstacles in
their path—particularly their relentless
pursuit by the drug police every step of the
way.

Now that the police are gradually but
inexorably being removed from our lives as
marijuana smokers (or whatever delivery
system one may choose), I’d say that it’s
a good time to return to our roots and
embrace the concepts of spirituality and
ritual celebration that once served as the
underpinnings of our relationship with the
weed.
The coffee shop concept that prevails
in Amsterdam and the Netherlands is
much closer to the traditional practice of
marijuana smokers than what we are seeing
now in Michigan and elsewhere weed is
being permitted to be bought and sold in
public. I’ve spent some delightful hours in
compassion centers like GC3 in Flint and
The Herbal Centre in Mt. Morris, where I
just spent the 4/20 holiday, because along
with the availability of multiple locallygrown strains of great weed offered by the
producers themselves in a cooperative,
“farmers market” sort of environment,
these establishments also provide smokers
with a special room where we can sit with
fellow patients and smoke our weed in
peace and fellowship.
Frankly, this is the opposite of what I’m
looking for in a marijuana provisioning
center. What I’m looking for is the
opportunity to get together in a congenial
setting with other smokers like myself
and get high together, share our herb and
our experiences, listen to music together,
engage in relaxed conversation and, when
we move on, take some weed home with
us. I submit that this is a more civilized and
humane system for taking care of the needs
of medical marijuana patients, or humans
of any stripe for that matter, than we are
afforded here under their present scheme.
The proliferation of provisioning centers
throughout Michigan and particularly in
Detroit should have led to a superior form
of organization for the dispensaries that
would include the on-site ingestion of weed
in a comfortable, friendly atmosphere,
but this prospective organic development
has been stymied by the attack on the
compassion centers by the Detroit City
Council and the DPD. Instead of allowing
these innovative installations to evolve and
flower into more perfect entities, the City is
trying to make sure that regression will be
the only course allowed.
In the first place, instead of being
ecstatic that over 200 new businesses
have opened in the city, many in seriously
dilapidated areas, in response to the
legalization of medical marijuana several
years ago, the City administration is trying
to reduce the number of care centers
to what Detroit Corporation Counsel
Melvin “Butch” Hollowell claims will be
“approximately 50 Medical Marihuana
Caregiver Centers in various locations in
the city.”
As Chris Feretti reports in the Detroit
News, Butch holds that “the city’s medical
marihuana regulations are lawful, fair
and reasonable. We will continue to
enforce compliance in the courts, while
concurrently processing the applications
submitted for medical marihuana caregiver
center licenses.”
About 195 applications overall have
been submitted. Of those, 74 are seeking
to operate in what the city calls “drug-free
zones,” Hollowell said. A group of caregiver
centers brought suit against the City in
March when their applications were turned
down outright when the City claimed
each of the dispensaries was located in a
so-called “Drug Free School Zone.” The
lawsuit was filed because the City provided
the applicants no means to appeal, but the
suit was dropped before it could be heard.
As Peretti reports, “The federal Drug Free
School Zone Act prevents the drug from
being delivered, sold or manufactured
within 1,000 feet of a school. State law
also factors libraries into the rule. The
city’s zoning regulations cover educational
institutions and goes beyond that,
prohibiting shops from operating near
child care centers, arcades and outdoor
recreation facilities.”
I’m leaving Detroit this week so I’ll have
to follow this issue from afar, but while
I’ve been here I couldn’t help but notice
the many green outlets and how good they
looked against the desolate landscape of
Detroit. Comrade suppliers, you’ll be in
my thoughts and prayers until my return.

Joins the Movement in Gaylord
Gaylord: Medical Marijuana centers Cloud
45 and D&L re-opened their doors in Gaylord,
Michigan. Disputes regarding the legality of
medical marijuana dispensaries came after
raids citing violations of case law established in
People versus McQueen, Hartwick and Tuttle.
In March, the City of Gaylord amended its
ordinances to allow for Medical Marijuana
Provisioning Centers, Medical Marijuana
Cultivation Facilities, and Medical Marijuana
Extraction Facilities in commercial and industrial
districts. Dispensaries and grow facilities
encouraged by the legitimization by local
authorities adjusted their business models to
comply with changes in the Medical Marijuana
Act in the fashion of dispensaries in Ann Arbor,
Ypsilanti, Detroit, Lansing, Flint and several
others.
Ben Horner, from the Cannabis Stakeholders
Group, helped the dispensaries induce the
Medical Marijuana Ordinance. According to
Horner, ”We believe that the dispensaries were
in compliance with the Medical Marijuana
Act, and that as the question of case law is
reviewed dispensaries have found the way
to stay in compliance with what the Otsego
County Prosecutor and SANE Officers mistakenly
interpreted as a violation. That is why there
are over 300 dispensaries across the state
with various business models, which include
farmers markets, therapy groups, collectives,
and non-profits. Statistics have proven that in
communities that have dispensaries, crime, drug
overdoses, teen use and suicides go down and
local economies improve.”

BIG STORY BREAKING.....
Several high end steak restaurants in the City of Troy feel the
need to institute a “you stink like weed, we’ll have to ask you
to leave” policy..... WHY? It appears that these high dollars
restaurants have caved in to the complaints of other customers,
which I find odd.... now if you are reeking of weed when you
come in you will be refused service.....understand I’m all for
refusing service to people who you don’t care for......however
some baller who blew a bone in the car before dinner, why
would you refuse him a meal....he will probably spend more on
his meal than a party of two..... he certainly won’t be a problem
like the guy ordering drinks from the bar...... So why would a
restaurant consider the odor of weed offensive? Because they
can..... You can walk into these places stinking like a bottle of
cologne or worse some old hag......their perfume is the worst....
won’t be refused for that stench...... Personally I would love
to call for a big protest/eat in....where we all puff hard before
going inside for dinner.. but they would only take our money
and laugh...so I was thinking that people standing outside
these places with signs that say POTHEADS NOT WELCOME,
might be in order......but as I wrote this it dawned on me that
the best thing we could do is stop spending our money at these
places......So I would ask two things.....if asked to leave because
of a weed order TEXT me at 313-999-0329, I want to hear your
story,. The second thing is PUFF TUFF before spending $40+ on
a steak......oh yeah, INVITE me to dinner with you, I always have
the herbfume going.......

So I’m thinking about finding
a caregiver, for myself.... I can’t
physically grow my own due to my
inability to lift anything, so I thought
a caregiver might be the way to go....
The problem is the deal.....I can’t see
you growing what, 12-18 lbs, in my
name and you want to give me a
free oz per month? WTF? How about
you give me 3lbs and keep the rest? I know people who get 12
free ozs a year while the grower has 50lbs.....oh and the grower
will sell his patients more, but at $200-250 per oz..... maybe
I don’t understand NEW MATH, but I had a grow store at one
point and I think I understand how to grow monsters indoors
here in Michigan...... So if you are looking for a new patient and
understand how my brain works feel free to hit me up....

Save the
in Michigan!

Many people ask me questions about issues
connected with medical marijuana and their children.
Some of these are as follows: Can the State take my
children from me if they find out I am a caregiver/
patient?; Can the State take my child if I give him/her
medical marijuana for Autism or Epilepsy, or many other
illnesses?; and Will I lose my children in my divorce
because I am a licensed caregiver/patient?
This month, I’ll discuss the issue of divorce and
child custody in the context of the Michigan Medical
Marijuana Act (”the MMMA”). First, as a member of the
human race, I believe in the freedom to think, speak
and act in any way one chooses, so long as it does not
interfere with the right to self-determination and/
or property rights of others. Next, as an attorney who
handles divorces, my philosophy is that except in
extreme circumstances, the best interests of children
are served only by remaining in the custody of both
parents. Moreover, the best case scenario is that parents
continue to live in the same school district, and that the
children have equal parenting time and access to both
parents. In short, the philosophy of freedom and the
best interests of children in a divorce are the same.
Unfortunately for children, not everyone agrees
with my philosophy, and custody becomes an issue in
many divorces. In order to guide the courts, there is a
list of 13 statutory factors which courts must analyze
in order to determine custody of children in a divorce.
This list and the legal analysis is far too
extensive to give a detailed run down
in a magazine article. However, the
nuts and bolts for determining custody
are whether one or both of the parties
has the ability and willingness to see
to the children’s financial, emotional,
educational, religious (if any), and family
relationship needs, in order to grow into
reasonably healthy adults.
The MMMA states that, “A person shall
not be denied custody or visitation of a
minor for acting in accordance with this
act, unless the person’s behavior is such
that it creates an unreasonable danger to
the minor that can be clearly articulated
and substantiated.” MCLA 333.26424(c).
However, even if there is no danger
involved, the factors to determine custody
must still be analyzed. Also, the factors
could be analyzed to deny a parent

custody and/or visitation. Thus, the essential question
is, does the use or growing of marijuana interfere with
one’s ability and/or willingness to see to the children’s
financial, emotional, educational, religious (if any),
and family relationship needs, in order to grow into
reasonably healthy adults? If the answer is no, then the
use or growing of marijuana should not even be a part
of the analysis of the 13 statutory factors.
Still, there are those who will attempt to make it
an issue in determining custody. In a divorce the wife/
husband may attempt to label their spouse who is a
caregiver as a “drug dealer”. Or, the wife/husband may
attempt to label their spouse who is a patient a “drug
addict”. The key to defending this type of labeling is
to stand firm and impress upon the court that you as
a caregiver or patient are no different than a medical
patient of any kind. That ingesting or growing medical
marijuana poses no more a threat to your ability to
parent than being an Oxycontin or Norco patient. Fact
is, it’s even safer around children than Oxycontin or
Norco. After all, your marijuana meds must be locked
away and out of reach of the children by law, while at
the same time the Oxycontin and Norco as well as all
the other prescription opiates are not required by law to
be locked away from children.
It is up to you and your attorney to present the
facts to the court. Your children’s well-being is at
stake. Children of divorce are damaged enough, even
in a shared custody arrangement. Keeping them from
a parent is not only detrimental to freedom, but it
causes even greater harm to the children. However,
if you or your attorney do not truly believe that the
cause of freedom and the best interests of children are
synonymous, then you may not be successful. Therefore,
if you are a medical marijuana patient or caregiver and
you find yourself in a custody battle, choose wisely the
person who represents you in your divorce. Save the
children the harm that will assuredly come if they are
denied equal access to both parents.
Like in all other aspects of life, freedom is not free.
One must think, speak, and act to further the cause of
freedom. But the denial of your freedom takes no action
on your part, you need only keep silent and do nothing.

the cat box lives. What do you think will

No it isn’t pretty. In fact it looks like
shit. Literally, that cat poo looks just
like any old shit. And yet, it is still quite
the attractive nuisance to that young
inquisitive mind, who just can’t resist
putting the thing into its mouth (poodites?). It’s quite a dilemma …inducing
abject disgust and nausea. We should
outlaw cat poo. Or at least regulate
the hell out of it. For the safety of our
children, of course.

finding it more and more difficult to
demonize the healing Canna.
Still they try. One of the most potent
arguments they have at their disposal is
to point to the increase in the number
of children that have been admitted
to ER facilities over the past couple of
years in Colorado since legalization took
effect. They LOVE that statistic because
it seems so dramatic. The stats show
that the number of child-Cannabis-ERincidents rose by a whopping 37% from
2009-2014! That seems HUGE until you
look at the actual number of kids they’re
talking about. In 2014 the number was
70 in the entire state of Colorado. The
hospitals say almost all of them had
eaten some form of either homemade
or store bought medicated “brownies”
or “cookies.” While they can’t say that
any of those kids died, they sure love
to suggest that one could at any time…
though there’s no evidence to support
that supposition.
And that’s the thing. It’s just fear
mongering for the sake of bolstering
their precarious position. Because they
can’t do anything else…they’re stuck
in that prohibitive mind set. They’ve
dug their heels in too deep. As a result,
they’re having to constantly pull the
wool so thinly across our eyes just to try
and get us to even listen. So thin, in fact,
that we’ve begun to see right through it.
Recently, new legislation passed in
Colorado’s State House that is designed
to significantly change the way parents
are able to better care for their kids.
Patently absurd, yes? And yet that is
the mentality most prohibitionists have
when discussing how to “protect” our
kids from Cannabis. But where cat poo
might actually harm your child, Cannabis
is completely NON-TOXIC. No one has
ever died from ingesting Cannabis-EVER. The same cannot be said for cat
poo (Toxoplasmosis anyone?).
That’s their fantastic idea. But they didn’t come
up with it in a vacuum. It turns out the Colorado
Cannabis Chamber of Commerce proposed this
notion months ago. It was a proactive campaign
geared towards showing legislators just how well
the Cannabis Industry is able to regulate itself.
The CCCC held a press conference in February to
announce these self-imposed changes to a small
group of reporters, myself included. They and
their members would no longer use these types of
shapes. The story didn’t get much traction at the
time.
Edibles come in many different shapes and
sizes. They’re made from different ingredients
and can take any number of forms. While our
legislators are proud of themselves for making
this particular distinction for the sake of faulty
prohibitionist argumentation, the outcomes won’t
really make a difference. Because, sure kids like
animal and people-shaped objects. But there
are so many other attractive shapes that can be
utilized: stars, crosses, flowers, a dodecahedron…
even cat poo.
The argument, “what about the children” is moot
when it comes to Cannabis prohibition. Mainly,
because over the last 80 years or so it hasn’t
worked in the least to keep Cannabis out of the
hands of our youth. What’s more, unregulated
Cannabis is sold on the Underground Market
by unscrupulous dealers who don’t think twice
about upselling their customers to harder, more
expensive drugs. National statistic show that
Cannabis use by teens is and has been on the
downswing since the 1980s.
Prohibitionists always look for ways
to demonize that which they are trying
to prohibit. It makes it much easier
to convince others of the “correctness”
of their position if they can point to
the “evils” done by said prohibitive

products. No more gummy bears or sour patch kids.

In those states that have legalized Cannabis,
statistics show that same decline— even though
those numbers are higher to begin with.
Young kids getting their hands on Cannabis
edibles is a challenge. Cannabis is non-toxic, yet
there are still uncertainties. When an infant or
toddler ingests Cannabis accidentally, I have to
ask where those parents were at the time. Yes,
accidents happen. But how is it the responsibility
of edibles manufacturers to ensure what happens
in your own house? If young kids are getting
Cannabis it’s because their parents aren’t being
responsible with it. Changing the shape of edibles
isn’t going to effect that.
What about the children? “The kids are
alright…” it’s their parents we need to educate. If
the prohibitionists really cared about keeping
Cannabis out of the hands of kids then they’d
help us legalize it and take it out of the hands of
ruthless dealers. If we put Cannabis into the hands
of regulated business owner’s, kids will have less
access to it. Period.
