An Arizona-based builder, Maracay Homes builds single-family homes for premium homebuyers in the greater Phoenix and Tucson markets. We remain in constant contact with you by phone, email and mail at regular intervals to continually update you on the progress of construction, as well as to remind you about scheduled meetings and orientations. 1 The information contained in the Customer Experience Guide (CEG) offers detailed descriptions and expectations for every step of the journey – from your first visit to our sales center to the day we hand you the keys to your new Maracay home. Dialogue with hundreds of customers helped Maracay Homes create Flex Design® to give you more choices for the way you want to live. NEXT STEPS TO HAPPY HOMEOWNERSHIP Our desire to maintain open communication with you extends through the buying process and after move-in. In an effort to improve the products and services we provide, we welcome your comments on our performance. You will receive a brief survey from Woodland, O’Brien and Scott approximately forty-five to sixty (45 to 60) days after closing on your new home. Please take the time to provide us with honest and accurate feedback. We aim to build the best home and the best customer relationships possible; your feedback is important to us and helps us reach that goal! The following paragraphs outline the events that typically take place in the purchase of a new home. Most of these events are covered in detail in later chapters of this guide, including time frames to which we must adhere for the construction and settlement process to run smoothly. For quick reference, we’ve provided checklists at the end of each chapter that spell out what you’ll need to do and what Maracay Homes will be doing “behind the scenes.” The home-building process is fascinating but also complex, with many decisions to make and details to arrange. While Maracay builds your new home, you’ll play an important part in several significant aspects of your purchase. This guide serves as the cornerstone of our effort to set mutual expectations during the planning, construction and servicing of your new home. If we establish a common set of expectations, there is an increased likelihood that your purchase of a Maracay Home will result in your satisfaction and eagerness to refer us to friends and colleagues. 2 NEXT STEPS — BUILDING YOUR NEW HOME TOGETHER Next Steps — Building Your New Home Together, Chapter 2, describes the Next Steps Meeting, which helps each of us gain an understanding of our mutual expectations. This chapter clearly outlines the selection, construction and warranty processes. Please be prepared to discuss the contents of The Maracay Way — A Customer Experience Guide at the Next Steps Meeting. After this meeting, you should have a thorough and realistic understanding of what we provide. FINANCING YOUR NEW HOME PURCHASE AGREEMENT The Purchase Agreement and various addenda presented to you at the time of purchase constitute the legal documentation of buying a new home. For your convenience, this guide includes a tab labeled “Purchase Agreement Documents,” immediately following the Overview Section, in which you can place a copy of your Purchase Agreement. Please read the Purchase Agreement and all attachments carefully as they spell out our mutual obligations. In the unlikely event of any confusion or inconsistency between your Purchase Agreement and The Maracay Way — A Customer Experience Guide, the Purchase Agreement will take precedence. Also, we will place your copies of the Public Report and Covenants, Conditions and Restrictions (CC&Rs) for your community in this tab, as well as the Homeowners’ Association (HOA) documents (Articles of Incorporation, Bylaws and Design Guidelines). Financing Your New Home, Chapter 3, provides a thorough description of the loan process. This chapter includes an introduction to Tri Pointe Connect and helps explain why we feel so strongly that they are the best choice for your new-home financing. Further, Chapter 3 includes a checklist of the documents you will be required to bring to your meeting with Tri Pointe Connect. TM YOUR NEW HOME SELECTIONS New Home Selections, Chapter 4, walks you through the exciting process of personalizing your new home with selections from the Maracay Homes Design Studio. Chapter 4 contains selection tips and time frames and explains selection limitations. TRADE CONTRACTOR SPECIALISTS Trade Contractor Specialists, Chapter 5, provides an introduction to the trade contractors that are available to you for the selection of additional customizing options in your new home, such as structured wiring, landscaping and pools. MEETINGS DURING THE CONSTRUCTION PROCESS Meetings during the Construction Process, Chapter 6, details the scheduled personalized interactions during the construction process. Familiarizing yourself with the information in this chapter will help you obtain the maximum benefit from these meetings. CONSTRUCTION OF YOUR NEW HOME Construction of Your New Home, Chapter 7, contains guidelines on safety, security and work in progress. This chapter provides valuable insights into the world of new-home construction and will help you appreciate and participate in the process of constructing your new home. 3 CLOSING ON YOUR NEW HOME Closing on Your New Home, Chapter 8, describes the documents you will sign and other important details about the closing process. We’ve included information to help you prepare for closing and moving. YOUR NEW HOME WARRANTY PROCESS New Home Limited Warranty Protection Program, Chapter 9, describes the Maracay Homes’ Limited Warranty Protection Program. This chapter also outlines the maintenance you should expect to perform on your new home and our warranty service commitment. It details the Full Warranty process at your 60-Day Follow-Up and 11-Month Review/One Time Services. Additionally, there is a special section on Emergency Service. THE TOP TEN The Top Ten, Chapter 10, lists the top ten (10) areas that tend to be a source of misunderstanding or frustration between home builders and their customers. At Maracay Homes, we address these areas upfront to ensure that the stage is set for a smooth process. SUPPLEMENTAL MATERIALS Supplemental Materials, the last section of this guide, contains valuable information for Maracay homeowners. This section includes a Homeowner’s Warranty/Standards, complete with your Maracay Homes Limited Warranty Protection Program. Another important document in this section is the Termite Treatment Certificate for your new home. 4 2 Next Steps Building Your New Home Together OVERVIEW As a Maracay customer, we encourage you to participate in a series of scheduled meetings with various members of your community team. These sessions will keep you informed and establish and maintain clear expectations for all parties. They will also facilitate clear communication and customer satisfaction. The first of these scheduled meetings is the Next Steps Meeting. MEETING PURPOSE The Next Steps Meeting is held between you and your New Home Advisor and will last approximately two (2) hours. At this meeting, we will review this guide in detail so you thoroughly understand our processes. ATTENDEES All parties named in the Purchase Agreement should attend this meeting. If a real estate agent assisted you with your purchase, he or she is welcome, but not required to attend. A WORTHWHILE INVESTMENT Be sure to read and become familiar with the material in this guide prior to the Next Steps Meeting. We realize there’s a lot to absorb, but considering the size of the investment you are making, you’re certain to find the investment of a few additional hours worthwhile. The Next Steps Meeting is the perfect opportunity to ask questions and obtain clarification. MEETING AGENDA During the Next Steps Meeting we will review the summary pages found at the end of each chapter and answer any questions you have after reading The Maracay Way — A Customer Experience Guide. We’ll give you a copy of the guide when you sign your Purchase Agreement. Your New Home Advisor will also have a hard copy on hand for your reference during scheduled meetings. 5 To-Do List Ours Deposit and verify earnest money. Architectural review of your home. Draw your plot plan. Order your building permit. Prepare your homesite for construction. Submit your Purchase Agreement paperwork to the lender and title company. 6 Yours Read The Maracay Way — A Customer Experience Guide and jot down any questions you may have. Review the options list given to you by your New Home Advisor at the time you signed your Purchase Agreement. Make note of the non-structural options that you want to add to your home. Your New Home Advisor will review these options with you during this meeting and finalize your choices before the PreConstruction Meeting. 3 Financing Your New Home TRI Pointe Connect™ A Clear Path To Homeownership. HOME FINANCING. TAILORED TO YOU. Financing is a critical step in buying your new home, but it doesn’t have to be difficult. TRI Pointe Connect™ is designed to provide a simple and clear path to homeownership by offering a full range of home financing options. Like any relationship, communication is key. And we’re ready to offer guidance and answer any questions, every step of the way. TRI POINTE CONNECT PROVIDES: 1. An impressive selection of loans with terms that fit your needs. 2. A transparent process that’s in sync with the construction and delivery of your home. 3. All the support, communication and TLC you’ll need from a group exclusively dedicated to providing financing for Maracay customers. FINANCING AND CLOSING PROCESS Taking occupancy and moving in requires that your lender be appropriately involved. This process helps to ensure that when your home is completed and delivered, you will be ready to enjoy it! LOAN APPLICATION If you have not already done so, you must apply for any financing required to close escrow on your new home within five (5) days of the date on your 7 Purchase Agreement. This step ensures there is enough time to meet all the criteria necessary to start and close on your new home. We ask each customer to make application with TRI Pointe Connect. Maracay’s investment in your new home is significant. Obtaining a preliminary approval from TRI Point Connect protects Maracay by giving us confidence you are eligible to obtain the financing needed to close your Maracay home when construction of your home completes. The checklist in this chapter will get you started on the documentation you need to provide to your lender. Your lender may require other items we have not mentioned. PRELIMINARY APPROVAL AND LOAN APPROVAL Obtaining loan preliminary approval prior to your appointment at the Design Studio will help you determine the dollar amount of selections that fits your budget and loan amount. Your preliminary approval should include the anticipated amount for all Design Studio selections. Your preliminary approval may be conditional upon certain requirements being met first. For example, you may need to provide copies of tax returns or a recent pay stub, or explain a late charge on one of your credit cards. Maracay Homes requires you to obtain loan approval within 14 days of the date of the Purchase Agreement before construction starts on your new home. Take care to meet all loan conditions promptly to help ensure that your home is started on time. LENDER AFFILIATION Although we have an affiliation with TRI Pointe Connect, we will work with any lender of your choice. Keep in mind that special incentives are offered in our communities when you obtain your financing through TRI Pointe Connect. If you have another lender, you’ll need to provide your New Home Advisor with their contact information. Instruct your lender to keep your New Home Advisor up to date on the status of your loan. 8 WHY TRI POINTE CONNECT? Your satisfaction is our ultimate goal. Maracay Homes strives to provide our customers with quality materials, finishes and amenities; we also seek to establish relationships with companies with like-minded goals. Obtaining financing is a very important step in the home-buying process. It is important to choose a mortgage lender you can count on. TRI Pointe Connect has streamlined the mortgage process, allowing customers to benefit from timely and efficient closings. TRI Pointe Connect offers an extensive array of products and programs to meet homebuyer’s needs. A SMOOTH PROCESS The mission of TRI Pointe Connect is to provide a highly satisfying, customer-focused mortgage experience that compliments the Maracay Homes purchase experience. In addition to unparalleled service, TRI Pointe Connect offers competitive mortgage products and terms. By selecting TRI Pointe Connect, you can be confident of a satisfying and timely closing experience. COMPLETE FINANCIAL PICTURE The job of your TRI Pointe Connect Loan Consultant is to completely understand your particular financial circumstances. You will review all information on the application at your meeting with your TRI Pointe Connect Loan Consultant. A situation rarely arises that your Loan Consultant has not encountered in the past. Do not hesitate to discuss any questions you have regarding your assets, income or credit. By providing complete information, you will prevent delays or extra trips to deliver documents. STEP ONE If you decide to use TRI Pointe Connect as your lender, you will need to contact your TRI Pointe Connect Loan Consultant and apply for a mortgage loan. Your New Home Advisor will provide the contact information. Note: You must apply for a mortgage loan with TRI Pointe Connect within five (5) business days after signing your Purchase Agreement and supply Maracay Homes with a preliminary approval within fourteen (14) days. Additionally, if you elect to use a lender other than TRI Pointe Connect, you must notify Maracay Homes of your lender selection in writing immediately, along with an underwritten loan approval from the outside mortgage company. In all cases, your final lender selection must be made within twenty-one (21) days from the Pre-Construction Meeting. 9 Loan Checklist BACKGROUND The following checklist will assist you with the loan application process. Once the application has been made and the initial disclosures issued, you can expect your TRI Pointe Connect Loan Consultant to request the documentation needed. INCOME The following items are necessary to disclose income: • Most recent pay stubs (Thirty (30) days consecutive) • Documentation of any supplemental income such as bonuses or commissions (last two (2) years) • W-2s for last two (2) years • If you are self-employed or earn income from commissioned sales, copies of tax returns with all schedules (last two (2) years). • Documentation of alimony or child support (if this income is considered for the loan) • Copies of any notes receivable (if applicable) • Names, addresses and phone numbers of all employers for the last two (2) years PROPERTY INFORMATION The following items are necessary to document your final purchase price: • TRI Pointe Connect will work directly with Maracay Homes to ensure your Purchase Agreement and any addenda are included in your loan file. • If you are working with a Maracay Homes’ trade contractor for a pool or landscaping company you will need to provide these contracts directly to TRI Pointe Connect or your outside lender. 10 REAL ESTATE OWNED The following items are necessary to document Real Estate Owned: • Most recent mortgage statements for each property owned • Current lease agreements and most recent two (2) years tax returns (if you own any rental properties) PERSONAL INFORMATION The following items are necessary to disclose personal information: • Social security number and driver’s license for each borrower • Home address for the last two (2) years • Divorce decree or separation agreements (if applicable) • Trust agreement (if applicable) • Power of attorney (if applicable) • Documentation of current residency status (if you are not a U.S. citizen) • Name, address and phone number of landlord (if applicable) • Bankruptcy papers, including discharge (if applicable) LIQUID ASSETS The following items are necessary to disclose liquid assets: • Most recent two (2) months’ statements for all bank accounts (all pages with full account #s) • Most recent two (2) months’ investment statements (if using funds for closing or reserves) • Most recent two (2) months’ retirement statements and terms of withdrawal (if using funds for closing or reserves) LIABILITIES TRI Pointe Connect will run a credit report which will list the majority of your monthly obligations. However, there are a few items that do not show up on most credit reports. Therefore, we need to receive the following in order to disclose all of your liabilities: • Student or home equity loans • Alimony, child-support or any other divorce related liability (if applicable, provide copies of divorce decree and child support documentation) Note: You will be asked to pay for an appraisal during the processing of your loan. 11 LOAN PROCESSING BACKGROUND Once you have given all preliminary information to your lender and sign a release to authorize the aforementioned steps, the lender will order a credit report and appraisal and may send verification forms to your employers, banks and current mortgage company or landlord. Your lender will provide you with a Loan Estimate. DEFINITION OF LOAN ESTIMATE The Loan Estimate is a form designed to provide disclosures that will be helpful to you in understanding the key features, costs, and risks of the mortgage loan for which you apply. VERIFYING SALES PRICE Before the loan processor submits your file to the underwriters for underwritten approval, he or she will verify the final sales price. Make sure that copies of all addenda (such as final changes signed after the original Purchase Agreement) were completed and have been sent to the lender. This assists the lender in determining the exact loan amount. If the final changes affect the total price of your home after this point, your lender may require you to resubmit your loan application for the higher amount, or ask you to pay for the additional items in cash. LOAN APPROVAL When you apply for a loan, your lender will discuss the time frame for obtaining underwritten loan approval and additional items that may be needed to expedite the process. If any of the documents requested have not been returned to the lender in a timely manner, approval may take longer. Note: As outlined in the Purchase Agreement, loan preliminary approval must be obtained within fourteen (14) days of the date of your signed Purchase Agreement, and underwritten loan approval must be provided prior to the start of construction on your new home. 12 OUTSIDE LENDER As detailed in your Purchase Agreement, you may choose an outside lender to finance your home. However, you will be offered special incentives (either a closing cost contribution or allowance) if you obtain financing through TRI Pointe Connect. You also accept the added responsibility of ensuring that your lender is prepared for closing on the date scheduled by Maracay Homes, as well as the responsibility for obtaining loan approval. Note: As specified in the Purchase Agreement, any delays in closing caused by an outside lender will result in added expenses to you. If you are unable to close escrow on your new home on the scheduled date for any reason (e.g., delay caused by an outside lender, vacation plans, moving company delays, etc.), we will charge a nonrefundable fee of $150 per day to extend your closing beyond the date set by Maracay Homes. Please review the “closing” provision of the Purchase Agreement. INTEREST RATE LOCK-IN The only thing anyone knows for certain about interest rates is that they will change. You will need to consider whether and when to “lock in” the interest rate for your loan. Please understand that this is your financial decision and we make no commitment on the delivery date, other than the date indicated in the terms of your Purchase Agreement. We can predict with reasonable accuracy approximately when your home will be completed, but nonworking days and other unforeseen circumstances can delay the schedule. Very often, your interest rate will be tied to an expiration date, so be sure to allow time for contingencies. 13 3 Summary: Financing Your New Home TRI Pointe Connect WHY TRI POINTE CONNECT? It is important to choose a mortgage lender you can count on. TRI Pointe Connect has streamlined the mortgage process, allowing customers to benefit from timely and efficient closings. TRI Pointe Connect offers an extensive array of products and programs to meet homebuyer’s needs. TIMING You will need to contact a lender and apply for a mortgage loan within five (5) business days after signing your Purchase Agreement. Additionally, you need to supply Maracay Homes with your preliminary approval within fourteen (14) days after signing your purchase agreement. Final lender selection must be made within twenty-one (21) days from the Pre-Construction Meeting. INTEREST RATE LOCK-IN The decision to “lock in” an interest rate is your financial decision. We make no commitment on the delivery date other than what is indicated in the terms of your Purchase Agreement. OUTSIDE LENDERS Note: As outlined in the Purchase Agreement, loan preliminary approval must be obtained within fourteen (14) days of the date of your signed Purchase Agreement, and underwritten loan approval must be provided prior to the start of construction on your new home. All rights reserved. 14 To-Do List Ours Obtain preliminary approval from your lender within fourteen (14) days of signing your Purchase Agreement Explain the loan application process and emphasize important dates to remember Ensure TRI Pointe Connect, if selected to provide your home financing, delivers exemplary service, competitive mortgage products, and a timely closing. Provide any information requested by lenders and appraisers. Yours Apply for a mortgage loan with TRI Pointe Connect within five (5) days of signing your Purchase Agreement. You may use either TRI Pointe Connect or an outside lender, but remember: if you obtain financing through TRI Pointe Connect, you’ll receive a closing cost contribution, or an allowance. Promptly provide your lender with all required information about your income, assets and credit. If you choose to obtain financing through an outside lender, we must have an underwritten approval from the outside lender with acceptable conditions prior to the start of your home. Avoid making employment changes or incurring any new debt, late-payment charges or non-sufficient funds charges. Please contact your TRI Pointe Connect Loan Consultant if you anticipate any of these events. Finalize your lender selection twenty-one (21) days after your Pre-Construction Meeting. If you use an outside lender, make sure they’ll be prepared to close on the date specified by Maracay Homes. During this period, we will be obtaining the necessary permits, finalizing the architectural drawings, engineering the homesite, coordinating with our trade contractors and preparing to start construction on your new home. Our organized process allows us to balance your desire for flexibility in personalizing your home while allowing the time needed to prepare for construction. Therefore, we will schedule an appointment with you for the Maracay Homes Design Studio and finalize all of your selections within fourteen (14) days of signing your Purchase Agreement. Meet with a New Home Designer to choose the right balance of colors, textures and finishes that truly reflect your tastes. We’ve created a relaxing and enjoyable experience for you. Preview top name brands you know and trust in one showroom. Personalize your home for the way you want to live. 17 LET’S GET YOU STARTED We hope your visit to the Maracay Homes Design Studio will be one of the most exciting steps you will take during the construction of your new home. When you sign your Purchase Agreement, your New Home Advisor will coordinate with the Design Studio to schedule your appointment. If you need to change your appointment, please call the Design Studio directly at (480) 889-3704. We will be happy to work with you to create a schedule that is convenient yet within the timelines of your Purchase Agreement. To ensure that you receive our undivided attention, the Design Studio is open by appointment only. Your Design Studio selections must be finalized prior to your Pre-Construction Meeting. The Design Studio is open Monday through Friday from 8:00 a.m. to 5:00 p.m. You may also find it beneficial to make child-care arrangements for younger children, as these important decisions will require your full attention, and space in the Design Studio is limited. SELECTION TIPS AND TIME FRAMES Your New Home Designer will guide you through the selection process, combining their own experience working with other customers with your own preferences and personal style. When you sign your Purchase Agreement, we will provide you with a list of all the options and assist you in selecting Maracay Homes Flex Design® alternatives available for your new home. 18 DESIGN STUDIO SELECTIONS The items that you will select during your appointment at the Design Studio are listed below. NOTE: Not all options are available at all communities ▪ Flooring ▪ Interior and exterior door hardware ▪ Kitchen, bathroom and laundry countertops and edge detail ▪ Water softener systems and reverse-osmosis water purification systems ▪ Shower doors for standard and optional secondary bathrooms ▪ Lighting packages, including ceiling fans and pendant fixtures ▪ Cabinet locations, door style, stain color, species of wood and accessories (e.g., roll-out shelves, glass doors, crown molding, hardware) ▪ Wood window sills, baseboards, door casings and crown molding ▪ Kitchen, bathroom and laundry sinks ▪ Closet organizers ▪ Standard interior paint colors and twotone paint options ▪ Stair-baluster woodtype, location, style and stain color ▪ Interior door style ▪ Appliances ▪ Cultured marble surrounds with steel porcelain tub at secondary baths ▪ Custom tile mud work for kitchen and bathrooms LIMITATIONS Maracay Homes invests significant upfront time and resources on architectural elevations, Maracay Homes Flex Design® options, floor plans and interior finish choices that create neighborhoods and homes of value. As a result of this upfront investment, we simply do not have the resources to build one-of-a-kind custom homes for individual buyers. Although this framework works well for the majority of our customers, we recognize that some will require greater customization than we can offer. Those individuals will need to wait until after closing to further customize their homes. Please understand that we do not make any exceptions to this approach. 19 TIMING AND LOCATION You will make your selections at the Maracay Homes Design Studio. At the time of signing your Purchase Agreement, your New Home Advisor will coordinate with the Design Studio to schedule your appointment. This appointment and finalization of all selections made in the Design Studio will take place within fourteen (14) days of signing your Purchase Agreement. The length of each appointment varies, but most customers are able to complete their selections within four to five (4 to 5) hours. Your New Home Designer will ensure that you have sufficient time to feel totally comfortable and satisfied with your choices. INTERIOR COLORS The Maracay Homes Design Team encourages you to bring cushions or swatches to coordinate colors within your new home. You will have the opportunity to view color samples in both natural and artificial light to receive an accurate impression of the color. Please note that variations can occur between samples and the actual material installed. COLOR VARIATIONS Keep in mind that all natural materials contain variations and, when installed in your home, will differ from the samples available in the Design Studio or displayed in our model homes. This is particularly true of wood products such as cabinets, stairs, rails and hardwood floors as well as granite and marble products. Such differences will typically extend across the products installed in your home as well. For example, you should anticipate variations across the grain in wood cabinets or granite countertops in a single kitchen. Manufactured materials such as tile, stone and carpeting will also differ from samples due to dye-lot variations. PRODUCT AVAILABILITY Although we choose our brand partners and their products with longevity in mind, change is inevitable. There are times when a manufacturer may update their product offerings with little or no notice to the industry and your original selections are no longer available. If suppliers discontinue any of your selections, we will contact you and work with you to make an alternate selection. Note: Re-selections must be made within one (1) week. It is imperative that construction of your new home progresses on schedule. 20 HOMES PURCHASED WHILE UNDER CONSTRUCTION Maracay Homes routinely starts construction on homes that are not yet sold. This practice allows us to make thoughtfully designed homes available to customers who are relocating from outside the Phoenix and Tucson area, as well as customers who sell their old home quickly and don’t have the luxury of waiting for a new home to be built from the ground up. If you are purchasing a designer home, all of the selections have been made and your ability to modify these selections or Maracay Homes Flex Design® options is likely to be very limited. See your New Home Advisor for additional information. MEASURE TWICE , CUT ONCE “Measure twice, cut once” is a favorite phrase among experienced carpenters who know to check their measurements prior to making the cut. This applies to your selections as well. We’re counting on you to make sure that our paperwork accurately reflects the choices you’ve made. This is important because your selection sheet serves as the template we will use to build your home. Note: We recommend that you retain your selection sheets for future reference. These materials are useful for matching paint colors, flooring colors and replacement items in your new home. CUSTOM DESIGN SERVICE AND MATERIALS Your New Home Designers are happy to offer their services to help you create a special and personal look for some features of your new home. For example, you may choose a custom design for your kitchen backsplash, vanity or tub splash or upgraded tile or solid surfaces for showers and vanities. We require a 100 percent deposit on custom selections at the time of your Pre-Construction Meeting. Requests for this service must be made during your first appointment with the Design Studio. A second appointment may be necessary to complete the process. 21 4 Summary: New Home Selections TIME FRAMES You’re going to be making many big decisions, and we realize that you may wish to have more time to do so. However, our construction processes depend on your cooperation, so we cannot make exceptions to any of the time frames we have established for making selections, as outlined in this chapter. We’re confident you will find that this process offers design flexibility unparalleled by builders similar in size and scope to Maracay Homes. If you feel you cannot work within our established time frames, a custom-home builder might better suit your needs. DISCONTINUED SELECTIONS If suppliers discontinue any of your selections, we will contact you to make an alternate selection. Re-selections must be made within one (1) week. VARIATIONS IN NATURAL MATERIALS All natural materials contain variations and will differ from samples and across single installations. Manufactured materials, such as tile, stone and carpeting, will also differ from samples due to dye-lot variations. ACCURATE SELECTIONS Please review the final selection sheet prior to signing to ensure it accurately reflects your selections. 22 To-Do List Ours Stay on top of the latest residential design trends. Document your selections to ensure that the correct items and colors are installed in your new home. Yours Schedule your Design Studio appointment and finalize all selections within fourteen (14) days of signing your Purchase Agreement. Collect cushions, swatches, photos, sketches and ideas you’d like to incorporate in your new home, and bring them to your appointment. If you have young children, arrange for someone to take care of them while you’re at the Design Studio. Make your Design Studio appointment enjoyable in every way! 23 24 5 Trade Contractor Specialist Meetings INTRODUCTION TO TRADE CONTRACTOR SPECIALISTS Certain selections for your new home require an industry specialist. We have very carefully chosen trade contractor specialists with vast expertise in home technology, landscaping and pools. If you would like to have any of these options included in the initial construction of your new home, we will set up an appointment for you to meet with the appropriate trade contractor. TOTAL HOME TECHNOLOGY You will meet with our knowledgeable and experienced home technology experts to discuss security, structured wiring and audio/ video needs for your new home. These trade contractors will guide you in selecting features that are unique to your specific situation and circumstances. In the end, whether it is home security, home connectivity or home entertainment, you can be sure your expectations will be met. This meeting must take place and your selections finalized within twenty-one (21) days after your Purchase Agreement. Please note that some low-voltage items you select may require additional high-voltage (110V) electrical outlets to operate. Discuss the additional outlets needed with your New Home Advisor immediately following your meeting with our total home technology provider. 25 LANDSCAPING Landscaping is a very important aspect of the overall design and feel of your new home. Your landscaping expert will be delighted to discuss design, installation, maintenance or any other aspect of your landscaping needs and wants, and takes great satisfaction in helping you create and design the outdoor experience you desire. This meeting must take place and your selections finalized within twenty-one (21) days after your Purchase Agreement. POOLS Our pool experts will meet with you to discuss and design the backyard oasis of your dreams. From pools to spas, our preferred pool partner has the expertise to make your visions come to life. This meeting must take place and your selections finalized within twenty-one (21) days after your Purchase Agreement. Note: If you wish to finance your pool or rear-yard landscaping as part of your mortgage, you will need to obtain approval from TRI Pointe Connect or your outside lender. The lender may require an appraisal of the value of the options. Pools and landscaping may not be included in VA or FHA mortgages. 26 5 Summary: Trade Contractor Specialist Meetings Our desire is to connect you, our valued customer, with experts who have proven themselves to Maracay Homes as specialists in the areas of home technology, landscaping and pools. Meeting with these specialists will give you the opportunity to design and bring to life your ideas for your new home. 27 To-Do List Ours Arrange meetings with experienced trade contractors who will help you select home technology options, pools and landscaping for your new home. Order the necessary products and materials and incorporate them into the construction schedule of your new home. Yours Carefully consider whether you would like to include home technology, landscaping, and/or pool options and upgrades with your new home purchase. Discuss with your New Home Advisor and lender whether these choices make sense for your situation. Work with your New Home Advisor to schedule meetings with Maracay’s preferred trade contractors for home technology, pools and landscaping. Make and finalize these selections within twenty-one (21) days after your Purchase Agreement. Immediately after meeting with our home technology experts, contact your New Home Advisor to discuss any additional electrical outlets that will be required for your lowvoltage selections. For instance, if you add a TV outlet or phone jack at your covered patio, we need to make sure those items are listed on your selection sheet next to “covered patio.” If you wish to include pools or landscaping in your mortgage, make sure you obtain the approval of TRI Pointe Connect or your outside lender. 28 6 Meetings during the Construction Process OVERVIEW INTRODUCTION As mentioned at the beginning of this guide, while your home is under construction you’ll probably feel a mixture of excitement and frustration. On any given day, there may be a lot of activity at your homesite, or none at all. That’s why we schedule several meetings with your New Home Advisor and/or Construction Project Manager to review the progress of your new home and discuss any questions or concerns you may have. All meetings are held during regular business hours from Monday through Friday. These meetings are reviewed below. Note: While we hope to accomplish many things during these meetings, nothing is more important to us than your safety. Please follow the safety procedures described in Chapter 7, Construction of Your New Home – Maracay Homes Safety Requirements, and remember that these meetings are not appropriate for children. 29 YOUR NEW HOME CONSTRUCTION PROJECT MANAGER Your Pre-Construction Meeting is typically the first opportunity you have to meet your community’s production team. Your New Home Construction Project Manager is responsible for all construction activities in your community. 1 . PRE-CONSTRUCTION MEETING Your New Home Advisor will schedule a Pre-Construction Meeting once you complete your option selections. This meeting will take place during business hours approximately one (1) week prior to the start of construction of your new home. This meeting typically takes about one and a half (1-1/2) hours. If you need more time, we’ll be happy to accommodate you. Your New Home Construction Project Manager and New Home Advisor will review with you the options you selected and the placement of your new home on your homesite. During this meeting, we are counting on you to verify the various items you selected on your agreement paperwork. Maracay Homes wants to be certain that the detail we will be providing to our trade contractors and suppliers is accurate and complete to avoid confusion in building your new home. In very rare situations, customers might require small changes at the Pre-Construction Meeting but sign off on them the same day. Please remember that changes or additions cannot be made after the meeting. Also, we can not commit to an exact closing date at this time. If you’re going to have a home inspector review your new home, you must notify your New Home Advisor at or prior to the Pre-Construction Meeting and complete an amendment to your Purchase Agreement. CUSTOMER COMMUNICATION FORM To facilitate excellent communication with our valued customers, we have created a form called, “Customer Communication Form.” This form can be obtained at any time from your New Home Advisor. It’s a great way to document any questions you may have at any time during the building process and to get prompt answers from the Maracay Homes’ Team. The process is simple: obtain a form from your New Home Advisor, complete it and return it to the Sales Office. Your form will be answered promptly by the appropriate member of the Maracay Homes’ Team. SELECTIONS AND CHANGES Prior to starting your new home, we provided the opportunity to make selections and choose Maracay Homes Flex Design® options (please see Chapter 4, New Home Selections for additional information). 30 PREPARATION Please bring the following items to your Pre-Construction Meeting: • The Maracay Way — A Customer Experience Guide • Purchase Agreement • Design Studio Selection sheets • Electrical, low voltage selections (if applicable),cable, phone and audio/video diagrams or specifications • Any Maracay Homes Flex Design® options you have chosen • Appropriate footwear and clothing to walk your homesite (see Chapter 7) • Landscape plan (if applicable) • Pool plan (if applicable) ADDITIONAL ATTENDEES If a real-estate agent helped you with your purchase, he or she is welcome, but not required, to attend. 2 . HARD-HAT TOUR BACKGROUND The next meeting we invite you to attend is the Hard-Hat Tour, which is conducted prior to the installation of insulation and drywall. At this meeting, your New Home Construction Project Manager reviews the framing of your home and its mechanical systems, which include heating, ventilating and air-conditioning (HVAC), plumbing and electrical. In addition, we review all of your selections and any Maracay Homes Flex Design® options, phone, cable and audio/video locations. Note: Please remember that at this time we cannot accommodate requests for custom changes or changes to the selections that you have made. ITEMS TO REVIEW We find that this meeting helps ensure that all selections are installed according to the original agreements. It also gives you an understanding of what is “inside the walls” in your new home. Plan on taking a few moments at this meeting to review with your New Home Construction Project Manager our warranty and service procedures and some of the maintenance items you will be responsible for in your new home. 31 SHORT NOTICE Your New Home Advisor will notify you when it’s time to schedule the Hard-Hat Tour, which is held shortly after the framing and mechanical systems are roughed in but just prior to the installation of insulation and drywall. This is a critical time in the construction of your new home, and there is a very short “window” during which we can conduct this meeting. Note: We are only able to provide a one to three-day (1 to 3-day) notice prior to your Hard-Hat Tour, and cannot stop the construction of the home in order to schedule this meeting. Your understanding and cooperation with these tight scheduling constraints are appreciated. The Hard-Hat Tour lasts approximately one to one and a half (1 to 1-1/2) hours. Your attendance is optional, but highly recommended. SAFETY We care about your safety and require all customers to schedule construction visits with their New Home Advisor. Please understand that access to your homesite during construction may not be permitted on certain days. Construction sites pose many hazards and risks, but if you observe the following safety requirements, your visit will be trouble-free: • Check in at the Sales Office before entering the job site • Wear a hard hat at all times • Wear closed-toe shoes • Don’t bring children or pets • Visit only during normal business hours • Park only in the street For more detailed information about our safety procedures, see Chapter 7, Construction of your New Home. 32 PREPARATION Please bring the following items to your Hard-Hat Tour: • The Maracay Way — A Customer Experience Guide • Purchase Agreement • Design Studio Selection sheets • Any phone, cable and audio/video diagrams • Any Maracay Homes Flex Design® options you may have selected • Appropriate footwear • Hard hat • Landscape plan (if applicable) • Pool plan (if applicable) ADDITIONAL ATTENDEES If a real-estate agent helped you with your purchase, he or she is welcome, but not required, to attend. YOU’RE ALMOST HOME! Soon you will be asked to attend a New Home Orientation, closely followed by a New Home Presentation. Both events are designed to effectively communicate how to operate, maintain and live happily in your new Maracay home. You will be notified of the date and time of the New Home Orientation and the New Home Presentation approximately forty-five (45) days prior to the completion of your new home. 33 3 . New Home Orientation Your New Home Orientation introduces you to your newly completed home and its many features — a meeting that goes beyond the traditional walkthrough to include a detailed demonstration of your new home’s operation and a review of your maintenance responsibilities and warranties. At this meeting, you will be meeting with your Warranty Representative. Your Warranty Representative is fully qualified to build and inspect every facet of your home. You will be glad they are an advocate for you! Equally important, we want to confirm that we have delivered your new home with all construction work completed and all of your selections correctly installed. At your New Home Orientation, your Warranty Representative will meet with you to offer information about your home’s warranties, maintenance schedule and warranty process. You will also learn how to operate the heating and air-conditioning units, appliances, electrical circuit breakers, plumbing shut-off valves and other necessary equipment to keep your home running smoothly and efficiently. This is our opportunity to familiarize you with your newly completed home and review instructions concerning the operation of the various components and features. During the New Home Orientation, please inspect the home for any items or areas that display chips, scratches or other noticeable defects. Such cosmetic items will not be covered under your warranty after this inspection. Your title-company appointment will be scheduled on the same day as your New Home Orientation. After the orientation is complete, you’ll be prepared to attend your title-company appointment and sign your closing documents. SCHEDULING OF YOUR NEW HOME ORIENTATION Your New Home Sales and Closing Coordinator will typically schedule your New Home Orientation forty-five (45) days prior to completion. This orientation is always scheduled for 9 a.m. or 1 p.m. several days before closing. Your Waranty Representative will meet you at your new home. Expect the orientation to take approximately two to four (2 to 4) hours, depending on the size of the home. PREPARATION FOR YOUR NEW HOME ORIENTATION If you have questions about home maintenance or Maracay Homes’ Limited Warranty Protection Program, make note of them to bring up at the New Home Orientation. If you have not already done so, please read Chapter 9, Your New Home Limited Warranty Protection Program, before your New Home Orientation. 34 ADDITIONAL ATTENDEES AT YOUR NEW HOME ORIENTATION Past experience has shown that this orientation is most beneficial when you are able to focus all your attention on the information we present about your new home. Although we appreciate that friends and family members are eager to see your new home, we can only accommodate those listed on the Purchase Agreement at this orientation. Therefore, Maracay Homes cannot accommodate children, other family members, friends or pets during any type of on-site visits or inspections. Please bring the following items to your New Home Orientation: • The Maracay Way — A Customer Experience Guide • Appropriate footwear and clothing to walk the interior and exterior of your home. • As a reminder, children cannot be accommodated at the New Home Orientation. • If a real-estate agent helped you with your purchase, he or she is welcome, but not required, to attend. HOME INSPECTORS If you’re going to have a home inspector review your new home, you must notify your New Home Advisor at or prior to the Pre-Construction Meeting and complete an amendment to your Purchase Agreement. Our formal construction meetings and orientations are scheduled and designed for you, not home inspectors, who generally conduct their work just prior to our various meetings. Specific time frames are outlined in the Home Inspector Addendum and coordinated by your New Home Advisor. It is very important that home inspections are scheduled after Maracay’s Pre-Walk Inspection, which takes place four to seven (4 to 7) working days prior to your New Home Orientation. For safety reasons, homeowners and real-estate agents cannot accompany inspectors unless a Maracay Homes’ team member is present. In addition, for safety reasons, Maracay Homes cannot accommodate children, other family members, friends or pets during any type of on-site inspection. Additionally, home inspectors are never allowed on the roof of a Maracay Home for safety reasons. Note: If you plan on using a private home inspector, it is your responsibility to ensure that the inspector fully complies with all Maracay Homes’ safety and liability insurance requirements. Proof of insurance must be provided to your New Home Advisor before any inspection can occur. Regardless of the documentation provided to you by your home inspector, Maracay Homes reserves the right to make the final determination for construction issues raised by the independent inspector based on applicable municipal codes and Maracay Homes’ quality standards. If there is a variance between items noted and issues corrected, it will be explained to you (and the inspector, if requested) in full detail. 35 IMPORTANT DOCUMENTS At your New Home Orientation, you will receive several important documents. One is a list of emergency phone numbers for critical trade contractors, such as heating and plumbing, who might be needed after hours or on weekends. The manufacturers’ literature for the furnace, water heater, appliances and other consumer products will also be provided. Finally, you will receive a copy of the completed New Home Orientation form. We suggest that you keep these items in your copy of The Maracay Way — A Customer Experience Guide. COSMETIC SURFACE DAMAGE During your New Home Orientation, we examine surfaces such as floors, walls, window glass, mirrors, appliances, countertops, etc., to ensure there is no damage or to repair any that may exist. After the New Home Orientation, any cosmetic repairs to your home will become your responsibility. During the move-in process, surfaces endure minor scratches and stress; therefore, these damages are not covered under Maracay Homes’ Limited Warranty Protection Program. Please use safeguards to protect your home’s surfaces prior to move-in. INSPECTING YOUR NEW HOME In addition to introducing you to your new home, the New Home Orientation is also an opportunity for you to inspect your home and note any details that require attention on the New Home Orientation form. In an effort to eliminate any confusion and avoid misunderstandings, verbal commitments will not be honored; please be sure to note all items in writing on the New Home Orientation form. This includes any items we agree to transfer from a home inspector’s report. COMPLETION OF ITEMS We strive to complete all items noted at the New Home Orientation prior to close of escrow. Generally, most items will be completed before you move in. However, Maracay Homes will not delay escrow for incomplete items. If work needs to be performed in your home after you move in, construction team members are available for appointments Monday through Friday, 8:00 a.m. to 4:00 p.m. Under normal circumstances, you can expect us to resolve all items within ten (10) working days. We will inform you of any delays caused by back-ordered materials. Only those items listed on the New Home Orientation form will be addressed. 36 4. YOUR NEW HOME PRESENTATION During the presentation of your new home, you will be asked to initial and sign off on the completed items from the New Home Orientation form. This documents that each item has been corrected to your satisfaction. Additionally, it is an important transition point where we, at Maracay Homes, pass your new home from the construction team to the warranty team. Your New Home Presentation and closing will normally be scheduled about four (4) working days after your New Home Orientation and will last approximately one (1) hour. You and your New Home Construction Project Manager will review and discuss all items listed on your New Home Orientation form. Any final questions or concerns may be discussed as well. Any new items discovered will be forwarded to our warranty department, and they will schedule a time to complete them. Provided there are no delays at closing, once the New Home Presentation is complete you’ll receive your keys and can move into your new Maracay home! FUTURE SERVICE Maracay Homes responds to warranty items as detailed in Chapter 9, New Home Limited Warranty Protection Program. It is important to distinguish between the items that are noted on the New Home Orientation form (generally referred to as “punchlist” items) and any regular warranty service items that arise after you move in. 37 6 Summary: Meetings During the Construction Process SAFETY During all visits to the construction site, your safety is our top priority. Please be familiar with and adhere to all safety procedures referenced in this guide. YOUR CONCERNS At meetings with Maracay Homes’ team members during the construction process, you have our undivided attention. This is the best time to ask questions or bring up any concerns. However, we cannot make changes to any selections or options at any of these meetings except as mentioned in the Pre-Construction Meeting. PRE-CONSTRUCTION MEETING Your Pre-Construction Meeting is the first meeting you’ll attend with your community construction team and is held about a week before physical construction begins on your home. This is when you will meet the rest of your community team. HARD-HAT TOUR The second meeting is the Hard-Hat Tour, held just before insulation and drywall is installed. We can only provide one to three (1 to 3) days’ notice to schedule the Hard-Hat Tour and will not stop construction of your home to accommodate this meeting. Please plan on spending one and a half to two (1-1/2 to 2) hours on this tour. NEW HOME ORIENTATION At the New Home Orientation, we will demonstrate the features, operation and maintenance of your new home. We will also examine surfaces to ensure there is no cosmetic damage, or to repair any damage that may exist. After this point, any cosmetic repairs to your home become your responsibility and are not covered under the Maracay Homes Warranty Program. Additionally, we will confirm with you that we have delivered your new home with all construction work completed and all of your selections correctly installed. 38 NEW HOME PRESENTATION This is the final step in the process leading to homeownership! Your Maracay Homes Team will present your beautiful new home to you and ensure that any items noted during the New Home Orientation have been corrected. If any new items are noted, they will immediately be referred to our warranty department. In most cases, immediately following this presentation you will be given the keys to your new home and new lifestyle! PRIVATE HOME INSPECTORS Private home inspections must take place prior to construction meetings and orientations (never at the orientation). Your New Home Construction Project Manager will review and address every item on the home inspector’s list. Maracay Homes will make the final decision as to which items are corrected. 39 To-Do List Ours Do everything possible to ensure your safety while on a Maracay construction site. Demonstrate the features and operation of your new home and explain what maintenance you will need to perform. Ensure that cosmetic damage to walls, floors, etc., is documented and repaired before you move in. Address all Customer Communication Forms and respond to you quickly. Yours Familiarize yourself with all the safety procedures outlined in this chapter. When attending meetings or orientations, remember to bring your Purchase Agreement; selection sheets; list of Flex Design® choices; telephone, cable and audio/video diagrams; landscape or pool plan (if applicable). Wear appropriate clothing and footwear for site visits. Make arrangements for child care on days you will be visiting the construction site. If you plan to hire a private home inspector, make sure his/her inspection is scheduled prior to Maracay construction meetings and orientations. 40 7 Construction of Your New Home OVERVIEW Building a new home can be one of life’s most treasured experiences. Your Maracay Homes’ Construction Team strives to make the entire home-building process enjoyable for you and your family. We always welcome your comments or questions. Our ultimate goal is to ensure your new home meets Maracay Homes’ exacting quality standards. Keep in mind that the construction timeline differs from home to home depending upon a number of variables, including the size of the home, the homesite, the weather and the overall number of Maracay Homes Flex Design® options that have been selected. The construction of a new home differs from other manufacturing processes in several ways. For example, your new home is built out in the open rather than in a controlled environment, so it is subject to weather conditions. Different options may be selected and different trades may work on each home. Homes are built by people, not machines, so each home is crafted differently even if the same options are chosen. By keeping these differences in mind, you can enjoy participating in and observing the construction of your new home. 41 MARACAY HOMES SAFETY REQUIREMENTS Safety is Maracay Homes’ top priority and a core value of our company. Our practices help ensure safety for our customers as well as for our team members and trade contractors. Maracay Homes is a true leader in the housing industry in safety standards. A new-home construction site is exciting, but it can also be dangerous. Therefore, we must require the following: • Hard hats must be worn at all times. • Hard-soled shoes are required; open-toed sandals or high-heeled shoes are never allowed on a job site. • Schedule an appointment with your New Home Advisor before visiting your site. Unscheduled site visits will not be accommodated. • A Maracay Team Member must accompany you at all times. • No children or pets are allowed on site (including during scheduled meetings). ADDITIONAL SAFETY PRECAUTIONS Please observe these common-sense safety procedures at all times when visiting: • Do not walk backwards, not even one step. Look in the direction you are moving at all times. • Watch for boards, cords, tools, nails or other construction materials that might pose a tripping hazard or cause injury. • Look both ways before walking into the street and between construction vehicles and other large obstacles. • Do not enter any level of a home that is not equipped with stairs and rails. • Stay a minimum of six (6) feet from all excavations. • Give large, noisy grading equipment or delivery vehicles plenty of room. Assume that the driver can neither see nor hear you. • Do not handle or attempt to use any tools, equipment, materials or ladders. • Please park your car as far away from the construction area as possible. Any damages that may occur to your vehicle are not the responsibility of Maracay Homes. • Understand that construction activities will continue in your neighborhood after you move in. Protect yourself and your children by staying well away from areas under construction, including storm-water management areas. Maracay Homes is not responsible for bodily injuries or property damage that may occur when someone trespasses onto construction areas. 42 A UNIQUE PROCESS As a consumer, you rarely have the opportunity to watch as the products you purchase are created. Virtually all the products you typically purchase are created in controlled environments like factories where workers manufacture thousands of similar products day in and day out. Your new home, however, is created right before your eyes, in all kinds of weather conditions, and with an incredibly varied set of trade contractors who are creating a one-of-a-kind product to your agreed-upon specifications. Your new home will be built using more than 100 different materials through the coordinated efforts of nearly 30 trade contractors and over 100 construction personnel. In order to efficiently and effectively meet construction deadlines, you must make your option selections within the time period specified in your Purchase Agreement. This cooperation and effort is of paramount importance during the construction process. “UGLY DUCKLING” PHASES While your home is under construction, it’s common to find scrap material and other debris on your homesite. In addition, your home will be exposed to the elements, and it’s very likely that somewhere along the line, errors will be made during construction. While we understand that this can cause you concern, please realize that every home we have ever built, including our beautifully decorated model homes, has gone through these exact same “ugly duckling” phases. You can feel confident that Maracay Homes will make corrections as necessary based on construction scheduling and our quality standards. INSPECTIONS AND SCHEDULING Maracay Homes operates with a set of standardized schedules and inspection processes to ensure that your home is examined and checked for errors or defects. These processes and inspection checks are typically not “continuous,” but rather occur at specific predetermined steps during construction. We point this out so you will understand that occasionally errors are made and may remain in the home for some period of time before they are corrected during the next scheduled phase. 43 PLANS AND SPECIFICATIONS JURISDICTION REVIEW The building department of the county or city where your home will be located must review and approve the plans and specifications for your home and homesite. It is difficult to predict the amount of time required for this process, and it can sometimes delay the start of your home. This is one of the reasons why we cannot make structural or Maracay Homes Flex Design® changes after signing the purchase agreement. ENGINEERING REVIEW Structural elements of your plans have been designed by a registered and licensed structural engineer to provide safety for you and your family. REGULATORY CHANGES From time to time, city or county agencies adopt new codes or regulations that can affect your home. Such changes are usually adopted in the interest of safety and are legal requirements with which Maracay Homes must comply. The codes and requirements in effect for each area can vary. This is one of several reasons why we may construct the same floor plan slightly differently in two separate jurisdictions, or in two separate time periods within the same jurisdiction. INDIVIDUAL FOUNDATION DESIGNS Another area where variations among homes can appear is in the foundation system. The foundation design is specific to each community and homesite. Maracay Homes determines the proper foundation plan to use based on soil conditions. 44 CHANGES IN MATERIALS, PRODUCTS AND METHODS The housing industry, building trades and product manufacturers are continually working to improve methods and products. In addition, manufacturers sometimes make model changes that can impact the final product. As a result, we may use methods or materials in your home that differ from those in our models or other homes in your community. Since such substitutions or changes may become necessary due to matters outside our control, we reserve the right to make them without notification. In such instances, these substitutions will be consistent with the quality of the substituted product or method. Sometimes certain products are discontinued. If this occurs during the construction process, we will contact you to make another selection. The new selection must cost approximately the same as the original. If you select an upgrade as a replacement for a discontinued product, you will be responsible for any difference in cost. VARIATIONS Many different trade contractors have assembled your home. The same individuals rarely work on every home in the same way. The exact placement of switches, outlets, door bell, vents and so on will vary slightly from the model and other homes with the same floor plan. COMMUNITY SPECIFICATIONS The most common source of misunderstanding about specific designs or products that are specified in our homes is when customers make assumptions based upon what they see at a different Maracay Homes’ community. There are many reasons why we tailor our products and options to each specific community. Note: Do not make assumptions about anything you see at a different Maracay community without first checking with your New Home Advisor. This is especially important if you are purchasing at a community that does not feature a model home. 45 QUALITY A HANDCRAFTED PRODUCT Maracay Homes will build your new home to the standards described in this guide. Each new home is a handcrafted product combining art, planning, engineering, science and raw labor. The efforts of many people with different training, experience and skills come together. We coordinate and supervise the contributions of these individuals to your new home. Just like safety, quality is also a cornerstone of our operations. We put checks and balances, processes and procedures in place to support the highest quality outcomes in each home we deliver. We take great pride in our reputation as a “Leader of Quality” in the Phoenix and Tucson housing markets. If you have any quality concerns, please discuss them with any of your Maracay team members. MARACAY HOME INSPECTIONS As part of Maracay Homes’ Quality Assurance Program, four (4) separate inspections will be made while building your new home. Along with verifying that the correct options are being installed, we make sure the home is compliant with building codes. We meet or exceed the Arizona Workmanship Standards. INSPECTIONS #1 PRE-SLAB INSPECTION Your New Home Construction Project Manager will verify all options before the slab is poured. #2 PRE-INSULATION INSPECTION Your New Home Construction Project Manager will inspect the framing, air-conditioning, plumbing and electrical systems of your new home before the drywall is installed in order to ensure that Maracay Homes’ standards are met. #3 TRIM INSPECTION Your New Home Construction Project Manager will review the installation of cabinets, trim carpentry, paint and drywall. #4 PRE-WALK INSPECTION This final quality inspection takes place several days before your scheduled New Home Orientation. Your New Home Construction Project Manager will inspect all the details of your new home. Note: If you decide to use a home-inspection company, you may schedule them after the Pre-Walk Inspection and before the close of escrow. Please schedule this inspection with your New Home Advisor. 46 CUSTOMER COMMUNICATION: PROCESS AND FOLLOW-UP There are times when a home under construction does not look its best or an error is made by one of the many people who participate in its construction. You can feel confident that we have systems and personnel in place to ensure that errors are corrected. We remind you that these corrections may not be made immediately because of schedules or availability of trade contractors. However, rest assured that the corrections will be made prior to completion of the home. We understand your interest in your new home while it is being constructed and welcome your input. To avoid duplication of efforts or misunderstandings, we ask that you bring up your concerns at the Pre-Construction Meeting, Hard-Hat Tour or New Home Orientation. If you feel it’s an urgent matter, contact your New Home Advisor. TRADE CONTRACTORS A COMBINED EFFORT Your home is built through the combined efforts of qualified contractors and specialists in many trades. Only authorized suppliers, trade contractors and Maracay Homes’ team members are permitted to perform work in your new home. TRADE CONTRACTOR AGREEMENTS Suppliers and trade contractors have no authority to enter into agreements on behalf of Maracay Homes. For your protection and theirs, the terms of our trade contractor agreements prohibit alterations without written authorization from Maracay Homes. Their failure to comply with this procedure will result in the removal of unauthorized alterations. Please do not attempt to enter into agreements directly with trade contractors or third-party contractors not associated with Maracay Homes. 47 SCHEDULES WEATHER The delivery date for your new home begins as an estimate. Until the roof is completed and the structure is enclosed, weather can dramatically affect the delivery date. Even after the structure is enclosed, weather can severely impact installation of utility services, final grading, landscaping or exterior painting. Extended periods of inclement weather may also delay work. When favorable weather conditions return, our trade contractors go back to work, picking up where they left off. Please understand that all of us are as eager as you are to see progress made on your home. OTHER IMPACTS ON THE SCHEDULE Weather is just one of a host of different variables that can impact the construction schedule of your home. Industrywide peaks in activity can severely tax a limited pool of qualified trade contractors. It is common for construction activity on a home to remain idle for several days while awaiting county or city building inspections. Also, certain products (such as drywall or concrete) are occasionally in short supply or may be temporarily unavailable. MARACAY HOMES’ ROLE Throughout the entire process, you can feel confident that we are as anxious as you are to see construction progress towards completion. We are a leader in our industry and have the leverage to minimize the delays that these types of situations can create. That being said, delays do occur, so please factor them into your personal plans. ADVANCE NOTICE As completion of your home nears, more factors come under our control and we can be more precise about your home’s completion date. Your New Home Sales and Closing Coordinator will contact you to discuss a targeted date for your closing, and follow up that call with written notification of the closing date no less than forty-five (45) days prior to the scheduled closing appointment. FINAL ARRANGEMENTS We suggest that until you receive notification of your scheduled closing appointment, you should avoid finalizing arrangements for your move. Until then, flexibility is the key to your comfort, sanity and convenience. We want you to enjoy this process and avoid unnecessary stress caused by circumstances beyond your control. Review Chapter 3, Financing Your New Home, for additional suggestions on this topic. 48 7 Summary: Construction of Your New Home SAFETY Your safety is our top concern when you visit the construction site. You must be familiar with safety procedures and coordinate all visits with your New Home Advisor. CONSTRUCTION ERRORS Sometimes there will be scrap material and debris in your home, and it is also possible that some errors will be made during its construction. Errors are not always corrected right away. This can be stressful, but rest assured that we have established processes at specific points to ensure that errors are corrected and the home is ready to progress to the next stage. ADDRESSING YOUR CONCERNS We welcome your observation of and participation in the construction of your new home. The best time to ask questions or bring up concerns is during the several scheduled meetings throughout the process. DIFFERENCES BETWEEN HOMES Every new home we build is different and individually tailored to each customer. Homes built in different communities or even at different times within the same community will have variations. Do not make assumptions about anything you see at a different Maracay community without first checking with your New Home Advisor. This is especially important if you are purchasing a home at a community that does not feature a model home. CONSTRUCTION SCHEDULE Many variables affect the construction schedule. For most of the time while your home is under construction, we can only estimate its completion date. This estimate is subject to change, so we ask that you remain flexible. We can provide a more definite date as the home nears completion. QUALITY INSPECTIONS Maracay Homes has built several checks and balances into the construction of your new home to ensure it is built to our high standards of quality. 49 To-Do List Ours Construct and deliver the quality home we promise within the time frame we specified. Conduct regular quality inspections to ensure your home is being built to our standards. Keep you up to date on the progress of construction. Put your mind at ease by answering questions and allaying any concerns you may have. 50 Yours Coordinate all construction-site visits with your New Home Advisor. Don’t be shy about asking questions and voicing concerns during scheduled meetings with Maracay Homes. Be patient and flexible. It’s best not to finalize your moving plans until you receive notification of your closing appointment. 8 Closing on Your New Home OVERVIEW INTRODUCTION Maracay Homes recognizes that timing is vitally important in planning your closing and move. We can schedule a targeted delivery date when construction reaches a point at which weather and other factors are unlikely to affect completion of your home. This occurs about forty-five (45) days before closing. Your New Home Sales and Closing Coordinator will contact you at this time to schedule your New Home Orientation and New Home Presentation, as described in Chapter 6, Meetings during the Construction Process, as well as your closing date. CLOSING LOGISTICS DATE OF CLOSING The actual closing of your new home takes place the same day as your New Home Presentation appointment. In order to facilitate a smooth and timely closing the day of your New Home Presentation, we ask that you sign all of your closing documents prior to this date. Typically, our title company is ready to have you sign by your New Home Orientation date. Our Escrow Officer at First American Title or Title Security Agency will contact you prior to your closing date to schedule an appointment to sign all of your closing documents. If you are unable to attend this signing appointment in person, you will need to arrange for a power of attorney for someone else to sign on your behalf with the title company. Typically, the signing appointment takes one to two (1 to 2) hours. If you are an out-ofstate customer, our title company can also arrange to have your closing documents mailed to your home or office. On the date of closing, you will not need to revisit our title company since your part of the closing is already complete. 51 LOCATION OF SIGNING The signing appointment on your new home will take place at the title company’s office. Our Escrow Officer will confirm the location with you when he or she schedules the appointment. There will not be a Maracay Homes team member present at the signing appointment; the title-company representative is authorized to complete appropriate paperwork on our behalf. CLOSING DOCUMENTS At closing, the documents necessary to convey your new home to you and to close the loan from your mortgage company will be executed and delivered. In addition to these standard items, the lender, the title company and Maracay Homes may require other documents to be signed. THE PRINCIPAL DOCUMENTS TYPICALLY INCLUDE THE FOLLOWING: ITEM DESCRIPTION Warranty Deed Conveys the home and homesite to you subject only to permitted exceptions Title Commitment At or before closing, you will receive a standard form for an American Land Title Association (ALTA) owner’s title insurance commitment to insure marketable title of your home to you in the amount of the purchase price, subject to title exceptions that are described in the commitment. Review the title commitment carefully and discuss any questions with the title company. Approximately sixty (60) days after the closing, the title company mails a standard ALTA owner’s title insurance policy, insuring you the title to your home in accordance with the commitment you received at closing. Keep the title insurance policy with your other valuable papers. Full Warranty We provide a Full Warranty with this guide. Please read it thoroughly. Promissory Note The promissory note is from you, payable to the lender in the principal amount of the loan, plus interest. If you are including property taxes and homeowner’s insurance in your monthly mortgage payment, that payment is determined by dividing your annual taxes and insurance by 12 and adding the result to the principal and interest.** Deed of Trust This encumbers your home as security for repayment of the promissory note. ** For FHA and VA loans, taxes and insurances must be included in the monthly payment. For conventional loans, you must make a down payment of 20 percent or more to avoid having taxes and insurance added to your monthly payment. Closing Disclosure The Closing Disclosure is a form that has been designed to provide disclosures that will be helpful to borrowers in understanding all of the costs of the transaction. The Closing Disclosure must be provided to you three (3) business days before you can sign your loan documents for your new home purchase. REMINDER - You must be in receipt of your lender's Closing Disclosure three (3) business days prior to being able to sign the loan documents to close on your home! 52 CLOSING EXPENSES Customary items that may be prorated to the date of closing are prepaid expenses, or reserves required by your lender and homeowners’ association. Prorations of general real property taxes and assessments will be based on the current year’s taxes and assessments or, if they are unavailable, on the taxes and assessments for the prior year. The county in which your home is located may impose partial-year improvement levies after closing. REAL-ESTATE AGENT/BROKER Maracay Homes will pay any and all commissions to the Real-Estate Agent/Broker and will not entertain any other arrangement between the purchaser and Agent/Broker. THE FINAL NUMBER The final cost figure is available near the actual closing date. Your Escrow Officer and lender will work together to assemble the total costs from all service providers on your transaction. Your lender will generate your Closing Disclosure detailing the costs and credits resulting in your final amount needed for closing. Please request and review your Closing Disclosure from your lender so that you receive the Closing Disclosure at least a week to ten (10) days prior to your scheduled closing date. Although a reasonably close estimate may be determined before the date of closing, the proration of several items included is affected by the closing date and cannot be calculated until that date is known. Note: Accuracy and timing of the final Closing Disclosure can often be a source of frustration for our customers, yet it is an inherent part of the process. Your patience and flexibility is appreciated. 53 CLOSING PREPARATION PLANNING Plan to bring certified funds, in the form of a cashier’s check or money order, to your closing appointment. If you would like to use a wire transfer of funds, please contact the title company at least two (2) days before closing to receive wiring instructions. Be sure to allow time to arrange for and obtain these funds. DOCUMENTS The Consumer Financial Protection Bureau (CFPB) combined disclosures required under the Truth in Lending Act (TILA) and Real Estate Settlement Procedures Act (RESPA). The new integrated Closing Disclosure provides clarity and protection for you. The Closing Disclosure is required to be delivered to you three (3) business days prior to signing your loan documents in order to close your new home. INSURANCE You need to provide proof to your lender that you have a homeowner’s insurance policy. Your insurance agent should know exactly what is needed. We suggest you arrange this at least four (4) weeks before the expected closing date. MARACAY HOMES OR LENDER ISSUES The title company is not authorized to negotiate or make representations on behalf of any of the parties involved in the closing. Therefore, please discuss any questions, agreements or other details directly with us or your lender in advance of your signing appointment. UTILITIES Construction Project Managers will turn on the electric, water and gas service to your new home initially, but prior to your closing date you will need to notify those utilities of your move so that new service is provided in your name. We suggest that you contact these companies 1-2 weeks ahead of time to avoid any interruption in service. Utilitycompany contact information is provided in the closing confirmation letter sent to you by your New Home Sales and Closing Coordinator immediately following the scheduling of your closing date. Maracay Homes will have utility services removed from its name after closing. Note: Telephone, cable TV and trashremoval service must be initiated by the homeowner. 54 8 Summary: Closing on Your New Home DELIVERY DATE A delivery date will be estimated only when construction reaches a point when weather and other factors are unlikely to affect completion of your home. This occurs approximately forty-five (45) days before closing. Until then, many factors can influence the schedule. Your New Home Sales and Closing Coordinator will contact you at this time to schedule your New Home Orientation and New Home Presentation as well as your closing date. CLOSING DATE Closing will occur the same day as your New Home Presentation. Your Escrow Agent from First American Title or Title Security Agency will contact you one to two (1 to 2) weeks prior to schedule an appointment to sign all your closing documents. FINAL COST The final cost figure is available near the actual closing. Although a reasonably close estimate may be determined before the date of closing, the proration of several items included is affected by the closing date and cannot be calculated until that date is known. AUTHORIZATION The title company is not authorized to negotiate or make representations on behalf of any of the parties involved in the closing. You will need to notify all applicable utility companies before closing, so your service is not interrupted. 55 To-Do List Ours Contact you approximately forty-five (45) days before closing with an estimated delivery date. Effective on the closing date, remove Maracay’s name from utility service on your new home. Yours Request your Closing Disclosure from your lender in advance of your closing. You should plan to review your Closing Disclosure from your lender at least one week to ten (10) days prior to the scheduled closing date. Remember, you must receive this document three (3) business days prior to being able to sign your closing documents for your new home. Set up your warranty file. Leave all manufacturer’s warranty documents in your new home. Keep you informed of all Maracay Community events via email and newsletters. Prepare for closing and your New Home Presentation, which will occur on the same day. Coordinate the transfer of utility services into your name before the closing date. Bring certified funds to your meeting with the title company for your closing expenses. Recommend Maracay Homes to your friends and family! 56 9 New Home Limited Warranty Protection Program ABOUT OUR WARRANTY PROTECTION As a quality new home builder, we are proud to offer our buyers the Home Builder’s Limited Warranty (Limited Warranty), a new kind of warranty – the most comprehensive new home warranty available today – as a sign of our faith in our homes and the people who service them. Unlike many new home warranties this Limited Warranty provides protection against more than just “major structural failures.” This Limited Warranty is a component of our Maracay Homes Limited Warranty Program. Through our relationship with Professional Warranty Service Corporation (“PWSC”), we are able to offer this exceptional approach to new home warranty protection. Simply stated, we warrant that your new home will be free of “Construction Defects” for the full eight years from the close of escrow. The Limited Warranty document defines those conditions that constitute a “Construction Defect” and describes the process we will use to determine whether a condition reported by you qualifies for coverage. HOME BUYER ADVANTAGES: Our Limited Warranty is not limited to major structural failures like many of the warranties offered by other builders. Refer to the sample warranty booklet for a detailed explanation of conditions that constitute a construction defect, including the overview provided on Page 4 of the sample warranty booklet (Standards by Which the Existence of a Construction Defect Will Be Determined). Also note that unlike many third party warranty programs that require homeowners to file claims with the Warranty Company (and pay claim service fees), you continue to deal directly with us throughout the entire warranty period. WHY WE ARE OFFERING THIS NEW LEVEL OF WARRANTY PROTECTION? We know your new home is most likely the largest investment you will ever make, and we want you to feel as secure and comfortable as possible in choosing us to build your new home for you. Very few builders are eligible to offer this unique, long-term warranty, and we think this says something important about us. And if we strive to give you this level of written warranty protection, imagine the quality we seek in the rest of your home. We haven’t repealed your common sense home owner maintenance responsibilities. These too, are an important part of the obligations associated with owning any home. We want you to know that a new home contains several thousand components and there is the possibility that there will be conditions in your home that will require correction by us. 57 We will be happy to answer any questions you may have about our Limited Warranty. A copy of it has been provided in the supplementary materials section at the end of this Customer Experience Guide. You may also contact our warranty administrator, PWSC, directly should you have any questions pertaining to the Limited Warranty at (800) 850-2799. MARACAY’S FIVE-STEP WARRANTY PROCESS: 1. Check this manual to determine if the item is covered, then submit a detailed, written service request to the Maracay Homes Warranty Department. 2. After the Warranty Department receives your request, a Warranty Representative will contact you within one (1) business day to schedule an appointment to review your items. 3. The scheduled review appointment will take place in your home, where the Warranty Representative will verify which items are covered. Please understand that this time is allocated to review only the items you submitted. We will make sure we have all the facts and information before we schedule service. Warrantable items will then be transferred to a service work order and the Warranty Representative will schedule work appointments with the appropriate trade contractors. 4. Trade contractors will perform warranty work during scheduled appointments. 5. Your Warranty Representative will request written confirmation from you that the work has been completed. To assist you in determining what types of items might require attention, we have included performance standards in this Customer Experience Guide’s supplemental materials section. They describe the tolerances of workmanship and materials within which you’re new home should perform during the term of your warranty period. *Tip - Keep a list of minor items needing Maracay’s attention. It is more convenient to have multiple items done at one time rather than be inconvenienced by multiple trips to fix each minor item as it pops up. ITEMS NOT WARRANTABLE INCLUDE: 1. Damage from accidents, abuse, misuse, neglect or alterations by the homeowner or others. 2. Damage from earthquakes, rain, floods, freezing temperatures, windstorms, lightning or other natural occurrences. Winds in excess of 54 miles per hour are considered natural occurrences per the Arizona Registrar of Contractors (ROC) guidelines. 3. Damage from act of war, vandalism, armed conflicts or persons engaged in criminal acts. 4. Damage due to lack of timely and proper maintenance. 5. Damage caused by homeowner or renter. 6. Damage due to ordinary wear and tear. 7. Damage to cosmetic surfaces. 8. Homeowner maintenance items. 9. Damage caused by failure to maintain proper grading and drainage. 58 REPAIR DECISIONS: The decision to repair, replace or make payment in lieu of repair or replacement of a covered condition in the home is at our or our Maracay representative’s sole discretion. These remedies are our only obligations under the Maracay Homes Limited Warranty Program. SERVICE HOURS AND APPOINTMENTS: All warranty appointments, meetings and work will be scheduled Monday through Friday between 8:00 a.m. and 4:00 p.m. except for major recognized U.S. holidays. When scheduling an appointment with your Warranty Representative, discuss expectations for how long the appointment will take and when the work will be completed. As part of home ownership, you will need to make time for us to make necessary repairs. This will mean in many instances taking unpaid time off of work or making other means for the work to be performed. The homeowner of the home (or an assigned representative) is required to be present for the entire time that work is being performed. If you have assigned a representative, he or she must be eighteen (18) years of age or older. For insurance reasons, we are not allowed to perform warranty work while alone in your home with a minor, and we would hate to inconvenience you by having to reschedule. 59 It is our goal to complete all work as quickly as possible. But keep in mind that it’s not uncommon to need two to three (2 to 3) consecutive days to accomplish warranty work. For example, drywall repairs done the first day may need to be painted the following day to ensure that the drywall mud (joint compound) has enough time to set before it is painted. OPPORTUNITIES FOR WARRANTY SERVICE / LIMITED WARRANTY PROTECTION PROGRAM DETAILS THE 60-DAY FOLLOW-UP: During the first couple of months that you’re living in your new home, you may notice items that need repair and/or adjustment. Moisture from the wood, paint, concrete, and other materials slowly evaporates during the first year causing cosmetic shrinkage cracks and pops. So, it’s a good idea to keep a running list of the items you find, since about forty-five (45) days after closing you’ll receive a letter from the Maracay Warranty Department asking that you submit a service request in writing. Within one (1) business day of receiving your request, your Warranty Representative will contact you to schedule an appointment at your home. If your home is experiencing an issue that keeps you from enjoying your new home you may submit for work before the 60 days. Example: shower door will not close properly. During this meeting, your Warranty Representative will review each of your submitted items. He or she will then identify the items Maracay Homes will address at this time, write them on a service request form and schedule the work with the appropriate trade contractors. Only the items that are covered by your Maracay Homes’ warranty will be listed on this form. As with the New Home Orientation, we need to identify in writing all items which we agree to address. Verbal discussions which are not reduced to writing on a service request commitment will not be acted upon or honored. Some items, such as drywall and grout, are repaired one time during the first year and can be addressed at your convenience one time during the first year of homeownership. It’s best to wait until the home has experienced both hot and cold seasons before scheduling this one time work. Under most circumstances, and with your cooperation with regard to scheduling, you can expect us to resolve all items within ten (10) working days. We will inform you of any delays 60 caused by back-ordered items and/or items which may need extra time to be manufactured and delivered. It generally works best for our customers if we address all warranty work at one time. This helps with scheduling constraints, such as the requirement that homeowners be present during scheduled service work appointments. Your Warranty Representative will request written confirmation from you that the agreed-upon work has been completed. Note: As you’ll recall from the New Home Orientation, and our building standards located in the supplemental section of this book, damage to cosmetic items such as chips, stains, dents, scratches, dings and paint touch-ups sustained after the NHP are not warrantable. Nor is other damage caused during the move-in period. 11 MONTH REVIEW & ONE TIME SERVICES At approximately the 10th month of home ownership, Maracay Homes will send a letter from the Maracay Warranty Department asking you to submit a service request in writing of the items you would like reviewed during your 11 Month Review. Within one (1) business day of receiving your request, your Warranty Representative will contact you to schedule an appointment at your home. As part of this 11 Month Review, Maracay Homes offers an optional one-time service call for drywall cracks and nail pops, painting of drywall repairs, stucco cracks exceeding 1/16-inch, caulking touch up and grout during the first one (1) year you own your home. Please note: • We suggest waiting until your home has gone through approximately eleven (11) months of heating and cooling before scheduling these services, as many components of a new home continue to equalize throughout the first year. For example, although we use dried lumber, the wood continues to lose moisture and shrink slightly in our desert environment. This can and will crack drywall and cause slight cracks to appear in the grout between your tile and baseboards. Our extreme temperature variations from winter to summer can also cause materials to contract and expand, with similar effects on your building components. • Service work is provided in accordance with the guidelines set forth in this chapter. 61 • The work will be performed during normal working hours (Monday through Friday, 8:00 a.m. to 4:00 p.m. except recognized U.S. holidays). • This service is not provided on any surfaces with wall coverings. • If drywall is repaired and the walls were originally painted by Maracay Homes, we will repaint the repaired areas. However, the paint may not be an exact match due to the age of the original paint. • Drywall repairs done on walls with custom paint (that is, applied by homeowners after close of escrow) are typically not repainted by Maracay Homes but are primed upon the request of the customer. These custom paints can be very tough to match as they are individually made in small batches. It’s a best practice to always purchase extra paint and keep it in the home away from extreme temperatures to help it last longer. Some repair issues occur under normal circumstances and are not going to be addressed by Maracay Homes. These include, but are not limited to hairline stucco cracks; scratched and or damaged glass and mirrors; burned-out light bulbs; batteries; replacing air-conditioner filters; and testing smoke alarms. INTERIM SERVICE: Should you encounter anything that needs attention between your close of escrow and the end of your first year of homeownership, submit a service request to Maracay’s Warranty Department. We recognize that there are warranty items that may require attention before or after your scheduled 60Day Follow-Up. Please submit a service request to the Warranty Department, either online or by letter or fax, as soon as possible. Maracay Homes will make every effort to contact you regarding your concerns within one (1) business day after receiving your written request. A Warranty Representative will investigate and may process certain pressing items prior to your next scheduled warranty appointment. Otherwise, minor items will be processed at your 60-Day Follow-Up and or 11-Month Review. Items taken care of at this time will follow the same process as outlined in the 60-Day Follow-Up section found earlier in this chapter. 62 HOW TO CONTACT US FOR 60 DAY FOLLOW UP, INTERIM AND 11 MONTH REVIEW SERVICES: We require that all requests for warranty service be made in writing. Requests via our web site or in written form help us to track all items to completion. Scottsdale Road, Suite 300 Scottsdale, AZ 85254 Fax Number (480) 970-8899 INFORMATION REQUIRED WITH ALL WRITTEN REQUESTS To better serve you, please be sure all requests include: • Your name and address • Your community name and homesite number • Phone number(s) where you can be reached during business hours • Your email address • A complete description of the item(s); for example, “master bedroom closet does not latch and the door handle seems loose” rather than “door problem.” We ask that you do not contact construction personnel on the site directly to perform warranty service. All requests must be logged into our warranty database to ensure that they are tracked and addressed. If the item concerns home maintenance, we will review the maintenance steps with you and offer whatever informational assistance we can. Please remember that Maracay Homes does not provide routine home maintenance, nor is it covered by any of our warranties. ROOF LEAK: A roof leak is not considered an emergency, since roof leaks cannot be repaired safely until the weather clears. If you are experiencing a roof leak, please move personal belongings away from the leak and make efforts to contain the intruding water. Sometimes poking a small hole in the drywall will help direct the water and prevent pressure from building up behind the drywall and causing further damage. Also see the “Storm Damage” section below. 63 STORM DAMAGE OR OTHER ACTS OF NATURE: Occasionally, questions come up about damage caused by storms, freezing temperatures, or other natural occurrences. Typical areas of storm damage are roof tiles and wind-driven rain intrusion into the attic via the roof vents. Such damage is not covered by Maracay Homes Limited Warranty Program, so if your home is damaged by a storm, contact your homeowner’s insurance agent immediately. Contain the damage as much as possible without endangering yourself. Damage by frost is not covered, so it is important to protect and cover your plants and trees and exterior back flow preventers during times of freezing temperatures. Sometimes things occur in your home that are of great concern to you but do not meet the definition of Emergency Service given below. You may be sure that every effort will be made by our Warranty Department to address your concerns in a timely manner. Note: If you feel you are facing a life-threatening emergency, call 911 or your local authorities. EMERGENCY SERVICE: Sometimes emergencies do occur, such as a gas leak or total loss of electricity. Our Warranty Department will address these promptly. But before you contact Maracay, please make sure your emergency fits this definition per page 12 of the Limited Warranty Protection Program: An emergency condition means an event or situation that creates the imminent threat of damage to the home or common elements, or results in an unsafe living condition due to a construction defect that you (or as applicable, the Homeowners Association) become aware of at a point in time other than our normal business hours and you were unable to obtain our authorized representatives. As per page 7 of the Limited Warranty you may incur reasonable expenses in making repairs in an emergency condition without prior written approval, provided the repairs are solely for the protection of the home or common elements from further damage or to prevent an unsafe living condition and provided you notify us as soon as is reasonably possible. To obtain reimbursement for repairs made during an emergency condition, you must provide us with an accurate written record of the repair costs. Please keep in mind most emergency service is covered for year one (1) of home ownership. Emergencies such as water leaks in years 2-8 of home ownership need quick attention however they may or may not be covered under the Limited Warranty. Please refer to warranty documents for more information. Some possible Emergency Service situations are as follows: • Gas leak. If you have a gas leak, leave your home immediately and do not use the phone in your home. Contact your utility company or plumber right away. • Total loss of electricity. Check with the utility company before reporting this to Maracay Homes or your electrician. 64 • Total loss of water. First, check your main water shut-off and contact the water department to be certain the problem is not a general outage in the area. • Plumbing leak that requires the entire water supply to be shut off. Please take steps to limit damage to surrounding areas and personal belongings. • Total stoppage of plumbing sewer system. Sewer stoppages caused by the home’s occupants will not be covered by the Maracay Homes’ Limited Warranty Protection Program. Blockages after 60 days may require the customer to pay the associated plumber’s costs if not construction related. This is because most construction related service issues occur quickly after move in. • Total loss of air-conditioning or heating. During the hot months of the year, air-conditioning contractors can be very busy and will give priority to homes without any cooling. If your home has multiple air-conditioning units and one or more of them are still working, you may have to wait a little longer for service. While we recognize that it is extremely important that an air-conditioning problem is treated as a top priority, please note that air-conditioning problems of any kind and regardless of weather conditions are not considered emergency service. PROCEDURE IF THEN Warranty emergency occurs during business hours Call Maracay’s Warranty Department at (480) 346-5214. Warranty emergency occurs after hours or on weekends or holidays Call the appropriate trade contractor or utility provider directly and call the after-hours Warranty message center at (480) 303-1112 so we can assist and follow up to ensure the proper repairs are completed. Note: Phone numbers for trade contractors or utility provider are listed on the Emergency Phone Numbers sticker you received at your New Home Orientation. MANUFACTURERS’ WARRANTIES: Some of the items in your home come with a warranty directly from the manufacturer. Per page 11 of the Limited Warranty we assign to you all the manufacturer's warranties on all appliances, fixtures and items of equipment that we installed in the home. Should an appliance or item of equipment malfunction you must follow the procedures set forth in that manufacturer's warranty to correct the problem. Our obligation under this Limited Warranty is limited to the workmanlike installation of such appliances and equipment. We have no obligation for appliances and equipment defined as consumer products. Consumer Product means any piece of equipment, appliance or other item that is a consumer product for purposes of the Magnuson-Moss Warranty Act (15 U.S.C.§ 2301, et seq.) installed or included in the home. Examples of Consumer Products include, but are not limited to, dishwasher, garbage disposal, gas or electric cook-top, range, 65 range hood, refrigerator or refrigerator/freezer combination, gas oven, electric oven, microwave oven, trash compactor, automatic garage door opener, clothes washer and dryer, hot water heater, solar water heater, solar water heating panels, furnace, boiler, heat pump, air conditioning unit, humidifier, thermostat, and security alarm system. Please read all information provided by the manufacturers which discuss the use and care of the appliances, as well as a description of the warranty on that particular item. Additionally, be sure to read all information and follow the instructions for each appliance. Each manufacturer has their own registration requirements that ensure you receive full warranties on their products. Warranties may be limited due to selling your home during the warranty period (original buyer only), non-registration of ownership, etc. If you have questions regarding warranty limitations, please contact the manufacturer directly and notify Maracay Homes that you’ve made the call. For the first year, manufacturers of kitchen and laundry appliances will work directly with you if any repairs are needed for these products. Each manufacturer provides materials explaining the use of each appliance and contact phone numbers. Be prepared to provide the model and serial number of the item and the close of escrow date on your home. Note: For issues with your appliances, you will need to contact the manufacturer prior to the end of the warranty period, typically twelve (12) months. LANDSCAPE: Landscaping beautifies the home and if maintained properly and in time will grow and blossom into something you enjoy for years. Some of the specific warranty limitations on are landscaping materials are: Trees – One (1) year from close of escrow date; Bushes and shrubs – Six (6) months from close of escrow date; Note: Proper maintenance must be performed to prevent future problems. Some of this maintenance includes proper watering and protection from the weather such as freezing overnight temperatures. Plants that thrive in the heat typically do not do well with some of our cold winter nights. HOME OWNER MAINTENANCE: Upkeep of your Maracay Home is very important both in the short and long term. Maintenance is the homeowner’s responsibility and begins as soon as you close. Your ongoing maintenance responsibilities include, but are not limited to, periodic repainting and resealing of finished surfaces as necessary, caulking for the life of the home and site, regular maintenance of mechanical systems, regular replacement of HVAC filters, preserving proper grading around the home and site, and clearing and cleaning drainage systems to allow for the proper drainage of water away from the home and site. As the homeowner you must use and perform periodic maintenance on all manufactured products according to the manufacturer’s instructions and specifications. The misuse, abuse, neglect or other failure to follow manufacturer’s 66 specifications with regard to manufactured products may void the manufacturer’s warranty. Per the Limited Warranty manufactured items have their own warranty and are not covered by the 8 year Protection Plan. As part of this Customer Experience Guide, Maracay has included a Homeowner’s Maintenance Checklist. Please refer to this document often as it will help you properly maintain your new home. This checklist is not intended to be a complete list but covers many helpful areas of home maintenance which will keep your home not only looking great but performing well and saving you potentially costly repairs in the future. It’s the homeowner’s responsibility to prevent landscaping materials or plants from growing into and contacting the exterior surface of the home or common elements such as walls or fences and from interfering with the proper drainage of water away from the foundation. Customers or their landscapers should not alter the drainage pattern or grade of the home site of the foundation so that it negatively affects the drainage of water away from the home or other common elements on the home site or violates the applicable code. Homeowners need to properly maintain each component of the home and home site including proper cleaning, care and upkeep. It’s important for you to utilize the home’s components only for the purposes for which they are intended and not damage, misuse, or abuse them. As a homeowner you must understand and perform the maintenance that the home and homesite require. Maracay Homes is not responsible for home maintenance issues or for damage that results from your failure to maintain the home and or the home site. Proper Care and maintenance of the home which includes but is not limited to the cleaning of appliances, fixtures, painted surfaces and floor coverings. Using the proper cleaning products and methods is very important to the longevity and appearance of your home. Maracay Homes will not be responsible for damages to items for failure to use the proper cleaning agents and or cleaning methods on surfaces. An example would be not using a neutral cleaner on natural stone products and causing damage to the appearance and performance of the stone. Many common household cleaners can strip off protective coatings and lead to damages to the products. Improper moisture levels can not only cause comfort issues but can also cause preventable damage to parts of your home. As a homeowner you need to take action to prevent excessive moisture accumulation by: A. Properly using ventilation equipment; B. Preventing excessive temperature fluctuation within the home; and C. Taking reasonable steps to avoid excessive dampness, humidity or condensation in the home or its common elements that may lead to damage. Maracay Homes provides the Home Builder’s Limited Warranty, a Construction Defect Warranty with an 8-Year Protection Period administered by PWSC (Professional Warranty Service Company), as a part of the Maracay Homes Limited Warranty Program. Please refer to that document for additional details on warranty coverage. 67 9 Summary: New Home Limited Warranty Protection Program Our commitment to your satisfaction doesn’t end after closing. You can be confident that we will deliver top-quality warranty service on your new home. You will have two scheduled opportunities for service during your first year of homeownership. These opportunities will occur at your 60-Day Follow-Up and 11-month Review. If you encounter situations that you feel require more immediate attention, Maracay Homes will be there to help. In addition, you’re covered by an Emergency Service procedure should the need arise. 68 To-Do List Ours Yours Continue to deliver first-rate warranty service after you close on your new home. Take advantage of the scheduled opportunity we offer for service work (60Day Follow-Up). Respond promptly to warranty requests you initiate by mail, fax or online. If a need for interim service arises outside of Maracay’s scheduled service, utilize our warranty request process (mail, fax or online). Work closely with our trade contractors to ensure all warranty work is completed quickly, safely and with quality in mind. Send a reminder to your home address for your 60-Day Follow-Up. Review and use the feedback on Woodland, O’Brien & Scott’s customer surveys to improve our processes and procedures. Send a reminder to your home address for your 11 Month Review Ensure that a person eighteen (18) or older is at the home on the day our Warranty Representative is scheduled to come. This will remove the unfortunate situation of us having to reschedule for another day since our insurance will not allow us to perform service work in your home without a person eighteen (18) or older in presence at the time of the warranty work. Familiarize yourself with the procedures for Emergency Service, just in case. 69 70 10 The Top Ten OVERVIEW INTRODUCTION The Maracay Way — A Customer Experience Guide is designed to help you prepare for the process of designing, constructing and owning your new home. We believe that by educating you about what to expect, you will have a more thorough understanding of our mutual obligations and the entire process will be less stressful and more enjoyable. We have identified the top ten (10) areas that have been a source of misunderstanding for home builders and their customers. At Maracay Homes, we tend to encounter these misunderstandings far less frequently, because by addressing them in advance with complete information, we set the stage for a smooth process. #1 NO VERBAL REPRESENTATION The construction process has hundreds of moving parts at any given time. Therefore, as noted in your Purchase Agreement, there can never be any verbal representation. All communication will be in writing with regard to the construction process, close of escrow and warranty for your new home. If you are unclear as to any expectations, please refer to the written documentation you have been given by Maracay Homes. It is our business practice to always set proper expectations and put all agreements in writing. 71 #2 MAKING SELECTIONS AND TIMING All selections, including Maracay Homes Flex Design® structural options and Design Studio selections, must be finalized within the applicable time period after you have signed your Purchase Agreement. UNDERSTANDING THE PROCESS We recognize and appreciate that this involves much work, thought and decision-making on your part in a relatively short period of time. Often we are asked if we can make an exception “just this one time.” On occasion, customers do not understand why they cannot continue to make changes or modifications when the physical start of their home is still several weeks away, or when the installation of finished materials takes place much later in the process. Here’s why: Many weeks before we begin construction, our homes are built “on paper.” Architectural drawings are completed, site engineering is done and documentation is sent to dozens of vendors and trade contractors who order materials specifically for that home. We also need to process specific information in order to obtain the appropriate building permits. YOUR COOPERATION IS NECESSARY All of our construction processes are built around your cooperation. Our Maracay Homes Flex Design® program offers design flexibility and cost effectiveness unparalleled by builders similar in size and scope to Maracay Homes. It is a challenging process to manage effectively, and we hope you’ll agree that the tradeoff is well worth your cooperation in this area. #3 DIFFERENCES IN HOME PLANS This is especially important if you are purchasing at a community that does not feature a model home of the type you have selected. There are many reasons why we tailor the products and options we include to each specific community. There are differences between communities and a natural evolution of home plans over time. If a particular detail is very important to you, please clarify with the community team exactly how that detail is handled in your community. 72 #4 SITE PLANS UNDERSTAND YOUR NEW HOMESITE It is your responsibility to fully understand, in advance, all aspects of your homesite. To assist you in this process, we will provide a copy of the site and plot plans. We will ask you to sign copies of these plans acknowledging that you have reviewed and fully understand them. These plans contain detailed information concerning the grading of the yard, water drainage patterns, utilities, easements (if any), where the home will be located on the site, and much more information too comprehensive to list here. All of the information is important and a possible source of dissatisfaction if you do not understand how to read and interpret the plan. At the PreConstruction Meeting, please ask your New Home Construction Project Manager to clarify and explain any aspect of the plan that you do not understand. SURROUNDING LAND USES It is your responsibility to fully understand the uses of the property surrounding your homesite, such as the location of parks and/or commercial areas. UTILITIES The placement of electrical transformers, switches, phone or cable TV pedestals, or other utility-related items is determined by the respective utility companies. It is very possible that one or more of these items will be located within the utility easement on your homesite. Maracay Homes does not represent or have any control over these placements, and therefore cannot entertain any requests for the location or movement. 73 #5 CONSTRUCTION PHASES CONSTRUCTION ERRORS At various times during construction you will find scrap material and other debris in your home. It’s also possible that some errors will be made during its construction. Errors are not always corrected immediately. We have standardized processes to ensure that your home is examined and checked for errors or defects, and that it is cleaned as appropriate for the stage of construction and your eventual occupancy. CONTACT YOUR NEW HOME COMMUNITY TEAM While we understand that the construction of a home can be a stressful experience, please remember that every home we have ever built, including our beautiful model homes, have gone through the same “ugly duckling” phases. Please feel free to contact the community team with any specific concerns that you have and to address any concerns at one of our pre-scheduled meetings. ADDITIONAL INFORMATION For additional information, please refer to Chapter 7, Construction of Your New Home. 74 #6 VARIATIONS MATERIALS WILL VARY It is our goal to ensure that you are as informed as reasonably as possible concerning warranties, defects and characteristics. Many of the materials, finishes and flooring used in the construction of your new home are subject to variations in color, texture, size and shading. The samples in our Design Studio are only typical of the average color, texture, size and shading. An exact match is neither implied nor guaranteed. VARIATIONS IN DRYWALL AND STUCCO TEXTURE It is very common in the housing industry to see various applications of drywall and stucco textures. Because these materials are applied by hand, the texture can appear random as no two surfaces will be alike. This is the beauty of the process: each application is unique. Hairline cracks in stucco are inherent in the product and are not repaired. VARIATIONS IN NATURAL MATERIALS Products made from natural materials will vary widely in appearance and can differ significantly from samples and similar products installed in models. This is especially applicable to granite countertops, wood cabinets, wood handrails and hardwood, marble and stone flooring. The appearance of natural materials can also vary within a single home’s installation. For instance, the grain and hue of a complete set of kitchen cabinets will vary from cabinet to cabinet. A granite countertop will have varying characteristics across its entire surface, such as unique color veins, flake size and color intensity. Because granite is a mined material, the location of seams will be determined by the granite company and may vary from one home to another. Additionally, there can be a difference in the veining of the granite due to different mining locations. VARIATIONS IN TILE FLOORING Tile appearance will vary in color, texture, shading and marking depending on the manufacturing process. The samples displayed in the Design Studio reflect an “average” of these characteristics. Ceramic and porcelain tiles have screen patterns. Some only have a single screen and stay more consistent than a multi-screen tile which shows higher variation. Several sizes or trim of the same tile will not match in dye lot because they are made independently. The actual size of the tile may vary from the size stated on the tile sample. An exact match is neither implied nor guaranteed when installed in your new home. VARIATIONS ARE EXPECTED Of course, our warranties cover any actual structural defects. But please be aware that when you are choosing the products described above, variations due to the natural materials used are to be expected, and these products will not be changed once installed if you are unhappy with some aspect of their appearance. 75 #7 PRIVATE HOME INSPECTORS BACKGROUND You are welcome to arrange for a private home inspector. We require that the home inspector provides evidence of proper liability insurance. Please be aware that we only agree to complete warrantable items that are listed on one of our official Maracay Homes forms. BUILDING STANDARDS There are many different private home inspectors and no generally accepted standards for what is included by these inspectors in their reports. We commit to constructing the home to the standards identified in the final section of this guide (which are consistent with standards published by the National Association of Home Builders). Not every item on your inspector’s list will necessarily be completed, as we may not share the inspector’s opinion. REPORTS Frequently a home inspector’s opinion governs what he or she looks for and includes in reports. There can be varying approaches to the same construction application. We will be happy to discuss your inspector’s report with you in detail, but we will only complete work that we list on one of our forms. #8 LANDSCAPING WARRANTY Landscaping materials are covered as follows: trees – one (1) year from close of escrow date; bushes and shrubs – six (6) months from close of escrow date; landscape equipment such as timer, pumps and trellises – (1) one year from close of escrow date. If you are concerned about the health of any plants prior to closing, please address it during your New Home Orientation. HOMEOWNER’S RESPONSIBILITY For all landscaping, it is critically important that you plan on investing time, effort and money in the proper care of your yard from the first day you close on your new home. Right after installation, the yard will require several weeks of proper watering to keep the roots moist and growing. Remember to protect plants and trees from frost damage. CARING FOR YOUR NEW YARD Please discuss any questions you have about the proper care of your yard with your New Home Construction Project Manager at the New Home Orientation. 76 #9 EMERGENCY SERVICE Emergency Service response from trade contractors is offered during the first year of warranty and is limited to some very specific situations. Water events are considered emergency for all 8 years but may not be covered if not deemed a defect by Maracay Homes. Please carefully review Chapter 9 to determine when you can expect after-hours phone coverage and/or response on mechanical problems. Also note the following: • In the case of water leaks, turn off the main shut-off valve. • A total sewage backup may be an emergency; however, the cause of the backup may or may not be warrantable. Contact the Maracay Homes’ warranty department, so we may assist you in determining the cause of the stoppage. • If there is a total loss of power, check with your utility company before contacting Maracay Homes. • A roof leak is not an emergency and is unsafe to fix during a storm. AIR-CONDITIONING Please especially note that air-conditioning problems of any kind and regardless of weather conditions are not considered emergency service. While we recognize that it is extremely important that an air-conditioning problem is treated as a top priority, it is likely that several days could pass between when the problem is first reported and when it is repaired. TEST BEFORE THE SEASON BEGINS To avoid the inevitable rush for service that heating and air-conditioning contractors experience every spring, please plan on testing your air-conditioning system in the spring before temperatures become too warm. In the fall, plan on testing your heating system before temperatures become cold. #10 WARRANTY SERVICE Warranty service is provided only during the week. The agreements that Maracay Homes has in place with its trade contractors is based solely on work performed on normal workdays: Monday through Friday from 8:00 a.m. to 4:00 p.m. except on recognized U.S. holidays. Weekend hours are not a part of the warranty program except with regard to very limited emergency service circumstances. All warranty work must be documented; therefore, it is imperative that Maracay Homes have a written request for service in order for us to hold our trade contractors accountable. 77 To-Do List Ours Clearly communicate what you can expect from the design, construction and warranty service processes. Build your home according to Maracay’s high standards, which are consistent with the standards of the National Association of Home Builders and the Arizona Registrar of Contractors. Service your home after closing in a way that ensures your satisfaction and willingness to refer Maracay to friends and family members. 78 Yours Review the Top Ten carefully and refer back to it while your new home is in the design and construction stages, as well as during the first two years of homeownership. Make sure you understand your site and plat plans. If anything is unclear, discuss it with your New Home Construction Manager at the PreConstruction Meeting.
