WHITE COLLAR CRIMINAL DEFENSE
LibbyHoopes has successfully defended companies, executives and other
professionals in all types of investigations, regulatory enforcement actions, and
criminal prosecutions. We have achieved victories and other positive results in
these matters through pre-charge advocacy, in negotiation, and at trial. Here are
some recent examples.
Criminal Charges Against Executives Dismissed
Two out of state chief executive officers of a national construction firm were
charged criminally with building code violations by a state district attorney. LibbyHoopes was
brought in on the eve of trial to handle the defense. Prior to commencement of the trial,
LibbyHoopes filed a carefully researched and crafted motion and convinced the court to dismiss the
charges on legal grounds.
Healthcare Professionals Cleared of Wrongdoing
In three recent matters, LibbyHoopes’ clients were the targets of intensive health care fraud
investigations. In one case, a prominent physician at a well-known Boston hospital was alleged to
have engaged in Medicare billing fraud. In another, we convinced the Justice Department to decline
prosecution of a primary care physician who had been suspected of serious Medicare billing
irregularities.
In yet another such case, LibbyHoopes represented a supervisor-target of a Medicare fraud/federal
grand jury investigating false claims for health care services. While the grand jury indicted one
executive of the target company, LibbyHoopes negotiated a “no admission of wrongdoing” result for
its client, leaving neither a penalty nor a permanent record.
Professionals Acquitted at Trial
Some cases should be negotiated and others litigated, depending on the client’s interests and
objectives. In two recent separate cases, LibbyHoopes represented a health care practitioner and
state court prosecutor, each charged with criminal offenses carrying prison exposure, loss of license
and the end of their professional careers. In each instance, following a multi-day trial, LibbyHoopes’
client was acquitted by a jury and completely exonerated. Both clients continue to practice their
professions with distinction.

All Charges Dismissed Against Trucking Company Executive
LibbyHoopes served as counsel in a recent high-profile case involving federal charges of
embezzlement, mail fraud and ERISA (pension fund) fraud against certain union officials and
trucking company executives. Before trial was to start, LibbyHoopes participated in extensive
negotiations with the government, resulting in dismissal of all charges against its (trucking company
officer) client.

For example, in one high profile “job action” targeting a large local employer, LibbyHoopes lawyers
appeared simultaneously in three separate courts, defending applications for criminal complaints
sought against mid-level managers and senior employees. In each case, the court rejected the
application and no charges were filed.
LibbyHoopes has also enjoyed a string of successes representing college and graduate students
charged with criminal offenses and related disciplinary violations, facing expulsion or suspension
from colleges and graduate schools in the Boston area. To date we have helped to exonerate
students at Harvard University, Boston College, Boston University, Northeastern University, and
Babson College.
Here are but a few examples of our efforts and successes in the civil and regulatory litigation area:
Civil Rights and Whistleblower Action Against Police Officials Dismissed
LibbyHoopes represented the Chief of Police and two superior officers of a major Boston area police
department in a federal civil rights and whistleblower action brought by a fellow officer. After
discovery was completed, a judge granted LibbyHoopes’ motion for summary judgment and
dismissed the case, which was upheld by the appellate court.
Claim Against Major Pharmaceutical Firm Defended
Working together with outside corporate counsel, LibbyHoopes represents a major publicly traded
pharmaceutical company in a massive “average wholesale price” multi-district litigation action in the
federal court.
LibbyHoopes Persuades U.S. Customs to Overturn “Failure to Declare” Forfeiture
On re-entering the United States, a LibbyHoopes client — then suffering from certain medical and
psychological ailments not immediately apparent to federal officers — failed to fully account to the
U.S. Customs Service all of the (significant) monies in the client’s possession. LibbyHoopes
interceded with Customs officials on the client’s behalf, and arranged to have the forfeiture order
reversed, with the monies returned to the client.

Home Builder Obtains Favorable Judgment
LibbyHoopes represents one of the nation’s largest builders of luxury homes in civil litigation and
arbitrations in Massachusetts. Recently, we obtained a summary judgment order on behalf of our
client in a case alleging various construction defects and fraud. LibbyHoopes has also had several
successful results for the same client in other court cases and arbitration proceedings.
Harvard Students Cleared of Sexual Assault
In unrelated actions (in different school years) commenced by the University disciplinary board,
LibbyHoopes has represented three Harvard students charged with sexual assault. These cases carry
profound consequences, including the prospect of a parallel criminal prosecution by local
authorities. With LibbyHoopes’ assistance, each of our clients was cleared of wrongdoing and went
on to graduate.
INTERNAL INVESTIGATIONS
Many of our clients are businesses and employers who face legal exposure as the
result of the unlawful or questionable conduct of their employees or officers. We
have also successfully represented clients victimized by the theft of trade secrets
or proprietary data by a competitor. In either instance, LibbyHoopes is equipped
to conduct prompt and extensive internal investigations, help secure the return of
stolen business and intellectual property, and work with law enforcement agencies
to protect the client’s immediate and long-term interests. This may include the
commencement of legal action and coordination of criminal proceedings against
the perpetrators. Internal investigations can also result in substantial changes in a
client’s business practices that might deflect government investigations by assuring compliance with
applicable regulatory schemes or assure prosecutors of the client’s good faith.

The Aftermath of the 9/11 Terrorist Attacks
One day after 9/11, one of the private security companies that screened passengers at Boston’s
Logan Airport called upon LibbyHoopes to review its operations and the conduct of its employees.
Employing a rapid response “team concept,” LibbyHoopes conducted a comprehensive internal
investigation on behalf of our client over the weeks that followed. In connection with this review,
LibbyHoopes occasionally used its unmatched contacts within the government to access valuable,
sensitive and timely information. LibbyHoopes continues to represent our client in civil litigation in
U.S. District Court in New York arising from the terrorist attacks.

Pension Fraud Probe for Investment Firm
LibbyHoopes has represented an investment advisory (‘40 Act) firm that had received a federal grand
jury subpoena as part of an investigation of alleged pension plan fraud. LibbyHoopes crafted a
coordinated response, dealing with the SEC and the Justice Department on the one hand while
conducting a thorough confidential investigation that confirmed wrongdoing by certain employees.
Our report allowed senior management to take appropriate disciplinary action, adopt remedial
measures, and self-report to the SEC. This strategy enabled the client to avoid any prosecution, civil
penalties, loss of license, or interruption in its business.
Wrongdoing within School Department Confirmed
LibbyHoopes was engaged to conduct an internal investigation on behalf of a major municipal
school department involving wrongdoing by senior executives. Our attorneys thoroughly reviewed
and brought the matter to a successful close, while advising and guiding municipal leaders as to the
appropriate disciplinary measures to be taken due to the facts uncovered.

Another LibbyHoopes specialty area is media and government relations.
LibbyHoopes regularly consults with corporations and executives confronting
potential crises that require a guiding hand. In resolving these situations,
LibbyHoopes’ collective experience as, and with, government officials, and our
relationships these officials and with members of the media are important tools at
our disposal. We get these calls because we get results for our clients.
The ability to work with the media in a case often transforms the result for a client.
The lawyers at LibbyHoopes have significant experience with both electronic and print media in
investigations, indictments and litigation. Contrary to conventional wisdom, on many occasions we
have advocated that our client talk with the press – usually with successful and satisfying results.
Silence, or “no comment” may be the prudent course in other cases. There is no formula here; each
case requires a carefully tailored strategy based on its own circumstances and advancing the
objectives of our client. When appropriate, we work together with top public relations professionals

Here are some examples of our efforts in this area:
LibbyHoopes Helped Guide the New Red Sox Owners through AG Probe
LibbyHoopes played a quiet, but crucial role, in its representation of New England Sports Ventures,
Inc., in its 2002 acquisition of the Boston Red Sox when the Massachusetts Attorney General
threatened to halt the sale. With the looming prospect of the re-opening the bid process to purchase
the team, LibbyHoopes interceded and helped secure a settlement that allowed the sale to the new
owners to proceed.
Residential Youth Home Survives Inquest and Media Onslaught
LibbyHoopes represented a non-profit residential facility for troubled youth in which a teenage
resident with a history of violence died while being restrained by two employees. Media coverage in
the wake of the incident was intense and overwhelmingly negative fueling demands for action
against our client. The district attorney commenced an inquest, an investigative process overseen by
a judge, to determine whether criminal charges should be brought. Employing a strategy that it
developed on behalf of the client, LibbyHoopes was able to change the media coverage to
accurately relate the unfortunate circumstances of the event and sympathetic efforts by the facility.
The inquest judge ultimately found no culpability. Our client was exonerated and, reputation intact,
returned to providing services.
Legislator Quickly Cleared in Court, and in the Court of Public Opinion
In cases where concerns of public perception and personal reputation are paramount, keen
investigative work is often the best defense. For example, LibbyHoopes succeeded in turning a
potentially damaging media story about a Massachusetts legislator into a legal and public relations
victory through a quick and effective internal investigation. Our high-profile client had, only the day
before, been sued for sexual harassment. By arranging a near-immediate meeting with plaintiff’s
lawyer and producing compelling evidence demonstrating that the client was the victim of nothing
more than unrequited affection, we not only forced the prompt dismissal of the lawsuit, but were
able to coordinate news stories that discredited the allegations, thus protecting our client’s
reputation.

FRANK LIBBY represents public companies and their executives, and private
individuals, drawn into governmental investigations and criminal proceedings.
In his 20 years as a trial attorney, Mr. Libby has conducted more than 30 jury
trials and numerous bench trials. He appears frequently in both state and
federal courts and before administrative tribunals, and has had extensive
experience representing companies and individuals before grand juries and in
connection with administrative investigations and proceedings.
Mr. Libby has expertise in minimizing corporate exposure to government
regulators, where there may be reason to suspect possible senior management

or other employee wrongdoing. He has significant experience in conducting
sensitive, internal investigations on behalf of publicly-held companies, and
other corporate clients, where employee wrongdoing exposes the client to both governmental and

After several years as a civil trial lawyer with a major Boston law firm, where he represented clients
in complex business disputes and professional liability cases, Mr. Libby was appointed an Assistant
U.S. Attorney in Boston, where he served in both the Civil and Criminal Divisions (1989-1996). As a
Civil Assistant U.S. Attorney, he appeared as the government’s chief trial counsel, bringing
enforcement actions on behalf of the United States, and defending civil claims, including claims for
injunctive relief and administrative review, brought against the United States and its agencies. As a
federal prosecutor, Mr. Libby conducted and supervised numerous grand jury investigations. While
with the U.S. Attorney’s Office, he represented the government in a number of important jury trials,
including the so-called Roslindale bombing case, which arose out of the death, in 1991, of a Boston
Bomb Squad officer, and the Charlestown “Code of Silence” drug and murder conspiracy case.
Mr. Libby is a 1982 cum laude graduate of Suffolk Law School, where he served as an Editor of the
Suffolk Law Review. Thereafter, he served as law clerk to the Honorable Richard B. Kellam, Senior
U.S. District Judge for the Eastern District of Virginia. On his graduation, in 1974, from the United
States Military Academy at West Point, Mr. Libby was appointed a commissioned officer in the
U.S. Army and served as a military Air Rescue helicopter pilot on active duty, both overseas and
stateside, and with the Massachusetts National Guard.

TOM HOOPES has spent more than 15 years successfully representing
corporations, executives, professionals and public officials in a wide range of
complex criminal and civil matters. He has substantial experience managing
media relations as well as internal business communications and some of these
cases have been very public. Typically, though, the resolutions have been

Mr. Hoopes has been named one of Boston’s top criminal lawyers by a
prominent Boston magazine as well as one of the top 100 lawyers in

In the criminal and government enforcement area, in federal and state proceeds, Mr. Hoopes’ cases
have covered a broad range of charges and potential charges, including tax crimes, health care
fraud, kickback allegations, wire and mail fraud, money laundering, securities fraud and public
corruption. He has also been involved in homicide and motor vehicle homicide, OUI, drugs, and
domestic assault and battery offenses in state and federal court.
Mr. Hoopes has conducted internal investigations, often with in-house or other outside counsel, for
corporations where employees and/or executives have allegedly engaged in wrongdoing. He has
successfully defended high-profile political figures in complex civil litigation in federal court.
Mr. Hoopes makes frequent appearances as a legal analyst on national and local television and radio

He is the former chair of the Massachusetts Bar Association Criminal Justice Section and has coauthored chapters for the Massachusetts Continuing Legal Education handbook on Massachusetts
Superior Court practice. Mr. Hoopes has taught trial practice at Harvard Law School and at every
other major law school in the Boston area. He is a member of the Boston Bar Association, the
Massachusetts Bar Association, the National Association of Criminal Defense Attorneys, and the
American Bar Association.
During his nearly ten years of public service as a state prosecutor, his successful cases included
murder, national drug distribution, public officials and professionals. He created and supervised the
White Collar and High Publicity Crime Units in Middlesex County, Massachusetts, and his efforts led
to the creation of the Massachusetts and national registry for physician misconduct.
Mr. Hoopes is an honors graduate of Haverford College and Boston University School of Law.

DOUGLAS BROOKS, who was named Partner in May 2005, focuses
his practice in the areas of white collar criminal defense and complex civil
litigation.
Mr. Brooks has defended clients in proceedings in federal and state courts,
which have involved a variety of charges, including public corruption,
securities fraud, ERISA violations, pension fund fraud, and violent crime.
Mr. Brooks has also advised clients in connection with enforcement

Mr. Brooks has participated in conducting comprehensive internal
investigations for corporate clients in the financial services industry, and
the airline security industry in the wake of the tragic events of September 11, 2001. Mr. Brooks also

MATT RICKMAN focuses his practice in white collar criminal defense and
civil litigation.
Prior to joining LibbyHoopes in May 2002, Mr. Rickman served as an Assistant
District Attorney in Middlesex County, where he directed investigations and
prosecuted a variety of criminal cases, in both district and superior courts.
Some of those cases included trafficking and other narcotic-related offenses,
complex corporate fraud and embezzlement schemes, domestic abuse, sexual
assaults, felony motor vehicle homicides, and numerous violent felonies.
During his tenure with the District Attorney’s Office, Mr. Rickman also
supervised other prosecutors in the Newton and Cambridge District Courts, where he was
responsible for overseeing and directing the prosecution of the nearly 5,000 cases falling within
those jurisdictions annually.
Mr. Rickman is an honors graduate of the Washington College of Law at American University in
1997, and Emory University in 1992. He is a member of the American and Boston Bar Associations.

SARAH WALSH focuses her practice in the areas of white collar criminal
defense and complex civil litigation. Prior to joining LibbyHoopes, Ms. Walsh
served as a Legislative Aide with the Massachusetts House of Representatives,
Office of James M. Murphy.

Prior to studying law, Ms. Walsh received a cum laude degree in
Organizational Communication from Ithaca College. She worked in the public
relations industry with firms in New York and Boston.

CASSANDRA ARRIAZA focuses her practice in the areas of white collar criminal
defense, government investigations, internal corporate investigations, and
complex civil litigation.
CASSANDRA ARRIAZA
Cassandra has experience in all stages of federal criminal investigations, from
pre-indictment through appeals. She has represented multinational
corporations and their executives in government investigations of potential
violations of some of the most pressing securities and enforcement issues,
including those related to the Foreign Corrupt Practices Act, Food Drug and
Cosmetic Act, revenue recognition, insider trading, and other criminal statutes
and securities fraud regulations. Cassandra also worked with clients in
conducting internal investigations and developing corporate compliance
programs.
After graduating from Harvard Law School, Cassandra clerked for the Honorable Jerome A. Holmes
on the Tenth Circuit Court of Appeals. Just prior to joining LibbyHoopes, Cassandra spent four
years at the D.C. office of one of Boston’s largest international law firms, where her practice focused
on federal criminal trials and appeals, internal investigations, SEC enforcement actions, and
investigations related to the Foreign Corrupt Practices Act.

Prior to law school, Cassandra graduated from Dartmouth College, summa cum laude, with high
honors in Psychology. Her honors thesis focused on eyewitness identification as the subject of
expert testimony. While at Harvard Law School, Cassandra was Managing Editor of the Harvard
Journal of Law and Public Policy, and she participated in the finals of Harvard’s moot court
competition and presented oral argument for her team before a panel of distinguished jurists,
including Supreme Court Justice Anthony Kennedy.
