Interpretation and Application
1.1For the purpose of these terms and conditions:
“Auto Salon” represents Status Corporation (ACN 133 761 832) and its
subsidiary companies.
“Auto Salon Events” represent all events organised by Status Corporation and its subsidiary companies.
“Advertising” represents any services carried out by Auto Salon including
trade stands, sponsorship and all forms of advertising or promotion within
any Auto Salon Events.
“Trader” represents any client/advertisers buying Advertising.
1.2 These terms apply in relation to any Trader buying advertising within
Auto Salon Events.
Variation Of Terms and Conditions
2.1 Auto Salon reserve the rights to alter these terms and conditions at
any time with or without notifications depending on the alteration.
Payment Terms
3.1 Auto Salon reserve the rights to sell, or market any trade stand that
was booked by advertisers unless paid in full before the due date shown
on the “Method Of Payment” form available from Status Corporation.
3.2 Auto Salon may charge an additional interest and service fee to any
unpaid advertising or balance of any unpaid advertising.
3.3 Any payment by credit card is subject to approval by Auto Salon, which
reserves the right to charge a service fee in respect of such payments.
Good & Services Tax (GST)
4.1 Trader will pay all goods and services tax (GST) applicable to services
provided by Auto Salon and it is acknowledged that prices quoted by Auto
Salon for services are exclusive of GST unless clearly expressed to the
contrary in a written invoice or quote.
Default
5.1 If Trader fails to pay any moneys owing to Auto Salon or fails to
observe or perform any of its obligations under these terms & conditions
or if Trader breaches the terms & conditions of any agreement it has with
Auto Salon at any time or commits ant act of bankruptcy or insolvency or
ceases or threatens to cease carrying on Trader’s business, then Auto
Salon may in addition to any other rights or remedies it may have:
5.2 Requires immediate payment of all moneys owing by Trader’s to Auto
Salon.
5.3Recover from Trader all costs relating to any action taken to recover
monies from Trader including any cost of debt collecting agencies and any
legal cost
5.4Cease any further deals or agreements in relation to further
Advertising in any Auto Salon Events.
Cancellation / Rejection of Advertising
6.1 Auto Salon reserves the right to reject any request of Advertising from
any Trader that has similar, close to or slight resemblance to the nature of
any Auto Salon Events.
6.2Auto Salon reserves the right to reject any request of Advertising from
any Trader that its nature of business is directly or indirectly in conflict
with any Auto Salon Events.
6.3 Any Trader wishing to cancel their advertising with any Auto Salon
Event must do so within at least 28 days prior to that particular event.
If Trader fails to do so, Auto Salon will still require full payment for any
cancelled Advertising within the 28 days period.
Indemnity
7.1 Trader will indemnify and keep indemnified Auto Salon and their
respective employees against all claims, demands, proceedings, damages,
costs, expenses, losses or any other liability whatsoever arising wholly or
partly, directly or indirectly in connection with any Auto Salon Events.
7.2 Auto Salon is not responsible for any property loses and damages
within Auto Salon Events. Auto Salon will not cover or acknowledge any
claims to any incident other than those that are covered by our Public
Liability Insurance.
Governing law
8.1 Trader agrees that these terms and conditions shall be construed
according to the laws of the State of New South Wales and Trader
consents to any proceedings arising out of these terms & conditions
being instituted and heard by any appropriate court sitting in the State of
New South Wales.
Logo, logo design and copyright
9.1 Trader will not use any logo, logo design or any logo /logo design that
resembles that of Auto Salon without the written consent from the director
of Auto Salon.
9.2 All intellectual properties produced within any Auto Salon events
remain the property of Auto Salon and are not to be used in any other
events without any written consent from the director of Auto Salon.
