In 2014, the Art Gallery of Hamilton will celebrate its 100th anniversary.
Today the AGH is the third largest public art gallery in Ontario with a
permanent collection of approximately 10,000 works of art that is
recognized as a jewel. The establishment of an art acquisition endowment
will enable us to look forward to the future, confident that we will be able
to continue to enhance our permanent collection through the acquisition
of significant works of art.
The Art Gallery of Hamilton is deeply grateful to the artists, collectors,
galleries, dealers and AGH Members who have so generously donated the
150 extraordinary works of art, exquisite pieces of jewellery, beautiful
decorative objects and fine antiques that will be sold at Super Auction Live.
We are also most grateful to Sotheby’s, in particular David Silcox, President,
and the staff who have provided us with counsel and advice and have
generously donated their services for Super Auction Live.
I would also like to thank the Volunteers and staff of the Art Gallery of
Hamilton who have dedicated legion hours to making Super Auction Live
a success.

Conditions of Sale
Each lot contains an estimated market value obtained from sources that the Art Gallery of Hamilton believes to be reliable,
but no representation or warranty as to the actual resale value of any work being auctioned is made or implied. The
estimated value is intended as a guide to assist you in your bidding. All lots are being offered subject to a reserve, which
is the confidential price below which each lot will not be sold.
General rules for Super Auction Live
All sales are final. No purchase can be returned, refunded or exchanged. All property is sold as is, as exhibited.
If the final purchase price is equal to or greater than 120% of the estimated value, the purchaser will be issued a
charitable tax receipt for the difference between the estimate and the selling price.
All bidders must purchase a ticket ($75) in order to attend Super Auction Live and be registered to bid. Bidders must
provide a valid credit card number. A credit of $75 will be applied to the lot’s final sale price.
Successful bidders should be prepared to pay for their purchases in cash, by American Express, MasterCard, Visa, or by
personal cheque payable to the Art Gallery of Hamilton on the evening of Super Auction Live. No HST or auction
commission is applicable.
Your credit card will be charged unless alternative arrangements are made prior to leaving the auction. Title to the offered
lot will then pass to you, and you will thereupon assume full risk and responsibility for the work purchased by you.
If the auctioneer determines that any opening bid is not commensurate with the estimated value of the work offered,
he may reject same and withdraw the work from sale; and, if, having acknowledged an opening bid, he decides that any
advance thereafter is insufficient, he may reject the advance and withdraw the work from sale.
In the event of any dispute between bidders, in the event of a missed bid, or in the event of doubt as to the validity of
any bid, the auctioneer will have, at his discretion, the final authority either to determine the successful bidder or to
re-offer and resell the work in dispute.
If any dispute arises after auction, the Sotheby’s record of the auction proceedings shall be conclusive.
The Art Gallery of Hamilton reserves the right to withdraw any work of art at any time before the actual sale.
The Art Gallery of Hamilton makes no warranties or representation of any kind or nature with respect to any work of
art including but not limited to, any representation or warranty of description, genuineness, attribution, provenance, or
physical condition, nor as to the right of reproduction, if any. Bidders and purchasers may not rely upon any statement
of the Art Gallery of Hamilton, oral or otherwise, other than as set forth in these conditions of sale.
Bidding in Person
If you would like to bid in person you must purchase a ticket ($75 each) and register for a paddle upon entering the
auction room. The paddle is numbered so as to identify you to the auctioneer. To register you will need a form of
identification such as a driver’s license, a passport or some other type of government issued identification. If you are
bidding for someone else you will need to purchase a ticket and provide a letter from that person authorizing you to bid
on that person’s behalf. Issuance of a paddle is at Sotheby’s sole discretion.
Once the first bid has been placed the auctioneer asks for higher bids, in increments determined by the auctioneer.
To place your bid, simply raise your paddle until the auctioneer acknowledges you. You will know when your bid has been
acknowledged; the auctioneer will not mistake a random gesture for a bid.
Absentee Bidding
Absentee bids can be placed either by phone during the auction on Tuesday evening, October 23, 2012 or by registered
absentee bid.
In either case, please use the form provided on the adjacent page and be sure to record accurately the lot number and
description of the work and all pertinent information. All bids are executed and are accepted, subject to the conditions
of sale printed in the catalogue of this auction.
Please place your registered absentee bid as early as possible, but no later than 4:00 p.m. (EST) on Monday, October 22,
2012. In the event of identical bids, the earliest received bid will take precedence.
Successful bidders will be notified and the purchase will be charged to your American Express, Visa, or MasterCard as
indicated on your completed form. The purchaser has the option to provide a replacement cheque within 48 hours of
notification.
Pickup
All works must be paid for at the conclusion of the Super Auction Live evening. Purchasers must pick up works at the
conclusion of the Super Auction Live evening upon proof of payment. Transportation may be arranged.
The Art Gallery of Hamilton is not responsible for acts or omissions of carriers and packers or purchased lots, whether or
not recommended by it. Packing and handling of purchased lots are at the entire risk of the purchaser.

Guide for Absentee and Telephone Bidders
If you are unable to attend the Super Auction Live sale conducted by Sotheby’s, you may give instructions to bid on
your behalf by completing the Absentee/Telephone Bid Form on the reverse. This service is free and confidential.
Please record accurately the lot numbers, descriptions and the top hammer price you are willing to pay for each lot.
Sotheby’s will try to purchase the lot(s) of your choice for the lowest price possible and never for more than the
maximum bid amount you indicate, except where you have authorized one bid above your maximum.
Plus One Bid: By checking the Plus One Bid column pertaining to the lot(s) on which you wish Sotheby’s to place
absentee bids you authorize Sotheby’s to bid one more time on your behalf. In the event that another bidder has bid
your maximum bid, Sotheby’s will bid one more time on your behalf, in which case you will either be the successful
buyer or be taken out of the bidding if another bid is made and surpasses yours.
“Buy” or unlimited bids are not accepted.
Alternative bids can be placed using the word “OR” between lot numbers. Then if your bid on an early lot is successful,
we will not continue to bid on other lots for you. Or, if your early bids are unsuccessful, we will continue to execute bids
for alternative lots until a bid is successful.
