G e m ä ß § 20 i d e r R e i c h s a b g a b e n o r d n u n g (RAO ) h a b e n die
F i n a n z ä m t e r d a r ü b e r z u w a c h e n , ob d u r c h S t e u e r f l u c h t o d e r in
so n stig e r W eise zu U n re ch t S te u ere in n a h m en v e r k ü rz t w erden.
Mit d e r A n w e n d u n g u n d T r a g w e i t e d i e s e r G e s e t z e s b e s t i m
m u n g h a t si c h d e r R e ic h s f i n a n z h o f (R F H ) w i e d e r h o l t , i n s b e s o n d e r e
i m G u t a c h t e n v o m 20. Mai 1933 b e f a ß t . H i e r n a c h so llte die S t e u e r
aufsicht n ich t n u r g e g en ü b e r be stim m te n Personen, sondern auch
s o n s t z u r A u f k l ä r u n g z w e i f e lh a f t e r T a t b e s t ä n d e a u s g e ü b t w e r d e n
k ö n n e n . J e d o c h s o l l te n n a c h d e n A u s f ü h r u n g e n d e s G u t a c h t e n s
d ie F i n a n z ä m t e r S t e u e r a u f s i c h t s m a ß n a h m e n n u r d a n n e r g r e i f e n
d ü r f e n , w e n n n a c h d e n G e s a m t u m s t ä n d e n d e s F a l ls ein b e g r ü n d e
t e r A n l a ß d a f ü r b e s t e h t , d a ß d u r c h S t e u e r f l u c h t o d e r in s o n s t i g e r

D e r R F H h a t d a n n a u c h i n e in e r n e u e r l i c h e n g r u n d l e g e n d e n
E n ts c h e id u n g seinen u rsp rü n g lich e n S ta n d p u n k t v e rla ss e n u n d
sich f ü r die a ll g e m e in e A u s k u n f t s p f l i c h t d e r B a n k e n i n S t e u e r
s a c h e n a u s g e s p r o c h e n . N a c h d e m d i e s e m U r t e il z u g r u n d e l i e g e n
d e n T a t b e s t a n d v e r l a n g t e d a s F i n a n z a m t v o n e in e m D a rle h e n s

D e r R F H ließ j e d o c h in s e i n e r E n t s c h e i d u n g diese G r ü n d e
n i c h t g e l t e n , s o n d e r n s t e ll t e sich n u n m e h r a u f d e n S t a n d p u n k t ,
d a ß d u r c h § 2 0 i R A O e ine a ll g e m e in e A r t d e r S t e u e r a u f s i c h t g e
s c h a f f e n w o r d e n ist, die d e n F i n a n z ä m t e r n d a s R e c h t g ib t, a u c h
z u m Z w e c k e d e r A u f d e c k u n g u n b e k a n n t e r S t e u e r f ä l l e A u s k u n f t zu

A u ch in der letzte n B erichtsw oche übte die U nsicherheit der w irt
schaftlichen E ntw icklung in den V ereinigten Staaten, wie schon seit lä n
gerer Zeit, ihre ungünstige E inw irkung auf den G eschäftsverkehr am
Brem er B aum w ollt er m inm ar k t aus. Die vereinzelt etw as bessere N ach
frage des In la n d es verm ochte daher ein A bgleiien der K urse nicht zu
verhindern.
Bei verschiedentlich etw as angeregterer K au flu st eröffnetc yder
M arkt am 22. A p ril m it einem A ufschlag von einigen P u n k te n , und die
Stim m ung war w ährend des ganzen Tages sehr stetig, so daß die Kurse
langsam einige P u n kte w eiter anziehen konnten. A m 23. A p ril war die
Stim m ung im großen und ganzen ruhig, w enn auch nicht ganz ein h eit
lich, die Kursbew egungen blieben daher auf ein äußerst geringes M aß
beschränkt. W enig U nternehm ungslust ließ den M arkt am M ontag, dem
25. A p ril, einige P u n kte tiefer eröffnen, jedoch verm ochten sich die
Kurse tro tz geringer U m sa tztä tig keit w ährend des Tages zu behaupten.
A u s M angel an neuen A nregungen von den ausländischen B örsen eröffnete der M arkt am 26. A p ril um einige P u n kte niedriger, im Laufe
des Tages zeigte sich jedoch verschiedentlich etw as m ehr K auf int er esse,
infolge dessen sich die K urse langsam um einige P u n kte erholen k o n n
ten. Die wenig zu friedenstellenden K abelberichte aus den V ereinigten
S taaten veranlaßten am 27. A p ril einen P reisrückgang von etw a
10 P unkten. Die Nachfrage war g rößtenteils unregelm äßig und erst am
N achm ittage verm ochte sich eine leichte B efestigung m it einer K urs
erhöhung von einigen P unkten durchzusetzen. Die etw as freundlicheren
B erichte aus N ew Y ork ließen den M arkt am 28. A p ril zw ar einige
