A few sparks, but budget passes
Dispute over money for firefighters vs. infrastructure most heated

There was an air of ease heading into City Council’s budget
finale Monday.
The process of balancing the
city’s spending plan had been
relatively smoother compared to
several years past. Humor often
entered dialogue. The conclusion
wasn’t expected to be too difficult.
Before the final 19-0 vote,
though, it wasn’t exactly simple.
Disagreements cropped up, the

more than $1 billion plan, but
a philosophical difference essentially boiled down to spending on
infrastructure needs or money for
public safety.

Brother, can you spare a dime?
That question –– or one much like it –– is
commonly asked by people who say they
are hungry or need money for some other
reason.
The question is heard daily throughout
the world, but panhandling is a subject that
will be studied by Downtown Vision Inc.,
the urban core advocacy organization that
oversees the 90-square-block improvement
district.
Based on preliminary discussions with
executives from social service agencies and
the Jacksonville Sheriff’s Office, DVI CEO
Jake Gordon said he’d like to see a strategy
developed that could reduce the likelihood
of panhandling by bringing together service providers, police and DVI.
“The goal is to make sure the Downtown
partners are coordinated,” he said.
What keeps people away from the neighborhood will fall into one of two categories, said Gordon.
“When people say they can’t find a place
to park Downtown, that’s a perception
issue, because there are plenty of parking
places. When people say it’s not safe, that’s
a perception issue because it’s one of the
safest parts of Jacksonville,” he said.
“But when people say they don’t like to
come Downtown because they might be
panhandled, that’s reality,” Gordon said.
Panhandling also is clearly against the
law. It’s a misdemeanor and considered a
nuisance crime.
Under City municipal code, “It shall be
unlawful for any person within the Central
Core Enhancement Area to solicit or beg on
any sidewalk, highway, street, roadway,
right-of-way, parking lot, park or picnic
grounds or other public or semi-public
area, or in any building lobby, entranceway, plaza or common area without the

the city is putting $500,000 over
the $6 million minimum recommended and has a backlog of
$24 million in needs, said council
member Lori Boyer.
Those needs are felt in every
district, she said, and pulling
from that source “is really unfortunate and a bad decision.”

him saying it was the best source
at the time.

Restaurateur Norm Abraham has decided to close the popular Two Doors Down
restaurant Nov. 25, the day before Thanksgiving.
That means the blue-collar workers,
dark-suited lawyers and judges, uniformed
police officers, mothers with babies in
strollers and myriad other customers who
patronize the Brooklyn diner will need to
find another source of comfort food and
comfortable conversation.
“I always feel like I’m visiting with
friends when I come here,” said Richard
Gropper, major gifts officer with the American Red Cross Northeast Florida Chapter.
Gropper visits three or four times a
week, sometimes for breakfast and lunch
the same day. He was

University of North
Florida colleague Alan
Verlander.
“I had to Google it,”
said Gropper after Verlander suggested they
meet there.

At least not for long. Sitting near the
front door during lunch Monday at the
436 Park St. location, Gropper met developer Michael Balanky and his wife, Gayle.
Balanky, in turn, shook hands around the
restaurant as he found a booth against the
wall.
The Balankys sat near Florida Public Service Commission Chairman Art Graham,
who was meeting with Cleveland Ferguson
III, a vice president for the Jacksonville
Transportation Authority.

Scott to begin two-day
recruiting trip to Kentucky

Gov. Rick Scott will fly to Kentucky early Tuesday for two days
of private meetings in Lexington
and Louisville with unidentified
business owners about moving or
expanding to Florida.
There won’t be any warm welcome from the top executive of
the Bluegrass State for Scott, who
has already has lined up at least
one Kentucky company to say it’s
bringing jobs to Florida.
Kentucky Gov. Steve Beshear,
a Democrat, will be busy the next
two days, said his spokesman
Terry Sebastian.
“Gov. Beshear is meeting with
a delegation of Taiwanese officials on a substantial deal for
Kentucky farmers, as well as
announcing an oral health initiative for thousands of Kentucky
children,” Sebastian said.
Beshear, who has traded barbs
with the Republican Scott over
the economies of both states, has
previously said the trip for Scott
will “waste his time.”
But Scott, who is scheduled to
be with staff from his office and
Enterprise Florida in Lexington
on Tuesday and Louisville on
Wednesday, already is poised to
announce
at
least some new
jobs while in
Kentucky.

which will be
made

For Scott, this is his fourth
“domestic economic development” mission this year.
Scott earlier went to Philadelphia, Los Angeles and Hartford,

week’s venture, was in a state
with a Democratic governor. It
remains to be seen how successful these recruitment trips will be.
The Philadelphia excursion
focused on the continued expansion of Wawa convenience stores
in Florida, while attracting more
maritime cargo highlighted the
stop in Los Angeles.

CEO of Enterprise Florida, the
state’s public-private business
recruiting agency, acknowledged
last week before a Senate committee that Florida failed to land
a “significant” Connecticut-based
company, one of “America’s
oldest and largest.” He said the
unidentified corporation didn’t
want to go south of the GeorgiaFlorida line.

in hunting for private businesses
to expand or relocate to Florida, have been playing up that
Florida doesn’t have a personal
income tax and is “proud” to be a
right-to-work state while targeting Kentucky’s “pro-union, big
government policies.”

Downtown Sgt. Rusty Bonifacio said in order for an officer to
make an arrest for panhandling,
the crime must be committed in
the officer’s presence.
“And most people won’t break
the law when a police officer is
watching,” he said.
While many assume that those
who ask other people for money
are homeless, people who run
social service agencies Downtown say that’s not necessarily so.
“Not all panhandlers are homeless and not all homeless people
are panhandlers,” said Dawn Gilman, CEO of Changing Homelessness, formerly Emergency
Services & Homeless Coalition of
Northeast Florida.
However, “the lower the
income level, the more common
it is,” she said.
Asking for money Downtown

Graham said he’ll miss the place
because a meal there allows him
to catch up with people during
his time away from Tallahassee.
The only issue, he said, is
staying focused when meeting
someone. “There are people you
see,” he said, as Drummond
Press President John Falconetti,
a prominent Republican, took a
seat nearby with colleagues and
jovially greeted Graham.
Ferguson said he’s eaten at Two
Doors Down at least 20 times and
takes the opportunity to “have
good conversations with friends
and getting caught up.”
After it closes, he’ll make his
lunch trek “probably back to my
desk.”
As usual, several practicing lawyers were in the house,
including the veteran Bill Birchfield, who took a seat at the counter.
Abraham was circulating
among the patrons, shaking
hands and sharing news, as
well as running the register and
rounding up orders for waitresses to deliver to the tables.
“I’ve made so many friends
in this business. They’re not just
customers,” he said.
One of his most loyal customers, Beaver Street Fisheries chairman Harry Frisch, couldn’t be
there Monday because he was
attending a Junior Achievement
event.
He is such a regular that his
assistant called Two Doors Down
in the morning to alert Abraham to their absence. Abraham
keeps a table reserved for Frisch’s
group.
Abraham said Frisch took it
hard when he heard the news of
the impending closure. “He’s the
man,” Abraham said. “He helped
build the business.”
Abraham, who’s been in the
restaurant business for four
decades, has known Frisch for
years and welcomed him as a
loyal customer since opening
Two Doors Down six years ago.
Frisch said Monday afternoon
that he will miss Abraham, the
staff, the food and their efficiency.
At 92, Frisch said time is a commodity that he cherishes. “Every

He said lunch at Two Doors
Down took just 40 minutes from
leaving his office to returning. It
also had convenient on-site parking.
“I never, ever had a bad meal
there. I never had a problem
there,” he said.
Frisch said Abraham also was
open to suggestions. Abraham
credits Frisch for the idea of posting the daily specials at each table
rather than only on the specials
board.
“He’s got personality. He’s a
friend to everybody,” Frisch said.
“You’re treated like it’s a home
away from home.”
Abraham learned in late June
he needed to vacate the leased
site by Dec. 29 because the property is being sold. He has known
that was a possibility since he
opened there in 2009. The property owner, Ware Family Realty
LLC, has not commented about
the future land use.
Abraham looked nearby to
relocate the business, but none of
the possibilities worked out.
He wanted a site in Brooklyn,
Riverside, LaVilla or elsewhere
Downtown that could accommodate a 5,000-square-foot restaurant that could seat 125 customers
and provide plenty of parking.
He also wanted minimal downtime to prepare a new location so
he could keep his team of nine,
including him and his business

The sites presented were too
far from his customers, would
take too long to build-out or
would require night and weekend operations. He considered
the unfinished Sax Seafood &
Grill building in LaVilla, but
among other challenges, it had a
lounge and Abraham said he isn’t
in the lounge business.
“I had to make a decision,”
Abraham said Monday morning.
The restaurant’s closing, in
two months, gives Abraham five
weeks to sell the furnishings and
equipment before the lease is up.
It also means his staff, which he
credits for their work and rapport
with customers, also likely will be
looking for jobs. The important
part of running a restaurant is
not the recipes, he said. It’s the
people who work there.
He said that while he could
start over, that wouldn’t be fair
to Carol, his wife of 52 years,
his family and friends, or himself. At 74, Abraham said it was
time to have fun doing what he
hasn’t had much opportunity to
do, such as travel.
To make sure Abraham had a
plan, his son, Jay, pinned down
that the first trips would be to
Alaska and Canada. “You got to
do it when you can,” Abraham
said.
He’s at peace now over the
decision, more now than two
months ago. “We’ve given our
life to the business,” Abraham
said.
Abraham’s restaurant ownership experience goes back 40
years, including a decade at the
former Tad’s Restaurant “two
doors down” on Park Street,
hence the name.
As Graham paid his lunch ticket Monday, he sympathized with
Abraham over the closing and the
difficulty in finding a new site.
“There’s nothing two more
doors down,” Graham said.

Appeals court rejects Council
death sentence in
1984 Duval murder

More than 30 years after a
teen’s body was found floating
in the St. Johns River, a federal
appeals court has tossed out the
death sentence of a man convicted in the drug-related murder.
The 11th U.S. Circuit Court of
Appeals on Friday upheld a lower-court decision that John Gary
Hardwick Jr., now 56, did not
receive adequate legal representation before being sent to Death
Row in the Jacksonville murder.
The appeals court ordered the
state to hold a new sentencing
hearing or to re-sentence Hardwick to life in prison. Hardwick
was convicted in the December
1984 murder of 17-year-old Keith
Pullum, whose body was found
in the river, according to court
documents. Hardwick was upset
about the disappearance of a
stash of quaaludes.
A three-judge panel of the
appeals court agreed with Hardwick’s argument that he received
“ineffective assistance of counsel”
during the sentencing phase of
the case.
The court said Hardwick’s
attorney did not bring up a series
of issues to jurors, who recommended by a 7-5 vote that Hardwick receive the death penalty.
Those issues, including Hard-
wick being neglected and abused
as a child and a long history of
substance abuse, could have been
considered as “mitigating” evidence to argue against the death
penalty.
“Because of counsel’s deficient
performance, the jury saw only a
drug dealer who brutally killed
someone for stealing his quaaludes,’’ said Friday’s 45-page ruling, written by appeals court
Judge Gerald Tjoflat and joined
by judges Frank Hull and Beverly
Martin.
Jurors didn’t hear about Hardwick’s childhood “that was
consistently marked by neglect,
deprivation, abandonment, violence, and physical and sexual
abuse.
They never had a chance to
examine the trove of documents
evidencing his decade-and-a-half
long history of drug and alcohol
addiction starting at the young
age of 11 or 12.” the ruling continued.
The ruling also said jurors were
not told of Hardwick’s heavy
intoxication at the time of the
crime, nor did they hear expert
testimony about how all the factors combined to render him
“substantially unable to conform
his conduct to the requirements
of the law, as the post-conviction
mental health experts unanimously concluded.”

was recorded Monday with the
Duval County Clerk of Court.
Property records show SMBC
bought the undeveloped land
from the city in June 2007 for
almost $3.1 million. It developed
the almost 1.03 million-squarefoot warehouse on nearly 67.9
acres in 2008. It also built a parking booth and service garage.
The property, at 4950 New
World Ave., carries a 2015
assessed value of almost $36.6
million.
In early 2009, Bridgestone
Americas Tire Operations celebrated the grand opening of the
center, which it said was the largest of its seven North American warehouses. It said it had
a capacity of 3 million tires for
shipment to Florida, Georgia and
the Carolinas.
It also was built to ship Latin
American-produced tires to the
entire U.S. and tires made in
Japan and other Asian countries
to the eastern half of the U.S., the
company said upon opening.

the $44 million state-of-the-art
facility was designed by architectural firms Randall Paulson and
Gresham, Smith and Partners
and constructed by The Conlan
Company. It was the first private development project at Cecil
Commerce Center.

was “silly,” and the disagreement
remained.
At one point, Crescimbeni said
Hazouri had been listening to the
unions instead of the city’s new
fire chief, who said the compromise reached was adequate.
Before the two really could
engage, council President Greg
Anderson had to step in.
“We’re going to chill out right
now,” he said, which moved the
discussion on.
Infrastructure initially won the
battle with an 11-8 vote.
Before the end of the night, the
vote was reconsidered, with an
11-8 vote in support of restoring
the salaries. At first, there was
confusion for what was thought
to be a repeat of the earlier vote.
But, council members Scott Wilson, Katrina Brown and Reggie
Gaffney had switched their votes.
Ultimately, the money was
pulled from drainage for the salaries.
As the five-plus hour meeting wore on, it turned out to not
be the only disagreement among
members.
Council member Bill Gulliford
pitched for the city to provide
$25,000 to Jacksonville Beach for
the purchase of fireworks. The
annual July 4th event benefited
more than just the Beaches communities, he said, and the city
should contribute.
“So it’s fireworks, not firemen?” Hazouri jokingly asked,
before saying he couldn’t support
the idea.
Yet, it wasn’t the substance of
the bill that rankled Matt Schellenberg. It was that Gulliford was
pitching the idea on the day of
the budget instead of during the
actual budget hearings. Gulliford
took exception to the scolding,
saying it showed a lack of respect
for how council members wanted
to do their business.
The amendment was later
amended for the city to pitch in
half, with a maximum of $25,000.
Despite the few dustups over
the expenses, most of the priorities laid out in Mayor Lenny
Curry’s budget remained.
Public safety still will add 40
additional police officers and 40
community service officers. Jacksonville Journey receives a $3
million boost. The Liberty Street
collapse is being fixed quicker
and for less money. Libraries kept
their additional hours. Infrastruc-
ture spending is back in place.
On those, the council agreed.
All the while, the man whose
name was attached to that budget
watched the proceedings from
his 4th floor office. “Prime time”
television, he called it.
“I’ve got cops,” Curry said.
“I’ve got investments in kids. I’ve
got investments in infrastructure
and public works. I’ve got what I
promised to taxpayers.”
Now, Curry said, it’s a matter
of putting the money to good
work, to ensure taxpayers it’s
properly being spent.
He was grateful for how his
first budget went smoothly. And
for the hard work of his staff.
Shortly after it was passed, Sam
Mousa walked into the mayor’s
large conference room. Curry’s
chief administrative officer spent
much of the summer poring over
the spending plan with his financial team to get the now-approved
budget in place. It wasn’t lost on
Curry.
“Good job Sam,” he said with
a handshake.
Mousa, a city hall veteran, had
a simple reply.
“Thank you, mayor.”

almost $1 million by the end of

But, he had a change of heart
after finding out money from the
pension plan has been used to
defend the fund in public records
requests disputes. That, he said,
could violate restrictive benefits
laws and swing the issue in the
city’s favor. The crux of his issue,
he said, was the fund’s fiduciary
responsibility.
Despite the council’s vote, it
doesn’t mean the two sides can’t
come to the table and find a resolution on the matter — a move
Gulliford said he hoped would
happen.
• Gulliford wasn’t the only one
with a change of heart. Council member Tommy Hazouri
changed his mind again, too.
Last week, he went into the
Rules Committee meeting intending to vote for Kirk Wendland,
Curry’s pick to lead the Office of
Economic Development. Instead,
Hazouri was the lone vote against
the former Jacksonville Economic
Development Commission head
after he didn’t like the way Wendland handled comments about
the old Shipyards deal.
Wendland was a project manager during that deal in the early
2000s, an agreement that had the
city invest $40 million for the
redevelopment of the riverfront
site Downtown that went awry.
Wendland said last week he
stood by the Office of General
Counsel and former Mayor John
Delaney’s administration for how
the situation was handled, which
drew Hazouri’s ire.
On Tuesday, Hazouri said since
then he’s heard positive things
about Wendland and respected
him, but would continue to watch
the city’s economic development
efforts. Wendland ended up
being approved 19-0.
Wendland, pension issue approved
The budget wasn’t the only item
on the City Council’s agenda.
Here’s a look at a couple of
other items council approved.
• Council members overwhelmingly supported a resolution reauthorizing the city’s legal
team to pursue litigation to determine whether a specially created
pension plan is illegal.
The Police and Fire Pension
Fund board created the senior
staff voluntary plan in 2000, with
city officials not finding out about
the benefit plan until 2012. Currently, it has three members,
including fund administrator
John Keane.
During discussions in recent
weeks, opinions had largely
boiled down to pursuing the
issue on principle versus the cost
such action might result in.

SJRPP will supply all coatings from

Technical Specifications will be reviewed
during the mandatory pre-bid meeting. Items that are to be painted shall

Notice is hereby given that the Beach
Community Development District (“District”) will receive proposals for the following District project:
TAMAYA / MERITAGE BLVD.
LANDSCAPE
The contract will require contractors
to provide construction services for the
Tamaya / Meritage Blvd. Landscape, as
more particularly described in the Project Manual and in accordance with the
plans and specifications.
The Project Manual consisting of the
proposal package, contract, proposal form,
plans and other materials will be available beginning Monday, September 28,
2015, 2015 at 12:00 P.M. by accessing the
FTP page at the England-Thims & Miller, Inc. website, https://etminc.exavault.
com/share/view/8k6l-4m73cmft.The
Project Manual will include, but not be
limited to, the Request for Proposals,
proposal and contract documents, and
construction plans and specifications.
The Project Manual will not be available
for pickup at the offices of EnglandThims & Miller, Inc.
There will be a mandatory preproposal conference at the offices of
England-Thims & Miller, Inc., 14775 Old
St. Augustine Road, Jacksonville, Florida
32258, on Tuesday, September 29, 2015
at 2:00 P.M. Failure to attend may preclude a Proposer from responding to this
Request for Proposals.
Proposals will be evaluated in accordance with the criteria included in the
Project Manual. The District reserves
the right to reject any and all proposals, make modifications to the
work, award the contract in whole
or in part with or without cause,
provide for the delivery of the project in phases, and waive minor or
technical irregularities in any Proposal, as it deems appropriate, if
it determines in its discretion that
it is in the District’s best interests
to do so. Any protest of the terms and
specifications must be filed with the
District within 72 hours after the Project
Manual is made available, together with
a protest bond in a form acceptable to the
District and in the amount of $10,000.00.
In the event the protest is successful,
the protest bond shall be refunded to
the protestor. In the event the protest
is unsuccessful, the protest bond shall
be applied towards the District’s costs,
expenses and attorney’s fees associated
with hearing and defending the protest.
Failure to timely file a protest will result
in a waiver of proceedings under Chapter
190, Florida Statutes, and other law.
Firms desiring to provide construction
services for the referenced project must
submit one original and nine (9) copies of
the required proposal no later than 1:30
p.m. on Friday, October 23, 2015 at the
offices of England-Thims and Miller, Inc.,
located at 14775 Old Saint Augustine
Road, Jacksonville, FL 32258 (the “Engineer’s Office”). The District’s Engineer
will conduct a special public meeting at
1:30 p..m. on Friday, October 23, 2015 at
the Engineer’s Office to open the proposals. No official action will be taken at
the meeting. The meeting is open to the
public and will be conducted in accordance with the provisions of Florida law
including but not limited to Chapter 190
of the Florida Statutes. A copy of the
agenda for the meeting may be obtained
from the District Engineer, at the Engineer’s Office, or (904) 642-8990. The
meeting may be continued in progress
without additional notice to a time, date,
and location stated on the record. Pursuant to provisions of the Americans with
Disabilities Act, any person requiring
special accommodations to participate
in this meeting is asked to advise the
District Office at least forty-eight (48)
hours before the meeting by contacting
the District Engineer at (904) 642-8990.

Manual, each proposer shall supply a
bid bond or cashier’s check in the sum

Instructions to Proposers. The District
reserves the right to return unopened
to the Proposer any proposals received
after the time and date stipulated above.
Each proposal shall remain binding for
a minimum of ninety (90) days after the
proposal opening.
The successful Proposer will be
required upon award to furnish a payment and performance bond for one
hundred percent (100%) of the value of
the contract, with a Surety acceptable to
the District, in accordance with section
255.05, Florida Statutes.
