Dear Sir or Madam,
as a competent supplier of battery and accumulator solutions, we would like to inform you about the

forthcoming cadmium prohibition. By the 26
of September 2008, at the latest, the placing on the
market of batteries or accumulators containing cadmium will no longer be permitted (Art.4 §1 in
connexion with Art.26 §1 of the Battery Directive 2006/66/EG).
More specifically, the ban is about the EU Battery Guideline which came into force on 26

September 2006 and contains a biennial respite for the implementation into national law. It is assumed
that implementation respite will be adhered to by all 27 member states of the EU.
According to Art.4 §1 of the directive, based on Art.95 of the EG-Agreement, the member states are
prohibited the placing on the market of:
a) all batteries and accumulators containing more than 0,0005% of mercury (Hg) per
weight, independent of being integrated in a piece of equipment or not, and
b) batteries and accumulators for electronic devices containing more than 0,002% of
Cadmium (Cd) per weight, including equipment-integrated pieces.

The prohibition according to letter a) excludes button cells containing a mercury content of maximum
2% per weight (Art.4 §2).
The prohibition according to letter b) exempts batteries and accumulators for electronic devices in
following systems:
•
emergency lightning and alarm systems
•
medical equipment
•
cordless power tools (Art.4 §3).

The exemption of cordless implements will be reviewed by the European Commission by the 26 of
September 2010.
By the coordinated implementation of these bans, distortions of competition will be averted within the
European Union (Art.95 of the EG-Contract).
The prohibition of the placing on the market of batteries containing cadmium also includes all battery
imports and will be regulated through sanctions at national level.
VARTA Microbattery GmbH has felt obliged to contribute actively to environmental protection for years
and therefore ceased e.g. the production of Nickel Cadmium Batteries in 2002. Since 1998, all
rechargeable button cells are produced solely with environmentally friendly Nickel Hydride
Technology.
All batteries and accumulators that are produced by VARTA Microbattery are free from mercury and
cadmium.
Our primary button cells are considerably below the allowed mercury concentration by Art.4 §2.
