We continue to look at the latest Christmas related gifts, with part two of our festive focus. We also delve into the world of greeting cards to see what new designs are on offer, and serve up a treat with the latest tableware lines. As more and more customers look for greener alternatives, we also take a look at some earth-friendly gift lines that have been made either using recycled items or natural materials in a sustainable way. As if that wasn’t enough, we take a look at the wonderful world of toys, while Nancy Hayes brings you a mix of gift ideas for the teen market. By the time this issue is published, I will have six months of editing Gift Focus under my belt. Whether it’s from talking face to face with clients at trade shows, on the telephone or via email, it’s clear to see the passion that people have for this industry. Times haven’t been easy in recent years, but one thing this economic climate does is keep you on your toes! It leads you to explore new avenues more actively, whether that is looking at alternative gift lines, discovering new types of marketing campaign, on-line activity or social networking. Moving with the times is crucial, as the GA proved by streaming its AGM and member’s day on-line for those who couldn’t make the day. New format for the 2012 Toy Industry Awards Next year will see the Toy Fair mark its 60th anniversary, and in celebration of this milestone a dedicated area of the new Upper West Hall at Olympia has been secured to host the 2012 Toy Industry Awards with a new special event format. The annual gala event, taking place on January 22nd 2013 – straight after day one of Toy Fair 2013 – will be more easily accessible by running in the same building as the exhibition. The format of the evening has been redesigned to incorporate a drinks reception with bowl food and canapés followed by an ‘Oscars style’ awards ceremony, which will celebrate the best in toy retail and product for 2012. In addition to the new venue, a set of revamped retailer categories has been announced for the awards. The application process for the awards will open in late September. The evening itself will directly follow the opening day of Toy Fair with a start time of 6.30pm, allowing guests to move easily from the exhibition into the awards event. The company has invested nearly two million euros in the extension, and the purchase of the latest digitally enhanced cutting equipment, which will provide shorter production lead times and greater control of production costs. This will lead to more sophisticated wooden toy designs, quicker deliveries and more competitive prices. Kimmidoll, a family of elegant and simplistic Japanese inspired dolls, with huge appeal to girls and young women, was created in 2008 by The Aird Group, an Australian graphic art studio. There was strong support for the timing of the Jewellery Show London, with retailers confirming that June worked well for their first Christmas buying. “The show reaffirmed that there are some incredibly innovative retail jewellers operating across the country, who know that discovering new jewellery brands and collections at events such as ours is what will keep them ahead of their competitors,” said Julie Driscoll, Exhibition Director. “We are really excited about building on this hugely successful launch. Get ready for Mega Show For seven trading days this October, Mega Show Part 1 and 2 takes place at the Hong Kong Convention & Exhibition Centre. More than 4,400 export-ready Asian suppliers will present the very best in gifts, housewares, toys, premiums, stationery, gift wrap and packaging, plus festive products to more than 70,000 buyers. Launched in 1992, Mega Show Part 1 takes place between 20th-23rd October, 2012. This show includes six product sectors: gifts; housewares and home décor; Christmas; festive and seasonal; toys and games plus baby and child; and lastly gift wrap and packaging. As the final buying opportunity in Hong Kong, Mega Show Part 2 will concentrate on gifts, homes, stationery, school and office. Part 2 takes place between 27th-29th October, 2012. For further details visit www.mega-show.com 10 giftfocus news&events Setting the standard for the housewares sector Once again, the exhibitor line up at Exclusively Housewares attracted retailers from across the UK and Europe. The event featured 122 exhibitors, the largest concentration of housewares suppliers at any UK trade show. This year there were 13 new exhibitors, some of whom were coming into the show under new UK management, for example the Italian brands Le Pentole and Tescoma (with Forma House), aerolatte (with Eddingtons), Burleigh Pottery (Denby) and Tenzo (Premier Housewares). The show also continues to attract export interest, and received visitors from more than 20 countries this year, with buyers from Ireland, France, Spain and the USA leading the way. Buyers also attended from Denmark, Poland and Italy, and from as far away as Russia, Australia, Canada and Hong Kong. Show Director, Simon Boyd commented: “In a year when we certainly did not expect to see visitor numbers increase, we are delighted that they’re on par with 2011, and that we have maintained a good mix of buyers from across all retail channels.” Next year’s show will take place between 11th-12th June at the Business Design Centre in Islington, London. Show organisers, Reed Exhibitions, announced the KickStart line up of designers back in June with the sole aim being to ensure that retailers and buyers find out about new designers as they launch. IJL runs the programme, supported by the British Jewellers’ Association (BJA). “KickStart provides a fantastic commercial launch pad for 10 of the best new designers in the UK jewellery industry. Their jewellery is of an extremely high standard in terms of both quality and originality. The latest investment – bringing the total to £2.3m in three years – will be focused on driving the global reach of the internationally recognised brand. Spring Fair International has been named Best Tradeshow Exhibition (above 2,000m) at the annual Association of Exhibition Organisers (AEO) Excellence Awards 2012 in July. A new hosted buyer programme will take place, which is set to attract more key overseas retailers to the NEC and result in increased orders for exhibitors. At the heart of the programme will be the World Congress for Department Store Buyers, which will coordinate retail tours, gala dinners and trend seminars to guide high level buying. Spring Fair 2013 will also herald the introduction of a new merchandising feature in Christmas Gifts; an e-commerce theatre in Volume Gifts; a buyer lounge in the Greetings hall; a home fragrance emporium in Hall 7, along with new entrance points in the atrium and Hall 12 to improve the spread of footfall. For more information visit www.springfair.com Pulse 2012 took place in June, drawing in an impressive calibre of buyers to the 10th edition of the show. The visitor figures demonstrated a marginal decrease of four per cent on 2011, which is representative of the current market conditions and a show date that fell directly after the Jubilee bank holiday weekend. Despite this, VIP visitors increased by three per cent as Pulse enjoyed a larger number of department store visitors, and press attendence was up by 118 per cent. Pulse also represented a 30 per cent increase on 2011 in new suppliers and designers throughout the show, and in sectors such as Launchpad. Looking forward to 2013, Pulse has announced a change in dateline for the summer event. Next year, Pulse will take place between 12th-14th May, 2013 at Earls Court in London. March & Co Limited concrete block construction with a tiled roof (often referred to as standard construction) situated in an area that is not susceptible to flooding. Buildings that are not of standard construction, or are situated in a flood risk area are still insurable, but the premium charged is likely to be higher. Premises which are also occupied by other businesses could increase the premium, depending on the trade involved. If the electrics are older than 15 years, some insurers will expect this to be checked by a qualified electrician. What is the security of the premises? You may need to improve the quality of the locks and install other protections. I have been running my small web-based giftware business part-time from home and I’m about to take the plunge and go full time, so I’m looking for suitable premises. I don’t really know where to start with regards to insurance. What key points do I need to bear in mind during my search for a property? This is a complex subject, so you will need to obtain professional help. This follows an investigation into the alleged dumping in the European Union of ceramic and porcelain products made in China. “This could have a significant impact on our members who deal in kitchenware, tableware and home accessories,” says Isabel. “But surprisingly, I have had little feedback in response to my mailing, which invited them to complete forms and provide the appropriate evidence to challenge these duties. “Members can write directly to the European Commission, but we will have more clout if we do this collectively through The GA. “In the meantime, suppliers may wish to consider bringing in product as soon as possible, or look to source it elsewhere. The message is clear: fill in those forms, return them to The GA and help us to help you.” Gift of the Year 2013 launches at Autumn Fair: new Gifts for Men category The GA will officially launch its Gift of the Year Awards 2013 at Autumn Fair International in September, where it will distribute business cards to encourage exhibitors to enter. These feature the benefits of winning, with an endorsement from Susie Pulling of One Button, who says: “Winning an award really increases brand awareness in the gift trade. We won in 2009 and that created a huge amount of interest, and the same is happening this year. We’ve already run out of the winning product and have had to reorder.” The 2013 competition – which has a new logo – sees the introduction of a new category, Gifts for Men. The Celebrate Britain category, introduced to mark the Queen’s Diamond Jubilee and the Olympics, will be dropped, while the increasingly popular Made in the UK will be retained. Outdoor Living will be renamed Garden and Outdoor Living to clarify the breadth of this category and recognise the growth in such products. The entry deadline is 17th December, 2012. The awards will again be presented at Spring 72 giftfocus Fair International on the Sunday evening of the show next February. GA’s monster idea Chief Executive, Isabel Martinson is pictured here on the GA’s imaginative stand at Home & Gift. It featured The Monster Factory’s VW Campervan, which won the Gift of the Year Judges’ Choice award and the Outdoor Living category. Isabel was inspired to use it after hearing Mary Portas’ partner, Peter Cross urge people at Pulse to ‘do something a bit bonkers’ every now and then. The GA’s Amanda Wilkins developed the idea and was also responsible for the display of Gift of the Year products at the show. Hundreds watch live streaming of AGM and members’ day Some 230 GA members went on-line to watch the live streaming of The GA’s AGM and to listen to speakers. Others set aside time after the event to watch it on-line, and within a few days the total reach had extended to more than 460. “We are thrilled and delighted,” says Isabel. “Many members are too busy to leave their businesses or are deterred from doing so by travelling long distances and the costs involved. However, this success supports our belief that they have confidence in our ability to provide information that is relevant to them.” The GA will now consider other on-line initiatives, such as webinars. The association will also look to organise more end-of-day events at trade shows which address the concerns of the moment. Home & Gift feedback on sales trends Feedback from exhibitors and buyers at Home & Gift revealed that sales of high-end and impulse-purchase products are holding up well, but the middle market continues to be a challenge. Isabel says that although the domestic market is relatively flat, more of its members are finding export success beyond the Euro Zone through The GA and BATF. She comments: “So, it’s not all doom and gloom. And we’ve had some fantastic events this year – the Queen’s Diamond Jubilee and the Olympics – which have created new markets for our industry and brought visitors to Great Britain who have purchased commemorative products. “But there is some consolidation and a number of companies have decided to stop trading, which is not only having an impact on the industry, but also affects GA membership.” Recruitment drive boosts membership The GA signed up more new members at Home & Gift this year than in 2012 and is pursuing other leads from the show. Its recruitment initiatives in Harrogate included a ‘two years for the price of one’ membership deal for retailers and a 20 per cent discount for exhibitors who signed up during the exhibition. Supplier members whose referrals at the show led to other exhibitors joining the association have each been offered a free entry into the 2013 Gift of the Year competition. Copywatch cases The GA reports that its Copywatch service is handling a number of cases, with its lawyers helping members to fight their corner. Some are challenging those who, they say, have copied their products, while others are rigorously defending claims that they have copied product. Agreement has already been reached in a number of instances, obviating the need to go to court and save money for members. g Further information For The GA, log onto www.ga-uk.org new EU cookie rules - Part 2 - In part two of his new series, David Mackley continues to look at cookies, and discusses what actions you can and should take to move towards compliance, as well as looking at the debate on analytics cookies If you own a website, then you should be aware of the new Cookie Law introduced on 26th May, 2012. This is part of new regulations intended to protect people’s privacy and impacts on all owners of websites that use cookies. The rules have caused much debate in the on-line community as businesses try and interpret their meaning. Many commentators say that the guidance seems to be intentionally vague and leaves many questions unanswered. Nevertheless, it is up to the business owner how they interpret the rules and determine the appropriate course of action. Actions to move towards compliance 1. Carry out a cookie audit At the very least, you should show that you are aware of the issues the Directive seeks to address and have begun to take steps to comply. You should then identify what cookies are being used – hopefully your website company can help you work this out. It’s important to recognise that this is not just ‘first party’ cookies that are set from your website domain but also any third-party cookies from social networks, web analytics tools and advertising networks. Some of these cookies may only become evident at key stages in the customer journey (e.g. on a sales confirmation page), so it is important to review these in detail by walking through the pages in question. Remember to include all websites you are responsible for, for example, a blog that might be on a different platform, and any campaign micro sites. 2. Evaluate the privacy impact of each cookie Once you have identified all the cookies associated with the site, the next step is to evaluate the privacy impact of each one. This will be based on the category of cookie as previously discussed in part one. 3. Decide how you will inform users of your website At the very least, your website/s should provide users with information about cookies, what they are and why they are used, as well as explaining which cookies are used on your website and what for. The ICO’s guidance document does provide some useful examples of how to draw users’ attention to cookie and privacy policies. For example: • Change the wording of the hyperlink, using the phrase ‘cookie and privacy policy’. • Moving the link from the footer to a more prominent position on the page. • Using a different text colour to make the link easier to spot. 4. Decide which method you will use for gaining consent, if required Where you need user consent, decide which solution you are going to use. Your website design company will hopefully be able to help you out here. The solution you eventually choose will depend upon your own attitude to the regulations. 74 giftfocus retail technology “Of all the third party cookies, the one that is causing most discussion is Google Analytics. If you run Google Analytics on your website then it has probably installed a tracking cookie. ” Third party cookies and the topic of Google Analytics One of the main areas of debate is around third party cookies. Strictly speaking, the owner of a website a user visits is deemed legally responsible for any cookie setting. So, even if the cookie was placed there by a third party as part of an agreement with you, it is you that is responsible for it. Of all the third party cookies, the one that is causing most discussion is Google Analytics. If you run Google Analytics on your website then it has probably installed a tracking cookie. At the moment there is a lot of debate about where Google Analytics cookies sit with the regulations, and at time of writing there has been no response to the new regulations from Google. If Google Analytics is classed as a ‘targeting or advertising cookie’ then an opt-in is required. In this case, websites the world over would need an opt-in facility. It is likely that a largely uneducated public would opt-out of using the cookie, and this would mean the website owner would lose a lot of the data that analytics provides. The Information Commissioner is aware of the difficulties of compliance in the complex multi-jurisdictional world of third party display advertising, ad networks and agencies, but, to reiterate, is clear that this complexity is not a defense for non-compliance. Dave Evans, Group Manager for Business & Industry at the Information Commissioner’s Office (ICO), said: “It’s highly unlikely that organisations will get into trouble because of one cookie or a few complaints, but we would seek to address any potential issues with the company concerned. In these situations we would be more likely to provide advice to the organisation. It is unlikely – but not impossible – that we would take action just for analytics cookies.” In an interview with The Register, Communications Minister Ed Vaizey said he wished that web analytics fell into the so-called ‘strictly necessary category’ in the ICO’s guidelines on the legislation. “We need to understand that consent is not black and white. Both the ICO and I have said on several occasions that there is a sliding scale of intrusiveness which should inform the level of effort you go to,” said the minister. “Obviously something like analytics or feature-based cookies are pretty low on that scale, and I know that the ICO will take that into account. Of course, that doesn’t mean that you don’t need to go to any effort at all, but something which tracks how many users visit a page is hardly the priority here.” The situation is not really helped by the fact that some government websites – including www.ico.gov.uk – have a Google Analytics opt-in, whereas others have not, such as www.direct.gov.uk; even though it uses Google Analytics it relies upon a link at the bottom of the website saying: ‘Privacy and Cookie Policy.’ The ICO does drop a large hint that it does not regard analytics cookies as posing a serious risk to privacy. Helen Goodwin says: By asking this question you will have realised the importance of a good display and the huge contribution it makes not only to your own business, but to your surroundings too. Exciting, colourful shop window displays play a crucial part in keeping the local profile high and customers returning time and again. So the first step? Positive thinking! Think colour, vibrancy and excitement. We all know about the wow factor – and that is what you need to create to keep those customers’ heads constantly turning. Sometimes, people will even go out of their way just to see your latest creation! Then you need to work out your message. Do you have a new product or promotion, or a special event you need to advertise? If so – theme it. Can you tie it in with a local festival, season or a particular colour? Inspiration can be found almost anywhere. Pull everything together and arrange your merchandise in pyramids – height at the back, working forwards and outwards. Your eye must flow easily from one item to the next, so space has an important part to play too. Good display techniques will help pull everything together. Neil Coxon says: Building a successful team takes many interventions, but one effective and quick step is to hold a short meeting, spending 30 minutes or so drawing up some team ground rules. Ask everyone to share their ideas on the ‘rules’ that they think you should collectively have on how everyone in the team needs to behave and work together. The word rule is strong in nature, but a process around ‘rules’ can help to draw out what people suggest in terms of how you work together/sell more/learn/deliver better service, etc. Start your meeting by putting up a large piece of paper q&a special on the wall, then use it to capture everyone’s suggestions for the rules that will help your team be more effective and achieve whatever it is you are trying to achieve. Remember that at this stage, neither you nor the team need to agree to these early ideas, so do capture them all. When everyone has finished, hold a team discussion on which rules you all think are the right ones for you all to stick to when you work together – gain commitment from everyone in the team. Write up the agreed list and use this at appropriate occasions to review your progress. You can even use them on a day-to-day basis to rate your team out of 10, and to identify any improvements or training needs. Working as a team is all about having a common focus, sharing feedback and improving together – and this simple process can significantly help you. Good luck! In-store lighting Q A I’m thinking about changing the lighting in my gift shop. What should I consider? Caroline Easton says: The impact that lighting can make in creating an inviting and attractive store is often underestimated. So, if you’re considering a redesign it is worth thinking about the lighting early on in the process, as it can help you create a great first impression and establish the perfect store environment. First consider what kind of shopping experience you want your customers to have, and how to create a space that will best showcase the products on display. Lighting can play a key role in helping you achieve this signature look and feel. For example, careful use of vertical lighting on walls can make your shop look more spacious, or for a more intimate feel use contrast produced by narrow beams. Great consideration should also be given to using the correct colour temperature – warm light for, say, leather goods – to ensure that your merchandise is always shown in the A very best light. Our eyes tend to follow the light, so a careful balance of accent and contrast can prove invaluable to focusing the shoppers’ attention. Accent lighting needs to be flexible, allowing a repositioning of the light as the products and collections change. Racks and display shelves can be lit from the ceiling or from underneath. A number of extremely cost effective and reliable linear LED fixtures which provide white light in shelf and under-counter are now available. Rack and shelf lighting can be highlighted with, for example, Mago IL compact flexible modules. The compact and unique design offers a stylish method of display lighting for small areas, such as under shelf lighting. This is a flexible and versatile system that can easily be adapted; the magnetic spots mean no tools are required to install or remove, and it also allows for immediate change and creative flexibility around your display. But new lighting doesn’t have to mean a dramatic redesign to deliver significant changes. Making a simple alteration can reduce energy consumption and maintenance costs without compromising light quality or ambience. There are now many retrofit energy saving solutions available, the newest and most efficient being LED lamps. LED solutions are increasingly being adopted by major retailers and delivering considerable savings and fantastic results both externally and internally. In fact, Philips MASTER LED lamps can save as much as 90 per cent of energy, setting new standards in watts consumed per square metre. Blogging Q A What are the benefits to blogging? Barbara Aspin says: Not only is blogging good for providing up to date information, it is also fantastic for networking. You can build on existing client relationships, establish new ones, and generally communicate with like minded businesses and business people. On a more technical note, regularly updating a blog and providing links between the blog and your website makes for a very happy Google. Generating traffic between your blog and website boosts your optimisation statistics and could in turn provide a wider profit margin. If you included advertising space on your blog, things could get even more profitable. Adding a handy blog feed onto your website is a simple way to link the two together, and it looks great when proudly displayed as a feature. Blog feeds help to reassure visitors to your website that the company is serious about its active on-line presence; as would a Search Engine Optimisation (SEO) campaign used in conjunction with an all-singing, all-dancing website. If you are thinking about linking up a blog with your website or already have one but would like to improve it, below are a few tips to get your blog noticed: • Engage readers within the heading and first couple of sentences of each blog. • Keep the fonts, layouts and tones consistent. This looks far more professional and less ‘busy’. • Spell check. It is worth getting a colleague to proof read each blog post to ensure the content reads right. • Keep images to a minimum. • Break up the pages and make your blogs easily readable, using bullet points, subheadings, paragraphs, tables, charts, diagrams, etc. • Allow for conversation to take place using more than one method (polls, competitions, discussions and debates). • Ensure keywords are used in tags and categories, and use a large amount of keywords within the actual content of the post. This is how people will find your blog. • End each post with a statement encouraging readers to perform an additional action, such as follow the company on Twitter, share your opinions in a public comment, or vote in a poll on the website, etc. g giftfocus 133 retailer interview a dream come true Husband and wife Paul and Kim Smiley set up their first gift shop – The Treasury in Beeston, Nottinghamshire – after working as agents for gift companies What is your career background? Kim has been in the gift business for most of her working life. It was when she was working with Junction 18, a major giftware supplier, that the company decided to change the status of sales roles to agency based, ie. self-employed. This meant that she was free to work for other principals, and so her sales agency business began to prosper and develop. Within the midlands and north-west, Kim developed relationships with some of the key operators within the gift, department store and garden centre retail sector. I (Paul) have been an agent for 10 years and got into the gift business after a career as a Retail Area Manager for a major brewer, restaurant and hotel retailer. I was inspired to join Kim after recognising the potential to fulfill my ambition to become self-employed and move out of the corporate rat race. What inspired you to launch your shop? For Kim the daily demands of driving on our congested roads grew too much and so we sought to combine our experience of the gift and catering markets, and so the inspiration for opening a gift and coffee shop was born. What items do you sell? We trade as a ‘home & gift’ offer. We felt that gave us a degree of flexibility in our product range. Our one stipulation, of course, is that everything we stock is design-led. In our area we felt there was an opportunity for a strong card offer, so we decided to dedicate one wall to handmade/finished cards. This has represented a core part of our business from day one. Our gift offer is seasonally driven and we try to offer an exclusive product range that represents quality and value – we have tried to position and market ourselves with this ethos in mind. We ask for support from our suppliers in ensuring exclusivity, and in return we keep the number of suppliers down so we can buy regularly and offer a sufficient range so that customers are not disappointed should they find us via a website listing. We stock Talking Tables, which offers a great range of table top trivia and fun products, allowing us to offer a gift for any event. Culinary Concepts is a high quality line which is well presented, and ideal as a wedding or dining gift. Illumens is a Suffolk based supplier which provides the majority of our home fragrance offers, in particular, taper diffusers. We also use OneWorld Trading as a onestop shop for sourcing our general gift and homeware selection. We have a very strong fashion jewellery range and have enjoyed great success with a fresh and original brand called Hot Tomato. We have also made the most of the recent growth in scarf sales as a fashion accessory. Whilst cards are our best seller in terms of volume, jewellery is our best seller in revenue terms. How would you describe the interior and layout of your shop? We opened originally in October, 2010 but only as a single floor, dedicated gift shop. This year, we opened another floor to introduce our tea-room downstairs. We probably need to point out that when we decided to open a shop, it was always on the grounds that we wanted to buy the freehold of the property, and so sourcing the ideal site took quite some time. giftfocus 135 a dream come true We’ve now put the property into our pension scheme, via a Self Invested Personal Pension (SIPP), a form of funding that is probably unknown by a lot of retailers and one that is certainly not investigated fully. Opening upstairs allowed us to create a different feel – we have exposed brick and original floorboards to give an urban chic feel, whilst downstairs we have a cleaner, white backdrop that is much softer. We have introduced the tea room, espresso and homemade cake offer within the last six weeks, so the white backdrop also adds a feeling of cleanliness to downstairs. The upper space is proving to be very successful, as we have already taken private bookings for hiring it out for a mother & baby massage and pamper day, a retirement party and a cupcake decorating demonstration. We have also introduced two key suppliers this year in Newgate Clocks and Pip Studio. We have always had a penchant for clocks (as they are great gifts for men, as well as great house gifts) and have stocked Thomas Kent from day one, but with the warehouse feel we have upstairs, the vintage and retro nature of Newgate has really added to the ambience. Pip Studio is a developing brand and we have had considerable success with its ceramic range. Where do your source most of your stock? The traditional routes of trade shows and agents. Fortunately, with our industry experience, it was always one area of opening the business that we never had to really concern ourselves with – we were always aware of the brands that we would like to carry and were confident in how to go about sourcing them. 136 giftfocus What sets you apart from your competition? Fortunately, direct independent competitors are not our prime area of worry, as they tend to operate in a similar manner and agree that supplying the same products too close to each other only dilutes potential (of course there are always exceptions to this but in general this sector operates in this way). Our concerns are with the ongoing growth of supermarkets in traditional urban areas and the seemingly never-ending support they appear to receive from local planners. We understand the commercial world we live in, but as customers are driven to purchase by convenience, the way supermarkets are diversifying into traditional gift and card retailing is only going to mean further pressure on independents. In light of this, it highlights the way that the independent sector needs to compete by offering quality, personal service and adapting to the changing buying habits of the consumer. We have invested significantly to try and offer a unique proposition to our target market. A place for (predominantly) ladies to browse, shop and enjoy a homemade cake, but more importantly, by allowing them to engage with a business owner who listens to their needs and cares about them. How important is your website and social networking to your business? The area of social networking is an interesting one. We have a Facebook page and Twitter feed, but without a website, we feel we have under-utilised its potential. We are just about to launch our full e-commerce website and at that point we will focus on this area more as our efforts can then more easily be measured. The risk with social networking, of course, can be that you spend hours of your day updating without being integrated in your sales channel to allow existing and new customers to buy from you. We have already recognised the readiness of a number of our target audience to engage with us in this way – in particular Facebook – and it is the quickest (and cheapest) way to inform your followers of product changes, sale items/offers, and the notification of events. What’s next for The Treasury? Next for The Treasury is to develop our food offer and in particular introduce a light-lunch menu to maximise our mid-day trade and of course finally set up our e-commerce website. The space we have created means that our private functions will be a significant growth area for us. ACID has established an ongoing partnership with the China IPR Helpdesk, an organisation that works with established intermediaries globally to communicate tips and advice on how to trade more safely in China. There are many similarities between UK law and China IP, but conversely many differences. There are legal differences between the two, but the fundamentals remain the same. Before starting a business relationship with a Chinese manufacturer, undertake a risk assessment. Once this is complete, we see that there are three possible routes forward: Going for gold – hoping for a good run before your IP is infringed. Staying away – impossible to protect your IP, therefore missing out on opportunities. Commercial reality – assess the risks, take protective measures and watch the market! Properly registering your IP is the most effective way to protect and enforce your product design rights. Design patent registration is relatively simple and cost effective, and is very important in enforcement. There is no substantive examination; it takes between eight and 12 months to grant a 10year term. In China, there are no unregistered design rights. You cannot register an existing design, including your own existing design – you have six months from the date you first publicly use the design, publish the design or apply for a design patent to file for an international patent application. You cannot take legal action in China if you do not have a registered design patent. Copyright Unlike in Europe, China offers a registration system for copyright, but it is important to keep evidence of design creation and ownership so that you can prove your copyright ownership. Having a copy of your work notarised by a Chinese notary is an easy and relatively inexpensive way to establish admissible evidence of a design audit trail. ACID members can also use the ACID Design Databank, a free benefit of membership. Trade marks File your trade marks in China as soon as possible; China operates a ‘first-to-file’ system and prior use gives little or no protection. It is very important to have an ‘official’ Chinese version. Chinese consumers often talk of foreign brands by reference to their Chinese versions. If you do not have one, the Chinese market will create one for you. The China Trade Mark Office considers foreign 138 giftfocus equivalents of marks. Choose from NICE Classifications and cover as wide a range as you possibly can. Relationships and agreements There is nothing better than a good initial recommendation and then establishing a good relationship with your manufacturer. Detailed agreements established with them should include an initial confidentiality agreement and a subsequent manufacturing agreement, underpinned by a written acknowledgement of your rights. A translated communication into Mandarin will pay dividends in communicating your anti copying strategy. Monitoring your market for any infringements and enforcing your rights will communicate that you are serious about protecting what you own. Regular visits and audit rights over factory’s books and employing local investigators to pose as potential customers can also help trap copyists and act as a deterrent. Taking action in China is difficult, not only logistically, but also from a legal standpoint – working in foreign jurisdictions obviously duplicates legal work, and therefore expense. Urging judicial authorities to become involved by filing private criminal prosecutions is an accepted route for IP infringement, as police and prosecutors are not always keen to pursue IP cases. Often, effective communication of an anti copying message on all websites, emails, invoices and correspondence can deliver a simple message that your company understands the rights which protect it, asserts those rights and communicates that any infringement of those rights is taken seriously. ACID has produced a simple statement in 12 different languages, including Mandarin. Remember, if you discover a copy of your design in the UK which you believe has been copied and manufactured in China, it is much easier to take legal action in the UK or in Europe. Often, taking legal action against the UK distributor and retailer can have positive results, and with recent improvements to the Patent County Court and the introduction later in the year of a new Fast Track Small Claims Court for IP, this will make access to justice more affordable. Finally, after launching ACID’s government endorsed Commission it, Don’t Copy it campaign, we want to hear about retail buyers with whom you work positively, so that we can invite them to join John Lewis and Selfridges who have signed the voluntary ACID Retailer Code of Conduct. We also want to hear about design buyers with whom you may have had a problem. IP law is very complex, and in this way we can engage positively with them to share our IP design buyer guidelines and compliance to help them avoid unintentional copying. Case Study Black + Blum’s candelabra (a registered design) was selected and stocked by a well known high street retailer – 14,000 units were sold. Without warning the product was dumped by the retailer and a Chinese manufactured lookalike was introduced on sale at half the price, which was ‘designed’ in house. Is this fair competition? When challenged, instead of putting their hands up they offered a paltry sum to persuade Black + Blum and ACID to sign a ‘shut up’ clause. Both organisations refused. So what next for Black + Blum? As Dan Black said: “It is the innovative zeitgeist which gives retailers their competitive edge and increases profit margins – our message to those who do not comply with IP law is don’t bite the hand that feeds you! Most of her work is inspired by the lost elegance and pastime of tea drinking, and in particular the Victorian and Edwardian eras. Subjects seen in her work include elegant architecture, tea sets, grandfather clocks, cakes, old lamp posts, pocket watches, hot air balloons and steam trains. “I have always liked a nice cup of tea, but it wasn’t until the first year of my degree when we had to choose a theme that I realised it was a passion verging on obsession!” she said. Helaina studied BA Design Crafts at Hereford College of Art and Design, graduating in 2006. “It was a great course, and we studied business alongside our creative skills. This meant I was prepared to be a self employed designer/maker as soon as I graduated, and I was exhibiting by Christmas 2006. I attended the British Craft Trade Fair in 2007 for the first time, and made contact with people from many galleries and won two awards – this was a great boost to my confidence and start to my career, and I haven’t looked back!” 146 giftfocus Helaina felt she would regret it if she didn’t decide to give her own business a go and said: “It wasn’t until I had a successful degree show (in terms of sales and making gallery contacts) that I decided to give it a go. “Initially, I wanted to build a good CV, and get my work seen and recognised, so I said yes to most opportunities given. I realised that I would have to work hard to establish myself in the craft world.” Helaina collects a lot of inspirational things – books and postcards, tea sets and cake stands, and looks through them when designing new products. “My main aim is to captivate people and make them smile. My work appeals to people who appreciate art, craft and tea!” Her most recent pieces are themed around hanging things on hooks. “I have been making ‘Cups and Hooks’ for a few years now, and these are my best seller; there are four 3D wire cups, hanging on four wire hooks, mounted on a painted MDF background. To this range I have added ‘Essential Utensils’ (a wire tea strainer, spoon and sugar tongs,) and ‘Spoons’. Implements suspended from hooks seem to capture people’s imagination, as the wire drawings look like real objects – it’s confusing yet captivating.” In recent years Helaina has been doing more private commissions, in particular commissions of people’s houses, and hopes this continues. She would also like to move into larger commissions for businesses and says: “I would like to move into printmaking to sell alongside my wire work, but I think it will take a few years of experimenting to produce prints I’m happy with.” Helaina recently scooped Highly Commended in both the Gift Focus Best Gift Product Award and Wow Factor Award categories at this year’s British Craft Trade Fair.
