1.
INTRODUCTION
1.1
There are many occasions when members of the Department witness violations of law. A
member who observes violations of the New York City Parking Regulations may issue a
Notice of Parking Violation. Members shall cite violations on the face of the Notice of
Parking Violation. Parking violations are not criminal offenses and generally result only in
fines. The Notice of Parking Violation is a legal document and is subject to the same
scrutiny that any piece of evidence might receive in a court of law. An error made in the
preparation of the violation may result in its dismissal.
1.2
Firefighters must be thoroughly familiar with the procedures necessary for preparing and
issuing a Notice of Parking Violation. Members must at all times adhere to these
procedures when issuing and serving a Notice of Parking Violation.
1.3
The Notice of Parking Violation can only be issued by a member who personally observed
the violation of law charged. Members should be aware that false statements on a Notice of
Parking Violation may be determined to be class A misdemeanors.
2.
2008 CHANGES TO THE CITY OF NEW YORK NOTICE OF PARKING
VIOLATION
2.1
Listed below are some of the most significant, recent changes to the Notice of Parking
Violation.
2.1.1 The most common violation codes and descriptions are pre-printed on the parking
violation.
2.1.2 A “Permit Displayed” box is located on the top, left side of the violation.
2.1.3 There is only one (1) line at the top of the violation for the respondent’s name
and/or Vehicle Identification Number (VIN).
2.1.4 The “Date Registration Expires” can be entered, or an oval for “N/S” (Not Shown)
can be filled in.
2.1.5 The “PLATE TYPE” field reflects the most common plate types:
(Passenger), “OMT” (Taxi/Limousine) and “COM” (Commercial).
“PAS”
2.1.6 The “BODY TYPE” field now provides a choice of seven (7) body types “Sdn,”
“Van,” “Subn,” “Delv,” “Trlr,” “P/U” and “Taxi.”
(See Section 7.2 of the
instructions for vehicles listed within a body type.)
2.1.7 The “Color” field is to the right of the “STATE” choices.
2.1.8 An envelope is attached to the Service Copy of the violation.

DESCRIPTION OF THE NOTICE OF PARKING VIOLATION
The Notice of Parking Violation is comprised of five (5) pages, and an envelope.
3.1
The top, white form, page 1, shall be filled out in pen by the issuing company.
After completion, this form shall be sent to the Bureau of Fire Prevention
Enforcement Unit, 9 MetroTech Center, 4th Floor, Brooklyn, NY 11201.
3.2
The yellow copy, page 2, shall be forwarded along with page 1.
3.3
The pink copy, page 3, shall be retained by the issuing company as a file copy for
their records, and filed in accordance with the Uniform Filling System, Section
1.3.7.
3.4
The white, Service Copy, page 4, shall be served upon the respondent or placed
on the vehicle in violation of the Parking Regulations.
3.5
The Hearing Instructions, page 5, shall be placed on the vehicle in violation of the
Parking Regulations
3.6
The orange PARKING VIOLATION envelope shall be placed along with the
Service Copy and Hearing Instructions on the vehicle in violation of the Parking
Regulations.
4.
REQUESTING AND RECEIVING NOTICE OF PARKING VIOLATIONS
4.1
Unit Officers shall telephone the Bureau of Fire Prevention Enforcement Unit to request
Notice of Parking Violations. When the Notice of Parking Violations are received, the
officer on duty shall:
4.1.1 Verify that the replacement packet contains twenty
Violations.

4.1.2 Insert a new A-228, RECORD OF SUMMONSES SERVED in the summons
binder. The Company Commander of the unit will endorse the existing A-228 and
file it in the Uniform Filing system under Index No. 1.3.7.

5.
ENSURING VALIDITY OF THE PARKING VIOLATION
5.1
For a violation to be valid, it must:
5.1.1 Be accurate, legible and complete.
5.1.2 Be served personally to the operator, if present.
5.1.3 Contain a full description of the vehicle.
5.1.4 Contain the time and date of violation.
5.1.5 Contain the place of occurrence.
5.1.6 Contain the correct section and subdivision of the Traffic Rules.
5.1.7 Contain a statement of the offense and necessary supporting facts.
5.1.8 Contain the printed name, signature, and Tax Registry Number of the
issuing member.
5.2
The Notice of Parking Violation must be legible and complete. All required fields
on the parking violation be filled in accurately. Section 238(2-a)(b) of the New
York State Vehicle and Traffic Law provides that violations containing
omissions, incorrect descriptions, and/or illegible statements may be dismissed.
CHARGE ONLY ONE (1) VIOLATION OF THE NEW YORK CITY TRAFFIC
RULES ON EACH PARKING VIOLATION.
5.2.1 All vehicle information required on the parking violation must be entered
accurately on all parking violations. If the “PLATE TYPE” or the “Date
Registration Expires” on a vehicle bearing New York plates cannot be
determined because the registration sticker is covered, faded, defaced,
mutilated, etc., the member should fill in the “N/S” (Not Shown) oval next
to the appropriate field, and insert the reason the oval is filled in, such as:
“Missing,” “Covered,” etc. If other required information is not shown,
write “N/S” or “NONE” - do NOT draw a line or leave blank.
5.2.2 Each character written on a violation must be immediately recognized as
the character it was intended to be. Anything less could be a hindrance to
violation processing and the adjudication of the violation. Therefore,
when writing violations, it is imperative that members adhere to the
Standard Alpha-Numeric Symbols listed below:

The registration sticker issued by the State of New York provides information
indicating the Vehicle Identification Number (“VIN”), “BODY TYPE,” ”Date
Registration Expires,” “Model Year,” “MAKE,” “PLATE,” “PLATE TYPE,” and
Vehicle Plate Check Digit (“PLATE CD”) of the vehicle to which the registration
sticker was issued. (See sample of a registration sticker, below).
5.3.1 For vehicles bearing New York license plates, the registration sticker
should be the primary source of vehicle information to be entered on the
violation. Members must always check the windshield for the registration
sticker and COPY THE VEHICLE INFORMATION DIRECTLY FROM
THE REGISTRATION STICKER.
5.3.2 When the New York State registration sticker is missing or illegible, the
vehicle description must be based on the metal license plate and the
physical appearance of the vehicle. If the required vehicle information
cannot be determined, issuers should write/shade “N/S” (not shown) or
NONE in the appropriate box. LEAVING A BOX EMPTY AND/OR
DRAWING A LINE ACROSS A BOX IS NOT ACCEPTABLE.
5.3.3 Exception to the Rule:
When the “PLATE TYPE” or “Date Registration Expires” cannot be
determined because the registration sticker is faded, covered, mutilated, or
missing, the issuer should shade the “N/S” (Not Shown) oval next to the
appropriate field and state the reason for the omission on the parking
violation.

6.
THE NOTICE OF PARKING VIOLATION BINDER
Notice of Parking Violations will be kept in a binder. The binder will be identified on its outer
cover with the unit’s designation and address, and type of violation contained.
6.1
To properly issue a Notice of Parking Violations, the following information will be needed
and shall be kept in the Notice of Parking Violation binder:
6.1.1 The unit payroll distribution number and the tax registry number of each member in
the unit.
6.1.2 Calendar.
6.1.3 Summons Book Insert Cards.
6.1.4 A-228, Record of Summonses Served.
6.1.5 Blue or black pen.
6.2
Issue Notice of Parking Violation in numerical order.
6.3
Enter only one (1) offense on each Notice of Parking Violation. Use a separate Notice of
Parking Violation for each additional offense.

LINE BY LINE INSTRUCTIONS FOR PREPARING THE NOTICE OF THE
PARKING VIOLATION
These instructions for preparing a City of New York Notice of Parking Violation are
designed to provide members with information and procedures for issuing parking
violations that can be properly adjudicated by the New York City Department of Finance.

Permit Displayed
Before writing a violation, members should inspect the vehicle for parking
permits. When writing a violation, issuers should shade either the “Yes” or “No” oval
next to “Permit Displayed.” When a vehicle does display a permit, members should
shade the “Yes” oval and enter the permit type and number in the space provided.
Shade the “No” oval for vehicles without a permit.
THE “YES” OR “NO” OVAL FOR PERMIT DISPLAYED MUST BE
SHADED FOR ALL VIOLATIONS ISSUED.

Name or VIN
2.1
Name
The name of the vehicle operator should be entered when the operator is
present at the time the violation is issued. WHEN THE OPERATOR IS
PRESENT, THE TICKET MUST BE PERSONALLY SERVED UPON
THE OPERATOR. THIS IS REQUIRED BY SECTION 238(2) OF THE
NEW YORK STATE VEHICLE AND TRAFFIC LAW. An operator is
considered present if, at the time violation is observed, the operator is
behind the wheel of the vehicle. The operator’s name must be entered on
the line at the top right side of the ticket. When the operator is present,
but refuses to provide identification, shade in the oval marked “Operator
Present, but ID Refused” located under the “Name or VIN” line.
2.2
VIN (Vehicle Identification Number)
The VIN is required when writing tickets for violation code
75,
(No Match Plate/Stickers).
In such case, enter the VIN from the dashboard of the vehicle and not from
the registration sticker.

Date Registration Expires
Enter the “Date Registration Expires” from the registration sticker. The month, day,
and year must be indicated (MM/DD/YY).

When information is missing from the vehicle, fill in the “N/S” oval next
to “Date Registration Expires - N/S.” When information is unavailable
because a sticker is unreadable, fill in the “N/S” oval and insert the reason,
such as “Covered,” “Faded,” “Defaced,” or “Mutilated.” If part of the
expiration date is not shown or unreadable, then insert as much as shown
or readable and write “N/S” in the appropriate space, and insert
“Missing,” “Covered,” etc.
When other required information is not
shown, write “N/S” or “NONE” — do NOT draw a line or leave blank.
Plate
Enter the license plate number as shown on the registration sticker using BLOCK
letters in the “PLATE” field. Copying from the registration sticker enables the
member to capture the license plate number with the Check Digit. Place the first
character of the plate number in the first box of the “PLATE” field. Do not skip
any spaces when writing the plate number. When the registration sticker is
missing or the sticker does not show the plate number (e.g. out-of-state vehicles),
copy the plate number from the metal license plate displayed on the vehicle.

When the plate number is unavailable, write “N/S” (for Not Shown) or
“NONE” across the “PLATE” field. MAKING NO ENTRY, ENTERING
AN INCORRECT “PLATE” NUMBER OR DRAWING A LINE
ACROSS THE FIELD ARE GROUNDS FOR A DISMISSAL OF THE
VIOLATION.
CD (Check Digit)
The Check Digit for New York State vehicles should be entered next to the
license plate number on the violation. Copy the Check Digit from the registration
sticker.

Plate Type
The three (3) letter “PLATE TYPE” code is printed on the New York State
registration sticker. An oval has been provided for each of the following common
plate types: “PAS” (Passenger), “OMT” (Taxi/TLC), and “COM” (Commercial).
For other plate types copy the three (3) letter code DIRECTLY from the
registration sticker into the “OTHER PLATE TYPE” field.

If the registration sticker information is not available, but the plate type
appears somewhere else on the vehicle (e.g. on the metal license plate),
consult the “Issuer Parking Violations Guide” (Card #2) and enter the three
(3) letter code in the box marked “OTHER.”
6.2
If the plate type for a vehicle cannot be determined because the
registration sticker is covered, faded, defaced, or mutilated, shade the
“N/S” oval — do NOT draw a line or leave blank.
Body Type
Enter the “BODY TYPE” of the vehicle from the registration sticker. Ovals are
provided for the most common body types. Shade in the appropriate oval or write
in another body type in the “Other” box. LEAVING THE BOX EMPTY
AND/OR DRAWING A LINE ACROSS THE BOX ARE GROUNDS FOR
DISMISSAL OF THE VIOLATION.
7.1
When the registration sticker indicates a body type but the physical
appearance of the vehicle clearly indicates that it is a different body type,
members should enter the body type from the registration sticker and write
what the vehicle appears to be on the top line (Section 2) of the violation.

Many New York City parking violations are issued to vehicles registered in New
York, Connecticut, Pennsylvania, New Jersey, Massachusetts, Florida, Virginia,
Maine, and North Carolina. An oval has been provided for each state listed in the
“STATE” field. Vehicles registered in any other state should be entered in the
box marked “OTHER.” Be sure to enter in the standard 2-digit alpha code for the
state as it appears on the “Issuer Parking Violations Guide” (Card #2).

For vehicles with United States government license plates, enter “GV” in
the field marked “OTHER.” For license plates issued by the United States
Department of State (e.g. Diplomat, Consul, United Nations), enter “DP” in
the field marked “OTHER.” If the State cannot be determined, enter “N/S”
(Not Shown) in the field marked “OTHER.”
LEAVING THE FIELD
EMPTY OR DRAWING A LINE ACROSS THE FIELD ARE GROUNDS
FOR DISMISSAL OF THE VIOLATION.
Color
Use standard colors (e.g. RED, YELLOW, BLUE, GREEN, GRAY) when
describing the vehicle and enter it in the box marked “COLOR.” Abbreviations
such as, “BL” for blue, BLK’ for black, and “YELL” for yellow are acceptable.

Model Yr (Model Year)
Enter the Model Year from the registration sticker. If the sticker is missing or the
Model Year is not shown, (e.g. some out-of-state vehicles), enter “N/S” in the
field.

Make
Enter the “MAKE” of the vehicle from the registration sticker. Ovals have been
provided for the 13 most popular vehicle makes. Shade in the appropriate oval.
When the “MAKE” is not listed (e.g. Volvo, Kia, BMW) indicate this in the box
marked “OTHER.” If the “MAKE” cannot be determined, enter “N/S” in the
“OTHER” box. LEAVING THE FIELD EMPTY OR DRAWING A LINE
ACROSS THE BOX ARE GROUNDS FOR DISMISSAL OF THE
VIOLATION.

When the registration sticker indicates a MAKE but the physical
appearance of the vehicle clearly indicates that it is a different MAKE,
members should enter the MAKE written on the registration sticker in the
MAKE field, and write what the vehicle appears to be on the top line of the
ticket. (See 2. Name or VIN, above).
Alt Plate (Alternate Plate and State)
The “Alternate Plate” and “Alternate State” fields are used ONLY when the
license plate number on the metal license plate of the vehicle does NOT match the
license plate number printed on the registration sticker.

In such cases, enter the registration sticker plate number and state in the
“PLATE” and “STATE” fields on the violation (see #4 and #8) and the
alternate license plate and state information from the metal license plate in the
“ALTERNATE PLATE” and “STATE” fields.
County
Shade in the appropriate oval for the County where the violation is issued.
The five (5) counties in New York City are: Manhattan (NY), Brooklyn (Kings),
Bronx (Bronx), Queens (Qns), and Staten Island (Rich).

Time
Enter the time that the violation is issued.

DO NOT USE MILITARY TIME.

THE “A.M.” OR “P.M.” OVAL NEXT TO THE TIME MUST BE
SHADED.
Date of Offense
The correct month, day, and year of offense (MM/DD/YY) must be entered in the
“Date of Offense” field.

Time & Date First Observed
“Time 1st Observed” and “Date 1st Observed” are required for violations for
which it is necessary to establish the length of time the vehicle is in a Time
Limited Zone before a violation may be issued.

The time and date first observed can also be used to strengthen a violation.
If the member witnesses a violation for an extended period of time (e.g. a
vehicle standing in a bus stop or double parked), entering the time first
observed can be included on the violation to give a clearer picture the
violating condition.
Precinct
Enter the number of the police precinct where the parking violation occurred.

Place of Occurrence
The violation must indicate where the vehicle was parked with sufficient clarity to
eliminate the possibility of other locations.
18.1
A general description such as “corner of Broadway and Chambers Streets”
is not precise enough to allow an Administrative Law Judge and the
respondent to know exactly where the violation occurred. “NW c/o
B’way and Chambers Street” is not sufficient because it cannot be
determined whether the vehicle was on Broadway or Chambers Street.
18.2
Whenever possible, indicate the address and street where the vehicle is
located. If the vehicle is parked in front of or opposite a building, enter
the building number and the name of the street, and shade the “Front of”
or “Opposite” oval on the violation, as appropriate. The full street name
must be entered. For example: 125 W 53 St. or 102-03 62 Drive.
18.3
When the vehicle is located at a corner, or the street address is not
available, indicate compass points and feet from the nearest cross street. For
example “S/S Chambers St., 75’ E/O B’way” (South side of Chambers Street, 75
feet East of Broadway).
When the street name includes additional
identifiers, they must be included (e.g. Queens Plaza North, Park Avenue
South, Flatbush Ave. Extension).

19.
Code, Fine, Charged Violation
The parking violation provides the most common violations issued in New York
City. To issue these violations, the issuer MUST shade in the fine amount oval next
to the violation.
19.1
The pre-printed violations most commonly issued by FDNY are for codes
20, 17, 14, 46, 67, and 40.
19.2
Members may also issue a parking violation for any other parking violation.

In Violation of All “Other” Violations
20.1
All violations that are not pre-printed on the parking violation should be
entered in the blank area provided on the ticket.
20.2
“Other” violations include sign, meter, non-sign, status, and commercial
violations. Members should always check their “Issuer Parking Violations
Guide” (code cards) for the correct violation code number, violation
description, sub-section of the traffic rules and the correct fine amounts.
20.3
Enter the violation code in the code box in the “Code” column.
20.4
Enter the correct fine amount for that violation and shade the fine oval.
20.5
Write the appropriate sub-section of the NYC Traffic Rules and violation
description. Always enter the sub-section of the law as it appears on the code
cards in parenthesis.
20.6
Enter the correct “Days/Hours in Effect” for the violation, if appropriate.
Example: When a vehicle is in violation of code 10-“No STP”-Anytime”,
the issuer should:
1. Enter code #10 in the box provided under the “Code” section.
2. Enter the correct fine amount of $115.00 for that violation as well as
shade in its corresponding fine oval.
3. Under the section “Charged Violation of Sect. 4-08,” enter (b) and
write “No STP” for the violation description.
Note: Depending on the type of violation, additional information may be
written in the Other Description/Rider field, (Section 19) or on the
top section of the ticket (Section 2).

Signature of Complainant
To ensure that the violation is valid, you must sign your name in the “Signature of
Complainant” box. By signing the Notice of Parking Violation you are swearing to the
accuracy of the charges it contains. Inaccurate information contained in the violation
can be considered perjury.

Issuing Agency
Enter the Fire Department Agency Code (FIRE).
23.
CMD (Command)
Enter the Unit that issued the parking violation (i.e. E274, L125).
24.
Name of Complainant (printed)
Print your last name first, first name last in the “Name of Complainant (printed)”
box.
25.
Tax Reg. No.
The member shall enter their “Tax Registry Number” in the boxes provided.

9.
VOIDING A NOTICE OF PARKING VIOLATION
9.1
A Notice of Parking Violation shall be voided when any of the following occur:
9.1.1 An error has been made during preparation.
A.
Corrections, erasures or changes of any kind are not permitted on any part of
the Notice of Parking Violation.
B.
When an error is made, STOP WRITING IMMEDIATELY. Use the next
Notice of Parking Violation and issue it with the correct information.
9.1.2 A Notice of Parking Violation is torn, mutilated or defaced in any manner.
9.1.3 A Notice of Parking Violation set (5 pages) is incomplete, or the self-addressed
envelope for the PARKING VIOLATION is missing.
9.2
Notice of Parking Violations are VOIDED in the following manner.
9.2.1 Print the word VOID across the face of all five (5) pages of the Notice of Parking
Violation.
9.2.2 Forward a Letterhead Report of Voided Notice of Parking Violation through the

9.2.3 Record the serial number of the voided Notice of Parking Violation, on the A-228,
RECORD OF SUMMONSES SERVED.
10.
SERVICE AND DISPOSITION OF THE NOTICE OF PARKING VIOLATION
10.1
The City of New York Notice of Parking Violation is compromised of five (5) pages and an
envelope. Upon completion of the Notice of Parking Violation, the member filling out the
document shall:
10.1.1 Serve the Service Copy, page 4, upon the respondent or place the Service Copy,
page 4, on the vehicle in violation of the Parking Regulations along with the
Hearing Instructions, page 5, and the orange PARKING VIOLATION envelope.
10.1.2 Record the Notice of Parking Violation Number on the A-228, RECORD OF
SUMMONSES SERVED.

10.2
Upon return to quarters:
10.2.1 Record the issuance of the Notice of Parking Violation in the company journal.
Indicate all circumstances surrounding the incident particularly if service was less
than routine. Provide a full description of what ACTUALLY HAPPENED; do not
repeat the language of the law. It is also recommended that the member issuing the
summons keep a personal record of the event for future reference.
10.2.2 Immediately forward the white page, page 1, along with yellow page, page 2, to the
Bureau of Legal Affairs, Administrative Enforcement Unit, 9 MetroTech Center, 4th
Floor, Brooklyn, NY 11201.
10.2.3 File the pink page, page 3, in accordance with the Uniform Filing System, Section
1.3.7
