The indictment comes at a time when Lowell and the Merrimack Valley have been experiencing a sharp increase in the use and distribution of heroin. Yesterday's indictment marks the first use in Massachusetts of a 1984 federal law establishing a drug-free zone, although cases have been previously brought under as a similar state law. Under the federal law, sentences of offenders can be doubled if they are convicted of selling drugs within 1,000 feet of a school or 100 feet of a playground. If convicted, the men face 10 to 20 years in jail on each count, double the typical sentence, according to US Attorney Wayne A. Budd. In Lowell, Mayor Richard P. Howe hailed the indictment as an "extraordinary move" and one needed to control drug abuse in the city. The investigation into the heroin scheme by agents of the Drug Enforcement Administration relied on informants who had bought 1,318 bags of heroin for $20,000 since April from the Cruz brothers and Garcia, according to an affidavit. The affidavit, written by DEA Special Agent Robert A. Kew, describes a multitude of heroin transactions that took place at 29-31 Chase St., a two- story, white vinyl-sided house that backs up on the playground.
