AFSCME 41st INTERNATIONAL CONVENTION CHICAGO, ILLINOIS AUDITING DEPARTMENT PRESENTS IRS 990 FILING REQUIREMENTS JULY 14, 2014 TODAY’S HOST Laura Reyes, Secretary-Treasurer, AFSCME International Additional Hosts Charles Jurgonis, Director, Financial Services Jeff Taggart, Associate Director, Auditing & Accounting Karen Tyler, Assistant Director, Auditing PRESENTERS Cathy German William Del Pino AFSCME AUDITORS PRESENTERS CONTACT INFORMATION Cathy German [email protected] William Del Pino [email protected] IRS 990 Filing Requirements Receipts are $200,000 or More or Total Assets at Year End are $500,000 or More IRS 990-EZ Filing Requirements Receipts are Less Than $200,000 and Total Assets at Year End are Less Than $500,000 IRS 990-N Filing Requirements Receipts Average $50,000 or Less During the Past 3 Years IRS 990-N is an online filing made at http://epostcard.form990.org IRS 990 Due Dates IRS Form 990, 990-EZ and 990-N are due May 15th or 4 ½ Months after end of Fiscal Year IRS 990 Mailing Instructions Make Sure Form is Signed & Dated Before Mailed Send 990 & 990-EZ “Certified Mail - Return Receipt Requested” Retain a Signed & Dated Copy IRS 990 Mailing Address All IRS Form 990 & 990-EZ Forms should be mailed to: Department of the Treasury Internal Revenue Service Center Ogden, UT 84201-0027 IRS 990 Late Filing Penalties $20 Per Day for Each Day the Return is Late Maximum Penalty - $10,000 or 5 % of Gross Receipts IRS 990 Extension IRS Form 8868 Can Be Filed to Request an Automatic 3 Month Extension An Additional 3 Month Extension can also be requested with explanation provided IRS 990 Failure to File Failure to File IRS 990, 990-EZ or 990-N for 3 Consecutive Years Will Result in the Loss of your Union’s Tax Exempt Status Check Your IRS Form 990-N Filing Status Go to the following website: http://www.irs.gov/charities/ article/0,,id=249767,00.html Check Your IRS Form 990-N Filing Status Click on the Box in the Middle of the Page Exempt Organizations Select Check Tool Check Your IRS Form 990-N Filing Status Click On: Were Automatically Revoked (Choice # 2) or Have Filed Form 990-N (e-Postcard) (Choice # 3) Check Your IRS Form 990-N Filing Status After Making Your Choice Fill in Your Affiliate’s EIN Number Check Your IRS Form 990-N Filing Status Choice # 2: If your Exempt Status Has Been Revoked, It Will Give the Revocation Date Check Your IRS Form 990-N Filing Status Choice # 3: If Your Affiliate has Filed a 990-N, it Will List the Years that have Been Filed Check Your IRS Form 990 or 990-EZ Filing Status Go to the Following Website: http://www.guidestar.org Create an Account Enter Email Address & Password Check Your IRS Form 990 or 990-EZ Filing Status For Future Visits to Guide Star, Just Sign In with Email & Password Enter EIN Number of Affiliate to View IRS Form 990 or 990-EZ Reinstatement Process If your Exempt Status has been Revoked, you must File Form 1024 to Apply for Reinstatement Write “Automatically Revoked” on top of Form 1024 & on Envelope Reinstatement Process File Form 8718 along with Form 1024 which Determines Fee to be Paid Fee is $400 if Annual Gross Receipts Average $10,000 or Less over the last 4 Years - Otherwise, Fee is $850 Reinstatement Process If your Exempt Status has been Revoked, you must File Form 1120 (US Corporation Income Tax Return) Until your Reinstatement is Granted Net Income Will Be Taxed at 15 % - 35 % Streamlined Retroactive Reinstatement Process If you Submit Form 1024 & Form 8718 No Later Than 15 Months after Revocation Posting Date, you can be Reinstated Retroactively and will not be Required to File an Income Tax Return.
