COUNCIL PUBLIC MEETING Wednesday, February 18, 2015 Concerning a Proposed Draft Plan of Condominium A PUBLIC MEETING has been scheduled for Wednesday, February 18, 2015 at 7:30 p.m. in the Council Chambers of the Municipal Offices, 225 East Beaver Creek Road, to notify the public and receive comments on the following applications that have been received by the Town. The proposed Draft Plan of Condominium would establish common element tenure for a proposed residential development comprised of four (4) semi-detached dwelling units and nineteen (19) townhouse dwelling units which is to be constructed on the subject lands. Any person may attend the meeting and/or make written or verbal representation either in support of or in opposition to the proposed Draft Plan of Condominium – Common Element. Written comments by any person unable to attend the meeting should be mailed/faxed/e-mailed to the Town Clerk, The Corporation of the Town of Richmond Hill to be received no later than 12:00 p.m. noon on Wednesday, February 18, 2015. Proposed Draft Plan of Condominium – Common Element Appeal: If a person or public body does not make oral submissions at the public meeting or make written submissions to the Town Clerk, The Corporation of the Town of Richmond Hill before the proposed Draft Plan of Condominium - Common Element is approved or refused, the person or public body is not entitled to appeal the decision of the Council of the Town of Richmond Hill to the Ontario Municipal Board and may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so. ITEM 1 INQUIRIES REFER TO TOWN FILES: D01-14001 & D02-14002 Andy Karaiskakis, Senior Planner 905-771-2412, [email protected] A request from 2179548 ONTARIO INC. and 2303042 ONTARIO INC. to amend the Official Plan and the Zoning By-law for lands described as Part of Lot 54, Registered Plan 65M-2104 and municipally known as 75 Norman Bethune Avenue, 85 Norman Bethune Avenue and 0 Norman Bethune Avenue. The subject lands are located on the south side of Norman Bethune Avenue and have a total lot area of approximately 3.7 hectares (9.3 acres). The proposed Official Plan Amendment would amend Exception Policy 6.2 of the Town’s Official Plan (2010) to permit an increase in the number of residential apartment dwelling units from 818 to 1,000 and to increase the permitted maximum permitted Gross Floor Area from 76,000 square metres (818,083.96 square feet) to 95,730 square metres (1,030,462.8 square feet). The proposed Zoning By-law Amendment would amend the “High Performance Commercial Industrial (MC1) Zone” under Zoning By-law No. 150-80, as amended by By-law 53-05, to permit the following: • • • • an increase of the maximum building height permitted by By-law 248-89 (the Buttonville Airport Height Restrictions By-law) in order to permit a nineteen (19) storey apartment building; the inclusion of a Holding (H) provision requiring the maximum height to comply with By-law 248-89 until such time as the Federal Buttonville Airport height restrictions are removed; a revision to the applicable parking standards by reducing the overall parking requirement from 1,747 spaces to 1,483 spaces; and, a reduction of the minimum east side yard setback abutting Highway 404 from 28 metres (91.8 feet) to 14 metres (45.9 feet). Any person may attend the meeting and/or make written or verbal representation either in support of or in opposition to the proposed Official Plan and Zoning By-law Amendments. The subject lands have a frontage of 30.7 metres (100.9 feet) on 16th Avenue and a total lot area of 0.27 hectares (0.65 acres). The proposed Zoning By-law Amendment would amend Zoning By-law No. 255-96, as amended, by rezoning the subject lands from “Special Residential One (SR-1) Zone” and “Low Density Residential (R6) Zone” to “Multiple Family One (RM1) Zone” with site specific provisions in order to permit a residential development comprised of 13 townhouse units. The proposed draft Plans of Subdivision and Condominium would facilitate the creation of the individual building lots and establish a private road as a common element, respectively as part of the proposed development.
