 CAPABILITY STATEMENT
Paul J Malam BSc (Hons) MRICS FIQ
Paul advises on a wide variety of issues relating to minerals, waste management and
heavy manufacturing developments, but specialises in the identification, appraisal,
acquisition and forward planning of such sites. He is experienced in the long-term
strategic management of large minerals and waste portfolios for both the landowning
and industrial sectors, and also advises on valuation, lease and sale negotiations,
compensation, non domestic rating and planning. Paul sits on both the Rating
Steering Group and the Land, Property and Minerals Committee of the British
Ceramic Confederation, representing his clients interests in the heavy clay
manufacturing sector. Paul is a Fellow of the Institute of Quarrying and an Affiliate of
the Chartered Institute of Waste Management.

Examples of Experience
Appointed Expert for valuation dispute at waste transfer station
Appointed as expert in disputed loan security valuation relating to a waste transfer
station and recycling facility in Grimsby. Paul’s instruction required the property to be
considered both in terms of base commercial/industrial property value with additional
research and commentary to then be provided as to the application of appropriate
premiums reflecting the bespoke nature of planned/permitted operations.
Expert Witness for disputed sand and gravel plant site rent
On behalf of a longstanding client, Paul acted as lessors agent in respect of disputed
rental arrangements under lease provisions for an open market rent review. Paul
provided expert advice to the client in respect of strategic and market reasons
supporting a fair level of rent to be levied before providing formal evidence to the
appointed Expert supporting the landlords’ position. The outcome of the exercise saw
Paul secure a substantial rental increase on behalf of his client.
Planning consent for flagship brickworks
Preparation of a major application to extend and reorganise one of the flagship clay
extraction operations for the UK’s largest brickmaker. The consent, providing 60
years of further clay reserves for the associated brickworks, was the result of a large
scale project management exercise including a full environmental impact
assessment. The quarry extension was consented subject to a range of conditions,
carefully negotiated to avoid costly, ongoing liabilities for future studies and
monitoring.
Expert Witness in respect of minerals and landfill compensation
Advising a Local Authority, Paul has provided valuation and expert witness advice in
respect of a compensation claim lodged resulting from the modification of planning
conditions under a mineral ROMP review. Paul represented his client in both
negotiations with the Claimant in respect of loss of mineral and landfill assets and
provided Expert Witness submissions for Lands Tribunal
Due diligence for ex British Coal property transfers
Advising the Land Restoration Trust, Paul provided due diligence advice for the
transfer of restored amenity land resulting from the closure of the UK coalfield to the
Trust for future long term management. Working alongside the Trusts legal team,
Paul was responsible for analysing remediation history, with a view to providing
complete sellers packs covering such matters as planning, remediation and title.
Strategic mineral search for factory investment
Advising the world’s largest clay product manufacturer on the location and acquisition
of strategic mineral reserves to support the development of a £20 million factory unit.
Paul provided geological and planning advice to identify workable reserves, and
undertook negotiations with landowners to progress securing options to extract.
