Ultimately, the WRO of TNPWD is having the projects for nearly Rs.3935 crores. From the above it can be clearly visualized that the World Bank officials are having more faith in Tamilnadu PWD in executing the various Water Resources projects realistically and holistically and thereby fulfilling the irrigation needs and Water supply demands. At this juncture it will be more appropriate to mention that the Government of India has already selected Tamilnadu as No. 1 state in the irrigation sector in the whole of India. We feel proud of the same. Our Hon’ble Chief Minister who is holding the portfolio of 156 years old Public Works Department is very much interested to implement the ultimate goal of Puratchi Thalaivi AMMA i.e. interlinking of rivers in the state for which the works are at the anvil. In order to execute the above projects, the present Man Power in PWD will not be adequate and on contrary requires additional staff. At least two Chief Engineer (Projects) posts along with required no. of SEs / EEs / AEEs / AEs and other supporting staffs are required to implement these schemes in an effective manner. Further Govt. in GO. Ms. No. 1983 PWD dated 02.12.1991 has fixed norms for Major and Medium irrigation Divisions that the Establishment cost should be 11.5% of the total project cost while for Building Divisions as Rs 2 crores per Division (City) and instructed to revise the norms after two years. But the same was not revised. However the committees constituted by Government during 2002 and earlier have recommended for the Major & Medium project Division as Rs.50 crores per Division. Hence it essentially requires additional staff as per norms prescribed by the Government. As such it is clear that there is need of additional staff strength as per norms and to implement the Budget announcement schemes. We strongly believe that the Engineer in Chief ,WRO & Chief Engineer (Gl) PWD , Chennai-5 will take necessary steps and request the Government for the continuance of the existing Circles and Divisions as per norms thereby eradicating the fear of closure of Circles / Divisions apart from requesting sanction of additional posts as demanded through this column. The Tamil Nadu Engineering Subordinate Service (TNESS) Rule, Part- 1, Branch I, Schedule II (referred to in rule 6), provides the qualification for the post of Supervisors (Section Level), as Degree in Engineering or Diploma in Civil Engineering or a pass in sections A and B of the Institution of Engineers Examination, provided that ‘No Candidate possessing the Diploma in Engineering (Civil or Mechanical) of the college of Engineering, Guindy shall be eligible for appointment, if suitable candidate possessing the degree in Engineering (Civil or Mechanical) of the Madras or Annamalai University or the B.Sc., (Engineering) degree of the Banaras Hindu University is available for such appointments’. 2. In the past years, Diploma holders are appointed in Section level posts due to meager outcome of graduate Engineers. 3. However in the recent years, due to starting of more than 537 and odd Engineering Colleges, over 40,600 number of Civil Engineering graduates are passing out every year which is more than the requirement for Public Works Department and other Engineering Departments i.e., enough graduate engineers are available for the recruitment of Assistant Engineers through TNPSC. 4. Advance explosion of knowledge and higher skills are required to handle the works attached to Section in tune with modern trends and advance in Engineering and Technology. 5. The Graduate Engineers who passed B.E. degree are exposed to modern technologies and are also having computer skills in addition, and hence their service will be very much useful to the department. bgh¿ahs® - V¥uš 2015 11 6. The minimum qualification prescribed for the Lawyer is B.L. degree and for the Doctor is MBBS degree whereas in the Engineering Departments the prescribed qualification is both the degree and diploma in Engineering. 7. Paramedical staffs possessing Diploma qualification like Diploma in Nursing are appointed only as supporting staffs to Doctors possessing MBBS qualification in Government Medical Service Department. 8. Since the Section Officers of PWD should have the knowledge of design, estimate preparation, investigation and execution of work, recruitment of Graduate Engineers at Section level is much more appropriate. 9. Competent graduate Engineers screened through TNPSC exams alone can meet the standards of State funding agencies such as World Bank, Central Government and other International Agencies for attaining fund and for efficient Planning, investigation, designs, estimation and Supervision etc. High rise buildings with provisions to earthquake résistance are proposed and executed with high technical skills. Maintaining the standards of reservoirs and up-keeping the records for assessing the Dam Safety are possible only if these sections are posted / filled with graduate engineers recruited by TNPSC. These eminent engineers alone can meet the challenges of the department. 10. Sufficient facilities are also available for the diploma holders already working in the Department for passing part time B.E. degree so as to enable them to appear for the direct recruitment of Assistant Engineers through TNPSC. 11. In order to have better quality and efficiency, the degree in Engineering must be specified as the minimum qualification for Section level posts in Public Works Department. 12. All the Section level posts in future should be filled in by Assistant Engineers having minimum qualification of degree in Engineering, through TNPSC every year. We also wish to add that the proposal to fix the minimum qualification for all Section level posts in PWD as a degree in Engineering is already discussed in the Board of Engineers Meeting and the proposal has been sent to the Government, which is under scrutiny in the Government. Ms. No .66 PWD dated 12.03.2007 by ordering as hereunder, (i) The Junior Engineers, coming under Tamilnadu Engineering Subordinate Service, re-designated as Assistant Engineers from the date of their acquiring B.E degree shall continue to be under the category of Junior Engineer and such re-designation shall not amount to appointment as Assistant Engineers and should be considered to continue under Tamilnadu Engineering Subordinate Service (TNESS) only and accordingly, their promotion, (i.e., recruitment by transfer, as Assistant Executive Engineer) shall be made within the 25% quota available for Junior Engineer of TNESS and not within the 75% quota earmarked for Assistant Engineers of Tamilnadu Engineering Service (TNES); (ii) The decision of the Hon'ble Supreme Court 2nd referred above protects only the re-designated Assistant Engineers who were wrongly promoted as Assistant Executive Engineer earlier within the 75% quota earmarked for Assistant Engineers of Tamilnadu Engineering Service before the date of judgement of the Hon'ble Supreme Court from demotion and their seniority had not been dealt by the Hon'ble Supreme Court and hence the Government shall have to revise the inter-se-seniority, i.e., in the promoted category of Assistant Executive Engineer based on the ratio laid down by the Hon'ble Supreme Court. bgh¿ahs® - V¥uš 2015 13 2. We submit that the ratio laid down by the Hon'ble Supreme Court in the judgment 2nd cited is that a re-designated Assistant Engineer shall continue to be Junior Engineer in Tamilnadu Engineering Subordinate Service and such re-designated Assistant Engineers shall be considered for promotion as Assistant Executive Engineer only within the quota of 25% earmarked for Junior Engineers of TNESS. 3. We submit that accordingly, the re-designated Assistant Engineers shall not be considered for inclusion in the seniority list for the category of Assistant Engineer and such re-designated Assistant Engineers shall be included only in the seniority list of Junior Engineers. 4. We further submit that the Hon'ble High Court have now ordered in the reference 1st cited above, to revise the seniority of re-designated Assistant Engineers promoted as Assistant Executive Engineer considering them within the 75% quota earmarked for Assistant Engineers of Tamilnadu Engineering Service and publish the seniority of Assistant Executive Engineers within 6 months based on the ratio laid down by the Hon'ble Supreme Court. The ratio laid down by the Hon'ble Supreme Court as stated supra, is that the re-designated Assistant Engineers shall be considered for promotion only within 25% quota earmarked for Junior Engineers. The Hon'ble High Court have categorically held that the Hon'ble Supreme Court have not dealt the seniority of the re-designated Assistant Engineers promoted already as Assistant Executive Engineers and hence the Government is bound to revise the seniority of Assistant Executive Engineers based on the ratio laid down by the Hon'ble Supreme Court. It is well settled law that any promotion in violation of rules will not confer any right to seniority. Therefore, the seniority of Assistant Executive Engineers shall be revised treating both the redesignated Assistant Engineers who were wrongly promoted as Assistant Executive Engineers within 75% quota and the Junior Engineers who were promoted (recruitment by transfer) as Assistant Executive Engineers already, i.e., before 27.11.2013 as Junior Engineers only and fitting them within 25% quota and fitting the Assistant Engineers from Tamilnadu Engineering Service within 75% quota and publish the seniority list of Assistant Executive Engineers so revised within 6 months as directed by the Hon'ble Court. 5. We, therefore, submit that the re-designated Assistant Engineers who were promoted within the quota of 75% earmarked for Assistant Engineers of Tamilnadu Engineering Service shall not be entitled to be considered for promotion as Executive Engineer until he becomes eligible on his turn within the quota of 25% earmarked for Junior Engineers according to their original seniority in the category of Junior Engineer. Therefore, for the reasons stated above, we kindly request that(i) The re-designated Assistant Engineers already promoted as Assistant Executive Engineers within the quota of 75% earmarked for Assistant Engineers of Tamilnadu Engineering Service and the Junior Engineers promoted (recruitment by transfer) as Assistant Executive Engineers earlier to 27.11.2013, the date of judgement of the Hon'ble Supreme Court referred 2nd above be fitted within the 25% quota earmarked for bgh¿ahs® - V¥uš 2015 14 Junior Engineers and accordingly revise the seniority in the category of Assistant Executive Engineers duly fixing the inter-se-seniority between Assistant Executive Engineers promoted from Assistant Engineers of Tamilnadu Engineering Service and the Assistant Executive Engineers appointed by recruitment by transfer from the Junior Engineers and from the re-designated Assistant Engineers as directed by the Hon'ble High Court following the ratio laid down by the Hon'ble Supreme Court as aforesaid; (ii) The panel of Assistant Engineers / Junior Engineers fit for promotion / appointment by recruitment by transfer as Assistant Executive Engineers approved after 27.11.2013 be revised by reverting the excess Junior Engineers / re-designated Assistant Engineers as per the ratio laid down by the Hon'ble Supreme Court; (iii) The Assistant Engineers re-designated from Junior Engineers should not be considered for promotion as Assistant Executive Engineers within the 75% quota of vacancies earmarked for Assistant Engineers in Tamilnadu Engineering Service but to consider them only within the 25% quota earmarked for Junior Engineers in the ensuing panel for promotion Asst. Executive Engineers. (iv) The re-designated Assistant Engineers already promoted as Assistant Executive Engineers within the 75% quota of Assistant Engineers in Tamilnadu Engineering Service earlier to 27.11.2013 should not be promoted further as Executive Engineer till the publication of seniority list of Assistant Executive Engineers as aforesaid under item no. (i) above. We also wish to add that, the Hon’ble High Court of Madras has also ordered the state government to apply its mind to the issue of inter-se-seniority in the context of the aforesaid judgement and accordingly circulate a draft seniority list, invite objections and thereafter publish the final seniority list within a maximum period of six months from 15.10.2014. Even though six months of period has gone, the order of the Hon’ble High court was not implemented till date.
