NEW CONSTRUCTION ADDENDUM RESIDENT: _______________________________________________________________________________________ RESIDENT: _______________________________________________________________________________________ PROPERTY ADDRESS: 4495 Lake Ave. S., White Bear Lake, MN 55110 Apartment #: __________________ This New Construction Addendum shall become part of the Residential Lease Agreement for all apartment homes located at the Boatworks Commons Apartments. 1. New Construction Lease Cancellation Option: Management agrees to provide Resident an option to cancel their Residential Lease Agreement in the event circumstances arise which prevents the Resident from being able to move into the unit on their scheduled move-in date. Resident shall have the option to cancel the lease without further obligation up to sixty (60) days prior to the scheduled lease start date. In the event Resident needs to exercise this option and cancel their lease, Resident agrees and acknowledges that Management shall be entitled to keep the Security Deposit based on the following schedule: a. If the written request to terminate the lease is received 60 days or more before the move in date: 50% of the security deposit will be retained by Management as a lease termination fee. b. If the written request to terminate the lease is received less than 60 days before the move in date: 100% of the security deposit will be retained by Management as a lease termination fee. c. All terms of the original lease will be in effect as of the move in date; this includes the termination of lease options, notice period and lease buy out fee schedule. Security Deposit Amounts: $1,000.00 2. Finish Schedules: Prospective and future leaseholder acknowledges that the floorplans, photos and finish samples provided are a representation of the final product and is in no way a guarantee or warranty of the final unit design. All dimensions shown in construction documents will be accurate within normal construction variances and tolerances. 3. Entry: Construction sites are inherently dangerous; prospective and future Leaseholders acknowledge and agree that limitations must be placed on entering the unit or construction site as a matter of safety and work efficiency. Prospective and future Leaseholders are prohibited from entering the unit or construction site in which the unit is located prior to the move in date without Management’s written permission. Entry to the building by any future or prospective Leaseholder must be accompanied by a Management Representative and must meet all safety requirements and a liability waiver must be signed. 4. Unforeseen Construction Delay: Management will make every effort to provide occupancy on schedule; however it is possible construction could be interrupted due to unforeseen circumstances beyond Management’s control which could delay the Residents’ scheduled move-in date. At Home Apartments, L.L.C., its employees, agents, contractors, subcontractors, developers, or any other related party shall not be held liable in any way for damages, costs, or inconveniences of any kind that may occur due to a delay in construction and/or scheduled move-in dates, or the use and enjoyment of any and all property amenities, community access or other items related to the construction of the property.
