Host Agreement
Mandatory for all St. Baldrick’s Event Hosts
I/We understand that the name St. Baldrick’s, the logo and leprechaun icon are registered trademarks of the St. Baldrick’s Foundation and use of said
properties in any printed materials or advertising require the written approval of the St. Baldrick’s Foundation.
PUBLICITY CONSENT AND RELEASE
I/We hereby irrevocably grant the St. Baldrick’s Foundation (“SBF”), permission to use my/our name(s), biographical or occupational description, and
business and personal information and/or artwork supplied by me/us to SBF -- portrait, picture, artwork, film footage, likeness, voice, or any or all of them
- in a greeting card, recording, print ad, motion picture film, television production or reproduction, direct mail piece, newsletter, Website article, Website
event, event donation page, press release, sound track recording film strip, still photograph, or otherwise, for purposes of furthering the charitable aims
of SBF.
Furthermore, I/we hereby grant to SBF, its clients, successors, assigns and/or anyone acting under the authority or permission of any of them, the right
to make originals where appropriate and to use in advertising and publicity, in any and all publications and other media without limitation or reservation
for any lawful purpose; and reproduce in any form or manner and to copyright any of the items referred to in the preceding paragraph in connection with
such charitable aims.
I/we hereby release whatever rights, title or property interest I may have in the items supplied by me to SBF as it pertains to me/us/our business. I
understand that I shall receive no compensation for my or our business’ appearance in promotional materials or activities. I/we hereby agree to hold SBF
harmless and to indemnify SBF and its contractors, agents and employees, and/or anyone acting under the authority or permission of SBF, from any and
all claims arising out of, or resulting from, my/our acts or statements in any of the above-mentioned items.
AGREEMENT ON CONDUCT
I understand that in hosting an event, I/ we are responsible for ensuring a safe and friendly environment. I understand that in participating in an event,
I am responsible for conducting myself reasonably and with due regard for others. I understand that my commitment of time and funds to the
Foundation does not in any way grant me authority to act on behalf of SBF, and understand that I/we cannot sign contracts or make other agreements
on SBF’s behalf, including but not limited to agreements with other charities and/or fundraisers, even with respect to my/our event. I/we understand that
we have a duty to cooperate with SBF in all regards, and that if we do not communicate with SBF promptly when asked, SBF may suspend my/our
event.
HOLD HARMLESS, WAIVER, AND ASSUMPTION OF RISK
I, _________________________________, an individual or authorized principal of ________________________________, an SBF host, have freely
and voluntarily chosen to participate in this head-shaving event. I understand that there are certain risks associated with hosting and/or attendance at a
head-shaving event and participation is not without risk to myself, employees, members of my family, or guests who may attend. I understand such risks
include, but are not limited to, personal injury, property damage or loss, and death.
In consideration of and as inducement to SBF’s acceptance of my or my company’s entry form for this head-shaving event, I/we expressly hereby
assume any and all risks of such damage or injury while hosting and/or attending this head-shaving, or any other function, of SBF or the surrounding
area thereto, and I hereby release and agree to indemnify, defend and hold harmless SBF, and all its related entities, its employees, directors, officers,
members, beneficiaries and agents from any and all liability of any nature, causes of action, debts, claims, and demands of every kind and nature
whatsoever for injury or damage, which I or any member of my family or any other person accompanying me to this event may incur, or for which I may
be liable, and which arises or is alleged to arise in connection with my hosting, or my or their participation, in a SBF event, whether occurring on the
event grounds or the surrounding area thereto, or traveling to or from such grounds or surrounding area. This release includes, but is not limited to, any
claim for personal injury, personal bodily injury or damage, property damage, or wrongful death whether the same shall arise by negligence, active or
passive, or otherwise while I/we engage in this event.
I have read and understand this Agreement, and am aware of the legal consequences of signing this Agreement, which I agree is governed by the law
and jurisdiction of the State of New Jersey, United States of America, regardless of where I live or where the Agreement is signed. I agree that a
photocopy of this Agreement will be sufficient to demonstrate that I signed the Agreement and that an original need not be retained by SBF. I
understand and agree that I/we may not host, participate or continue to participate in the head-shaving event unless I/we have read and signed this
Agreement, and that my execution of this Agreement binds both me and any corporation of which I am principal and which is a SBF Host. I also agree
that I will not allow or participate in the use of a razor to shave the head of any participant at the event.
