Are you ESOS ready?
ESOS (Energy Savings Opportunity
Scheme) is UK legislation based on the
EU Energy Efficiency Directive (2012) that
has come into effect and will impact many
businesses and organisations. You may
be aware of the legislation and have taken
measures to comply, you may still require
help and advice to be compliant. If you
are not already doing so, you should start
taking strategic steps now to attain the
compliance deadline of 5 December 2015.
ESOS policy drivers
The policy drivers behind ESOS are to
increase energy efficiency to improve
business profits and competitiveness, as
well as trying to mitigate climate change.
ESOS requires all UK large ‘undertakings’
(the vast majority of which are commercial
businesses) to undergo a mandatory
assessment of energy use and energy
efficiency opportunities across sites that
collectively represent the majority of the total
energy use of that organisation.
Savills Energy has developed an ESOS
Compliance offer that will allow both Savills
clients, plus the wider market to achieve
ESOS compliance. Crucially the Savills
Energy offer will also inform clients of the
measures they need to take to ensure
Energy Performance Certificate (EPC) April
2018 legislation compliance.
The audit must be repeated every four years
under the ESOS regulations.
Who is affected by ESOS?
Large undertakings1 are required to
undertake Energy Audits covering 90%
of their energy consumption (including
transport). In the UK this is called ESOS and
all audits must be complete by 5th December
2015. Approximately 7,250 UK enterprises
will be affected, occupying between 170,000
and 200,000 buildings. Savills itself is covered
by the legislation, we are working to ensure
compliance with ESOS.
The Savills Energy offer
Given the ESOS Compliance deadline
is December 2015 it is important that
impacted organisations start the process
as quickly as possible. Savills has put an
ESOS Compliance audit team in place,
led by experienced ESOS lead assessors,
to provide best advice and deliver the
most effective and efficient method of
compliance. Different approaches are
available to achieve compliance, Savills
Energy will work with the client as the
ESOS Lead Assessor to deliver the best
solution, ensuring any compliant information
that currently exists is used to speed the
process up and reduce costs.

A ‘large undertaking’ is an organisation engaged in a trade or business which:
employs at least 250 persons (irrespective of hours), or has an annual turnover in
excess of £38,937,777 and an annual balance sheet above £33,486,489. Or is
part of a corporate group that fits that criteria. It can include not-for-profit bodies
such as Charities, as well as Universities, Trusts, and Partnerships.

Link to Minimum Energy Standards
Savills will ensure that as part of the
ESOS compliance, data on the properties
which may fall foul of the Minimum Energy
Efficiency Standards (MEES) will be
reviewed and highlighted, and a route map
to achieving 2018 EPC compliance can be
worked up (so properties don’t fall into the
bottom F & G, and potentially E grades).
Penalties for non-compliance
The Environment Agency can levy
civil penalties against non-compliant
organisations. Penalties include:
n Public disclosure of non-compliant
organisations and details on noncompliance
n Financial penalties up to £50,000, plus
£500 per day
